Legally, a major distinction between neglect and abandonment is that in the case of the latter, parental rights are immediately terminated, and the court system need not make an effort to reunite the child to its parents. For a neglected child, the court does have this obligation, but the parents are obligated to cooperate with the courts and Child Protective Services (CPS) in order to improve their approach to parenting. A parent who has no interest in cooperating nor ability to cooperate with the state agencies on these matters is then considered to have "abandoned" the child, and the courts need not deal with the "parents" in these cases any further. Children are then referred to private agencies for adoption.

The Federal Labor Standards Act administers a standard set of labor law regulations for each state to follow. Under federal law, workers are not entitled to any breaks during the workday, including rest break or lunch breaks. However, several states grant general workday breaks or meal breaks, or even both types of breaks, to its employees. Arizona is not a state that requires employers to provide workday or lunch breaks.

The United States Department of Labor administers labor law rules and regulations that each state must follow. The labor department promotes safe working conditions for U.S. employees and helps employers by providing a standard set of guidelines they must follow through the Fair Labor Standards Act (FLSA).

Additionally, states may supplement these federal regulations with its own set of labor regulations, providing employees with additional work benefits and privileges. At a minimum, each state must require its employers to provide any FLSA benefits ... Read more »

The Industrial Commission of Arizona runs the Arizona Workers' Compensation program. The no-fault insurance program provides coverage for the medical expenses and lost wages for injuries and illness suffered on the job, regardless of who is at fault. Medical benefits and compensation are awarded on a temporary or permanent basis, depending on the prognosis of the injury or illness.

Employees don't pay for workers' compensation. Under Arizona state law, employers are required to provide workers' compensation insurance to employees. Even if you only work part-time, the employer is required to provide you with coverage. Employers are required to post a notice of coverage as well as a notice explaining your right to waive coverage. If you don't want to be covered, you'll need to complete and submit a rejection form to your employer prior to an on-the-job injury.

If you suffer a life-threatening injury on the job, seek emergency help immediately. Let your medical provider ... Read more »

In Australia, in common with many other countries, the executor named in a will by the deceased must distribute assets under the will according to the terms of the will. The executor usually needs to obtain a grant of probate from the relevant court. Many third parties such as banks and financial institutions hold the property on behalf of the deceased and, to protect themselves legally, will not release it without a grant of probate. Some property can only be passed on via probate, such as a share of a house held as a tenant-in-common.

What Happens When Property Goes to Probate?

What Is a Grant of Probate?

When a person dies, the executor of his estate uses his will to distribute his property and assets. Typically, wills go through.

South Carolina s probate laws establish how a person s property gets handled after death. These laws govern everything from what is required to.

The law of supply is a basic economic principle stating that as supply for a certain product increases, the price for that product will also increase. This is typically seen with new products that are in high demand, but may also apply to many other products, including commodities. The laws of demand and supply are often compared and used with one another, but are independent economic theories.

While the law of supply suggests that companies tend to maximize profits by producing products as their price increases, that is not always the case. Certainly, if a company sees a price increase and can produce a product for the same cost, it will take advantage of that situation as long as it can. In some cases, however, producing more of a product leads to certain inefficiencies. For example, a company may have to pay overtime or call for unscheduled deliveries, both of which make production more expensive. This could increase the price, yet only maintain the profit margin at previ ... Read more »

A law degree is an academic degree conferred for studies in law. Such degrees are generally preparation for legal careers; but while their curricula may be reviewed by legal authority, they do not themselves confer a license. A legal license is granted (typically by examination) and exercised locally; while the Law Degree can have local, international, and world aspects- e.g. in Britain the Legal Practice Course is required to become a British solicitor [ 1 ] [ 2 ] or the Bar Professional Course (BPTC) to become a barrister. The first academic degrees were all law degrees- and the first law degrees were doctorates. The foundations of the first universities in Europe were the glossators of the 11th century, which were schools of law. [ 4 ] The first European university, that of Bologna. was founded as a school of law by four famous legal scholars in the 12th century who were students of the glossator school in that city. the Sunday law refers to a statute regulating or prohibiting commercial activity on Sundays. Although Sunday laws were formerly common, they have declined since the 1980s, when many courts held them invalid because of their origin in religion because Sunday being the Christian Sabbath. Sunday laws are also known as Sunday-closing law, or Lord s Day Act.

The Sunday law is justified, not by religious dogma, but as a sanitary measure and as a legitimate exercise of the police power. The law proceeds upon the theory, entertained by most of those who have investigated the subject, that the physical, intellectual, and moral welfare of mankind requires a periodical day of rest from labor and, as some particular day must be fixed, the one most naturally selected is that that is regarded as sacred by the greatest number of citizens and that by custom is generally devoted to religious worship, or rest and recreation, as this causes the least interference with business or existing cust ... What is Education Law?

Education Law is the area of law that relates to schools, teachers, and the rights of Americans to a public education, as well as standards for those students who attend private schools.

