Collaborative law involves each person engaging their own family lawyer and all agreeing that they will work together in a series of meetings to settle the arrangements needing to be made through agreement rather than by adjudication in court.

  • Most people using collaborative law to make their family arrangements do manage to reach agreement.
  • The process involves a series of meetings without correspondence between lawyers, leading to greater predictability of costs.
  • All relevant matters can be discussed and the impact on other areas of family life examined, so the relevant process is holistic, although the financial disclosure aspect is no less rigorous than it would be in court.

If you would like more information about how collaborative law involving the barristers at 4PB could assist you or your client, please contact our dispute resolution clerk, Denise Fallon. on 0207427 5200

Laws would be ineffective without people in charge of enforcing them. One of the basic necessities of the criminal justice system is the presence of police or other law enforcement officers who make sure that people in society who are not abiding by the law are apprehended so the courts can deal with them appropriately.

Graduates with criminal justice degrees often fill jobs in law enforcement, although many law enforcement positions do not require a specific college education. Criminal investigators on the local, state or federal level work to determine how and why crimes happen and who is responsible for them. They use a variety of detection techniques including forensics and interrogation of witnesses or suspects to uncover the truth about the crime and prepare the prosecution for court. The same detection techniques may also be used to reveal that a suspect is innocent.

A criminal prosecutor usually works in the local District Attorney s Office, the State Attorne ... Read more »

#Yale Law School - TLS wiki

Since U.S. News began ranking schools, Yale Law School has always held the No. 1 position, and for good reason: It is unanimously considered one of the preeminent centers of legal studies in the world, and while its closest rivals also offer formidable prestige and their own array of career opportunities, Yale Law has remained a distinctive institution in many ways. It has graduated both Bill and Hillary Clinton, President Ford, and Supreme Court justices Clarence Thomas, Samuel Alito, and Sonia Sotomayor. Famed for its abolition of standard grades in the 1960s and the lowest ratio of students to faculty in the country (currently 7.9:1), Yale Law has also earned equal acclaim for its supposed "scholarly" bent and its legendary admissions process.

A new car is any vehicle sold with less than 18,000 miles or within two years of original delivery, whichever comes first. All other cars are considered used under the law.

Getting a professional degree can be a long and rigorous process. Two of the most difficult advanced degrees are a Doctorate of Medicine (MD) and a Juris Doctor (JD). Some universities offer joint MD/JD programs to reduce the amount of time needed to get both degrees from seven years to six.

While medicine and the law often intersect in the real world, joint MD and JD degree programs focus on two very different curricula. The combination of both requires a studious and determined student. At most universities offering the program, including Duke University, students are required to apply separately to the School of Medicine and the School of Law. If accepted into both programs, they are eligible for the dual degree program. Many universities, like the University of Chicago's School of Medicine, encourage candidates to apply for the law school after the first two years of the medical school program to be sure that they are not overwhelmed by the academic challenge.

#MBA Ranking

Ranking MBA

Rankings generate hype, debate, sometimes even controversy. To a large extent, their legitimacy has developed because they represent a connection between academia and the media. They are one of the resources used by prospective MBA candidates.

Is It the Best for Me?

When trying to figure out which business schools are the best for a candidate, the most popular tools for assessing qualities are rankings and accreditations. But what are they and which ones should prospective students be looking at most closely?

Do Rankings Reflect the Quality of Business Education

Business school candidates should take rankings into account as they contain an enormous amount of useful data, but applicants should also take time to study their methodology. Rankings should not be viewed as the most important aspect.

What is the Lemon Law?

A vehicle that continues to have a defect that substantially impairs its use, value, or safety. Generally, if the car has been repaired 4 or more times for the same Defect within the Warranty Period and the Defect has not been fixed, the car qualifies as a Lemon. All States differ so you should consult the Lemon Law Statutes for your particular State. Note that the warranty period may or may not coincide with the Manufacturer's Warranty.

Do I have a Lemon?

If the paint is peeling, the light switch came out when you pulled on it, the car makes funny noises but otherwise drives just fine, or you found 10 things you don't like about your new car but none of them prevent you from driving it, then No, you do not have a Lemon .

States use official lotteries to raise revenue for schools and other shared public resources. These are primarily games of chance, which don't require any specific skills or knowledge, such as scratch-off tickets and games where numbers are drawn at random. Ohio state lottery laws were enacted in 1973, after a voter-approved constitutional amendment created the Ohio Lottery Commission.

The first lottery tickets went on sale that next year. Ohio joined the popular, multi-state Mega Millions lottery game in 2002. In 2005, the Ohio Lottery began administering and monitoring the licensing of bingo games for charitable causes.

