A law firm is an organization formed by one or more lawyers that are engaged in the practice of law. These organizations have the purpose to advice clients (individuals or corporations) about legal rights and responsibilities with the government or other institutions, besides they represent their clients in business negotiations, criminal or civil cases, and other situations in which it is necessary a legal support.

There are a variety of law firms in size; for example, smaller law firms are the majority of lawyers in all countries that work as freelancers on specific specialties such as labor law, tax law, criminal law and family law; while larger law firms has separated groups in litigation and transactional departments, this way these firms can provide a diversity of services to their clients.

To receive federal funding for schools, states must institute a bullying policy under federal law. This rule focuses mostly on discriminatory acts. For example, a Caucasian child in an all-black school might be protected by the federal guidelines if she s bullied on the basis of her race, whereas she might not be if she s tormented in an all-white school for reasons that don t qualify as discrimination. No federal law prohibits bullying itself, but the federal government mandates that schools must address persistent discriminatory behavior that turns a child s school into a hostile environment.

Pennsylvania s bullying policy loosely extends to acts that take place off school grounds. They must be of such a nature that they d be prohibited on school property as well, and they must take place in a school supervised location. If another child threatens your child at the bus stop, you may have a basis for legal action just as you would if it had happened on the school playgroun ... Read more »

#The Eviction Process

The Eviction Process

Eviction Flow Chart (Shows timeline and steps in the eviction process.)

If your landlord tells you to move, it doesn t mean you have to. In San Francisco, rent controlled tenants (most tenants) can only be evicted for certain just causes . Plus, here, and everywhere in California, evictions must follow specific legal procedures and a court process before you can be forced to move, unless you are a sole lodger living with the owner.

Beware. Most no fault evictions require landlords to pay relocation payments and restrict whether or not a landlord can raise the rent on a new tenant or convert the unit into a condominium. Tenants who move just because the landlord tells them to—without making the landlord actually issue an eviction notice—allow the landlord to evade re-rental and condo conversion restrictions, as well as relocation payments.

#The Law Of Unintended Consequences: Georgia s Immigration Law Backfires

Migrant farm workers from Mexico finish a long day of harvesting organic vegetables (Image credit: Getty Images North America via @daylife)

By Benjamin Powell

To forgo a repeat of last year, when labor shortages triggered an estimated $140 million in agricultural losses, as crops rotted in the fields, officials in Georgia are now dispatching prisoners to the state’s farms to help harvest fruit and vegetables.

The labor shortages, which also have affected the hotel and restaurant industries, are a consequence of Georgia’s immigration enforcement law, HB 87, which was passed last year. As State Rep. Matt Ramsey, one of the bill’s authors, said at the time, “Our goal is … to eliminate incentives for illegal aliens to cross into our state.”

Now he and others are learning: Be careful what you wish for, because you may get more than you bargained for.

THE INVISIBLE HAND OF STEVE MOSTYN

Steve Mostyn: Pushing a Pro-Lawsuit, Job-Killing Agenda

Steve Mostyn is a Houston personal injury lawyer specializing in hurricane lawsuits. He has become extremely wealthy off the losses of others in the wake of damaging storms. Mostyn is the largest funder of liberal candidates in Texas who oppose lawsuit reform and push his pro-lawsuit, job killing agenda.

Mostyn knows most Texans are conservative and don’t like lawsuit abuse, so he has also created a number of groups with conservative sounding names to fool voters. During election years, he puts up millions for these deceptively named groups which back candidates who want to roll back the lawsuit reforms that are keeping the Texas economy strong. He’s hoping voters won’t realize that the money is coming from a liberal, personal injury trial lawyer whose primary agenda is, presumably, his own self-interest.

#The MBA Tour E-Bulletin

Rankings are a comparison of business schools that is organized by journalists. Accreditation is a process of quality assessment that is conducted by peers under the supervision of professional associations. Rankings will only tell you which business schools a magazine or newspaper thinks is number 1, number 2, number 3, etc. but accreditation will tell you that a business school meets specific international standards. In terms of measures of quality, accreditation is much more important than rankings.

The MBA Tour encourages you to look at BOTH rankings and accreditation when you choose an MBA program. We have asked our colleagues to provide information to help you better understand both processes.

Accreditation

Accreditation is a very important measure of a business school that is not understood by many people who apply to an MBA program.

