#Why Software Doesn t Follow Moore s Law

Post written by Brian Maccaba

Brian Maccaba is CEO of Waratek, a specialist Java virtualization company based in Dublin, Ireland.

In 1965 Gordon Moore, co-founder of Intel, predicted that the number of transistors per square inch on integrated circuits, which had doubled every year since they were invented, would continue to do so for the foreseeable future. That prediction proved remarkably visionary.

So why haven’t computer systems achieved the same advances in speed, power and capacity promised by Moore’s Law? By this I mean in terms of visible and useful outputs, the amount of work achieved for a given investment in computer systems and operations. Despite a ten-fold increase in microprocessor performance every 5 years, corporate IT spending has increased, not declined.

The primary reason for this disconnect is that the size and complexity of operating systems has largely o ... Read more »

#Whistleblowing for employees.

You’re a whistleblower if you’re a worker and you report certain types of wrongdoing. This will usually be something you’ve seen at work - though not always.

The wrongdoing you disclose must be in the public interest. This means it must affect others, eg the general public.

As a whistleblower you’re protected by law - you shouldn’t be treated unfairly or lose your job because you ‘blow the whistle’.

You can raise your concern at any time about an incident that happened in the past, is happening now, or you believe will happen in the near future.

Who is protected by law

You’re protected if you’re a worker. eg you’re:

  • an employee, such as a police officer, NHS employee, office worker, factory worker
  • a trainee, such as a student nurse
  • an agency worker
  • a member of a Limited Liability Partnership (LLP)

Get independent advice if you’re not sure you’re prot ... Read more »

#Who Can Inherit from an Estate?

Determining who inherits the assets of a decedent s estate is usually simple if the estate has a valid will, because the will sets out who the assets go to. However, wills can be fuzzy if they're not well drafted, and sometimes beneficiaries can be hard to track down. If the estate is intestate. meaning it does not have a valid will, the laws of intestacy determine who inherits what. Even if an estate does not have a will, the surviving spouse and the children of the decedent generally have rights to inherit.

Inheritance rights of the surviving spouse

If the decedent was married at the time of his or her death, his or her surviving spouse has a role in the disposition of the estate whether there is a valid will or not. When there is a valid will, the surviving spouse has a choice:

  • He or she can choose to take any inheritance stated under the will.
  • He or she can elect to take against th ... Read more »

#William Mitchell law school first to offer ABA-approved online degrees.

A Minnesota law school will become the first in the country to allow students to earn their degrees largely from home, with the blessing of the American Bar Association.

On Wednesday, William Mitchell College of Law in St. Paul plans to announce its new hybrid option: Students will spend only a week or two on campus each semester, and take the rest of their classes online.

It s the first such program at a fully accredited law school. And depending on whom you ask, it s a risky, or a long overdue, venture that could shake up the tradition-bound halls of legal education.

It moves them slightly forward into the 21st century, said Robert Oliphant, a professor emeritus at William Mitchell who supports online teaching. Law schools are about the last institutions in the world to try to change. They re just very stuck in the mud.

The ABA, which accredits 203 law schools nationwide, ha ... Read more »

#4 Internet privacy laws you should know about

Sorry

Last year after an outpouring of opposition, Internet advocates logged a victory when they defeated the controversial Stop Online Piracy Act (SOPA).

Now there are other new bills and efforts to amend existing law that could reshape how businesses share digital information about users and what powers the federal government has in obtaining online data. Below are four that are either actively being debated, or could come up for consideration soon.

Electronic Communications Privacy Act (ECPA)

Since this law setting standards for how the government can access digital information of citizens passed in 1986, technology has changed dramatically, but the law has not.

Proponents of ECPA reform say the most egregious portion of the law involves the rights the government has to obtain electronic files without needing a warrant. "A paper letter sitting in your home or office drawer has a s ... Read more »

Every state but California requires lawyers to graduate from an accredited law school and to pass the bar exam. In California, however, 60 college credits and 864 hours per year of correspondence law classes (not accredited) enable you to qualify to take the bar. After practicing law in California for five to seven years, you can then sit for the bar in other states.

While none are accredited (and thus not useful except in California), there are online law schools. Some of the better known schools include Concord Law School and the Abraham Lincoln University School of Law (see resource list for more).

The LL.M degree is a post graduate degree for those that have finished law school and want a specialization. These degrees are possible online, including from ABA-approved schools like NYU. More and more schools are putting LL.M degrees online.

You may have paid a visit to franchise headquarters. In other words, you re almost there. You re almost a franchise owner.

You have one more thing to do, and it has to do with the law. You need to do everything in your power to protect yourself legally, and there s only one way to do it: You need to hire a franchise attorney.

#8 Federal Laws That Protect Employees

There was once a time when workers were at the mercy of their employers when it came to job-related safety and benefits, to say nothing of hiring and promotions. However, a push for employee rights gained momentum in the 20 th Century, resulting in a series of important laws that millions of Americans rely on to this day.

