Texas enacted comprehensive laws in 1995 that clarified that women have a right to breastfeed in public. Moreover, it also set up standards for employers to advertise themselves as ‘mother-friendly’ if they develop breastfeeding support policies, and set up a demonstration project to determine the feasibility of breastfeeding support policies for all state employees. Texas has a statute governing human milk banks. There is also a law governing breastfeeding services to mothers discharged early from the hospital.

Tex. Health Safety Code § 161.071

MINIMUM GUIDELINES FOR HUMAN DONOR MILK BANKS. The department shall establish minimum guidelines for the procurement, processing, distribution, or use of human milk by donor milk banks.

The authority responsible for child abuse law in Canada rests with the federal government.

In December, 1991, Canada signed and ratified theUN Convention on the Rights of the Child. As a ratified member, Canada is internationally accountable with regard to its universal legislation on the rights of children and youth. These include the right for children and youth to live in a safe, protective and nurturing environment.

Somalia has stated it intends to ratify the Convention soon.

Duty to report is the most important of all child abuse laws.

In Canada, if someone knows of or suspects that a child is being abused, that person has a legal obligation to report the known or suspected abuse. Failure to report can result in charges being laid, as well as a fine of up to $10,000.

When I inform students of the existence of this duty to report law, typically they bawk and cite how unfair that is.

Until we discuss actual child abu ... Read more »

    #Parental Consent and Notification Laws

    Abortion

If you are under 18, your state may require one or both of your parents to give permission for your abortion or be told of your decision prior to the abortion. In most states with these requirements:

You can ask a judge to excuse you from getting permission or telling your parent or guardian. (This is called a "judicial bypass.")
    • A legal guardian can give permission or be notified in place of a parent. If you meet legal rules showing that you are independent of the care and control of your parents or a guardian, you do not need to get their permission or notify them.

In some states, you can be excused from involving a parent without going to a judge if you are the victim of abuse or neglect and you or your doctor report this to the appropriate authorities. If you are facing a medical emergency and require an immediate abortion, most states will not impose their parental involvement requir ... #Parents For Megan s Law and The Crime Victims Center - Sex Offender Email Alert - Report Sex Offenders - Report Child Abuse - National Megan s Law Helpline

    Megan’s Law

Megan’s Law is named after a 7-year-old Hamilton Township, New Jersey girl named Megan Nicole Kanka. On July 29, 1994, she was lured into her neighbor’s home with the promise of a puppy and was brutally sexually assaulted and murdered by a two-time convicted sex offender who had been convicted in a 1981 attack on a 5-year-old child and an attempted sexual assault on a 7-year-old. Sparked by community outrage, petitions began circulating throughout the state of New Jersey demanding the right to be made aware of sexual predators. Megan’s parents, Maureen and Richard Kanka, had gathered more than 430,000 signatures, and 89 days after Megan’s disappearance the first state law that mandated active community notification was signed into law, New Jersey’s Megan’s Law.

Cyber law refers to the law that governs the use of communication technology, mainly the Internet. It is a mix of all laws concerning intellectual property, freedom of expression, privacy and jurisdiction. When it comes to the Internet, the lack of clarity with regard to geographical boundaries and jurisdictions can pose a problem. For example. in just a single deal three different states/jurisdictions could be involved

    (a)  The laws of the state or country which the user belongs to

    (b)  The laws of the state or country applicable to the individual or organization with whom the deal has been struck

    (c)  The laws of the state or country where the host server is located.

In other words, a single transaction could be subject to the laws of three countries at a time. The jurisdiction in one particular country may consider the contents of a website legal whereas the same contents may be declared illegal by the jurisdiction of another geographical area or ... #Elements of a contract

    Elements of a contract

    Offer and acceptance

A contract is formed when an offer by one party is accepted by the other party.