Accreditation provides an independent validation of MBA courses. Several accr ... Read more »

#The Immigration Act of 1924 (The Johnson-Reed Act) - 1921–1936 - Milestones - Office of the Historian

The Immigration Act of 1924 (The Johnson-Reed Act)

The Immigration Act of 1924 limited the number of immigrants allowed entry into the United States through a national origins quota. The quota provided immigration visas to two percent of the total number of people of each nationality in the United States as of the 1890 national census. It completely excluded immigrants from Asia.

Literacy Tests and “Asiatic Barred Zone”

In 1917, the U.S. Congress enacted the first widely restrictive immigration law. The uncertainty generated over national security during World War I made it possible for Congress to pass this legislation, and it included several important provisions that paved the way for the 1924 Act. #Why an Elder Law Attorney is a Good Choice

Rather than being defined by technical and legal distinctions, Elder Law and Special Needs Law is defined by the clients to be served. In other words, the attorney who practices Elder Law or Special Needs Law works primarily with people as they age and people with disabilities.

Elder Law and Special Needs Law attorneys use a variety of legal tools and techniques to meet the goals and objectives of their clients. Elder and Special Needs Law attorneys typically work with other professionals in various fields to provide their clients quality service and ensure their needs are met.

Using this holistic approach, for example, an Elder Law attorney will address general estate planning issues and will counsel clients about planning for incapacity with alternative decision making documents. This attorney will also assist clients in planning for possible long-term care needs, including nursing home care. Locating the appropriate typ ... Read more »

#THE LAW OF INERTIA

T he law of inertia states that:

A body will preserve its velocity and direction so long as no force in its motion's direction acts on it.

For example : a package thrown out of an airplane will continue to move at the speed of the airplane on the horizontal axis (in the direction of the airplane's movement). Since the law of gravity acts on the package (a vertical downward axis), the package will gather speed along the vertical axis, but on the horizontal axis its speed will remain equal to that of the airplane.

(In this explanation we have left out the force of air-resistance).

%img src="incl4.jpeg>

The" /%Galileo discovered the law during the first decade of the seventeenth century, but in fact he did not understand the law in the general way we have formulated it here. #When Life Gives You Lemons.

When Life Gives You Lemons.

The Tesla Motors Team April 9, 2014

We were taken by surprise by a lemon law claim recently filed against Tesla by a Wisconsin lawyer, describing himself as the "Lemon Law King", who says that we ignored his client's three demands for a buy-back after alleged problems with a Model S.

First, let us state that we believe in lemon laws – they exist to protect customers against cars that repeatedly suffer defects. That's a worthy thing to address. We also make a point of going above and beyond in customer service, which extends to buying back cars on fair terms from any customer who ultimately remains unsatisfied with their vehicle. We never want someone to be unhappy in their ownership of a Model S.

In this case, however, there are good reasons to be skeptical of the lawyer's motivations. The service record shows that the Tesla service team did everything reasonably possible to help his client a ... Read more »

#The law on alcohol and under 18s

There are a number of laws around alcohol and under 18s so as a parent it's best to have an understanding of them. Some of them could also land you in trouble if you unknowingly break them.

What does the law say?

Alcohol consumption in the UK is governed by strict laws.

It is against the law (1) (2):

  • To sell alcohol to someone under 18 anywhere.
  • For an adult to buy or attempt to buy alcohol on behalf of someone under 18. (retailers can reserve the right to refuse the sale of alcohol to an adult if they’re accompanied by a child and think the alcohol is being bought for the child.)
  • For someone under 18 to buy alcohol, attempt to buy alcohol or to be sold alcohol.
  • For someone under 18 to drink alcohol in licensed premises, except where the child is 16 or 17 years old and accompanied by an adult. In this case it is legal for them to drink, but not buy, beer, wine and cider with a ... Read more »

Rumor, innuendo and gossip are things hard-news reporters generally avoid (as opposed to reporters on the celebrity beat). Most importantly, reporters do not have the right to libel the people they write about.

#The Moral Crisis on Our Southern Border

The Moral Crisis on Our Southern Border

No one knows just how many tens of thousands of Central American nationals most of them desperate, unescorted children and teens are streaming across America s southern border. Yet this phenomenon offers us a proverbial teachable moment about the paradoxes and hypocrisies of Latin American immigration to the U.S.

For all the pop romance in Latin America associated with Venezuela, Nicaragua, and Cuba, few Latinos prefer to immigrate to such communist utopias or to socialist spin-offs like Argentina, Bolivia, Ecuador, or Peru.