These days, the Department of Labor enforces roughly 180 worker protection laws, ranging from pay requirements to parental leave benefits. Other protections are supervised by agencies such as the U.S. Equal Employment Opportunity Commission. Below are some of the key federal protections offered to employees.

1. The Minimum Wage

The Fair Labor Standards Act ensures that American workers receive a minimum wage for their work. Since 2009, most private and public employers have had to pay staff members at least $7.25 per hour, although some legislators have tried to increase that amount. I ... Read more »

#1L Guide to Buying Cheap Textbooks - Top Law Schools

1L Guide to Buying Cheap Textbooks

Law school is very expensive and many students are on a tight budget. Legal textbooks can eat away at that budget, costing as much as $200 per book. Below is a short guide for 1L's on how to find the best deals on textbooks.

1) Buy used books

There is really no good reason to buy a brand new, shrink-wrapped textbook. Unless your professor requires a textbook that was just published a month ago, you should be able to find a used copy online. Some people argue that they need a new book because they prefer clean pages. However, there are plenty of used books out there that have no markings. Out of the six used textbooks I bought for 1L year, only one of them had highlighting on the pages. When buying online, read the seller descriptions for used books and you will know if the pages are clean. If you stick to used textbooks and aren't too picky, you should never pay more t ... #5 ways to put a law degree to work

FORTUNE Dear Annie: Last spring, I graduated from a good law school and, all these months later, I still can’t seem to get hired by a law firm in my (fairly large) city. Most of them seem to be shrinking, not growing, and the informational interviews I’ve had so far have been interesting mainly because they’re so negative. Even some partners at big firms have told me “off the record” that getting ahead in the profession has been both boring and grueling, a really bad combination, and I should find something else to do with my life. The question is what. Do you or your readers have any ideas about how I should broaden my job search? I’d still like to use my law degree if possible, especially since I went into debt to get it.  No Name, Please

Dear N.N.P.: When I put your question to Mark Newall, a senior vice president at Boston-based Keystone Associates Legal, he said your jaded interviewees have ... Read more »

International Trade Law Guide

Written by Karin Johnsrud, edited by Silke Sahl

Last Updated July 28,

International trade is a complicated area of law to research because there are numerous levels of trade organizations and interactions. There are bilateral trade agreements, regional trade agreements and multinational trade agreements. Each of these agreements has its own history, policies and dispute settlement procedures. Trade organizations established under the agreements have separate resources that can be searched. Furthermore, individual countries have their own policies and laws relating to international trade. As an example, the United States Congress must pass legislation enacting international trade agreements before the United States can officially become a party. The national policies have to be researched individually and frequently separately from the resources relating to the international organizations.

#8 Stanford Men Vied For Glory. She Didn t. Guess Who Won?

Follow Comments Following Comments Unfollow Comments

Something surprising just happened at Stanford Law School. In this year’s graduating class, eight men and one woman vied to be this year’s commencement speaker. Each male tried to position himself as the rightful leader of the class. The female candidate never did so. And yet, when the 180-person graduating class was done voting, she won.

How did Marta Belcher pull it off? The story of how she outwitted her rivals would make a lovely logic puzzle. See if you can figure it out, based on the following hints.

Belcher has a deep interest in the way ideas get shared, developed and protected. Most recently, she’s been an intern at the Electronic Frontier Foundation. which champions file sharing, open-source software and free speech online. She’s held summer jobs at Apple and the Ropes Gray law firm, related to intellectual property issues.

#9 books that new law students should read

Courtesy of John Althouse Cohen on flickr

As a professor of law, I am naturally biased in favor of my profession.

Notwithstanding the naysayers, law students and lawyers commit to the pursuit of justice against obstacles that yield only to the keenest and, one hopes, most ethical minds.

Yet the study of law is in large part a matter of reading.

Lots of reading.

But not all legal reading need be as dry as a prospectus or as weighty as a Supreme Court ruling. Much of the law can be absorbed through great literature and thoughtful nonfiction. Indeed, I suggest that newly minted law students spend the summer before their classes begin with the following nine works (roughly one a week) as preparation for entering what remains the noblest of professions.

Whether you're a soon-to-be law student or a citizen interested in better understanding our justice system, you could do worse than to spend this ... Read more »

#10 Top Affordable Recognized Law Schools in the U. S.

When evaluating law schools, reputation, location, and the percent of graduates passing the bar exam are very important factors. However, due to high tuition fees and a harsh economy, nowadays affordability is also a vital consideration.

If that is your case, then you probably ought to consider in-state schools. Typically, their tuition is lower in price. Nevertheless, some of the law schools in our list have relatively low out-of-state tuition fees.

In putting together the list, we searched for law schools providing some of the nation s lowest tuition fees, which are also included in U.S. News and World Report s special lists of law schools, or else ranked among the top 20 best-value law schools by National Jurist. or included in other special lists by notable sources.
