Questions touching the scope, effect or application of a rule of law which the courts apply in determining the rights of parties.

An issue before a court of appeal that requires the application of legal principles.

A question of law is usually contrasted with a question of fact. a mixed question of law and fact and even a question of discretion.

In the context of an appeal, a question of law is often put forward as an alleged error of law ; termed as a "question" for reasons of political correctness as it is not a recognized as a error until the appellate court says so.

In Woodhouse AC Israel Cocoa Ltd. Justice Alfred Denning (aka Lord Denning), wrote of the most commonly given example of a question of law :

The World Law Dictionary English may be the common language of the world, but the Common Law is not the common law of the world.

Some of the world’s leading law faculties have joined together to create an online database of legal terminology, all linked to a single English dictionary of law, with the aim of making it easier to understand and communicate legal concepts in different languages.

The overall aim of the project is to create the world’s best and largest multilingual law dictionary.

At launch, which is planned for January 2016 for the first few languages, there will be 10,000 English legal terms in the dictionary.

Academics in the field of law and linguistics have complained for decades about the shortage of good bilingual legal dictionaries 1 pointing out that legal publishers are reluctant to spend the time or money required to produce a good legal dictionary 2. These scholars have written extensively on the shortcomings of multilingual leg ... Read more »

October, 2003; Last Reviewed Dec. .

A contract intends to formalize an agreement between two or more parties, in relation to a particular subject. Contracts can cover an extremely broad range of matters, including the sale of goods or real property, the terms of employment or of an independent contractor relationship, the settlement of a dispute, and ownership of intellectual property developed as part of a work for hire.

Typically, in order to be enforceable, a contract must involve the following elements:

The parties to the contract have a mutual understanding of what the contract covers. For example, in a contract for the sale of a mustang , the buyer thinks he will obtain a car and the seller believes he is contracting to sell a horse, there is no meeting of the minds and the contract will likely be held unenforceable.

The contract involves an offer (or more than one offer) to another party, who accepts the offer. For example, in a contract for ... Read more »

    About Distance Education

If you've ever wondered what is distance learning, it is defined as the process of transferring knowledge to learners (students) who are separated from the instructor (teacher) by time and/or physical distance and are making use of technology components. such as the Internet, video, discussion forums, CD's, tapes and other forms of technology to accomplish learning.

Distance learning is what should occur if special consideration has been taken regarding the course design, instructional techniques, communication mediums, and organization and administrative issues associated with the distance education program. #Workplace safety

    Workplace safety: an overview

Workplace safety and health laws establish regulations designed to eliminate personal injuries and illnesses from occurring in the workplace. The laws consist primarily of federal and state statutes. Federal laws and regulations preempt state ones where they overlap or contradict one another.

The main statute protecting the health and safety of workers in the workplace is the Occupational and Safety Health Act (OSHA). Congress enacted this legislation under its constitutional grant of authority to regulate interstate commerce. OSHA requires the Secretary of Labor to promulgate regulations and safety and health standards to protect employees and their families. Every private employer who engages in interstate commerce is subject to the regulations promulgated under OSHA.

In order to aid the Secretary of Labor in promulgating and enforcing regulations, the act establishes the National Advisory Committee on Occu ... Read more »

In short: The Ph.D. or Doctor of Philosophy, is arguably the most prestigious degree in existence. The average amount of time required to earn a Ph.D. is five years, but the degree's financial payoff is huge. According to the U.S. Census Bureau, professionals with doctorates earn approximately $37,265 more each year than workers with bachelor's degrees.

The doctoral degree is the highest academic credential it is possible to earn. Whether it's a research Ph.D. (DPhil to the Brits), a D.A. (Doctor of Arts), or some other variant, the doctorate degree typically requires four to six years of additional study beyond the master's level. To get a doctoral degree the graduate student must complete a course of study, do original research and write a publishable thesis or dissertation. Not surprisingly, only one in 100 Americans call themselves "doctor." Consequently, a doctorate commands respect.

The doctoral student takes advanced courses in a chosen field, ... Read more »

    #Choosing a Law School

From fields of study to future career paths, here's what you need to keep in mind when choosing a law school.

