Rental laws protect tenants from many types of landlord fraud. Unfortunately, there are some landlords who make more money scamming tenants than renting apartments. Knowing what to look for can help you avoid trouble and recover any money you lose.

1. Security Deposit

The bulk of the complaints from tenants in the area of landlord fraud comes from the landlord withholding some of all of the security deposit after the tenant moves out. Rental laws dedicate what the landlord can take out of the security deposit as reimbursement for cleaning, repairs and other expenses, as well as how soon to return all or some of the security deposit. However, some landlords never intend to return the security deposit and use the following ways to hold on to the money:

• Excessive cleaning charges: They clean the apartment themselves and charge you for much or all of the deposit

In strict common law. no contract. with attendant reciprocal legal obligation, exists without consideration. But for a gift, the absence of consideration is a requirement .

As Justice Jackett wrote in Littler v Canada :

"A contract of sale, which is, by definition, a transfer of property for a consideration, cannot be a gift, which is, by definition, a disposition of property without consideration."

In Re Bayoff Estate. the Court adopted this list of requisite elements for a valid gift:

"(A)n intention to donate; acceptance of the gift; and a sufficient act of delivery."

At issue in the Littler decision was income tax and in particular the oft-involved concept of gifts. As of 2007, the Canadian Government allows the deduction of taxable income by the value of a gift to specified persons, such as registered charities.

I just finished my Contracts final, but I will not blame my grade on this book.

This does what it is supposed to. It supplements the material that the Prof. presents in class. If you are not sure what the modern rule is, this is where you go. If you are not sure if there is an exception, this is where you go. If you are not sure what the basic functions of the rule is, this is where you check. If you are not sure what Restatement or UCC section applies, this is where you check.

This book is great for supplementing your notes and filling in the gray areas. For that, it is invaluable, but like all commercial outlines, it cannot replace your notes.