An offer must be distinguished from mere willingness to deal or negotiate. For example, X offers to make and sell to Y calendars featuring Australian paintings. Before any agreement is reached on size, quality, style or price, Y decides not to continue. At this stage, there is no legally binding contract between X and Y because there is no definite offer for Y to accept until the essential terms of the bargain have been decided.

An offer need not be made to a specific person. It may be made to a person, a class of people, or to the whole world.

An offer is a definite promise to be bound, provided the terms of the offer are accepted. This means that there must be acceptance of precisely what has been offered. For example, a used car dealer offers to sell B a Holden panel van f ... Read more »

    #Employment Discrimination

    Employment discrimination: an overview

Employment Discrimination laws seek to prevent discrimination based on race, sex, religion, national origin, physical disability, and age by employers. A growing body of law also seeks to prevent employment discrimination based on sexual orientation. Discriminatory practices include bias in hiring, promotion, job assignment, termination, compensation, retaliation, and various types of harassment. The main body of employment discrimination laws consists of federal and state statutes. The United States Constitution and some state constitutions provide additional protection when the employer is a governmental body or the government has taken significant steps to foster the discriminatory practice of the employer.

The Fifth and Fourteenth Amendments of the United States Constitution limit the power of the federal and state governments to discriminate. The Fifth amendment has an explicit requirement that ... Read more »

    #Employment Discrimination Law.

    What is Employment Discrimination Law?

Employment discrimination law refers to federal and state laws that prohibit employers from treating workers differently based on certain attributes unrelated to job performance. Discrimination by government employers violates the constitutional guarantees of equal protection and due process. Discrimination by private employers may conflict with any number of statutory protections, most notably, Title VII of the Civil Rights Act of 1964.

Not all classifications qualify for protection against discrimination in the workplace. Under current law, individuals are protected against discrimination based on race or skin color, national origin, genetic information (such as family medical history), gender or pregnancy, religion, disability, and age. In some cases, it is also illegal for employers to discriminate based on marital status, political affiliation, and sexual orientation.

The Law of Segregation is based on one of the benchmark scientific experiments in genetic studies, the Mendel Pea Plant Experiment.

It was a stroke of genius considering that it was performed in the 19th century.

Of course, Mendel knew nothing about the processes behind inherited behavior, but found out the rules dictating how characteristics are passed down through the generations.

The way in which he meticulously planned his experiment to generate testable. rather than observational data, is a shining example of experimental design .

Gregory Mendel was an Austrian monk studying at the University of Vienna. Like many pioneering scientists, his discoveries were largely ignored until long after his death.

Mendel noticed that certain characteristics appeared to be passed on from parents to offspring, in many species, and wondered why this was so. He also wanted to establish what characteristics were taken ... Read more »

#What is wrong about giving online legal advice?

Are there any legal restrictions for giving financial advice in the US?

    Nikhil Nirmel. Founder of Lawdingo.com

I m building a company around the concept of delivering legal advice online ( Lawdingo.com ) and I can speak to some of the concerns I ve heard from lawyers:

    - Ambiguity surrounding establishment of an attorney-client relationship.

    - Concerns about cross-jurisdictional advice

    - Fee splitting (in cases where there s an intermediary)

    - Confidentiality. If attorney-client communication assumed to be private is made public, it could violate an assumed attorney-client privilege.

Each one of these problems can be solved, and that s what we ve done at Lawdingo. I do believe, as you seem to as well, that the internet has the potential to be an amazing medium for seeking guidance from an attorney.

    #Estates and Trusts

    estates and trusts: an overview

During the early 1500's in England landowners found it advantageous to convey the legal title of their land to third parties while retaining the benefits of ownership. Because they were not the real "owners" of the land, and wealth was primarily measured by the amount of land owned, they were immune from creditors and may have absolved themselves of some feudal obligations. While feudal concerns no longer exist and wealth is held in many forms other than land (i.e. stocks, bonds, bank accounts), the idea of placing property in third party hands for the benefit of another has survived and prospered. This is the idea of a trust.

