Having an unhealthy obsession with another person can sometimes lead to irrational and dangerous behavior. These actions can include following the subject around or regularly sending him unwanted gifts or letters. While this behavior may start out harmless, it becomes the crime of stalking in Florida if it causes the victim emotional distress.

In Florida, harassment and stalking are not separate offenses. Instead, the state recognizes stalking as a crime, with harassment being an activity that can lead to a person being arrested and convicted of stalking. Harassment involves a course of conduct directed at a person that serves no legitimate purpose but to cause emotional distress. An example might be sending threatening letters to a person every day. Stalking is not limited to harassment alone and can include repeatedly following a person around. It can also include cyberstalking, which involves using email or other electronic communications to harass a person.

Mendel Pea Plant Experiment

The Law of Segregation is based on one of the benchmark scientific experiments in genetic studies, the Mendel Pea Plant Experiment.

Save this course for later

It was a stroke of genius considering that it was performed in the 19th century.

Of course, Mendel knew nothing about the processes behind inherited behavior, but found out the rules dictating how characteristics are passed down through the generations.

The way in which he meticulously planned his experiment to generate testable. rather than observational data, is a shining example of experimental design .

Gregory Mendel was an Austrian monk studying at the University of Vienna. Like many pioneering scientists, his discoveries were largely ignored until long after his death.

The basic premise underlying our unique approach to ranking schools: the "new normal" for the legal job market is no longer new, it's just normal. Going to law school no longer guarantees graduates a good job, or even just a job. Given the cost of law school, potential students should prioritize their future job prospects over all other factors in deciding whether and where to attend law school. Lemon laws will likely cover used cars if the car was covered under a certain type of warranty. Despite the fact that a used car is a much more likely candidate to be a lemon, federal lemon laws generally cover only new vehicle purchases. But there is one major exception: if the owner has received an express written warranty along with the used vehicle, then federal lemon law will likely cover the used car. An express written warranty can include the balance of a manufacturer s warranty, a separate limited warranty given by the dealer, or an extended warranty or service contract purchased from the dealer at the time of the vehicle purchase. Some used vehicles are certified by the dealer, which extends the existing warranty or creates an additional short warranty on the used vehicle. Having such a warranty will not only offer the potential for a breach of warranty claim, but federal lemon laws can also apply to the situation.

An Online Law Degree Doesn't Require an LSAT to Be Useful!

The fact is that an approved law degree program prepares you for a great variety of industries and sectors, and any company would be happy to have someone with, say, a Juris Doctor, Corporate Executive Juris Doctor, Bachelor of Science in Law, or the Master of Legal Letters, on their team. Whatever business your employer is engaged in, they could almost certainly use a legal perspective in their business dealings, and that is precisely what you offer.

You also offer the sharp mind and trained intellect that law school instills. Some of the best minds of our nation have law degrees that did not require an LSAT, and you will rank among them with your own JD degree. #Law School Survival - How To Build Law School Outlines

Before beginning your semester, create a word document for each of your classes and saving them to a folder labeled with the year and semester, such as "Spring 2012". For each document, open your professor's syllabus and make a heading for each class scheduled. Then go through each assignment and make a subheadings in your document for notes and each case assigned to be read.

#Law School Basics

What's a JD degree?

The Juris Doctor (JD) degree is the graduate degree required to practice law in the United States. The JD degree is offered by American Bar Association (ABA)-approved law schools, by law schools that are not ABA-approved, and by many Canadian law schools.

  • A bachelor's degree is required for admission into a JD program.
  • The LSAT is an integral part of the law school admission process in the United States, Canada, and a growing number of other countries.
  • The JD program is generally a three-year, full-time academic program.
  • All US states accept graduation from an ABA-approved law school as meeting that state's education requirement for eligibility to sit for the bar examination.
How long does it take to get a law degree? To find alternatives to the usual three-year program, talk to the individual law school.

A creditor must usually have a judgment before it can execute a writ of garnishment on an employer or financial institution. However, an employer or financial institution might receive a writ of fieri facias that asks it to declare what property it has that belongs to the debtor and in what amount it is indebted to the debtor as a preliminary matter. The creditor sends a writ of garnishment to the employer or financial institution to pay off such debts as consumer credit debts, tax liens, child support, spousal support or student loans. The amount garnished is then forwarded to a court or to the creditor

Instead of garnishing wages, creditors may opt to garnish a debtor's bank account. The only limits on bank garnishment are for exemptions that mirror the federal laws on exemptions, such as not being able to garnish federal benefits. Exemptions under Louisiana law also include income from Individual Retirement Accounts, annuity contracts and pensions, meaning that a creditor ... Read more »

#What Types of Income Can Be Garnished?