Instead, hundreds of thousands of poor people continue to risk danger to enter democratic, free-market America, which they have often been taught back home is the source of their misery. They either believe that America s supposedly inadequate social safety net is far better than the one back home, or that its purportedly cruel free market gives them more ... Read more »

#Why Attending Law School Is The Worst Career Decision You ll Ever Make

The news for would-be attorneys keeps getting worse. According to analysis from the Wall Street Journal released yesterday, only 55% of class of 2011 law school grads were employed full-time as lawyers nine months after graduation. The other 45% may be unemployed, working at Starbucks or starting their own law school hate blogs. Couple this with declining starting salaries (they fell $9000 between 2009 and 2010) and the fact that 85% of law school grads are facing an average debt load of $98 500 and you can see why law school as a career path has taken a public lambasting in recent years.

There’s a good reason that the WSJ’s data – based on figures from the American Bar Association – may seem shocking. It marks the first look at employment figures related solely to jobs requiring a legal degree and passage of a bar exam. Previously, law schools reported employm ... Read more »

#Which law firms will fund your LPC and GDL course fees and pay maintenance costs?

Of the firms advertised in TARGETjobs Law 2015, 46 sponsor their future trainees through the conversion course and LPC.

The promise of a generous salary is a tempting reason to become a trainee solicitor but the flipside is that qualifying is an expensive business. Non-law graduates need to cover conversion course (usually known as the CPE or GDL) fees, which range from £3,000 to £10,200 full time, and all graduates who want to become a trainee solicitor need to fund the legal practice course or LPC, which costs from £7,500 to £14,750 full time, depending on course provider and location. It’s wise to start thinking about how you’re going to finance this while still on your undergraduate degree.

#Whistleblower Law.

Whistleblower law is related to Wrongful Termination law and includes the statutes that protect employees from being terminated or otherwise discriminated against in retaliation for exposing suspected dishonest or illegal activities or wrongdoings, that violate the public trust, occurring in their place of employment. Although the term whistleblower is generally associated with government workers who report government fraud, these laws actually offer protection to employees of public or private companies, as well as government agencies. Some of these statutes also make provisions for monetary awards for employees who expose an employer who is guilty of these types of violations.

The federal Whistle Blower Protection Act (WPA) protects most federal employees who work in the executive branch. It also requires that federal agencies take appropriate action. The Office of Special Counsel (OSC) was created by this act and is tasked with investigating ... Read more »

For the past five years, Lawyerist has published an annual list of the best law firm websites. Now, you can find out what they have in common.

The 2015 best law firm websites are out! Check out the current top 10.

Out of over 50 nominations, we have narrowed the field down to the ten best. There were many good nominations, but the top ten are some really excellent, responsive websites.

Responsive web design turned out to play a big factor in getting to the top ten. A responsive website should look good on any screen, from a big desktop display to a smartwatch. Law firm websites still have a way to go on this, though. Many great-looking nominations — including some websites built in the last year — wound up in the discard pile because they are not responsive.

Apart from responsiveness, however, I will not explain the criteria I used to pick these ten websites. Great website design is in the eye of the beholder, and it is up to you to take a look and de ... Read more »

#When Is An MBA Worth It?

Earning an Master's in Business Administration (MBA) can help professionals enhance their career opportunities, receive increased compensation and job promotions. An MBA can provide the skills and knowledge necessary to start a new business, and many employers require an MBA for certain management or leadership positions.

On the other hand, an MBA from a top business school can cost nearly $100,000 – a substantial expense for recent graduates and substantial time out of the workforce for early-career professionals. The question becomes, is earning an MBA worth the cost? It all depends. (For more, see: Should You Get An MBA? )

#Which part time MBA program offers the most ROI: Villanova or Temple?

Matt Benedetto Law student at Stanford, investor, and chess-boxing enthusiast

I have to say temple here especially if you are an instate student. In state temple is $27,000 a year, so $54,000 over 2 years. Where nova is $94,000. I m not sure how these figures change if you are part-time but I imagine its similar.

Now temple with out of state tuition is $39,000, so $78,000 for 2 years. Still a $16,000 difference.

The question then is, of course, is nova worth $16,000-$40,000 more than temple, and the answer is almost certainly no. The employment prospects are similar out of both schools, and both have strong ties to Philadelphia. Very few, but some, get jobs in New York. But these schools are strong regional schools, so you best way to maximize ROI is to stay close to the mother ship, I.e. Philadelphia.