    Location, Location, Location

If you're not considering a Top 10 school, you may want to start your search by thinking about where you'd like to practice law one day. As a law student, you'll get to be involved in the community through clinics and build connections with professors and students which will, in turn, open doors for job opportunities. So, with that in mind, you can cross out any schools located in states where you do not want to practice as a lawyer.

    Don't Play the Field

As you start to narrow down your list of schools based on where they are, you should also be thinking about what kind of law you'd like to practice after you graduate. Law schools do have specialties, just as practicing lawyers do. By applying to schools that are focused on your preferred field of study, you'll be able to better prepare ... Read more »

    What is Personal Injury Law?

Personal injury law refers to the legal remedies and defenses involved in civil lawsuits brought as a result of wrongful conduct. In fact, the word ?tort? comes from a Latin term meaning twist, wrong, or harm. In contrast to criminal law, a tort action does not involve the government prosecuting the wrongdoer. Rather, these cases involve a private plaintiff seeking compensation (usually money) for the harm caused by the defendant?s actions.

Most personal injury cases are based on the doctrine of negligence. In essence, negligence requires every member of society to act responsibly and avoid putting others at risk. That is not to say that negligence will result each time someone gets hurt. The doctrine recognizes that some accidents are unavoidable. To establish liability, the plaintiff must show that a reasonably prudent person in the defendant?s position would have acted differently under the circumstances.

Members of the state Board of Higher Education shot down the proposed University of Massachusetts law school yesterday after months of forceful debate over the plan and intense scrutiny by state officials, who concluded that the school's financial plan was too fragile and that legal questions about its structure had not been answered.

The 8-to-3 vote against the state's first public law school followed an emotional two-hour meeting at Bunker Hill Community College, where supporters of the merger between unaccredited Southern New England School of Law and nearby UMass-Dartmouth cheered statements in favor of the project and bristled at opponents' arguments. Scattered hugs and tears followed the decision.

''When people tell the story of public higher education in the Commonwealth, a long story with some sad chapters, they will tell the story of what you did today," UMass-Dartmouth chancellor Jean MacCormack, a leade ... Read more »

Although the law may not like the sound of it, there are often different degrees of guilt that can be associated with a crime depending upon the prosecutor, defense attorney, and even the judge.

If you've ever heard of the case Commonwealth v. Woodward (also known as the "nanny case,) then you already have a leg up in the realization that there can be several different degrees of guilt associated with any given crime. In that case, a nanny was convicted of murdering a toddler by shaking the child until it died. According to the jury's verdict, the nanny was to spend a minimum of 15 years in prison. However, the nanny was released from prison a week after entering the establishment because the judge threw out the jury's verdict.

From the beginning of the Woodward case, the prime question that needed to be answered was what charges should be brought against the nanny. The question "did she do it?" was easily answered in the affirmative by almost every par ... Read more »

Legal Separation Laws in the U.S. Copyright HG.org

A legal separation and a physical separation are not the same thing. In a physical separation, although the couple lives separately, there is no formal legal agreement.

A legal separation allows a husband and wife to live separately and formalize the arrangement by a court order or a written agreement. The arrangement addresses spousal support, and child custody, visitation and support, when relevant.

It is not equivalent to a divorce or dissolution and recognizes the possibility that the couple may reunite. It does not terminate a marriage, and so, does not allow the parties to remarry.

It is not necessary to be legally separated before obtaining a divorce. Although, most states have provisions for legally separated couples to commute their separation agreement to a divorce action, should they decide to do so.

Not all states recognize legal separations.

#Claims That Obamacare Website Violates Health Privacy Reveals Embarrassing Fact-GOP Does Not Understand HIPAA Or Obamacare

(Image credit: Getty Images via @daylife)

If you happened to catch yesterday’s House Energy and Commerce Committee hearings on the failures and foibles of the Obamacare website launch—or as New Jersey Democrat Frank Palone so aptly named the proceedings, “the monkey court”— you heard Congressman Joe Barton (R-TX) argue that a line of source code embedded in the software that operates the website violates the Health Insurance Portability and Accountability Act of 1996, better know as HIPAA, and infringes on our medical privacy rights.