Generally, a trust is a right in property (real or personal) which is held in a fiduciary relationship by one party for the benefit of another. The trustee is the one who holds title to the trust property, and the beneficiary is the person who receives the benefits of the trust. To understand ... Read more »

Defamation Law falls under Tort Law. It refers to false statements about a person, communicated as fact to one or more other persons by an individual or entity (such as a person, newspaper, magazine, or political organization), which causes damage and does harm to the target?s reputation and/or standing in the community. Defamation is addressed primarily by state legislation. However, Constitutional Law may also apply, as the right of freedom of speech also extends to certain defamation claims. Defamation is categorized as either Slander or Libel.

The general harm caused by defamation is identified as being ridiculed, shamed, hated, scorned, belittled or held in contempt by others, and lowers him/her in esteem of a reasonably prudent person, due to the communication of the false statement. This tort can result in a lawsuit for damages. Many states have statutes requiring that the allegedly damaged party must first demand a printed retraction of the defam ... Read more »

When window tint is installed to the glazing of a vehicle it reduces the amount of visible light, how much depends on the darkness of the tint. Car window tint is graded in a % VLT (Visible Light Transmittance - the amount of light the film allows to pass through). Some companies grade the film as how much light the film blocks so 20% VLT could be that it allows 20% of light to pass through, however with another company if could allow 80% of light to pass through as the 20% is the amount of light it blocks, this confuses things and you should always check before installing film. In this article all percentages refer to the visible light transmittance (VLT).

Authorities in many countries and states have laws as to how dark you can tint your windows. This is because if the windows are tinted too dark you may not be able to see hazards clearly, especially at night, and also police may not be able to identify individuals inside a vehicle. In this article we have tried to compile ... Read more »

    #Pareto s Principle - The 80-20 Rule

    What It Means

Project Managers know that 20 percent of the work (the first 10 percent and the last 10 percent) consume 80 percent of your time and resources. You can apply the 80/20 Rule to almost anything, from the science of management to the physical world.

You know 20 percent of your stock takes up 80 percent of your warehouse space and that 80 percent of your stock comes from 20 percent of your suppliers. Also 80 percent of your sales will come from 20 percent of your sales staff. 20 percent of your staff will cause 80 percent of your problems, but another 20 percent of your staff will provide 80 percent of your production. It works both ways.

    How It Can Help You

The value of the Pareto Principle for a manager is that it reminds you to focus on the 20 percent that matters. Of the things you do during your day, only 20 percent really matter. Those 20 percent produce 80 percent of your results. Identify and ... Read more »

Online law degrees are becoming more common as law schools struggle to accommodate an exploding number of enrollments. Instead students can study long distance from a wide range of accredited institutions across the nation for a Juris Doctor degree. Successful graduation from an online school allows graduates to take a bar examination in any jurisdiction just as it would for graduates of a conventional law school.

    Flexibility

Following an online program allows for much flexibility than attending a traditional classroom. Whereas students may have to change their personal schedule to fit in with the requirements of the classroom, virtual classrooms allow for the student to work at their own pace; although they may still have deadlines for assignments to be completed, they can choose a time of day to study and work which fits in with their schedule.

    Financial savings

#Enforcement of Federal Immigration Laws at the State and Local Levels

Encouraging state and local law enforcement agencies to help enforce federal immigration laws could help identify out-of-status immigrants eligible for deportation, but may also have unintended consequences, according to a study issued today by the RAND Corporation.

"Enforcement of immigration laws has traditionally been a federal responsibility," said Jessica Saunders, lead author of the study and a criminologist with RAND, a nonprofit research organization. "But it's clear that the federal government alone isn't going to be able to clear the backlog of cases without some additional assistance.

"The question is, how do you involve state and local law enforcement in immigration enforcement without disrupting their regular duties or placing additional, undue financial burdens on cities and states? Currently there is no consistent, nationwide approach."

