The new Chinese bankruptcy law went into effect June 1, 2007.  It is China s first bankruptcy law since 1986, which law applied only to state-owned enterprises (SOEs). Since that law was enacted before China s 1993 economic reforms, many of its provisions were inadequate for or in conflict with China s new more market-centered economy.

China s new bankruptcy law mirrors the modern bankruptcy laws of other countries, particularly the United States. The new law applies to all legal entities, including foreign invested enterprises (FIEs), such as WFOEs and Joint Ventures, though it does not apply to individuals.

The law utilizes an administrator who will act much like bankruptcy trustees do in U.S. bankruptcy proceedings. Beijing (AFP) - A prominent Chinese human rights lawyer has confessed guilt a week after being detained in a major crackdown on legal activists, state media said.

Zhou Shifeng is one of more than 130 lawyers detained or called in for questioning by state security bodies this month, according to tallies by rights groups.

The lawyer provided legal aid to families of children poisoned by milk powder from a powerful dairy firm, and this year defended an 81-year-old writer detained for criticising the ruling Communist party.

Zhou has reportedly not been able to meet a family-appointed defence lawyer. The official Xinhua news agency said late Saturday that he admitted guilt and pleaded for a second chance .

#DFA - New Car Lemon Law

The Arkansas New Motor Vehicle Quality Assurance Act, Act 297 of 1993, provides procedures for a consumer to receive a replacement vehicle, or full refund, for a new motor vehicle which cannot be brought into conformity within the warranty provided. The time period a new vehicle is covered under the Lemon Law ends 24 months after the date of the original delivery of the motor vehicle, or the first 24,000 miles whichever is the latter. The refund from the manufacturer shall be for the full purchase price (less an offset for use by the consumer determined by multiplying the purchase price by a fraction of the number of miles driven by the buyer divided by 120,000 miles), collateral charges such as sales taxes, title taxes, and extended warranties. When the sales tax is refunded to the consumer by the manufacturer, the manufacturer is then entitled to a refund from this office.

#Definitions of Child Abuse and Neglect in Federal Law - Child Welfare Information Gateway

Federal legislation provides guidance to States by identifying a minimum set of acts or behaviors that define child abuse and neglect. The Federal Child Abuse Prevention and Treatment Act (CAPTA) (42 U.S.C.A. 5106g), as amended by the CAPTA Reauthorization Act of 2010, defines child abuse and neglect as, at minimum:

  • Any recent act or failure to act on the part of a parent or caretaker which results in death, serious physical or emotional harm, sexual abuse or exploitation ; or
  • An act or failure to act which presents an imminent risk of serious harm.
  • This definition of child abuse and neglect refers specifically to parents and other caregivers. A child under this definition generally means a person who is younger than age 18 or who is not an emancipated minor.

    Ten months after graduation, about 58 percent of DePaul's graduates had found jobs requiring them to pass the bar, according to data from the American Bar Association. At Chicago-Kent it was about 59 percent.

    How Important is a College Degree?

    In my opinion, the importance of a college degree is directly related to how far you want to go in aviation.  For example, Northwest will not consider an applicant without a four-year degree while other airlines may.  Just because an airline does not require a degree, doesn't mean that they are going to consider you on equal footing as a degreed pilot.  For example, American Airlines doesn't have a requirement for a four-year degree however, the average new-hire pilot has at least a bachelors degree (according to Air Inc ). At "least" having a bachelor's degree means that some applicants that were hired have advanced degrees like masters, doctorates, etc.

    Many regional airlines will hire without degrees also, but that may be as far as you go career-wise and may never afford the chance to fly the "heavies".   Remember, the key is to be as competitive as possible in order to reach your goal in aviation.   While ... Read more »

    Barron's "Dictionary of Legal Terms" is a solid text. When I asked a law friend of mine which law dictionary I should purchase he told me that "Black's" was the best law dictionary out there. However, it is rather expensive at eighty or so dollars. Even the pocket version of the text is at least twenty dollars. So I sprang for this law dictionary at about eight dollars.

    The only reason that I did not give this 5 stars is that it is not as complete as some of the other books that I looked at. This version has "more than 2500 legal terms" and the other books were all about 3000. However, I have not yet come across a word or jargon that I was unable to find in this book so I am not sure what the other 500+ words or phrases are.

    Solid book. Highly recommended.

    The employees safety and well being on the job are important to the employers. However, accidents and illnesses can arise from work and when they do, the employees are covered under the WC law. The Hawaii WC law was enacted in 1915, and its purpose was to provide wage loss compensation and medical care to those employees who suffer a work-related injury. The WC law in essence requires the employer to provide certain benefits without regard to the fault of the employer and prohibits an employee from filing civil action against the employer for work-related injuries or illnesses. Any employer, other than those excluded (section 386-1), having one or more employees, full-time or part-time, permanent or temporary, is required to provide WC coverage for its employees.

    Federal civil rights laws provide protection from harassment that is based on a student’s, race, religion, gender, national origin, disability or color (StopBullying.gov ). Those laws do not cover LGBT youth being harassed due to their sexual orientation, but certain cases may overlap. For example, a male student who is being bullied for an effeminate nature, whether or not he is gay, has rights under this law.

    Divorce is the termination of a marriage by court judgment. A judicial decree is awarded declaring the marriage to be dissolved. It leaves both spouses free to marry again.     Many, if not most, students take out loans to pay for law school. There are a number of loan programs for graduate students, and some specifically for law students. In order to be eligible for loan aid, you must submit the FAFSA (Free Application for Federal Student Aid).     As a business school dean, I am frequently asked about rankings. Alumni wonder whether their degrees have lost—or gained—value because of rankings, and aspiring applicants fret about which rankings to trust. After all, there are many out there, each with a different formula, and each with a different school at the top. This puts prospective applicants in a position of consulting advisors who rarely agree. Given the element of subjectivity involved, it’s tempting to throw your hands in the air, as many academic leaders do, and conclude that rankings simply do not matter.

    Law School courses are open only to students enrolled as FULL-TIME Columbia University graduate degree candidates. Full-time graduate degree candidates may take up to 2 (two) Law courses per term but not more than 4 (four) Law courses during their entire Columbia course of study. JD and LLM foundation courses, legal writing, research, clinical, and externship offerings are NOT open to non-Law students.
