#Antimatter haze found in thundercloud, and the laws of physics can’t explain it

Six years ago, atmospheric physicist, Joseph Dwyer, accidentally flew his plane into a thundercloud, and right through an unexpected pocket of antimatter. And while we know high-energy positrons - the antimatter counterpart of the electron - can be caused by cosmic rays making contact with the atmosphere, or by particularly active lightning storms, what Dwyer detected could not be explained by either of these scenarios.

"This was so strange that we sat on this observation for several years," Dwyer, from the University of New Hampshire in the US, told Davide Castelvecchi at Nature.

The flight in question took place on 21 August 2009, when Dwyer, then at the Florida Institute of Technology in Melbourne, Florida, set out to detect gamma rays (γ-rays) - extremely high-frequency electromagnetic radiation made up of high-energy photons. He installed a particle detector on a Gulfstrea ... Read more »

#Antitrust Laws And You

Many consumers have never heard of antitrust laws, but enforcement of these laws saves consumers millions and even billions of dollars a year. The Federal Government enforces three major Federal antitrust laws, and most states also have their own. Essentially, these laws prohibit business practices that unreasonably deprive consumers of the benefits of competition, resulting in higher prices for products and services.

The three major Federal antitrust laws are:

  • The Sherman Antitrust Act
  • The Clayton Act
  • The Federal Trade Commission Act.

The following information on these laws comes from the Antitrust Enforcement and the Consumer guide.

The Sherman Antitrust Act

This Act outlaws all contracts, combinations, and conspiracies that unreasonably restrain interstate and foreign trade. This includes agreements among competitors to fix prices, rig bids, and allocate customers, which are puni ... Read more »

#Anti-apartheid heroes urge Cameron not to repeal Human Rights Act

Some of South Africa’s most influential intellectuals and activists have urged David Cameron to reconsider his plans to repeal the Human Rights Act. warning that the move is reminiscent of the mindset that created apartheid.

In a letter to the Observer, 25 of the country’s most eminent playwrights, lawyers, politicians and artists say that more than two decades after the British people spoke out against apartheid in South Africa, it was their turn to reciprocate with support for a country that is in danger of betraying that honourable history .

Their intervention is timed to coincide with Mandela Day. the second since the anti-apartheid hero’s death. The signatories describe their “horror” at Cameron’s desire to replace the act with a British bill of rights. Britain’s role in challenging apartheid, they said, meant they had a duty to intervene on behalf of the British people.

In today's fast-paced, technologically complex economy, businesses rely on project managers to shepherd projects through to completion. According to the Association for Project Management, "at its most fundamental, project management is about getting things done through people." In practice, project managers may orchestrate development of a new product, an overhaul of business processes, or a corporate restructuring. The common element is a big-picture coordination of activities according to a schedule and budget, combined with a need to manage risk and uphold quality standards.

A master's degree in project management cultivates the technical and theoretical knowledge critical to effective project leadership. Available a variety of formats, the master's in project management generally takes a year or two to complete. Working professionals can earn a master's degree online, applying the skills they learn directly in the workplace.

#Antitrust Laws - Ayn - Rand Lexicon

The Antitrust laws an unenforceable, uncompliable, unjudicable mess of contradictions have for decades kept American businessmen under a silent, growing reign of terror. Yet these laws were created and, to this day, are upheld by the conservatives, as a grim monument to their lack of political philosophy, of economic knowledge and of any concern with principles. Under the Antitrust laws, a man becomes a criminal from the moment he goes into business, no matter what he does. For instance, if he charges prices which some bureaucrats judge as too high, he can be prosecuted for monopoly or for a successful intent to monopolize ; if he charges prices lower than those of his competitors, he can be prosecuted for unfair competition or restraint of trade ; and if he charges the same prices as his competitors, he can be prosecuted for collusion or conspiracy. There is only one difference in the legal treatment accorded to a criminal or to a businessman: ... Read more »

#Are There Accredited Online Law Schools?

Although accredited online law degree programs will not qualify graduates to practice law in most states, they can provide business professionals or foreign-educated lawyers with a better understanding of the U.S. legal system. Many of these programs culminate in a Juris Doctor or Master of Laws.

Accredited Online Law Schools

In most states, aspiring attorneys must graduate from a Juris Doctor (J.D.) program accredited by the American Bar Association (ABA) in order to sit for the state bar examination and therefore practice law. Currently, the ABA does not approve any online J.D. programs. There are, however, schools accredited by the Distance Education and Training Council (DETC).

These schools are for business professionals who want graduate law training, lawyers educated abroad or, in some cases, aspiring attorneys. California is the only state that allows graduates from an online school to sit for its state bar ... Read more »

#Any payments to people smugglers may have broken Australian law

Any Australian officials paying people smugglers to take asylum seekers back to Indonesia may have broken Australian laws carrying potential jail terms of up to 20 years and contravened international law, judicial experts say.