The RAND study provides an overview o ... Read more »

What’s Good: A sharply made satire that doesn t switch into a preachy mode.

What’s Bad: The music just doesn t fit into the plot.

Watch or Not?: Jolly LLB is an enjoyable film filled with quirky humor. It doesn’t rant off bantering needlessly for the sake of humor. Sticking strictly to the plot, the film delivers brilliantly, the discrepancies of the Indian Judicial system.

The story is a slice of David and Goliath fitted smartly in a legal drama. Young lawyer Jagdish Tyagi aka Jolly is frustrated with his legal career going nowhere. He leaves Meerut and moves to Delhi in search of thriving opportunities. Easy popularity comes knocking on his door when he tries to en-cash some residual fame off a Land Cruiser hit-and-run case fashioned on the similar BMW case of Sanjeev Nanda, by filing a PIL.

Before we move onto explaining the law, I would like to ask you something. Have you ever wondered why individuals belonging to the same family or plant progeny, have similar characteristics? Why do offspring look similar to their parents? Well, most of you might be knowing the Mendelian inheritance or Mendelian genetics theory. It answers the above questions. Simply put, this is possible because of the transfer of genes or inherited traits, in humans and plants alike. Gregor Johann Mendel. a German monk, needs to be credited with this important discovery that he made in the 19th century.

    Mendelian Genetics

To start with, all of us living things, including plants and microorganisms, have chromosomes, which carry factors responsible for various characteristics that we possess. These factors basically control the phenotype and genotype of that individual. For instance, a particular flower is red colored or a person is blue-eyed, because of the factor coding it, w ... #End of Web Design

Websites must tone down their individual appearance and distinct design in all ways:

    • visual design
    • terminology and labeling
    • interaction design and workflow
    • information architecture

These changes are driven by four different trends that all lead to the same conclusion:

    1. Jakob's Law of the Internet User Experience

Users spend most of their time on other sites. This means that users prefer your site to work the same way as all the other sites they already know.

This Law is not even a future trend since it has been ruling the Web for several years. It has long been true that websites do more business the more standardized their design is. Think Yahoo and Amazon. Think "shopping cart" and the silly little icon. Think blue text links.

We all depend on our cars for traveling and for many other purposes. Life without a car just seems impossible. But what if someone seizes your car and you can't take it back. In this case, understanding some laws regarding repossession would be a huge help.

Car repossession occurs when a person fails to pay the car payments that he/she owes to the creditor, and the creditor takes back the car. If you have bought your car on loan, and you are late with your payments, and you don't even have enough car insurance, your vehicle could be seized. Once you buy a vehicle on loan, your creditor has more rights on the car than you. If you don't make your monthly payments on time, the creditor has the full authority to take back your car without a warning or a court notice in advance. If you have fallen behind your monthly payments, then it is necessary for you to understand the various automobile repossession laws. The good news is that, there are some limitations that the creditor ha ... Read more »

“When [legal professionals] look up a word in a dictionary and they often do they are as likely

When the reader want to know the definitions of a legal term, a legal dictionary is the right tool for the legal researcher. A legal Dictionary is designed to provide easy reference to vocabulary commonly used in the legal community.

In legal research, legal dictionaries may serve several functions. #Environmental law: area of practice

It s important for a trainee joining an environmental team to understand in advance what falls under the environmental banner in their firm.

Long gone are the days when this area of law was viewed by clients and colleagues alike as a domain for tree huggers. The business world has a growing awareness of the challenges and opportunities of climate change and the low carbon economy and turns increasingly to environmental lawyers to provide strategic and regulatory advice.

    Fast-changing legislation

At its heart there is something of a paradox. On the one hand, the environmental lawyer needs to be a real specialist in complex and fast-changing regulations; on the other, he or she is perhaps one of the last bastions of general practice surviving in a large commercial law firm – requiring the practitioner to have a working knowledge of commercial, corporate, litigation and property law.