As with many other states that run an official lottery, Ohio uses the proceeds from its lottery primarily to fund public education (lawmakers earmarked lottery profits for education in 1983). Now, roughly 4 percent of Ohio's education funding comes from the state lottery, according to the Ohio Lottery Commission's website .

#What is behind the end of ACS: Law?

Andrew Crossley, the founder of ACS:Law, has blamed his decision to abandon his pirsuit of alleged unlawful filesharers on hackers and bomb threats, but what else could be behind it?

ACS:Law was targeted by Anonymous last year, as part of a series of Distributed Denial of Service (DDoS) assaults against entertainment industry websites. However, there is no evidence it was "hacked" - private emails were exposed during the attck, but apparently as a result of an inexpert effort by the firm to restore its website, not an outside infiltration of its server.

Nevertheless, the exposure of embarrassing personal details about Mr Crossley was a humiliation. Meanwhile the loss of sensitive data ACS:Law had collected on members of the public remains under investigation by the Information Commissioner's Office.

#MBA Rankings: What do business school rankings measure?

Which B School?

Many students applying to the US for MasterпїЅs degrees and MBA programmes say that they will apply only to the пїЅtopпїЅ schools. The general perception is that attending a school lower down the rankings will not be a good investment in terms of time or money. All such students are making the assumption that published rankings are a valid guide to quality of education and potential career benefits of attending a particular university. But what do rankings actually measure? Are they reliable? And which rankings are the best?

All systems of ranking base their conclusions on responses to surveys of students and alumni, and data provided directly from the schools. Most also use the concept of пїЅpeer reviewпїЅ in which deans of schools and programme heads are asked to rate the other schools (but not themselves) on a scale of 1-5. The questionnaires seek to establish first the quality of the educ ... Read more »

I have a question regarding to the changes to come on immigration law. My file was received by the Buffalo office in January 2nd , but I only received my AOR on March 10th .

Am I going to be under the current law or the new one to come?

I do not understand when they say “Those who applied before February 27, , will not be subject to the new proposed provisions in the legislation.”

Does it means, received AOR before February 27, or those who sent the application before February 27, ?

Here is what the CIC website says:

Q7. What happens to someone who has already applied to immigrate to Canada? How will the new amendments affect them?

Those who applied before February 27, , will not be subject to the new proposed provisions in the legislation. These provisions, once passed, will apply to applications received on or after February 27, .

#Meal and Rest Breaks in Indiana

Indiana employers aren't require to offer meal breaks or rest breaks.

Although some Indiana employers provide meal or rest breaks, you might be surprised to learn that federal law doesn’t give employees the right to time off to eat lunch (or another meal) or the right to take short breaks during the work day. Employees must be paid for shorter breaks they are allowed to take during the day, but employers are not required to provide these breaks in the first place.

Of course, many employers provide these breaks as a matter of custom and policy, recognizing that an employee who is hungry and tired is neither productive nor pleasant to customers and coworkers. Sensible as this seems, employers are not legally required to allow breaks, at least by federal law.

In some states, workers have more protections. A number of states require employers to provide meal breaks, rest breaks or both. However, Indiana doesn’t follow this tren ... Read more »

#Medical Malpractice

Medical malpractice is when a doctor makes a mistake that causes you or a loved one serious harm. Legally, medical malpractice has occurred when a doctor fails to comply with a reasonable standard of care. When someone who is not a doctor makes a mistake, he or she is often said to have acted negligently. Malpractice is simply negligence applied to healthcare professionals. Tragically, a doctor’s mistake can have severe, or even deadly, consequences for a trusting patient.

According to a study released in 2013 from the Journal of Patient Study, as many as 440,000 people die every year from preventable medical errors.  This makes medical mistakes the 3rd leading cause of death in America, behind heart disease and cancer.

In Michigan, a patient has the right to file a lawsuit against any physician or hospital, which may have committed malpractice. However, the filing requirements for a malpractice lawsuit are lengthy and complicated. Thes ... Read more »

“What internship (or full-time) offer should I take?” “What’s the right first step now that I’m finishing up my MBA?”

The life of an MBA student is demanding. Managing the classwork and interviewing process today is much harder than when I was an MBA student. Outside of class, students must spend more time networking and preparing for the interview gauntlet to live up to the expectations of recruiters and compete effectively against impressive peers. You can have dozens of smart, talented, exceptional students vying for one or two coveted positions. It’s simply not easy.