But any domestic investigation of legal breaches would have to be authorised by the government, which is stonewalling all discussion of the explosive claims, refusing to confirm or deny allegations that $30,000 was paid to six people smugglers to return asylum seekers to Indonesia in May.

Phillip Boulten SC, a leading Sydney barrister, and Nicholas Cowdery, a former director of public prosecutions in New South Wales, told Guardian Australia that an Australian paying people smugglers would likely be in breach of the provisions of the Criminal Code outlawing people smuggling, or assisting people-smuggling. But both pointed to the fact that the government itself would have to initia ... Read more »

#Antitrust laws

Antitrust: An Overview

Trusts and monopolies are concentrations of economic power in the hands of a few. Economists believe that such control injures both individuals and the public because it leads to anticompetitive practices in an effort to obtain or maintain total control. Anticompetitive practices then lead to price controls and diminished individual initiative. These results in turn cause markets to stagnate and depress economic growth.

Because of fears during the late 1800s that monopolies dominated America's free market economy, Congress passed the Sherman Antitrust Act in 1890 to combat anticompetitive practices, reduce market domination by individual corporations, and preserve unfettered competition as the rule of trade. The Sherman Antitrust Act forms the foundation and the basis for most federal antitrust litigation.

As for the states, many have adopted antitrust laws that parallel the Sherman Antitrust Act to prevent anticompet ... Read more »

#Arizona Immigration Law (S. B. 1070)

On April 23, 2010, Arizona Gov. Jan Brewer signed into law Senate Bill 1070 aimed at preventing illegal immigration that has significantly affected the Mexico-bordering state over many decades. The new law, entitled Support Our Law Enforcement and Safe Neighborhoods Act, would require law enforcement officials to enforce existing federal immigration laws in the state by checking the immigration status of a person they have "reasonable suspicion" of being in the U.S. illegally. An immigrant found without proper documentation would be charged with a misdemeanor.

Although the law says nothing about deportation, it allows law enforcement agencies to immediately transfer a person it believes is in violation of any U.S. or state laws into Customs or Border Protection, and subsequently, to a federal facility in the state.

The impact of S.B. 1070 is far-reaching. If the law takes effect on July 29, 2010, issues involving state's rights, ... Read more »

Copyright law in the U.S. is governed by federal statute, namely the Copyright Act of 1976. The Copyright Act prevents the unauthorized copying of a work of authorship. However, only the copying of the work is prohibited--anyone may copy the ideas contained within a work. For example, a copyright could cover a written description of a machine, but the actual machine itself is not covered. Thus, no one could copy the written description, while anyone could use the description to build the described machine.

Copyrights can be registered in the Copyright Office in the Library of Congress, but newly created works do not need to be registered. In fact, it is no longer necessary to even place a copyright notice on a work for it to be protected by copyright law. However, the Copyright Act does provide additional benefits to those who register with the Copyright Office. Consequently, copyright registration and the use of a copyright notice is recommended.

#Are There Any Rankings for Online Law Schools? Top Law Schools

Rankings of Online Law Schools

The Internet has revolutionized many aspects of our society and there are now several online law schools offering degrees out there. However, law is inherently a conservative arena, for in law present decisions are determined by examining past decisions that set a precedent. Along these lines, online law schools are still stigmatized and are not yet ranked by any law school ranking.

Personally, I like the idea of online law schools and am open to the concept. However, the reality of online law schools is that at present their graduates fare poorly in the job market as online law schools are not yet considered the equal of even marginal brick and mortar law schools.

Until online law schools become more prestigious, I would focus upon the traditional ABA approved law schools. That being said, if you are in California, which does not require that you attend an ABA a ... Read more »

Meaning of "tort"

"Tort" means civil wrong. The word itself is derived from French or Latin roots. The law of torts is concerned with compensation for damage suffered as a result of another's acts or omissions.

Definition: Tort

From the French, deriving from the Latin torquere. to twist. Any civil wrong, other than a contract dispute, for which there is a remedy. Implies acts that bend or warp societal rules prohibiting causing harm to others.

Liability in tort arises when some interest of another is harmed. Tort law is not intended to punish wrongful conduct. Rather, the point of this branch of law is to determine liability for harm and assign the cause of harm to the most appropriate actor. This then gives the injured party a place to seek a remedy.

The nature of acts giving rise to injury creates the first organizing principle when considering tort liability. Some acts are clearly intended to give rise to injury, such as physi ... Read more »

#Arizona Illegal-Immigrant Law Draws Strong Opposition

Related

The toughest anti-illegal-immigrant measure in a generation passed the Arizona legislature this week. If signed, as expected, by Republican governor Jan Brewer, the law will give local police sweeping new powers in regard to undocumented workers. Currently, immigration offenses are violations of federal, not state, law, and local police officers only can inquire about a person's immigration status if that person is suspected of another crime. Under SB1070, however, Arizona police will have the right to stop anyone on "reasonable suspicion" that they may be an illegal immigrant and can arrest them if they are not carrying a valid driver's license or identity papers.

