CCF File Briefs with United States Supreme Court

Adoptive Couple v. Baby Girl

The Center on Children and Families has filed an Amicus Brief with the United States Supreme Court. The case of Adoptive Couple v. Baby Girl, a minor under the age of fourteen years, Birth Father, and the Cherokee Nation, No. 12-399, is set to decide two issues: whether a non-custodial parent can invoke ICWA to block an adoption voluntarily and lawfully initiated by a non-Indian parent under state law; and whether ICWA defines “parent” in 25 U.S.C. § 1903(9) to include an unwed biological father who has ... The Fletcher School s keystone degree program, the Master of Arts in Law and Diplomacy (MALD), enrolls over 180 of the top students from more than 80 countries. The interdisciplinary approach to the curriculum - drawing from the school s three divisions - ensures that each student gains a breadth of knowledge in international affairs. Students gain depth of knowledge through two fields of study in functional and regional concentrations. For decades, the MALD degree program has graduated many of the world s leaders in private, public and non-profit sectors.

The two-year Master of International Business (MIB) program is a hybrid degree that combines a flexible international affairs curriculum with a core of business courses. Much like a dual MBA-international affairs degree, it allows students to gain a firm grounding in business skills while building contextual intellig ... Read more »

#Worst law schools

Whittier Law School in Orange County, California is, officially, the worst law school in the United States. Appalachian School of Law edges out the University of Law Verne College of Law and several other richly deserving candidates for second-worst place.

Whittier, Appalachian and La Verne essentially tied for the uncoveted bottom spot, but Whittier “won” the tiebreaker, thanks to a pitiful 17.1 percent employment score. In addition Whittier’s 61 percent under-employment score is the highest among all ABA-approved schools.

Appalachian School of Law in the rural, westernmost reaches of Virginia appears very close to the bottom in all but two categories: under-employment and cost. Also, the number of students that ASL does not categorize for employment purposes (the “unknown employment” score) is notably high.

The third-place University of La Verne College of Law ranks dead last among the 194 law schools that “U.S. News” ranks by academic p ... Read more »

Today's news and the lighted signs along our Houston highways these weekend remind us not only to "click it or ticket" and "Seat belts all the time, all riders, every ride" is not only a new campaign to remind Houston area drivers to wear their seat belts but could also be kicking off the new year of seat belt laws for our children too.

Last September a series of new laws regarding drivers and riders in Texas including laws regarding cell phone and texting while driving as well as new laws regarding booster seat use. The law regarding booster seats gave parents a "grace period" where from Sept. 1, and June 1, parents could obtain the booster seat they needed for their children. Warnings were issued. But starting today parents will no longer receive warnings but tickets, fines and possibly even greater prosecution for not having their children in a booster car seat.

What is the new child safety /booster/car seat law in Texas?

#Florida Recording Law

Note. This page covers information specific to Florida. For general information concerning the use of recording devices see the Recording Phone Calls, Conversations, Meetings and Hearings section of this guide.

Florida Wiretapping Law

Florida's wiretapping law is a two-party consent law. Florida makes it a crime to intercept or record a wire, oral, or electronic communication in Florida, unless all parties to the communication consent. See Fla. Stat. ch. 934.03. Florida law makes an exception for in-person communications when the parties do not have a reasonable expectation of privacy in the conversation, such as when they are engaged in conversation in a public place where they might reasonably be overheard. If you are operating in Florida, you may record these kinds of in-person conversations without breaking the law. However, you should always get the consent of all parties before recording any t ... The book comes in three formats: paperback, hardcover, and digital. The most popular digital edition is the Kindle texbook. which can be purchased on Amazon (along with both of the other formats). The Trinity Law School, as it is now known, was founded in 1980 as the Simon Greenleaf School of Law and was originally located in Anaheim, California. It was originally named in honor of the Nineteenth century Harvard law professor Simon Greenleaf who was a major authority on the laws of evidence and also wrote The Testimony of the Evangelists. which was a work of Christian apologetics concerning the evidences for the resurrection of Jesus Christ .

The Simon Greenleaf School of Law was the brain-child of John Warwick Montgomery. Montgomery rose to prominence in the 1960s as a confessional Lutheran theologian and as a Christian apologist. He held the chair of Professor of Church History at Trinity Evangelical Divinity School in Deerfield, Illinois (1964–74). A founding board of trustees collaborated with Montgomery to establish in 1980 the Simon Greenleaf School of Law.