Garnishment is a means for creditors to collect a portion of what’s owed to them by having the debtor’s employer pay a portion of their paycheck directly to the creditor.  However, not everyone is paid in straight wages, and not everyone’s income consists of an employee paycheck.  Those who are subject to a garnishment order may wonder what types of income are subject to garnishment.

Garnishment is governed by both federal and state law. In many cases, the federal and state laws conflict – as far as what can be garnished, as well as garnishment limits and when that happens, the law that’s the most favorable to the employee prevails.  The summary below pertains to the US federal garnishment laws, which are covered in Title III of the Consumer Credit Protection Act (CCPA.)

Wages, Bonuses, Commissions Tips

Wage garnishment is by far the most common type of garnishment.  An employee’s wages (whether hourly ... Read more »

#credit history

#Payment history

Credit payment history determines 35% of a FICO Score

The first thing any lender wants to know is whether you’ve paid past credit accounts on time. This is one of the most important factors in a FICO Score.

A few late payments are not an automatic "score-killer." An overall good credit picture can outweigh one or two instances of late credit card payments.

However, having no late payments in your credit report doesn't mean you’ll get a "perfect score." Your payment history is just one piece of information used in calculating your FICO Scores.

Credit payment history on many types of accounts

Account types considered for payment history include:

  • Credit cards (Visa, MasterCard, American Express, Discover, etc.)
  • Retail accounts (credit from stores where you shop, like department store credit cards)
  • Installment loans (loans where you make regular payments, like car loans)

Defamation — also called slander (for spoken or otherwise transitory statements) and libel (for written or otherwise published content) — is:

"the communication of a statement that makes a claim, expressly stated or implied to be factual, that may give an individual, business, product, group, government, or nation a negative image."

To win a U.S. defamation lawsuit, the plaintiff, at the very least, must prove that the defendant:

  • Caused material harm to the plaintiff by publishing or broadcasting said false statement of fact;
  • Acted either negligently or with actual malice;

In the United States, federal defamation law is closely tied to the First Amendment. As a result, federal slander and libel laws are more defendant-friendly in the U.S. than those in common law countrie ... Read more »

If you plan on sticking with your spouse, then you're also stuck with your in-laws. Here's Dr. Phil's advice for dealing with your new extended family:

  • There can be no divided loyalties. When you get married and start your own family, that's where your primary loyalty needs to be.
  • Good fences make good neighbors. Your in-laws need to be your neighbors and there need to be really good fences up. Set boundaries about when they are and are not invited into your lives.
  • You've got a finite amount of physical and emotional energy. If your in-laws are draining you, you may need to change the boundaries. Reassure them that you are not closing them out, you are simply focusing on yourselves.
  • Once you've set boundaries, talk to your parents about them. They're not as fragile as you may think.

Washington state law provides a guarantee that any used car purchased from a dealer is safe to drive. Dealers are bound by an ldquo;implied warranty of merchantability rdquo; that lasts for a reasonable amount of time depending on the car #039;s mileage and age.

The only defects not covered by Washington #039;s implied vehicle warranty are those specifically negotiated between the buyer and the dealer.

A signed waiver to the implied warranty is valid only if the dealer explains the ldquo;As-Is rdquo; terms in detail and you agree to the terms. The parts of the car that aren rsquo;t covered by the implied warranty must be listed in writing on the waiver.

    Student Loan Consolidation

    Best Student

    Loan Consolidation

Whether you have federal student loans (such as Stafford, PLUS, or Federal Perkins loans) or private student loans, there are a number of student loan consolidation services that can help you consolidate your loans into one single debt. This can result in lower interest rates. and, in some cases, dramatically reduced monthly loan payments. Many consolidation services offer fixed interest rates for the life of the loan, which can lock in your savings for years to come. This is good since consolidation loans typically have longer terms than other loans - usually anywhere from 10 to 30 years.

A recent study by the National Center for Education Statistics shows that half of all recent college graduates have an average student loan debt of $10,000. For some students, this amount is much higher. Additionally, many students receive loans from a number ... Read more »

    #Private Loans

    Loans and Lenders

The majority of students finance their legal educations through a combination of federal and private loans. For students who qualify for federal aid, private loans can be used in addition to the Stafford loans and as an alternative to the Graduate PLUS loan in financing your education. Private loans are also a great resource for international students and non-eligible permanent residents.