While grilling Cheryl Campbell of CGI Federal—the key contractor responsible for building the Healthcare.gov website—Barton bellowed, “How in the world can this website be HIPAA-compliant when HIPAA is designed to protect the patient’s privacy?”

Barton continued to hammer the woman–who probably doe ... Read more »

For most couples, applying for the marriage license is the least romantic part of getting married. They go, they sit, they fill out the form, they show their IDs, they pay the fee and then they leave. It's about as romantic as a visit to the DMV. It is a necessary part of the process, though. Without a marriage license, your wedding is at best a really fancy and romantic party. The license is what seals the deal with the state and the government. It's important, even though it feels like a chore.

Marriage licenses can be traced all the way back to the middle ages. They started being used by the Catholic Church to get around a situation called The Banns of Marriage. For the most part the Banns of Marriage are associated with the Catholic Church though it has ties to the Church of England as well.

You are probably familiar with that part of the marriage ceremony during which the officiant asks if there are any objections to the union that is about to happen. This is a ... Read more »

A body of rules that delineate private rights and remedies, and govern disputes between individuals in such areas as contracts, property, and Family Law ; distinct from criminal or public law. Civil law systems, which trace their roots to ancient Rome, are governed by doctrines developed and compiled by legal scholars. Legislators and administrators in civil law countries use these doctrines to fashion a code by which all legal controversies are decided.

The civil law system is derived from the Roman Corpus Juris Civilus of Emperor Justinian I ; it differs from a common-law system, which relies on prior decisions to determine the outcome of a lawsuit. Most European and South American countries have a civil law system. England and most of the countries it dominated or colonized, including Canada and the United States, have a common-law system. However, within these countries, Louisiana, Quebec, and Puerto Rico exhibit the influence of French and Spanish s ... Read more »

The United States is a litigious society that requires a large number of lawyers to sift through the law through court and administrative hearings to resolve issues. As legal costs increase, paralegals have been trusted with a larger number of duties, tasks and responsibilities. As a result, the United States Department of Labor, Bureau of Labor Statistics has identified the paralegal career as a field with rising demand for employment and a great potential for career growth.

Paralegals (also called legal assistants or legal secretaries) support attorneys with basic legal paperwork, documentation and tasks. These include preparation of depositions, affidavits, arguments, reports, pleadings and motions for hearings. Legal assistants conduct basic background research into case law, judicial decisions and relevant published material.

Criminal convictions have long-term consequences. For someone who has been charged with a crime, whether a DUI, assault, or a property crime like embezzlement or petty theft, worries about jail time and possible punishments and penalties may be just the beginning. Criminal charges are serious, and even with a first offense, a person charged with a crime may be facing consequences that can affect their life permanently.

While the most pressing concern associated with criminal charges is often fear of being separated from family or loved ones, the ways a defendant can be permanently affected vary greatly. For example, a criminal defendant may lose their job or even their professional license, both common consequences of a criminal conviction. As extreme as it may sound, some states automatically revoke a plumber s license for certain offenses. In addition, conviction for some crimes, such as drunk driving, can result in driver's license suspension. Some criminal defendants may ... Read more »

    What is Criminal Law?

Criminal law involves a system of legal rules designed to keep the public safe and deter wrongful conduct. Those who violate the law face incarceration, fines, and other penalties. The American criminal justice system is both complex, and adversarial in nature. With the exception of minor traffic violations, accused individuals will require the assistance of an attorney.

Specific crimes and the consequences for violating them are found in penal codes enacted by legislators at the local, state, and federal levels. Less serious crimes are classified as misdemeanors. These typically carry a maximum of up to one year in the county jail. Examples include petty theft, possession of small amounts of controlled substances, and first-offense drunk driving.

Crimes of a more serious nature are classified as felonies. These carry punishments of a year or more in state or federal prison. Felonies include violent crimes like murder, burglary, a ... Read more »

#Common Law Law - Legal Definition

Common law is the system of deciding cases that originated in England and which was latter adopted in the U.S. Common law is based on precedent (legal principles developed in earlier case law) instead of statutory laws. It is the traditional law of an area or region created by judges when deciding individual disputes or cases. Common law changes over time.

