What is Bankruptcy?

Bankruptcy allows individuals, couples, and businesses that cannot meet their financial obligations to be excused from repaying some or all of their debt. Bankruptcy has been in existence since ancient times. In the United States, the rules and procedures for filing bankruptcy are governed by federal law. States are prohibited from legislating in this area of the law.

Generally speaking, there are two types of bankruptcy. In a liquidation bankruptcy, debtors must surrender their property, which is sold, and the proceeds distributed to creditors. In return, all debts are permanently discharged. In a reorganization bankruptcy, debtors are allowed to keep their property. But the debtors must agree to an installment plan to repay creditors a portion of the amount they owe.

Filing for bankruptcy involves submitting a petition and fee to the bankruptcy court. The fee is close to $300 for most personal bankruptcies. The petition will conta ... Read more »

#De Novo

This handbook is named De Novo, a Latin phrase that means “starting over.” In the law, de novo is the “standard of review” that a court uses when it wants to evaluate the facts of a case on appeal without accepting the findings of the lower court.  In an attempt to provide a useful tool for your new beginning at Duke Law School, we put together the following materials.  This is a student-written compilation of information and opinions that we think will give you a solid introduction to Duke, Durham, and everything else that comes with being at Duke Law.

We know choosing a law school isn’t easy.  After all, how could you possibly know what a school is going to be like before you’ve had a chance to live in the community?  While everyone who worked on this project really enjoys Duke Law School and is happy with their decision, there is a ton of stuff that we would have liked to have known before we arrived in Durham to start classes.  This booklet is intended ... #Defamation Law Made Simple

Learn the basics of slander and libel -- the rules about who can say what without getting into legal hot water.

"Defamation" is a catch-all term for any statement that hurts someone's reputation. Written defamation is called "libel," and spoken defamation is called "slander." Defamation is not a crime, but it is a "tort" (a civil wrong, rather than a criminal wrong). A person who has been defamed can sue the person who did the defaming. (For in-depth information on defamation claims, check out Nolo's Defamation, Libel Slander  section.)

Defamation law tries to balance competing interests: On the one hand, people should not ruin others' lives by telling lies about them; but on the other hand, people should be able to speak freely without fear of litigation over every insult, disagreement, or mistake. Political and social disagreement is important in a free society, and we obviously don't all share the same opinions or beliefs. For instan ... Read more »

What is Alcohol Law?

Alcohol law covers criminal, administrative, and personal injury cases involving alcoholic beverages. Each of these categories of cases is governed by a unique set of rules, and alcohol lawyers tend to limit their practices accordingly. Rules dealing with alcohol are generally a matter of state and local law. However, federal laws and regulations control issues such as the importation, taxation, labeling, and advertising of alcoholic beverages.

Federal lawmakers have also found creative ways to influence alcohol regulation issues that fall within the exclusive authority of the states. For example, in 1984 the U.S. Congress passed legislation that makes the full appropriation of highway funds to a state contingent upon that state outlawing the purchase or possession of alcohol by people under the age of 21. Initially criticized as congressional extortion, all states have now come into compliance with the federal act.

Thinking about law school? Consider California law schools. California offers a complete menu of law schools ranging from ABA approved schools, Concord Law School, state approved schools, unaccredited law schools, correspondence and online law schools. But the really unique thing about the California law schools is that their graduates, even those graduating form non ABA approved programs, generally speaking, are permitted to take the bar exam and become practicing lawyers.

Must you take the LSAT before attending a California law school?

That depends upon the particular school. As a general rule if wish to be considered for one of California’s ABA approved law schools the answer is yes. #Defamation Law: Legal Elements of Libel - Slander Cases.

Find a Personal Injury Lawyer

In essence, a defamation claim can arise when one person says something damaging about another person. However, if a plaintiff could successfully sue every time his or her feelings got hurt, there would be more defamation cases than the legal system could handle. For this and other reasons, defamation is a complex kind of tort (civil injury). This article discusses the key legal concepts of defamation law, different types of defamation - libel vs. slander - and their essential elements.

Why Defamation is Complex: Harm to Reputation and Free Speech

The essential harm alleged in a defamation claim is "damage to the plaintiff's reputation in the community." Because reputation is such an intangible thing, and because of the tendency of some people to react strongly to perceived insults, defamation has evolved -- over centuries of legal decisions -- into a complex concept ... #Defamation legal definition of defamation

Defamation

Any intentional false communication, either written or spoken, that harms a person's reputation; decreases the respect, regard, or confidence in which a person is held; or induces disparaging, hostile, or disagreeable opinions or feelings against a person.

Defamation may be a criminal or civil charge. It encompasses both written statements, known as libel. and spoken statements, called slander.

The probability that a plaintiff will recover damages in a defamation suit depends largely on whether the plaintiff is a public or private figure in the eyes of the law. What is Consumer Rights Law?

Consumer rights and consumer protection law provides a way for individuals to fight back against abusive business practices. These laws are designed to hold sellers of goods and services accountable when they seek to profit by taking advantage of a consumer?s lack of information or bargaining power. Some conduct addressed by consumer rights laws is simply unfair, while other conduct can be described as outright fraud. Consumer rights laws exist at the federal and state level. They are enforced by government agencies, offices of attorneys general, and through individual and class action lawsuits filed by victims.

Types of Consumer Protection Cases

The most common kinds of abusive business practices occur when consumers are in particularly vulnerable circumstances. For example, when people fall behind on their bills, debt collectors are in a position to make life even more difficult by calling in the early morning or l ... Read more »

The new Chinese bankruptcy law went into effect June 1, 2007.  It is China s first bankruptcy law since 1986, which law applied only to state-owned enterprises (SOEs). Since that law was enacted before China s 1993 economic reforms, many of its provisions were inadequate for or in conflict with China s new more market-centered economy.

China s new bankruptcy law mirrors the modern bankruptcy laws of other countries, particularly the United States. The new law applies to all legal entities, including foreign invested enterprises (FIEs), such as WFOEs and Joint Ventures, though it does not apply to individuals.

The law utilizes an administrator who will act much like bankruptcy trustees do in U.S. bankruptcy proceedings. The administrator s role is to help the creditors and to assist in assuring the bankruptcy runs smoothly. The law provides who may serve as an administrator and it is expected most administrators will come from the ranks of China lawyers and China acco ... Read more »

#Deportation laws

Deportation (also called "removal") occurs when the federal government formally removes an alien from the United States for violations of a number of immigration or criminal laws, described in more detail below. Once deported, an alien may lose the right to ever return to the United States, even as a visitor.В

Removal is a legal proceeding, and an alien who is subject to this procedure has legal rights prior to being removed from the country, including the right to challenge the removal itself on procedural or constitutional grounds. Following is a discussion of the removal process.

Classes of Deportable Aliens

Any alien that is in the United States may be subject to deportation or removal if he or she:

  • Is an inadmissible alien according to immigration laws in effect at the time of entry to the U.S. or adjustment of nonimmigrant status;
  • Is present in the U.S. in violation of the Immigra ... Read more »