To initiate the private loan application process, you can either apply by telephone, mail, or online (check with the lender). We recommend students use the online application process, if available. Many lenders will render a decision on your application within 24 hours. Please review the terms and conditions to determine which lender best suits your needs. Additionally, students should carefully read all application and promissory note materials. Remember that the promissory note is your contract with the lender. You should file your loan material ... Read more »

The law also makes it illegal to retaliate against a person because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit. The law also requires that employers reasonably accommodate applicants' and employees' sincerely held religious practices, unless doing so would impose an undue hardship on the operation of the employer's business.

This law amended Title VII to make it illegal to discriminate against a woman because of pregnancy, childbirth, or a medical condition related to pregnancy or childbirth. How Smart Traffic Lights Could Transform Your Commute

What Law Schools Can Teach Colleges about Lowering Tuition

Administrators are being forced to cut prices as fewer students apply to law school, thanks to fewer jobs in legal, but the rate of tuition increases at other colleges and universities shows no sign of slowing down

Two years into his presidency at Roger Williams University, Donald Farish still could not understand why its law school was charging students $41,400 a year. With law schools seeing huge declines in applicants as legal jobs dried up, something needed to be done. It was time we confronted the reality, Farish said.

So the law school slashed its tuition by 18 percent this year, adding Roger Williams to a long list of law schools trying to bring back students by doing something extraordinary with their prices: lowering them.

    12. Be joyful. Seek the joy of being alive-for every reasonable gladness that you can get or give, is treasure that can never be destroyed, and, like the springtime gladness, doubles, every time with others it is shared.

    8. A SCOUT SMILES AND WHISTLES under all circumstances. When he gets an order he should obey it cheerily and readily, not in a slow, hang-dog sort of way. Scouts never grouse at hardships, nor whine at each other, nor swear when put out. When you just miss a train, or some one treads on your favorite corn--not that a scout should have such things as corns--or under any annoying circumstances, you should force yourself to smile at once and then whistle a tune, and you will be all right.

A scout goes about with a smile on and whistling. It cheers him and cheers other people, especially in times of danger, for he keeps it up then all the same.

Trademark rights arise in the United States from the actual use of the mark. Thus, if a product is sold under a brand name, common law trademark rights have been created. This is especially true once consumers view the brand name as an indicator the product's source.

The BitLaw discussion of common law trademarks is divided as follows:

The term common law indicates that the trademark rights that are developed through use are not governed by statute. Instead, common law trademark rights have been developed under a judicially created scheme of rights governed by state law. Federal registration, a system created by federal statute, is not required to establish common law rights in a mark, nor is it required to begin use of a mark. However, federal registration, if available, is almost always recommended and gives a trademark owner substantial additional rights not available under common law. See the BitLaw discussion of federal registration for more information.

Legislative law are laws that are passed by your representative. Like your Congressional or Senate Rep. They write a bill, it has usually two or more sponsors. Then it goes through committees like the Judicial Committee to see if the legal language is correct. then its taken to the floor of the house or senate, if it passes then it goes on to the president to either sign or veto.

A Referendum law is actually voted on by voters. Many States have referendum laws. States like Florida they have to pass by a super majority 60% of the vote. Some States only require a simple Majority.

Laws like Michigan's Marijuana law is an example of a Referendum, people gathered enough signatures, people write the language and if the language is approved by a board then you can get the referendum on the ballot.

You will see this also used to draw out voters. Like Marriage Amendments. Michigan for example, that was an Amendment to the State Constitution. They crafted the language ... Read more »

Complaints, concerns, and questions about ERISA laws should be directed to your local office.

The protective laws under ERISA only apply to private employers (non-government) that offer employer-sponsored health insurance coverage and other benefit plans to employees. ERISA does not require employers to offer plans; it only sets rules for benefits that an employer chooses to offer.

ERISA laws do not apply to privately purchased, individual insurance policies or benefits.

Student loan interest rates rise, worrying some experts

Student loan debt, which has risen 20 percent to $1.2 trillion between 2011 and 2013 -- surpassing every other form of non-mortgage debt -- is becoming increasingly expensive.

Because the U.S. Congress failed to take action, interest rates on undergraduate Stafford loans rose today to 4.66 percent from 3.86 percent last year on both subsidized and unsubsidized borrowing. Graduate students who take out unsubsidized Stafford loans saw their borrowing costs increase to 6.21 percent from 5.41 percent. PLUS loans, which are available to graduate students and parents of college students, will increase to 7.21 percent to 6.41 percent. None of these increases, which could be negated if Congress takes action after the Fourth of July holiday, apply to existing loans.

Lauren Asher, president of The Institute on College Access and Success (TICAS), for one is worried that the increased rat ... Read more »

    Student Loan Interest Rates

Wells Fargo offers competitive student loan rates with fixed and variable interest rate options.  While variable student loan interest rates usually start lower than fixed rates, a fixed rate option can offer protection if interest rates go up over time.
