#Law forms

The law is a serious matter and you should seek to protect your rights at all times. IF YOU HAVE ANY QUESTIONS concerning the use of these forms or your legal rights, it is strongly recommended that you consult with an attorney. If you need assistance finding an attorney, you may contact the DeKalb Bar Association’s Lawyer Referral Service at 404.373.2580. Additionally, if you are financially unable to hire an attorney you may contact the following legal organizations to determine whether or not you qualify for their services:

  • Atlanta Legal Aid Society, DeKalb Office, 404.377.0701
  • DeKalb Volunteer Lawyers Foundation, 404.373.0865

The law may change at any time, making current form packets outdated. You should research and review those statutes and procedural rules that pertain to your case to ensure that your complaint or petition is accurate and is in compliance with current Georgia law.

#Law Firm Names: An Explanation - Law Blog

lawyers and law firms

Earlier today, we picked up an entertaining read by Reuters on Chinese law firm names. They aren t bound by the same ethics rules as U.S. firms, so they can be more creative. Beijing-based King Wood, for instance you won t find a Mr. King or a Mr. Wood at the firm. They don t exist. But the name is catchy.

Anyway, earlier today we wrote this:

In the U.S. ethics rules require law firms to carry the last name of partners who work there, or who did before they retired or died. China has no such rules. Firms there are free to name themselves however they like, and an evocative name can be an asset.

Then we had an astute reader leave this comment:

In the U.S. ethics rules require law firms to carry the last name of partners who work there, or who did before they retired or died.” — This is probably true in only a minority of U.S. states. I believe at least half of the states now al ... Read more »

New York University School of Law, or NYU Law, was established in 1835. It is the oldest law school in New York City. Despite the rather large student population of around 1,500, class sizes remain fairly small with a student to faculty ratio of 9 to 1. There are currently more than 200 faculty members on staff, which results in lots of individualized attention. A strong alumni network also helps aid students after graduation.

There are many degree options at NYU Law, including J.D, LL.M. and J.S.D. degrees. Students also have the opportunity to complete joint degrees with other schools at NYU such as the Stern School of Business. Individuals can pursue dual degrees with outside schools, like the Harvard Kennedy School of Government or Princeton University s Woodrow Wilson School of Public and International Affairs.

Some of the most popular areas of study are environmental law, intellectual property law, international law and tax law. NYU Law s curriculum differs a b ... Read more »

Under US bankruptcy law. a person's estate consists of all assets or property of any kind available for distribution to creditors. [ 1 ] The estate (or assets) of a bankrupt person is administered by a trustee in bankruptcy. The legal position in all common law countries is similar in this respect.

In land law. the term "estate" is a remnant of the English feudal system. which created a complex hierarchy of estates and interests in land. The allodial or fee simple interest is the most complete ownership that one can have of property in the common law system. An estate can be an estate for years, an estate at will, a life estate (extinguishing at the death of the holder), an estate pur auter vie (a life interest for the life of another person) or a fee tail estate (to the heirs of one's body) or some more limited kind of heir (e.g. to heirs male of one's body).

Fee simple estates may be either fee simple absolute or defeasible (i.e. subject to future cond ... Read more »

    #Law Office Management Software

    (Availabilty of this product unknown.)

    Web-Based Law Office Management Applications

Experts have been predicting that soon all of our software and data storage will only exist "in the cloud" (i.e. on the Internet.) It isn't happening as quickly as many predicted, especially for attorneys, but the quantity and increasing quality of this category of software indicates that the prognisticators may be correct. The emergence of the iPad may hasten the move to the cloud.

The disadvantages of Web-based law office management software are concerns about the company going out of business overnight (possibly taking both your software and your data with them), not being able to access your software or client files when access to the Internet is down or is otherwise inaccessible, concerns about security and local ethics rules that prohibit putting confidential client information on another's server.

Criminal law involves prosecution by the government of a person for an act that has been classified as a crime. Civil cases. on the other hand, involve individuals and organizations seeking to resolve legal disputes. In a criminal case, the state, through a prosecutor, initiates the suit, while in a civil case the victim brings the suit. Persons convicted of a crime may be incarcerated, fined, or both. However, persons found liable in a civil case may only have to give up property or pay money, but are not incarcerated.