I think, slightly biased because I went there for undergrad, temple is a strong ... Read more »

But don't kid yourself. What matters exponentially more than that M.B.A. is the set of skills and accomplishments that got you into business school in the first place. What if those same students, instead of spending two years and $174,400 at Harvard Business School, took the same amount of money and invested it in themselves? How would they compare after two years?

If you want a business education, the odds aren't with you, unfortunately, in business school. Professors are rewarded for publishing journal articles, not for being good teachers. The other students are trying to get ahead of you. The development office is already assessing you for future donations. Adm ... Read more »

#What’s Wrong with the Violence Against Women Act?

When Congress passed the Violence Against Women Act (VAWA) in 1994, it was a landmark in federally recognizing the scourge of domestic violence. It also brought about a very practical change, meant to address the problem of cops treating such cases as private family matters instead of serious crimes. With grant funding as reward and with the backing of many leaders in the battered women’s movement, VAWA encouraged states to adopt mandatory arrest policies that allowed domestic violence cases to move forward without the cooperation of victims. Eighteen years later, with a reauthorization of VAWA now stalled on Capitol Hill, a vocal group of researchers and advocates are questioning whether VAWA’s original intent—to make law enforcement the primary tool to stop domestic violence—was the right approach. “VAWA’s focus on law enforcement reduces the really more complicated thing of violence against women to be a problem of the law,” say ... #When Adultery Is a Crime - The Atlantic

South Korea has scrapped a law against infidelity that arose from the chaos of the Korean War.

We noticed that you have an

Last week, a South Korean court struck down a national institution: a six-decade-old law that made adultery a criminal act carrying a prison sentence of up to two years. It should be left to the free will and love of people to decide whether to maintain marriage, the majority opinion declared. Some 53,000 South Koreans had been indicted and 35,000 jailed for the crime since the government started tracking such figures in 1985. Naturally, the ruling sent the shares of condom and morning-after pill manufacturers soaring.

Adultery bans are a fading but persistent global phenomenon. and they re instructive when it comes to assessing how sexual and gender dynamics are shifting in different societies. In the United States, for example, adultery laws enacted in the 1700s and 1800s were often p ... Read more »

#Whistleblowing for employees.

You’re a whistleblower if you’re a worker and you report certain types of wrongdoing. This will usually be something you’ve seen at work - though not always.

The wrongdoing you disclose must be in the public interest. This means it must affect others, eg the general public.

As a whistleblower you’re protected by law - you shouldn’t be treated unfairly or lose your job because you ‘blow the whistle’.

You can raise your concern at any time about an incident that happened in the past, is happening now, or you believe will happen in the near future.

Who is protected by law

You’re protected if you’re a worker. eg you’re:

  • an employee, such as a police officer, NHS employee, office worker, factory worker
  • a trainee, such as a student nurse
  • an agency worker
  • a member of a Limited Liability Partnership (LLP)

#Online Law Schools Have Yet to Pass the Bar - US News

Many argue that fully online programs aren't the path to a traditional legal career.

Updated: 6/20/12

Enrolling in an online J.D. program may seem like a convenient alternative to spending three years and more than $100,000 on a traditional legal education. especially for working adults—but prospective students should be wary of the potential pitfalls, experts say.

Wholly online J.D. programs are not accredited by the American Bar Association, and graduates of the programs are eligible only to take the California Bar Exam, given that it's the only state in which online law schools can officially register (though some states have been known to make exceptions on an individual basis). In all, there are 12 unaccredited distance or correspondence law schools registered in California, including Concord Law School of Kaplan University, California School of Law, and the Abraham Lincoln Univer ... #Which Legal Form Is Best for Your Business, Incorporation Article

When you start a business, you must decide on a legal structure for it. Usually you'll choose either a sole proprietorship, a partnership, a limited liability company (LLC), or a corporation. (Also, some businesses choose to operate as cooperatives.) There's no right or wrong choice that fits everyone. Your job is to understand how each legal structure works and then pick the one that best meets your needs. The best choice isn't always obvious. You may, after reading this section, decide to seek some guidance from a lawyer or an accountant.

For many small businesses, the best initial choice is either a sole proprietorship or, if more than one owner is involved, a partnership. Either of these structures makes good sense in a business where personal liability isn't a big worry -- for example, a small service business in which you are unlikely to be sued and for which you won't be borrowing much money. #What is the Difference Between an Attorney a Paralegal and a Lawyer?

One common area of confusion for those outside the legal profession is the difference between various job titles among legal professionals. After all, in many jurisdictions there are now paralegal firms that offer services that to some might seem similar to what an attorney can do. So what is the difference between an attorney and a paralegal, an attorney and a lawyer, and other legal professionals?