Passions about illegal immigration run high in Arizona, a point of entry for thousands of undocumented workers going to the U.S. from Mexico, and tensions were heightened by the recent murder of a rancher in a remote border area where illega ... Read more »

An intellectual movement whose members argue that law is neither neutral nor value free but is in fact inseparable from politics.

Critical legal studies (CLS) is a sometimes revolutionary movement that challenges and seeks to overturn accepted norms and standards in legal theory and practice. CLS seeks to fundamentally alter Jurisprudence. exposing it as not a rational system of accumulated wisdom but an ideology that supports and makes possible an unjust political system. CLS scholars attempt to debunk the law's pretensions to determinacy, neutrality, and objectivity. The law, in CLS scholarship, is a tool used by the establishment to maintain its power and domination over an unequal status quo. Openly a movement of leftist politics, CLS seeks to subvert the philosophical and political authority of what it sees as an unjust social system. CLS advances a theoretical and practical project of reconstruction of the law and of society itself. CLS is also a membership orga ... Read more »

This article is about the criminal justice law. For Internet disconnection policy, see Graduated response. For other uses of the term "Three Strikes", see Three Strikes (disambiguation) .

Three Strikes Laws are statutes enacted by state governments in the United States which require the state courts to impose a life sentence (usually with the possibility of parole) to persons who have been convicted of three or more serious criminal offenses. These statutes became very popular in the 1990s. Twenty-four states have some form of habitual offender laws.

The name comes from baseball. where a batter is permitted two strikes before striking out on the third.

The practice of imposing longer prison sentences on repeat offenders (versus first-time offenders who commit the same crime) is nothing new, as Judges often take into consideration prior offenses when sentencing. However, there is a more recent history of mandatory prison sentences for repeat offenders. ... Read more »

Consumer laws and Consumer lawyers in India

Consumer rights are the rights given to a consumer to protect him/her from being cheated by salesman/manufacturer. Consumer protection laws are designed to ensure fair trade competition and the free flow of truthful information in the marketplace.

The laws are designed to prevent businesses that engage in fraud or specified unfair practices from gaining an advantage over competitors and may provide additional protection for the weak and those unable to take care of themselves. Consumer Protection laws are a form of government regulation which aim to protect the rights of consumers.

For example, a government may require businesses to disclose detailed information about products particularly in areas where safety or public health is an issue, such as food. Consumer protection is linked to the idea of consumer rights (that consumers have various rights as consumers), and to the formation of consumer organizations which ... Read more »

(redirected from Probate law )

The court process by which a Will is proved valid or invalid. The legal process wherein the estate of a decedent is administered.

When a person dies, his or her estate must go through probate, which is a process overseen by a probate court. If the decedent leaves a will directing how his or her property should be distributed after death, the probate court must determine if it should be admitted to probate and given legal effect. If the decedent dies intestate without leaving a will the court appoints a Personal Representative to distribute the decedent's property according to the laws of Descent and Distribution. These laws direct the distribution of assets based on hereditary succession.

In general, the probate process involves collecting the decedent's assets, liquidating liabilities, paying necessary taxes, and distributing property to heirs. Probate procedures are governed by state law and have been the ... Read more »

#Arizona law stakes claim over unauthorized campaign signs

With city elections in Phoenix next month and 2016 races around the corner, Arizona regulators are warning people that they might need to pull up stakes on the many campaign signs on lawns and street corners.

Signs that were installed without prior inspection could create danger around utility lines and bring hefty fines, according to a longtime state law.

The Arizona Blue Stake law mandates that anyone doing excavation must have utility lines marked first. It's a law that was enacted in 1974 and has been enforced by the Arizona Corporation Commission.

Recently, the commission has been reminding campaigns and campaign supporters that the law applies to signs staked into turf. Anyone who wants to plant a sign must call 811, the nonprofit call center that arranges for utility locators to mark the locations of utility lines at no charge. The wait is normally about two days.

#Arizona State Senator Sylvia Allen Suggests Law Making Church Attendance Mandatory for Everyone

Arizona State Senator Sylvia Allen (R) was discussing a bill Tuesday that would allow citizens to carry concealed weapons and bring them into public buildings.

Along the way, she decried the moral decay of our country and suggested offhand that the legislators should be considering another bill to fix that:

How we get back to a moral rebirth in this country, I don t know, since we are slowly eroding religion at every opportunity that we have. Probably we should be debating a bill requiring every American to attend a church of their choice on Sunday to see if we can get back to having a moral rebirth. That would never be allowed.