It commenced operations by offering evening classes in a four-year undergraduate cou ... Read more »

#For-Profit Law Schools: Impacting the Future of Legal Education

2C210" /% The InfiLaw System. a for-profit company that owns several law schools and professional development firms, is challenging the status quo in legal education in a way similar to for-profit education companies such as University of Phoenix, Strayer, and DeVry. However, recent features in the Wall Street Journal. the ABA Journal. and the Charleston Post and Courier suggest that this new approach has not been wholly well-received.

InfiLaw applies its profit-oriented approach to legal education. According to its website, InfiLaw creates curricula based on “emerging market realities,” job demand, job competition, and return on investment. Founded in 2004 by Sterling Partners, a private-equity group, InfiLaw quickly purchased two for-profit independent schools, Florida Coastal School of Law (Jacksonville, FL) and Phoenix School of Law (Phoenix, AZ). #From John Law to John Maynard Keynes

This article appeared in Globe Asia in the February 2009 issue

The economic-financial crisis of 2008 has produced, if nothing else, grist for the financial press. Bernard Madoff s alleged $50 billion scam and the assertion that we need a mega-Keynesian stimulus package the bigger, the better represent two of today s favorite topics. In an attempt to make their reportage and opinions more interesting, the authors often attempt to link historical episodes to their Madoff and stimulus stories.

John Law and his Mississippi Company, which was established in 1717 and collapsed in 1720, are standard references that accompany Madoff s alleged Ponzi scheme. In fact, the only obvious connection between Law s Mississippi Company and Madoff s operations is that their values went up and then down. This fact fails to merit mention, however.

What merits attention is that Law was an economist of note and a precursor to John May ... Read more »

#Frequently Asked Questions

Frequently Asked Questions

Is it legal to have a car seat in the front seat of a vehicle when there is no back seat (i.e. for a single-cab pickup truck)?

Colorado law requires infants under 1 year old and under 20 lbs. to ride in the back seat; there are no exemptions. If your child is over 1 year old and over 20 lbs. then it is legal for them to ride in the front passenger seat, but not recommended. If you must do this, please be sure the vehicle seat is positioned as far from the airbag as possible and be sure that your child is tightly secured in their car seat, and that their car seat is properly installed in to your vehicle. NEVER place a rear-facing child restraint in front of an active airbag.

When can my child legally ride without a booster seat?

Colorado Law requires children to be in boosters (or other appropriate car seats) until they are 8 years old. However, best prac ... Read more »

Divorce rates are on the rise in the United States, with approximately half of all marriages ending in divorce. Divorce is undoubtedly a difficult emotional and financial process for all parties involved. To aid in the termination of marital unions, all states have established divorce laws.

Primarily governed by individual states, divorce laws that apply in one state may not necessarily apply in another. States sometimes have similar divorce laws, especially with regard to issues of spousal support and alimony, child custody, and property division. However, divorce laws can vary tremendously when it comes to filing procedures, child support, divorce grounds, and residency requirements. If you are considering divorce, a caring and qualified divorce attorney can help you understand the divorce laws in your state.

Under divorce law, there are two types of divorce contested and uncontested. Contested ... Read more »

Abraham Lincoln University (School of Law)

Abraham Lincoln University School of Law offers a unique program for the study of law. This program is unlike any other in the United States. We combine traditional law school materials with time-tested teaching techniques to create a truly unique law program. I would like to share with you some highlights of our program and to explain how we differ from traditional law schools. I will explain the advantages that Abraham Lincoln Law School has over most traditional law schools.

Traditional law schools teach by the casebook/Socratic method. This means that students read books with edited cases that they must "brief" and then attend classes where students are called upon to recite their "briefs." A "brief" is a synopsis of a case that generally contains a recitation of the relevant facts, the issue before the court, the relevant rule of law, the analysis by the court and the court’s conclusion. The professor will then m ... Read more »

The Law of Capital your most valuable asset, in terms of cash flow, is your physical and mental capital, your earning ability.

Your Earning Ability

The first corollary of the Law of Capital says: Your most precious resource is your time. Your time is really all you have to sell. How much time you put in and how much of yourself you put into that time, largely determines your earning ability. Poor time management is one of the major reasons for poor productivity and underachievement in every industry in America. It is the number one problem for both managers and salespeople in every field.