A "crime" is any act or omission (of an act) in violation of a public law forbidding or commanding it. Though there are some common law crimes, most crimes in the United States are established by local, state, and federal governments. Criminal laws vary significantly from state to state. There is, however, a Model Penal Code (MPC) which serves as a good starting place to gain an understanding of the basic structure of criminal liability.

This theory was found true when meiosis was extensively delineated in the following years. During anaphase II of meiosis. the genes on the homologous chromosomes separate as the homologous chromosomes move apart from each other toward the opposite sides of the dividing cell.

A Michigan court dismissed a lawsuit on Friday brought by former students of  Cooley Law School who accused their alma mater of  misrepresenting recent graduate job placement statistics.

The former Cooley Law grads were seeking $250 million in damages, claiming they decided to attend Cooley based on what they said was misinformation from the school. Law Blog reported on the case here .

But Judge Gordon Quist, who got the case, wasn’t buying it. The court dismissed lawsuit on the grounds that purchasing a legal degree is not protected by the Michigan Consumer Protection Act.

Even if it was, the job numbers at stake were “literally true” whether they differentiated between recent grads in legal jobs vs. non-legal jobs or not, the court stated, adding that the grads “unreasonably relied upon the representations” in question in their law school decision.

The plaintiffs’ attorney and Cooley Law School’s legal counsel did not immediately re ... Read more »

#Law: No such thing as common-law wife

When Elayne Oxley sold her former council house and was poised to plough the proceeds into a new shared home in her partner's name, her solicitor delivered a warning that should have made her stop and think. To protect her interests, her right to a share in the ownership of the new house should be recorded in writing. Oxley blithely dismissed the advice, insisting airily that she knew her partner, Allan Hiscock well enough not to need written legal protection .

Thirteen years on, she has just emerged from a two-year legal battle with her former partner which is estimated to have run up total costs of at least 50,000. Last month she was awarded 40% of the proceeds of 35 Dickens Close, Hartley, Kent, in a court of appeal judgment which ensures Oxley v Hiscock a place in the law books.

Oxley, 51, who now runs a domiciliary care service, was divorced with three young children when she met Hiscock. He advised her to buy her council ... Read more »

A Law degree is the degree conferred on someone who successfully completes studies in law. However many law degrees are insufficient education for a license to practice law by the administrative body of that jurisdiction. For example in England and Wales one needs to complete the Legal Practice Course to become a solicitor [ 1 ] [ 2 ] or called to the bar to be a barrister. [ 3 ]

The first academic degrees were all law degrees, and the first law degrees were doctorates. The origins of the doctorate lie in the ijazat attadris wa 'l-ifta' ("license to teach and issue legal opinions") in the Islamic madrasahs from the 9th century. [ 4 ] The foundations of the first universities in Europe were the glossators of the 11th century, which were schools of law. [ 5 ] The first European university, that of Bologna. was founded as a school of law by four famous legal scholars in the 12th century who were students of the glossator school in that city. #Law of Supply: Definition - Example

    Instructor: Tara Schofield

This lesson explains the law of supply. The connection between the law of supply and pricing is discussed. Several examples of provided to further explain the law of supply in action

    What is Law of Supply?

Pricing is one of the biggest opportunities and one of the greatest challenges a company faces. If you are creating a price for a product, you must consider how much consumers are willing to pay without underpricing your product. Pricing is a critical aspect of the law of supply.

The law of supply is an economic principle that helps explain how to appropriately price products based on how much supply is available of a product. The law of supply explains that if people are willing to pay more money for a product, a company will produce or manufacture more of that product to capitalize on the increased revenue.

The opposite also holds true that as the price of a ... Read more »

#Law of Segregation - Biology Video by Brightstorm

Gregor Mendel's law of segregation has four parts. First, it defines an allele. Second, it states that organisms inherit one allele from each parent. Third, it states that gametes only carry one allele for each trait. Fourth, it defines the difference between dominant and recessive genes.

The law of segregation is commonly known also as Mendel s First Law and this is the idea that every inheritable trait or gene as we now call them is controlled by a pair of factors or alleles and those pairs of alleles, when you make gametes separate from each other so that for example if you have a dominant version of allele and a recessive version of allele, one of your gametes will be containing the dominant one, the other one will contain the recessive one. And this is caused by the separation of homologous chromosomes that is seen during the process of gamete formation called meiosis.