Forced church on Sunday for everyone! (Tell me again, Christians, how your religious liberty is being threatened ?)

Not that going to church would do anything. We obtain our morals independently ... Read more »

#Arizona-Style Immigration Laws Hurt the Economy

Follow Comments Following Comments Unfollow Comments

With the “papers please” portion of Arizona’s recent immigration law SB 1070 going into effect, civil rights and watchdog groups are in overdrive readying for the litany of purported abuses and complaints. Lydia Guzman, president of Respect Respeto. a civil rights group in Arizona that records abuses at the hands of police, said, “Our hotline has been receiving hundreds of calls a day since the law was implemented.”

Forcibly removing peaceful unauthorized immigrants from the U.S. separating them from their families, property, and jobs, to satisfy arcane labor market regulations created by Progressive politicians, is an appalling indecency. It also inflicts significant economic harm. Arizona’s immigration laws have drastically damaged its economy since mid-2007. The humanitarian arguments may leave those who complain the loudest about unauthorized immigration unmove ... Read more »

#Arizona’s bad immigration law takes effect - The Washington Post

By Editorial Board September 20, 2012

AFTER A TWO-YEAR struggle, a federal judge this week authorized Arizona law enforcement agencies to require officers to check the immigration status of anyone they suspect is in the country illegally. Wearing the wrong clothes, speaking with the wrong accent or having the wrong skin color could land you in hot water in Arizona.

The state’s “show me your papers” provision — one of the most bitterly contested parts of the obnoxious immigration law enacted in 2010 — is the second such measure to receive a green light from federal courts. The first was from Alabama, where a similar policy was implemented about a year ago.

There, according to a recent report by the National Immigration Law Center, an immigrant advocacy group, law enforcement officers have created an “environment of racial profiling” that has encouraged private citizens to discriminate and abuse ... Read more »

Our list of affordable law schools includes schools with a solid reputation which also provide affordable tuition costs.

If you’re considering going to law school, it goes without saying you’ll want to assess a law school’s reputation, success rate of graduates passing the bar exam and other factors of overall quality. Moreover, these days, with a challenging economy and rising tuition expenses, you’ll also want to look at the tuition costs and the affordability of a particular school.

One way to manage the expenses of a law degree is to consider in-state law schools. However, some law schools offer reasonable out-of-state tuitions. While it may not be your first choice among all law schools, ideally, you should aim to select a school which offers both a stalwart reputation and affordability.

With a predilection to costs, this list highlights ten affordable law schools with sensibly priced in-state and out-of-state tuition rates and solid national standings.< ... Read more »

(redirected from statute law )

An act of a legislature that declares, proscribes, or commands something; a specific law, expressed in writing.

A statute is a written law passed by a legislature on the state or federal level. Statutes set forth general propositions of law that courts apply to specific situations. A statute may forbid a certain act, direct a certain act, make a declaration, or set forth governmental mechanisms to aid society.

A statute begins as a bill proposed or sponsored by a legislator. If the bill survives the legislative committee process and is approved by both houses of the legislature, the bill becomes law when it is signed by the executive officer (the president on the federal level or the governor on the state level). When a bill becomes law, the various provisions in the bill are called statutes. The term statute signifies the elevation of a bill from legislative proposal to law. State and federal statutes are c ... Read more »

Abstract: Why has the Obama Administration, as part of its lawsuit against the Arizona statute that attempts to help enforce national immigration laws, not claimed that the state law requires or allows illegal racial profiling? The answer is surprisingly simple: Arizona state law actually contains more stringent restrictions against racial profiling than federal guidelines published by the U.S. Department of Justice (DOJ). Consequently, if the Obama Administration files suit alleging that the Arizona law is illegal because it uses racial profiling and is discriminatory, it will also have to file suit against all of the federal law enforcement agents who follow DOJ’s Guidance on race profiling in law enforcement activities. Such a suit against Arizona is completely unwarranted and would constitute litigation based on political or other improper considerations, not the rule of law.

The Obama Administration has attacked the new Arizona statute that attemp ... Read more »

#Arkansas and Indiana pass changes to religious laws - BBC News

Governor Asa Hutchinson signed a reworked bill

Arkansas and Indiana have passed laws to quell the outcry over new "religious freedom" legislation that critics say encourages anti-gay discrimination.

Republican Arkansas Governor Asa Hutchinson signed a revised version of his religious objections bill that he hopes addresses these concerns.

The amendments mean his state's law more closely mirrors what Bill Clinton signed into federal law in 1993.

Indiana also approved law changes which were signed off by its governor.

The Indiana amendment prohibits businesses from using the law as a legal defence if they refuse to provide services to gays and lesbians, or other groups.

The change does not apply to churches, religious schools, or non-profit religious organisations.

It also prohibits discrimination based on race, colour, ancestry, religion, age, disability, national ... Read more »