Attorney vs. Paralegal

The biggest distinctions between attorneys and paralegals are education and licensing. To be an attorney, one must attend and graduate from an American Bar Association (ABA) accredited law school (in most cases obtaining a juris doctorate degree); undergo a rigorous background screening by the state in which he or she intends to practice; and take and pass a grueling licensing test called the bar exam designed to determine if the attorney is minimally competent in the majo ... #Will the legal establishment allow a two-year law school?

Jewel Samad | AFP | Getty Images

When President Barack Obama said last week that law schools would "probably be wise" to move away from three-year programs to two, he gave lip service to the stakeholders.

"The question is can law schools maintain quality and keep good professors and sustain themselves without that third year?" the Harvard Law graduate asked in remarks at New York's Binghamton University. "My suspicion is that if they thought creatively about it, they probably could."

Easy for him to say.

"Who will fight like crazy to prevent two-year schools from being able to accredit J.D.s? Just about everybody in the established order," said Columbia Business School professor Rita Gunther McGrath, who has written about the troubles facing law schools.

Under a two-year system, McGrath sees lost revenue for administrators, poorer job prospects for professors and fewer studen ... Read more »

#5 Reasons Not to Get a Dual JD

Don't pursue an extra degree just because you can.

As the global marketplace grows increasingly complex, professionals want to gain a diverse skillset, allowing them to thrive in diverse, rapidly-evolving environments. As a result, more and more people are pursuing dual degrees, including JD/MBAs.

I received my JD/MBA from Harvard University several years ago, and I have found it to be extremely worthwhile. As an entrepreneur, I rely on both my business and law education daily. However, this dual degree is not right for everyone, and you need to carefully consider it before making this investment.

This week, I will discuss the potential reasons not to pursue a JD/MBA. Next week, I will explain the substantial benefits of this dual degree.

Here are five reasons a JD/MBA may not be right for you:

1. Cost: Most JD/MBA programs are four years long and cost at least $50,000 more than a law degree al ... Read more »

#6th Circuit says Michigan tribe subject to federal labor laws

Credit Joe Gratz / flickr/creative commons

A federal appeals court says a northern Michigan Indian tribe does not get to set its own labor rules at the casino it operates near Manistee.

The Little River Band of Ottawa Indians claimed tribal sovereignty allowed it to adopt its own laws that ban strikes and discourage union organizing by casino employees. The Teamsters challenged the tribal act, and the union won before the National Labor Relations Board.

But the Little River Band says the board has no jurisdiction in this instance.

Not so, says the U.S. Sixth Circuit Court of Appeals. The court says Indian tribes are sovereign, but, with just a few exceptions, federal laws still apply to them. The court said the Indian Gaming Regularity Act was adopted by Congress to help tribes with economic development.

“It does not, however, immunize the operation of Indian commercial gaming ent ... Read more »

#William Mitchell law school first to offer ABA-approved online degrees.

A Minnesota law school will become the first in the country to allow students to earn their degrees largely from home, with the blessing of the American Bar Association.

On Wednesday, William Mitchell College of Law in St. Paul plans to announce its new hybrid option: Students will spend only a week or two on campus each semester, and take the rest of their classes online.

It s the first such program at a fully accredited law school. And depending on whom you ask, it s a risky, or a long overdue, venture that could shake up the tradition-bound halls of legal education.

It moves them slightly forward into the 21st century, said Robert Oliphant, a professor emeritus at William Mitchell who supports online teaching. Law schools are about the last institutions in the world to try to change. They re just very stuck in the mud.

The ABA, which accredits 203 law schools nationwide, ha ... Read more »

#On-line learning gets tryout at summer school

Greenwich High School rising senior Zeik Dume works on his Algebra II course in Odysseyware Thursday at Central Middle School.

For seven Greenwich high school ers, there would have been no summer school this year without new software.

Among them, they are taking five “credit recovery” classes to earn credits for courses they did not pass during the school year. With just a handful taking those classes, there were not enough students to meet enrollment minimums to staff them.

In the past, the lack of numbers would have meant those classes could not be run. Students would have to make up the courses another time, likely during the school year. For some, the delay in catching up could have meant having to spend another year in high school.

Administrators did not want to see that scenario, so they came up with an alternative: The students would become their own teachers, by doing the cour ... Read more »

#6 Predictions for Law Firm Marketing in 2015

We recently asked a several dozen experts for legal industry predictions for 2015, which we will publish here later this week.  Larry Bodine provided six for law firm marketing  and we’ve  decided to run his viewpoints as a standalone post.

