#Jane Doe - Lawyers Sue Dershowitz for Defamation - Law Blog

paul cassell

Alan Dershowitz Associated Press

Alan Dershowitz has vowed to slap a defamation suit on the two lawyers who claimed in a court document that Florida financier Jeffrey Epstein arranged sexual liaisons for him with an underage prostitute.

Those lawyers have beaten him to the punch.

Paul Cassell and Bradley Edwards, who represent a woman claiming she had sexual relations with Mr. Dershowitz at Mr. Epstein s direction, have filed a defamation lawsuit against Mr. Dershowitz in Florida circuit court, according to Mr. Cassell.

States the lawsuit:

Immediately following the filing of what the Defendant, DERSHOWITZ, knew to be an entirely proper and well-founded pleading, DERSHOWITZ initiated a massive public media assault on the reputation and character of BRADLEY J. EDWARDS and PAUL G. CASSELL accusing them of intentionally lying in their filing, of having leveled kn ... Read more »

Stalking refers to harassing actions by one person which are directed toward another and which result in her feeling unsafe or fearful. In the United States (US), there are both state and federal laws that address this type of behavior. Depending upon the jurisdiction under which the crime is committed, a perpetrator may be liable criminally and civilly.

When compared with many laws, which often stem from legislation that is centuries old, stalking laws are fairly new. In the US, every state and the District of Columbia (DC) has stalking laws, but this was not always the case. Even now, there are many definitions of the crime. One reason it is difficult to consistently define this offense is because it generally consists of a number of actions which may be viewed normal under different circumstances.

The creation of these laws was necessary, however, because it was recognized that more people acted in ways that instill fear in others than was once recognized. The abs ... Read more »

#Islamic law is adopted by British legal chiefs

Solicitors told how to draw up Sharia-style wills penalising widows and non-believers

Islamic law is to be effectively enshrined in the British legal system for the first time under guidelines for solicitors on drawing up Sharia compliant wills.

Under ground-breaking guidance, produced by The Law Society, High Street solicitors will be able to write Islamic wills that deny women an equal share of inheritances and exclude unbelievers altogether.

The documents, which would be recognised by Britain s courts, will also prevent children born out of wedlock and even those who have been adopted from being counted as legitimate heirs.

Anyone married in a church, or in a civil ceremony, could be excluded from succession under Sharia principles, which recognise only Muslim weddings for inheritance purposes.

Nicholas Fluck, president of The Law Society, said the guidance would promote good practice in ap ... Read more »

#J. D. Program

The Juris Doctor Program strives to prepare students to be superb lawyers who combine the highest analytical ability with ethical sensitivity. The Georgetown Law faculty laid out its aspirations for Georgetown Law graduates in the 1999-2004 Long Range Plan:

First, as lawyers. they should be capable of addressing imaginatively and constructively novel problems arising from new institutional arrangements and technologies, based on familiarity with the theoretic foundations of legal materials. Second, as leaders in their profession. they should enjoy and have the capacity to assess, criticize, and reform laws and institutions. Third, as citizens with the capacity to lead public debate. they should pursue social justice with wisdom, knowledge and integrity."

The diverse interests of our extraordinary faculty and the rich curriculum they offer uniquely equip Georgetown Law for this ambitious task.

The Guidelines were originally written by the Judicial Administration Committee of the Judicial Conference of Indiana and then adopted by the Indiana Supreme Court. The Court periodically reviews amendment to the guidelines. When the guidelines are revised, a new online support calculator is developed and is available on the Calculator site. Blank forms can also be printed from the site.

Indiana calculates support based on the gross weekly income of both parents. Gross weekly income includes salaries, variable income like commissions and overtime, investment income, worker's compensation, unemployment benefits, disability benefits, inheritance and gifts. Based on the weekly income of both parents, the court will calculate the basic child support obligation and divide that obligation between the parents. Parents may be required to pay other amounts, such as for health care, in addition to the basic child support obligation.

There are no specific laws that provide protection for employees who have been wrongfully terminated from their job.

Rather, wrongful termination may be covered by federal or state laws that prohibit employment discrimination, by contract law if your employer breached an employment agreement, or if the company violated its own policy by terminating the employee.

However, in most states (other than Montana), employees are presumed to be employed at will. which means that an employee can be fired without notice and without a reason. So unless an employee is covered by an employment contract or collective bargaining agreement or the law has been violated, an employer doesn t need a reason to fire you. Here is a list of exceptions to employment at will .

A franchise business is a business in which the owners, or "franchisors", sell the rights to their business logo, name, and model to third party retail outlets, owned by independent, third party operators, called "franchisees". Franchises are an extremely common way of doing business. In fact, it's difficult to drive more than a few blocks in most cities without seeing a franchise business. Examples of well-known franchise business models include McDonalds, Subway, UPS, and H R Block. In the United States, there are franchise business opportunities available across a wide variety of industries.

To invest in a franchise, the franchisee must first pay an initial fee for the rights to the business, training, and the equipment required by that particular franchise. Once the business begins operating, the franchisee will generally pay the franchisor an ongoing royalty payment, either on a monthly, quarterly, or annual basis. This payment is usually calculated as a percentage of t ... Read more »

#J. D. Student Central

Dear Students,

Welcome to the Transactional Law Program's Web pages.

I became the director of the Transactional Law Program in July 2012 after retiring as a partner in the Boston office of Skadden, Arps, Slate, Meagher Flom LLP, where I practiced in the firm s mergers acquisitions department for almost 30 years. The principal goal of the Transactional Law Program is to provide a solid foundation of essential practice skills to students seeking a career in transactional practice and to those who will need these skills at some point in their careers, regardless of the specific area of legal practice they pursue. We seek to bridge the gap between what students learn in traditional law school classes and the skills they need when they enter the legal practice arena.

The growth and success of the Transactional Law Program including the Program s expanding course offerings and the Transactional Practice Concentration reflects BU Law s unwave ... Read more »

Former Blank Rome chairman David F. Girard-diCarlo and his wife, Constance, announced a $5 million gift Tuesday to the Villanova University law school for the establishment of a center on ethics and compliance.

The center, launched a few months ago, will offer course work, programs, and conduct research on corporate compliance and ethics, an area of increased focus by business, government regulators, and law enforcement.

"Adhering to the highest ethical standards in your profession and encouraging others with whom you interact to do the same can and will create a culture that promotes achievement," said a statement released by Girard-diCarlo and his wife, a lawyer and former Aramark executive. "It is our hope and expectation that this new center will reinforce the importance of fostering an environment based on ethics and integrity not only in law and business but also in life."