The U.S. is a common law country. In all states except Louisiana, which is based on Napoleonic code, the common law of England was adopted as the general law of the state, or varied by statute. Today almost all common law has been enacted into statutes with modern variations by all the states. Broad areas of the law, such as property, contracts and torts are traditionally part of the common law. Because these areas of the law are mostly within the jurisdiction of the states, state courts are the main source of common law. The area of federal common law is primarily limited to federal iss ... The legal relationship results in the adoptee becoming the legal heir of the adopter and terminates any legal rights then in existence with the natural parents.

While certain jurisdictions only permit one of the two types of adoptions, other jurisdictions recognize two types of adoptions – open and closed adoptions. An open adoption permits the birth mother to select her child’s adoptive parents. A closed adoption, meanwhile, results in the birth mother relinquishing all rights over the child and allows a state administrative agency to conduct the selection process. Some jurisdictions also permit the parents in an open adoption to maintain their visitation and contact rights.

Most cases in which parental rights are termina ... Read more »

    #Common Law Defined

    COMMON LAW

That which derives its force and authority from the universal consent and immemorial practice of the people. The system of jurisprudence that originated in England and which was latter adopted in the U.S. that is based on precedent instead of statutory laws.

Traditional law of an area or region; also known as case law. The law created by judges when deciding individual disputes or cases. The body of law which includes both the unwritten law of England and the statutes passed before the settlement of the United States.

In Old England there were two types of Courts - law and equity. In the law court the Judge applied statutes. As time went on situations that were not covered by statutes were uncovered and Judges 'created' law, usually in equity. This is 'common law.'

The U.S. is a common law country. In all states except Louisiana (which is based on the French civil code), the common law of England was adopted as the ge ... Read more »

Federal employment discrimination is a heavily regulated subject, and when hiring an employee, there are a host of rules and regulations that an employer can run afoul of. Many of these laws only apply to certain employers, and many of these laws have exceptions. Here is an overview of the regulatory framework regarding federal employment discrimination.

Although this list is not exhaustive, these are the most commonly litigated areas of employment discrimination law:

    • Title VII of the Civil Rights Act of 1964 (Title VII), prohibits employment discrimination based on race, color, religion, sex, or national origin
    • The Equal Pay Act of 1963 (EPA), protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination
    • The Age Discrimination in Employment Act of 1967 (ADEA), protects individuals who are 40 years of age or older

Posted By Stephen D. Rosenberg In ERISA Statutory Provisions

Dismayed at the attention her father was receiving from her teenage friends over dinner in a Chinese restaurant, Sally Draper remarked to the table that her father s joke about stray cats and slow restaurant service was one he had been making for years. I thought of this when I saw Mike Reilly s interesting post last week on the test for determining whether a plan is a governmental plan or not, because I have been leading off stories about governmental plan and other exemptions from ERISA for many years with the story of a client who, in 1975, was assigned this new law to oversee for his employer, with the new law, of course, being ERISA. My client liked to say how, back then, with no case law to guide them, they would handle the exemption by means of an if it looks like a duck and quacks like a duck, then it s a duck analysis. In other words, if they thought a plan looked like a governmental plan, and it was relat ... Read more »

#Common law marriage - Family Lives

Understanding the myth of common law marriage

Contrary to popular belief, there is no such thing as a common law marriage . In England and Wales only people who are married, whether of the same sex or not, or those in civil partnerships can rely on the laws about dividing up finances when they divorce or dissolve their marriage.

The assumption by many unmarried couples in a long standing relationship that they have acquired rights similar to those of married couples is wrong. This common misconception needs to be addressed particularly as for many years official statistics show numbers of marriages in decline as more people choose to cohabit (living together without being married).

Many people also believe that by having a child together they acquire legal rights, whether married, in a civil partnership, or not. This is also not true. Although there is scope to apply to court for financial provision when there are childr ... Read more »

#Common law legal definition of Common law

    Common Law

The ancient law of England based upon societal customs and recognized and enforced by the judgments and decrees of the courts. The general body of statutes and case law that governed England and the American colonies prior to the American Revolution.