    * * *

Here are Mr. Bodine’s six predictions for legal marketing next year:

    1. The firm website becomes the sine qua non  of legal marketing. A law firm website is now the essential element of its marketing. Hinge research showed that 77% of professional firms generate new business leads online. 70 percent of law firms in another survey said their website generated new matters, according to Alyn-Weiss research .

    2. The rise of the review sites.   Because so many consumers habitually look to review sites before buying anything, lawyers will have to pay close attention to reviews about them on Avvo, Personalinjury.com, Yelp, Goog ... Read more »

#1L Guide to Buying Cheap Textbooks - Top Law Schools

1L Guide to Buying Cheap Textbooks

Law school is very expensive and many students are on a tight budget. Legal textbooks can eat away at that budget, costing as much as $200 per book. Below is a short guide for 1L's on how to find the best deals on textbooks.

    1) Buy used books

There is really no good reason to buy a brand new, shrink-wrapped textbook. Unless your professor requires a textbook that was just published a month ago, you should be able to find a used copy online. Some people argue that they need a new book because they prefer clean pages. However, there are plenty of used books out there that have no markings. Out of the six used textbooks I bought for 1L year, only one of them had highlighting on the pages. When buying online, read the seller descriptions for used books and you will know if the pages are clean. If you stick to used textbooks and aren't too picky, you should never pay more t ... #5 Questions to Ask When Choosing an MBA Entrepreneurship Program - US News

How a program integrates hands-on learning opportunities into the curriculum can vary, experts say.

Attending business school has traditionally been a way to advance in the ranks of an established company, but recently more students are electing to work for themselves soon after getting their degree.

Forty-five percent of alumni entrepreneurs from the classes of 2010-2013 started businesses at graduation, as compared with just 7 percent of alumni entrepreneurs who graduated before 1990, according to a March report from the Graduate Management Admission Council.

Many students in MBA programs select entrepreneurship as their focus to better prepare themselves for being employers, investors, inventors and other necessary roles that keep the world of entrepreneurship spinning.

Experts say learning opportunities available vary at different schools, but programs with a strong entr ... Read more »

#3 Bad Reasons to Get an MBA - US News

Don't apply to business school just to bolster your resume.

There are many reasons why an MBA degree is a great way to turbocharge your career, and this blog has covered several of them. But there are also bad reasons for going to business school. These three should not be your motives for contemplating getting an MBA.

    1. You're unsure what else to do. Perhaps you are feeling pressured to go for the degree by well-meaning family or friends. Or, maybe you’re just a little too excited about the partying and social events that abound at business schools.

At the dawn of the financial crisis, many young professionals turned their thoughts toward business school as the job market grew increasingly unstable. This is an understandable rationale, but taking a two-year break as a placeholder activity doesn’t make a lot of sense professionally or financially. A better bet would be to take time to travel the world and find ... Read more »

#21 Questions to Ask During an Interview for a Legal Job

Landing an interview, dressing to impress and confidently answering interview questions are only part of the equation of a successful interview. It’s important that candidates show an interest in the law firm or organization and treat the interview like a conversation. One of the best ways to do this is by asking thoughtful questions --not just questions whose answers readily appear on the firm’s or organization’s website. To help jumpstart the process, below (in no particular order) find 21 interview questions to ask during a legal job interview.

    2. Did you focus on X while you attended law school? (If you are still in school) Do you recommend any courses or clinics that would enhance my understanding of X field?

When a woman hears the words "I want a divorce," the turmoil of the separation can propel her to make some horrible mistakes that can cause a lot of trouble later .

Divorce attorney Randall Kessler of Kessler and Solomiani in Atlanta has revealed the 6 biggest mistakes that women make in a divorce.

Firstly, women should not panic and should go online and find out everything that they need to know. They should meet a lawyer or more than one lawyer and find out what their rights are. Women should remember that they are not going to get kicked out of their home immediately just because their husband is not paying their rent or mortgage anymore and should not get intimidated into agreeing to a settlement before they are ready to.

#4 things you should know about Utah gun laws

SALT LAKE CITY In the weeks since the Sandy Hook massacre, where 20 children were killed at a Connecticut elementary school, the rhetoric around the nation has been about safety and gun control, including laws that allow Americans to carry a firearm.