Lemon laws will likely cover used cars if the car was covered under a certain type of warranty. Despite the fact that a used car is a much more likely candidate to be a lemon, federal lemon laws generally cover only new vehicle purchases. But there is one major exception: if the owner has received an express written warranty along with the used vehicle, then federal lemon law will likely cover the used car. An express written warranty can include the balance of a manufacturer s warranty, a separate limited warranty given by the dealer, or an extended warranty or service contract purchased from the dealer at the time of the vehicle purchase. Some used vehicles are certified by the dealer, which extends the existing warranty or creates an additional short warranty on the used vehicle. Having such a warranty will not only offer the potential for a breach of warranty claim, but federal lemon laws can also apply to the situation.

It was a stroke of genius considering that it was performed in the 19th century.

Of course, Mendel knew nothing about the processes behind inherited behavior, but found out the rules dictating how characteristics are passed down through the generations.

The way in which he meticulously planned his experiment to generate testable. rather than observational data, is a shining example of experimental design .

Gregory Mendel was an Austrian monk studying at the University of Vienna. Like many pioneering scientists, his discoveries were largely ignored until long after his death.

#Law School Offers Free Tuition To 50 Applicants

We know the new economics for middle-tier law schools. Applications are down, so to convince students with good test scores to come to your school, you have to offer them money. It s the market, imperfect though it may be, at work.

So when a law school offers full scholarships to a number of students with strong academic credentials, don t think that it s doing you a favor. They re trying to fill their seats, not trying to address the fundamental cost problem of law school. If a law school is offering scholarships to high-performing students, that means that the low-performing students who are paying full price are subsidizing the people in their class who are most likely to bust up the curve. Addressing the value proposition of law school involves lowering tuition for all students, not making law school free for the kids with potentially better options.

That said, there s nothing wrong with a little price co ... Read more »

    #Privacy - Internet Law

Among the many legal issues presented by the Internet, privacy is a leading problem. In fact, Internet privacy covers a broad range of concerns: fears about the safety of children in chat rooms and on the World Wide Web, the privacy of e-mail, the vulnerability of web users to having their Internet use habits tracked, the collection and use of personal information, the freedom of people to chat and post messages anonymously. Moreover, the rapid evolution of the Internet has frequently brought such privacy concerns before lawmakers and the courts.

Privacy concerns are frequently newsworthy. During the 1990s, child safety advocates highlighted special online dangers for children following high-profile abuse cases. Internet commerce has also been affected, too. The Federal Trade Commission (FTC) report noted in 2000 in its annual report to Congress that survey data demonstrated 92% of consumers are concerned about the misuse of personal information onli ... Basic information about the Master of Business Administration degree

The Master of Business Administration (MBA) is an internationally-recognized degree designed to develop the skills required for careers in business and management. The value of the MBA, however, is not limited strictly to the business world. An MBA can also be useful for those pursuing a managerial career in the public sector, government, private industry, and other areas.

Most MBA programs include a "core" curriculum of subjects, such as accounting, economics, marketing, and operations, as well as elective courses that allow participants to follow their own personal or professional interests. Some schools require that MBA candidates complete an internship at a company or organization, which can lead to concrete job opportunities after the program.

Quality business schools generally require that candidates have at least a few years of professional work experience before starting an MB ... Read more »

It relates magnetic fields to electric currents that produce them. Using Ampere's law, one can determine the magnetic field associated with a given current or current associated with a given magnetic field, providing there is no time changing electric field present. In its historically original form, Ampere's Circuital Law relates the magnetic field to its electric current source. The law can be written in two forms, the "integral form" and the "differential form". The forms are equivalent, and related by the Kelvin–Stokes theorem. It can also be written in terms of either the B or H magnetic fields. Again, the two forms are equivalent (see the "proof" section below).

Ampere's circuital law is now known to be a correct law of physics in a magnetostatic situation: The system is static except possibly for continuous steady currents within closed loops. In all other cases the law is incorrect unless Maxwell's correction is included (see below).

Generally, if a person has a physical or psychological (mental) disability that causes him/her to be unable to do any kind of work for which he/she is suited (given the person s age, education, and work experience) and the disability is expected either to last for at least one year or to result in death, then that person will be considered disabled for Social Security purposes.

Social Security administers four separate benefit programs for individuals with disabilities: Social Security Disability Insurance (SSDI), Supplemental Security Income, Disabled Widows and Widowers benefits (DWB), and Disabled Adult Child Benefits (DAC). The medical requirements to prove disability, as well as the process for making disability determinations, are the same for each program.