The principles and rules of action, embodied in case law rather than legislative enactments, applicable to the government and protection of persons and property that derive their authority from the community customs and traditions that evolved over the centuries as interpreted by judicial tribunals.

A designation used to denote the opposite of statutory, equitable, or civil, for example, a common-law action.

The common-law system prevails in England, the United States, and other countries colonized by England. It is distinct from the civil-law system, which predominates in Europe and in areas colonized by France and Spain. The c ... Read more »

#Compare Online Degree Programs - Costs - Accreditation

Like a traditional college, an online college provides students education with the hope of improving their day-to-day lives and futures. They emphasize that an online degree can raise your earning potential and brighten your career prospects while simultaneously allowing you to maintain your current lifestyle and schedule.

The right online college may improve your life, but a poor choice can leave you tens of thousands of dollars in debt with a worthless degree. To choose a reputable online college for you, evaluate yourself and consider the following criteria.

    • Your learning style: Be honest about your goals and studying habits. With no physical classroom or strict schedule, online learning requires self-discipline. However, online schools are not infinitely lenient; most schools will terminate your student status if you wait too long to complete your coursework.

Disability discrimination occurs when an employer or other entity covered by the Americans with Disabilities Act, as amended, or the Rehabilitation Act, as amended, treats a qualified individual with a disability who is an employee or applicant unfavorably because she has a disability.

Disability discrimination also occurs when a covered employer or other entity treats an applicant or employee less favorably because she has a history of a disability (such as cancer that is controlled or in remission) or because she is believed to have a physical or mental impairment that is not transitory (lasting or expected to last six months or less) and minor (even if she does not have such an impairment).

The law requires an employer to provide reasonable accommodation to an employee or job applicant with a disability, unless doing so would cause significant difficulty or expense for the employer ("undue hardship").

Millions of Americans experienced bullying at some point as a child. I personally experienced bullying between 5th and 8th grade when I went through a phase where I stopped growing up as much as out for a few years. Psychologically, I saw myself as a short, fat kid for years after, well into college when I was actually 6'3? tall and well built. The effects of bullying can be damaging and long lasting.

As a result, forty-nine states in the US have passed anti-bullying legislation focused on bullying that occurs at school. Georgia led the charge in 1999 when it was the first state to pass such legislation, while Montana lags behind the rest of the country and remains, at the time of writing, the only state in the union without anti-bullying laws.

In most instances, Indiana state law does not have provisions that mandate that employers provide breaks to employees. The only exception is for minors under the age of 18 and working more than a six hour shift. These minors, under Indiana labor laws breaks, must be given at least one 30 minute break or two breaks totaling 30 minutes, to be used at any point in the shift that the employee needs them. Indiana labor laws breaks mandates that all of these breaks be logged and kept as record in order to be in compliance with state labor laws and mandates for Indiana labor laws breaks.

If you’re considering a postgraduate-level degree in business, there are three main options available to you: MA, MSc or MBA. The core courses of any postgraduate business degree aim to introduce advanced-level topics in areas of business such as accounting, finance, marketing, human resources and operations management. Many programs then offer a wide range of elective courses, although some are specialized in one particular area of interest right from the start.

Some of the key differences between an MBA and other Masters in Business programs are explained below:

MBAs and other postgraduate business degrees have many similar entry requirements, including GMAT/GRE scores, academic achievements and evidence of language requirements. #Constitutional Law.

    What is Constitutional Law?

Constitutional law deals with the fundamental principles by which the government exercises its authority. In some instances, these principles grant specific powers to the government, such as the power to tax and spend for the welfare of the population. Other times, constitutional principles act to place limits on what the government can do, such as prohibiting the arrest of an individual without sufficient cause. In most nations, including the United States, constitutional law is based on the text of a document ratified at the time the nation came into being.

The U.S. Constitution itself became the law of the land well over 200 years ago, and the tenets set forth in the document remain in full force today. The way in which the Constitution is applied, though, has always been subject to court interpretation. As circumstances and public opinion evolve through the years, so too do the interpretations offered by th ... Read more »

    #Computer Science

    What is Computer Science?