The U.S. Constitution clearly spells out that American citizens have the "right to keep and bear arms" and that those rights "shall not be infringed." The Utah Constitution further defines the right to bear arms as a means for "security and defense of self, family, others, property, or the state, as well as for other lawful purposes" and that those rights "shall not be infringed."

However, the types of "arms" allowed assault weapons has been debated ad nauseum in recent weeks.

More recently, a man was photographed at a Utah JCPenney store Wednesday openly carrying an semi-automatic rifle over his shoulder. While not illegal in the state of Utah, many shoppers were co ... Read more »

On-line learning today provides a quality alternative to on-the-ground courses. It offers students greater flexibility as to time and place as most courses are offered asynchronously, meaning students can take them at any time of the day or night. The Chief Academic Officers find that the outcomes from distance education courses are equal to or better than those of traditional, on the ground, courses.

More than 5 million students or 25% of all college and university students are enrolled in distance education courses according to the National Center for Education Statistics. Eleven percent of students are enrolled exclusively in distance education c ... Read more »

#8 Stanford Men Vied For Glory. She Didn t. Guess Who Won?

Follow Comments Following Comments Unfollow Comments

Something surprising just happened at Stanford Law School. In this year’s graduating class, eight men and one woman vied to be this year’s commencement speaker. Each male tried to position himself as the rightful leader of the class. The female candidate never did so. And yet, when the 180-person graduating class was done voting, she won.

How did Marta Belcher pull it off? The story of how she outwitted her rivals would make a lovely logic puzzle. See if you can figure it out, based on the following hints.

Belcher has a deep interest in the way ideas get shared, developed and protected. Most recently, she’s been an intern at the Electronic Frontier Foundation. which champions file sharing, open-source software and free speech online. She’s held summer jobs at Apple and the Ropes Gray law firm, related to intellectual property issues.

#28 Great Places to Buy Law Books Online

By Michelle Fabio. Law School Expert

Law books are without a doubt one of the biggest expenses for students, and it doesn t help that textbook prices increased nearly threefold between 1986 and 2004 according to the Government Accounting Office (PDF). Sadly, selling them back for pennies is perhaps even more depressing than buying them in the first place.

The Internet has created a virtual playground for shoppers, and here are 28 places you can save money on law books -- and note that many buy back books as well:

    1. AbeBooks.com. A subsidiary of Amazon.com with books discounted up to 90% off list price.
    2. AddALL. Popular textbook search and comparison engine.
    3. Alibris.com. Textbooks from 10,000 independent bookstores.
    4. Amazon.com. Surely you know of Amazon s excellent book selection, but don t miss their Marketplace, which has some of the best prices anywhere on used books.

You find that the study or practice of law is not what you had expected and you are planning a career change. What do you do with your law degree?

“You can do so much with a law degree!” Many disgruntled law students and lawyers can tell you that they’ve heard this line enough to make their eyes roll back into their heads. But is this quip true?

It really is. You can, in fact, do a lot with a J.D. besides practicing law, contrary to popular belief. The transferable skills that a law degree helps you develop are useful in a variety of non-law related professions.

#8 things never to say to your daughter-in-law

This article is a different perspective than you might expect on this topic. I m not a mother-in-law yet, but I am a daughter-in-law and I have a lot of friends who are also daughters-in-law (DILs). Between us, we pooled this list of the most unflattering or annoying things our mothers-in-law (MILs) say to us.

There is a caveat: some daughters-in-law have great relationships with their MILs. They don t mind when their MILs offer advice unasked or question how they run their households. Unfortunately, this isn t true for everyone. These suggestions are for those well-meaning, wonderful mothers out there that want to know what they can do to improve their relationships with the wives of their sons (because nothing else they ve tried has worked so far). Avoid saying the following things, and you re sure to notice positive results.

#5 ways to put a law degree to work

FORTUNE Dear Annie: Last spring, I graduated from a good law school and, all these months later, I still can’t seem to get hired by a law firm in my (fairly large) city. Most of them seem to be shrinking, not growing, and the informational interviews I’ve had so far have been interesting mainly because they’re so negative. Even some partners at big firms have told me “off the record” that getting ahead in the profession has been both boring and grueling, a really bad combination, and I should find something else to do with my life. The question is what. Do you or your readers have any ideas about how I should broaden my job search? I’d still like to use my law degree if possible, especially since I went into debt to get it.  No Name, Please

It’s been three years since I graduated from Harvard Business School, and I’ve spent a lot of time thinking about what I wish someone would have told me BEFORE B-school and definitely while I was going through my job search.