A creditor must usually have a judgment before it can execute a writ of garnishment on an employer or financial institution. However, an employer or financial institution might receive a writ of fieri facias that asks it to declare what property it has that belongs to the debtor and in what amount it is indebted to the debtor as a preliminary matter. The creditor sends a writ of garnishment to the employer or financial institution to pay off such debts as consumer credit debts, tax liens, child support, spousal support or student loans. The amount garnished is then forwarded to a court or to the creditor

Instead of garnishing wages, creditors may opt to garnish a debtor's bank account. The only limits on bank garnishment are for exemptions that mirror the federal laws on exemptions, such as not being able to garnish federal benefits. Exemptions under Louisiana law also include income from Individual Retirement Accounts, annuity contracts and pensions, meaning that a creditor ... Read more »

The degree awarded to an individual upon the successful completion of law school.

Juris doctor, or doctor of Jurisprudence. commonly abbreviated J.D. is the degree commonly conferred by law schools. It is required in all states except California (which includes an option called law office study) to gain Admission to the Bar. Gaining admission to the bar means obtaining a license to practice law in a particular state or in federal court.

Until the 1930s and 1940s, many states did not require a person to have a law school degree in order to obtain a license to practice law. Most lawyers qualified for a license by working as an apprentice for an established attorney for a specified period. By the 1950s most states required a law school degree. State legislatures established this requirement to raise the standards of practicing attorneys and to restrict the number of attorneys. The degree offered by most Colleges and Universities was called a master of laws (L.L.M ... Read more »

    What's a JD degree?

The Juris Doctor (JD) degree is the graduate degree required to practice law in the United States. The JD degree is offered by American Bar Association (ABA)-approved law schools, by law schools that are not ABA-approved, and by many Canadian law schools.

    • A bachelor's degree is required for admission into a JD program.
    • The LSAT is an integral part of the law school admission process in the United States, Canada, and a growing number of other countries.
    • The JD program is generally a three-year, full-time academic program.
    • All US states accept graduation from an ABA-approved law school as meeting that state's education requirement for eligibility to sit for the bar examination.

If you plan on sticking with your spouse, then you're also stuck with your in-laws. Here's Dr. Phil's advice for dealing with your new extended family:

    • There can be no divided loyalties. When you get married and start your own family, that's where your primary loyalty needs to be.
  • Good fences make good neighbors. Your in-laws need to be your neighbors and there need to be really good fences up. Set boundaries about when they are and are not invited into your lives.
  • You've got a finite amount of physical and emotional energy. If your in-laws are draining you, you may need to change the boundaries. Reassure them that you are not closing them out, you are simply focusing on yourselves.
  • Once you've set boundaries, talk to your parents about them. They're not as fragile as you may think.

#Lawful Interception Architecture for LTE Evolved Packet System

Lawful Interception is a legally sanctioned official access to private communications. It is a security process in which a service provider or network operator collects and provides law enforcement officials with intercepted communications of private individuals or organizations. Lawful interception is always done in accordance with the applicable national or regional laws and technical regulations.

3GPP Evolved Packet System (EPS) provides IP based services. Hence, EPS is responsible only for IP layer interception of Content of Communication (CC) data. In addition to CC data, the Lawful Interception (LI) solution for EPS offers generation of Intercept Related Information (IRI) records from respective control plane (signalling) messages as well.

3GPP lawful interception functional architecture for EPS is similar to 3G PS functional architecture. The following figures contain the reference configuration ... Read more »

#What Types of Income Can Be Garnished?

Garnishment is a means for creditors to collect a portion of what’s owed to them by having the debtor’s employer pay a portion of their paycheck directly to the creditor.  However, not everyone is paid in straight wages, and not everyone’s income consists of an employee paycheck.  Those who are subject to a garnishment order may wonder what types of income are subject to garnishment.

Garnishment is governed by both federal and state law. In many cases, the federal and state laws conflict – as far as what can be garnished, as well as garnishment limits and when that happens, the law that’s the most favorable to the employee prevails.  The summary below pertains to the US federal garnishment laws, which are covered in Title III of the Consumer Credit Protection Act (CCPA.)