However, what I’m noticing is that with all of the preparation to get the offer(s), there isn’t much time or energy left to think through what these first jobs mean to a 40-year career. Often times, when I ask students where they want to work, the response is: “On a brand I lo ... Read more »

According to the American Association for Paralegal Education (AAfPE), paralegal certificate programs are usually designed for students who already hold an Associate or Bachelor degree. The ABA implemented guidelines in addressing online components to paralegal certificate programs. To achieve and maintain ABA approval, institutions must offer and require students to complete the equivalent of ten semester credits in a traditional classroom setting and those classes offered online have to meet certain requirements. The ABA considers video interactive instruction equivalent to a traditional classroom.

Some institutions imply the availability of online paralegal program components with their website language. The University of California at Irvine states at least half of its course requirements, 150 hours or 15 units, must be completed in a traditional classroom. #Media Law.

Media Law is a legal field that relates to legal regulation of the telecommunications industry, information technology, broadcasting, advertising, the entertainment industry, censorship, and internet and online services among others.

As the popularity of various media have proliferated, the field of media law has become more important. Just over a century ago, the media would have consisted of print and live performances alone. Today, the media comprises not only the printed word and live actors, but also radio, television, movies, video games, mobile devices, and the Internet.

Intellectual Property

One of the biggest areas of concern related to media law is intellectual property. This can take the form of copyright concerns for original works, trademarks for different brands, or even patents for media related technologies or processes. Sometimes individuals are in a position through their employment or other activity to observe unethical or unlawful conduct, or discover documentary evidence of wrongdoing. The wrongful acts may include an employer falsifying records or accounts, an accounting firm withholding information from the Internal Revenue Service, or a stockbroker unlawfully sharing insider information.

If you have witnessed such behavior or have knowledge of wrongful activities, you may not know what to do. You may fear that if you tell someone about the wrongdoing you could lose your job or be retaliated against in other ways.

A person who has damaging information about a large entity such as a company or government agency and chooses in good faith to disclose the wrongdoing is called a whistleblower.

Whistleblowers are protected by several federal and state laws against the punitive or deterrent actions an entity may take to intimidate and silence them. The actions may include fir ... Read more »

In Tennessee, the police have several responsibilities towards victims of domestic violence. If possible, they must transport the victim to safety. They are also required to refer the victim to local services such as domestic violence shelters and provide him with a written statement informing him of his rights. The police also must let the victim know that the alleged offender may be allowed to post bail following arraignment.

When Tennessee police arrive at the scene of domestic violence, they must arrest the primary aggressor--the person who acted violently towards others in the domicile. In many cases, two or more people involved in the incident have injuries or acted violently. In these cases, the police must determine who is the primary aggressor. If both people are equally responsible for the incident or the police cannot determine who acted violently first, they may elect to arrest all parties or decline to make an arrest at all. #Missouri Legal Ages Laws

    State Legal Age Laws: Overview

Those who are 18 and older are considered adults in the eyes of the law, but many states also set age limits for minors with respect to certain legal obligations and privileges. For instance, minors in most states may consent to certain medical treatments or petition the court for emancipation from one's parents. In general, state laws identify certain legal processes that minors may encounter and have made exceptions to accommodate them.

Summary of Missouri Legal Age Laws

Missouri statute does not specify age limits below the age of majority (18), but it does offer some limited exceptions for minors. For instance, a minor may consent to medical treatment if married or if the treatment is for pregnancy, sexually transmitted infections, or substance abuse. Additionally, a married minor (if the spouse is 18 or older) may be included in the joint ownership of real estate.

#Megan s Law Resources by State

Megan's Law is the common term for state laws that create and maintain a sex offender registry that makes information on registered sex offenders available to the public. The first Megan's Law appeared after the rape and murder of seven year-old New Jersey resident Megan Kanka by a sex offender who lived in the girl's neighborhood. Soon after the passage of this first Megan's Law, the federal government implemented requirement that all states establish sex offender registries and provide the public with information about the registered offenders.

While each state's version of Megan's Law differs slightly, they all require some form of sex offender registration and community notification. The information that states typically collect about the sex offenders includes: the offender's name, address, picture and the nature of their crime. States publish this information on freely available web sites that the public can query in many different way. ... Read more »

    Mendel's Experiments

Austrian monk Gregor Mendel studied pea plant genetics in the 1800s

Gregor Mendel was an Austrian monk who studied pea plant genetics in the 1800s. Mendel's experiments provided quantitative data, which would eventually revolutionize the understanding of the inheritance of traits. Unfortunately for poor Mendel, his findings were largely ignored until 1900, when the observation of meiosis helped scientists realize the significance of Mendel's experiments.

Mendel's laws helped explain chromosome-based inheritance of traits. Mendel is also credited with identifying the concept of dominant and recessive traits. We've already seen how a dominant trait affected Adrian's flying hamster experiment.

Now we're going to examine Mendel's first law of inheritance. also known as Mendel's law of segregation. It states that, ' the all ... Read more »