So here are my top 10….

    #12. 4 Ampere s Law

    12.4 Ampere's Law

Physicists conclude that electrostatics can be described by the two conditions: E = 0, E =.

No sources or sinks of Magnetic Field lines; and Ampere's Law.

We can immediately translate the statement that magnetic fields have no sources or sinks into the statement: B = 0, since, (again by the divergence theorem,) we know that sources and sinks correspond to non-vanishing divergence.

You are probably familiar with the Biot-Savart Law which describes the magnetic field produced by an electrical  current element.

Ampere's Law states that, for constant current flow, the flux of electrical current through a surface is proportional to the line integral of the magnetic field (counterclockwise) around its boundary:

Stokes' Theorem, applied to B, gives

Upon combining these two we obtain, for any surface S :

#9 frequently asked questions about common-law unions

    Fotolia

    1. What if I want the rights of a married couple but I don’t want the certificate or the whole wedding thing?

Some provinces allow you to register your coupledom as a “civil union” or a “domestic partnership.” In Nova Scotia, for example, you just fill out a form for $22.68 and get the same rights as married couples under the law. If the relationship goes to crap, a Statement of Termination costs $30.29. (How cold would that be? A Dear John letter accompanied by three tens and three dimes.)

    2. What do I have to do to be considered in a common-law union?

What is common-law for insurance or tax purposes might be different from the family law definition. To be considered a common-law spouse in the eyes of the law, a couple must be in a marriage-like relationship and live together for a certain period of time. That period, in Ontario and New Brunswick ... Read more »

#9 Habits To Manifest Your Dreams Using The Law Of Attraction.

    SHARES

We are powerful manifesting machines, but since we have 50 to 70 THOUSAND unconscious thoughts per day, of which about 80% are NEGATIVE we're not always manifesting wonders!

While it's true that the first step to using the law of attraction is shifting to more positive way of thinking, the reason people give up working with LOA is that they believe that if they start thinking positive thoughts, then all their dreams will manifest.

The law of attraction is not a magic wand. Because the brain preferentially scans and stores negative experiences, we have to consciously, habitually build the positive mental muscle. We all have layers and layers of stories, limiting beliefs, fears and blocks that have become the interior landscape of our minds and cannot be changed overnight just by thinking positive thoughts.

In order to become a master at manifesting with the law of attractio ... Read more »

#2016 U. S. News Law School Ranking: the Highlights - Law Blog

    U.S. News World Report

U.S. News World Report has just released  the latest edition of its ranking of America s best law schools. For the most part, institutions that have dominated the list for years still rule, but other schools lost or gained substantial ground. One reason is a new scoring methodology that punishes schools for employing their own graduates.

The validity of U.S. News s rankings has long been a source of contention among legal educators, but few deny its influence  with prospective students. And at a time when demand for law degrees is at a historic low, the pressure on law schools to place high—or at least hold steady—is arguably more intense. Here are highlights

    from the magazine’s 2016 ranking:

#9 books that new law students should read

Courtesy of John Althouse Cohen on flickr

As a professor of law, I am naturally biased in favor of my profession.

Notwithstanding the naysayers, law students and lawyers commit to the pursuit of justice against obstacles that yield only to the keenest and, one hopes, most ethical minds.

Yet the study of law is in large part a matter of reading.

    Lots of reading.

But not all legal reading need be as dry as a prospectus or as weighty as a Supreme Court ruling. Much of the law can be absorbed through great literature and thoughtful nonfiction. Indeed, I suggest that newly minted law students spend the summer before their classes begin with the following nine works (roughly one a week) as preparation for entering what remains the noblest of professions.

Whether you're a soon-to-be law student or a citizen interested in better understanding our justice system, you could do worse than to spend this ... Read more »

#98 new Kentucky state laws go into effect next week

FRANKFORT, Ky. (WKYT) - From new booster seat requirements to rules designed to crackdown on teens using cough medicines to get high, nearly a hundred new laws go into effect in Kentucky next week.

The new laws were approved during the Kentucky General Assembly's 2015 regular session.

The state constitution specifies that new laws take effect 90 days after the adjournment of the legislature. The General Assembly’s 2015 session adjourned on March 25, making June 24 the day for new laws to take effect.

There are some exceptions. Bills that contained an emergency clause, such as this year’s measure to fight heroin abuse, went into effect immediately upon being signed by the governor. A handful of bills also specified their own effective dates, such as a measure that goes into effect early next year to offer some civil protections to victims of dating violence.