    Wages, Bonuses, Commissions Tips

Wage garnishment is by far the most common type of garnishment.  An employee’s wages (whether hourly ... Read more »

Exponents: Basic Rules (page 1 of 5)

Exponents are shorthand for repeated multiplication of the same thing by itself. For instance, the shorthand for multiplying three copies of the number 5 is shown on the right-hand side of the equals sign in (5)(5)(5) = 5 3. The exponent , being 3 in this example, stands for however many times the value is being multiplied. The thing that's being multiplied, being 5 in this example, is called the base .

This process of using exponents is called raising to a power , where the exponent is the power . The expression 5 3 is pronounced as five, raised to the third power or five to the third . There are two specially-named powers: to the second power is generally pronounced as squared , and to the third power is generally pronounced as cubed . So 5 3 is commonly pronounced as five cubed .

When we deal with numbers, we usually just simplify; we'd rather deal with 27 than with 3 3 . But with variables, ... Read more »

Entrepreneurial law is a dynamic area that changes rapidly. With this edition of Entrepreneurial Law the authors aim at reflecting these changes. Although there were no major legislative changes to the Companies Act of 1973 or the Close Corporation Act of 1984, several minor, but significant changes were made to these two important pieces of legislation which are now reflected in this edition. The authors have also referred to, or discussed, the most important judgments since the last edition of Entrepreneurial Law in 2000.

The specialty of "elder law" evolved in the 1980s as it became increasingly clear that the complicated legal issues confronting seniors - in particular qualifying for Medicaid coverage of long-term care - were beyond the expertise of general-practice attorneys. In recent years, we've increasingly seen the field described as "elder care law" and the lawyers as "elder care" attorneys.

Elder law or elder care attorneys typically help families:
    • plan for Medicaid coverage of long-term care, and apply for coverage when the time comes;
    • plan and administer an estate;
    • represent guardians and conservators; and
    • create and administer trusts.

Unlike many other areas of the law, elder law is defined by the needs of the client, rather than a particular field of law. Because of this, elder law attorneys are also aware that their clients' needs often extend beyond basic legal services. For this reason, they are linked to a network of prof ... Read more »

#Law Schools Beat Colleges At Lowering Tuition

How Smart Traffic Lights Could Transform Your Commute

What Law Schools Can Teach Colleges about Lowering Tuition

Administrators are being forced to cut prices as fewer students apply to law school, thanks to fewer jobs in legal, but the rate of tuition increases at other colleges and universities shows no sign of slowing down

Two years into his presidency at Roger Williams University, Donald Farish still could not understand why its law school was charging students $41,400 a year. With law schools seeing huge declines in applicants as legal jobs dried up, something needed to be done. It was time we confronted the reality, Farish said.

So the law school slashed its tuition by 18 percent this year, adding Roger Williams to a long list of law schools trying to bring back students by doing something extraordinary with their prices: lowering them.

Law schools at public universities dropped their ... Read more »

UMass Law: of Sterling Vision and Silver Spoons

Once upon a time, long ago, UMass Law was a stable, rising law school in a sea of resizing, confused law schools:

"Other schools are losing enrollment and decreasing their academic indicators," Bilek said. "To be stable and be increasing academic quality, at a time when nationally legal education is trying to figure out what to do, I would say is where we want to be.

#Law students: seven ways to motivate yourself

    Sponsored by:

“What’s the point? I won’t make it anyway”; “Why would law firms pick me over others?”; “I’m never going to get a 2:1 or a first”; “I’m not intelligent enough for this”.

These statements sometimes run through my mind and if you’re a law student, you may have had similar thoughts. I’ve never been the most intelligent student or someone who just “gets it”. I take my time and ask questions until I understand.

But after passing my GCSEs and A-levels, I began to believe in myself and was accepted to study law at the University of Portsmouth.

My first year was overwhelming and even now, entering my third year, I still have negative thoughts. But it’s natural to feel inadequate and wish you had the same grades or as much work exper ... Read more »

Below you will find information on what, if any, rules Tennessee has regarding immigration checks by law enforcement, educational institutions, and employers, as well as the existence of E-Verify requirements, restrictions on public benefits based on an individual's immigration status, and more.

Officials at city and county jails in Tennessee are required to report anyone who may be in violation of federal immigration laws to U.S. Immigration and Customs Enforcement (ICE) authorities.

Legislative law are laws that are passed by your representative. Like your Congressional or Senate Rep. They write a bill, it has usually two or more sponsors. Then it goes through committees like the Judicial Committee to see if the legal language is correct. then its taken to the floor of the house or senate, if it passes then it goes on to the president to either sign or veto.