Invest Yourself Carefully

The second corollary of the Law of Capital says: Time and money can be either spent or invested. One of the smartest things that you can do is to invest three percent of your earnings every month back into yourself on personal and professional development, on becoming better at the most ... Child support refers to the sum that the noncustodial parent must pay to the custodian. This sum serves as a parental contribution for the child's basic living expenses, such as food, clothing, shelter, health care, and education. When a court orders a parent to pay child support, the parent must pay directly to the child's custodian rather than directly to the child. States generally do not impose an obligation to pay support for a child after that child has reached the age of 18.

An individual, however, only has a legal responsibility to support one's own biological children. Thus, a court cannot order an individual to pay child support for a stepchild, subject to the caveat that the individual did not formally adopt the stepchild. While the vast majority of states adhere to this rule, a few state statutes differ with regard to stepchild support. To determine the law in a particular jurisdiction, see state laws .

#Frequently Asked Questions About Custody - Access

1. What do the words ‘custody’ and ‘access’ mean?

Custody is the term used to describe where the children live, and who makes decision for or about the children.

2. What does ‘best interests of the child’ mean?

This is the test that the court uses to make decisions about custody of and access with children, or parenting arrangements of any kind, where the children s needs and well-being are always the most important factors. The judge must decide what is best for the children, not what is best for the parents.

In February 2013, Nova Scotia s Maintenance and Custody Act was changed. The Act now includes a list of factors that judges must consider when making decisions about the best interests of a child. Judges will consider all relevant circumstances they are not limited to considering only the factors on the list.

In any given discussion, once such a comparison is made, the discussion is automatically over and the one who made the comparison has lost the debate by default.

Internet service provider AOL is becoming frustrated by the lack of effective anti-spam laws in the UK.

"While the volume of spam originating in the UK may be lower than many countries, strong anti-spam legislation sends the right signal," said a spokesman for AOL.

"We would like more legal avenues in the UK to hit spammers where it really hurts - in the pocket," he said.

The problem lies in loopholes which effectively give spammers the right to spam any address in the UK, said Steve Linford, who heads up Spamhaus.

"British law allows spammers to spam business addresses and it is up to spammers to determine whether an address is a private one or a business one," he told the BBC News website.

Baroness Butler-Sloss, the former President of the Family Division of the High Court, is leading a drive to overhaul the current laws, which date back to Victorian times, completely replacing the notion of neglect with a new crime of child maltreatment .

For the first time, inflicting emotional and psychological harm on children would be treated as seriously as causing physical injuries or abandoning them.

It follows a string of cases in which the authorities have failed to step in early enough despite warning signs of neglect and abuse, including the Baby P case and the Edlington torture scandal.

Baroness Butler-Sloss, now a cross-bench peer, has helped draft an amendment to the Government s Crime and Courts Bill, which is currently being considered by a committee of MPs, to overhaul the neglect laws, with the support of the charity Acton for Children.

The current law on wilful neglect is governed by the Children and Young Persons Act 1933.

It may seem obvious, but what is law. Law, or legal studies, comes into contact with almost every area of human life, touching upon issues relating to business, economics, politics, the environment, human rights, international relations and trade. It is telling that the first academic degrees developed were all related to law. As a law student, you can expect to learn how to tackle some of the most problematic – indeed, often seemingly irresolvable – conflicts and issues in modern society and morality. In providing a framework through which to examine and understand different societies and cultures, law degrees are a useful way to prepare not only for specific legal careers, but for a broad range of professional roles – and indeed, for life in general.

There are lots of different types of law degrees  available, varying according to where you study. In most countries, law degrees take the form of an LLB (Bachelor of Laws) which allows you to ... Read more »

#General Eviction Information for New York

    What is an eviction?

An eviction is a court process a landlord can use to evict a tenant from a rented apartment, house, or mobile home.

An eviction case, which lawyers call a Summary Proceeding, is started when the landlord has someone else serve the tenant with two (2) papers, the Notice of Petition (has the time, date, and place of court hearing) and the Petition (has the reason the landlord wants to evict the tenant). You must be served with both of these papers at least 5 days before the court date, and the court date can t be later than 12 days after you are served.

Just because a landlord starts an eviction case doesn t mean that the landlord will win. Tenants have certain rights, and there are several defenses to an eviction action.

If you have lived in a rooming house or hotel for at least 30 days, the landlord must use the eviction process to make you move.