Computer Science is about understanding computer systems and networks at a deep level. Computers and the programs they run are among the most complex products ever created; designing and using them effectively presents immense challenges. Facing these challenges is the aim of Computer Science as a practical discipline, and this leads to some fundamental questions:

    • How can we capture in a precise way what we want a computer system to do?
    • Can we mathematically prove that a computer system does what we want it to?

    #Consideration Lecture Notes

    Introduction

The mere fact of agreement alone does not make a contract. Both parties to the contract must provide consideration if they wish to sue on the contract. This means that each side must promise to give or do something for the other. (Note: if a contract is made by deed, then consideration is not needed.)

For example, if one party, A (the promisor) promises to mow the lawn of another, B (the promisee), A's promise will only be enforceable by B as a contract if B has provided consideration. The consideration from B might normally take the form of a payment of money but could consist of some other service to which A might agree. Further, the promise of a money payment or service in the future is just as sufficient a consideration as payment itself or the actual rendering of the service. Thus the promisee has to give something in return for the promise of the promisor in order to convert a bare promise made in his favour into a b ... Read more »

Used a much older version of Abacus Law and it was straightforward and decent. But this was back in the Windows 95 and Windows 98 days. Appointment book looked like a real book, contacts looked like real rolodex cards, that sort of thing.

Then, I switched the office to PCLaw which had more features and more in depth accounting we needed. Their tech support was good but the software was not perfect (tech support needed to repair corrupted data a few times, etc. ? not cool),

Then, switched to custom software web-based on our own server. But, that is a headache too to add functions and fix things over time. We re lawyers not programmers!

Now, PCLaw is part of the evil empire (Lexis Nexis) ? just a joke BTW ? so not sure how much it is now. I see they also have Juris too. PCLaw may be even better than before under Lexis Nexis s wings.

Anyways, that is why I was interested in Houdini Esq ? advertised to have lots of great features despite goofy name, logo, ... Read more »

Although the "net neutrality" debate seemed settled by the recent FCC vote to apply Title II utility-style regulation to broadband, these rules could be overturned in court or changed by a simple majority of commissioners appointed to the FCC by the next president. The only way to lock in the rules consumers and businesses want is to pass legislation that can't be changed easily by the next presidential election. Rand Paul is looking to overturn the recent FCC action with proposed legislation before the primary votes are cast.

    Constitutional Law: An Overview

The broad topic of constitutional law deals with the interpretation and implementation of the United States Constitution. As the Constitution is the foundation of the United States, constitutional law deals with some of the fundamental relationships within our society. This includes relationships among the states, the states and the federal government, the three branches (executive, legislative, judicial) of the federal government, and the rights of the individual in relation to both federal and state government. Both parties can agree on increasing the rent rates after a certain number of years. However, rent rates below $150 a month can be increased only with prior written consent by Ministry of Housing officials. This directive is covered by Law number 93 dated Oct. 4, 1973. The Ministry will give its approval based on fairness of rates proposed to the tenant. The Ministry will also determine if there’s a reasonable return on landlord’s investment on the property.

    On Security Deposits

The tenant must consign a security deposit which is equal to a month’s rent through the landlord. The said deposit will be reimbursed to the tenant at the event of the termination of lease agreement. The security deposit may not be reimbursed if there are amounts owed by the renter (tenant) to the owner or that any damage had been inflicted by tenant on the landlord’s property.

    #Consumer Credit

    Consumer Credit: An Overview

Credit allows consumers to finance transactions without having to pay the full cost of the merchandise at the time of the transaction. A common form of consumer credit is a credit card account issued by a financial institution. Merchants may also provide direct financing for products which they sell. Banks may directly finance purchases through loans and mortgages.

The law of consumer credit is primarily embodied in federal and state statutes. These laws protect consumers and provide guidelines for the credit industry.

States have passed various statutes regulating consumer credit. The Uniform Consumer Credit Code has been adopted in eleven states and Guam. Its purpose is to protect consumers obtaining credit to finance their transactions, ensure that adequate credit is provided, and govern the credit industry in general.

In 1968, Congress passed the Consumer Credit Protection Act in part to regulate th ... Read more »