American Right to Education

American laws mandate that every child be given the opportunity to an education. Each state has its own school system, and as a result, there are very different laws among the various states with regard to management of schools, teachers, and funding for public education. However, they are all overseen by the federal government through the Department of Education.

Equal Education Opportunities

There is a strong emphasis on providing equal opportunities for education. This includes both to minorities and historically disadvantaged groups, as well as to those with disabilities. The Equal Education Opportunities Act of 1974 provides that no state can deny an equal opportunity to educat ... Read more »

The laws governing abortion are the most controversial in the United States today. The disunity among states regarding these laws, particularly those that define a legal abortion, reflects society s conflicting views toward abortion.

Abortion laws, as treated here, contain three main parts: a definition of an illegal abortion, a definition of a legal abortion, and a section dealing with consent and/or notice. There are also sections dealing with the penalties for violating the laws, residency requirements, waiting periods, and abortionists licensing requirements. These sections are impossible to compare. Because the Supreme Court through inconsistent rulings has caused the laws regulating abortion to be so unsettled, many state legislatures are not enacting any legislation pending the outcome of various lawsuits and federal legislation. Therefore, waiting periods, spousal notification, and other particulars mentioned below are not separately treated because the Cour ... Read more »

Employers have the option to offer benefits for short- and long-term disability income insurance, according to the Michigan Department of Energy, Labor and Economic Growth. These incomes are designed to pay employees enough to cover living expenses. Most short-term policies include a waiver of premium, where a patient's insurance premium costs are covered during short-term disability. Also, policies often contain an elimination period, which is a period of time that a patient must wait before he can claim disability benefits. In order to qualify, patients must remain totally disabled during the elimination period. The time of an elimination period is established by the policy.

A civil case is a legal case involving civil law or common law. which involves disputes between individuals or organizations in which some form of compensation may be awarded to the victim. Criminal law, on the other hand, involves cases in which the state is against an individual as the individual has broken the state's laws. A civil case may also be referred to as civil action. civil proceedings, or a civil suit. Civil cases are almost exclusively intended to correct private issues such as breaches of contracts or various negligence issues. Public issues that affect individuals and the functioning of society as a whole are typically handled in criminal court.

The idea of punishment in a civil case is usually much different than in other legal cases. In criminal law, individuals are punished through time in jail or in prison. Sometimes they are required to pay a fine and in some particularly extreme cases they are executed. In a civil case, on the other hand, an individual ... Read more »

The distance online MBA is a part-time MBA format, and one that is largely undertaken by students who wish to remain in their current role while they study. Employer-funded candidates will make up a certain proportion of each class. However, the majority of students will be self-funded candidates who have taken the initiative to pursue an MBA, but who cannot afford to forego their salary or to relocate – or simply do not wish to.

Yet, this is where the real appeal of an MBA online becomes apparent. While traditionally, a part-time MBA candidate would be limited to schools in their local area, they can now choose to study at any one of a solid selection of highly-respected international business schools, enjoying the benefits of the school’s network, access to world-class faculty and – of course – the ability to put a prestigious, globally-recognized school on their resume.

Trinity Law School is one of five law schools in the United States that teach law from a Christian perspective. It is the only one of the five schools that is a California Bar Examiners approved law school. It was founded in 1980 as Simon Greenleaf School of Law. The Juris Doctor degree (J.D.) is conferred upon law students who pass a three-year J.D. program. In the United States, the degree usually requires at least three years of full-time coursework, and some schools offer part-time evening programs to accommodate working professionals.

The common coursework includes family law, criminal law, tax law, constitutional law, contract law, torts, civil procedure, and business law. Most schools offer a focused "track" program allowing law students to selectively focus on a particular field of law. These elective courses may be taken only after the mandatory coursework is completed. Typically, this is accomplished during the third year of law school. Most schools have legal clinics that offer focused instructional training combined with some real-word applications.

To obtain a law degree or J.D. you must have received a four-year undergraduate degree, and pre-law classes are not required. Most states require that practicing attor ... Read more »

Russian oligarchs' taste for British justice helped London lawyers rake in a record-breaking 5bn of profits last year.

When the lawyers have totted up all the hours spent on the four-month long High Court battle it is expected to rank among the most expensive cases to have been fought in London courts. And Abramovich vs Berezovsky is just one of a slew of oligarch battles making their way through London's legal system, and turning the lawyers involved into multi-millionaires.

Mark McAteer, national editor of Legal Business magazine, said the Russian legal battles have helped push the profits at top 100 law firms in the Capital to more than 5bn for the first time ever.

Litigation for Russian clients has been a massive source of revenue for a number of firms – both big firms and boutique firms, he said.

Asked by mirifique ( 1511 ) May 26th,

The conventional wisdom 2 3 years ago (e.g. the Wall Street Journal law blog, various blogs, advice from law students, etc.) appeared to be that if you went a to third tier law school, you d need to dramatically lower your expectations in terms of starting salary (i.e. get comfortable with $(40 )50 60k instead of $90 100k) and job prospects (i.e. rely more on networking through clerkships than on-campus recruiters; take temporary contract review jobs for a while). A year ago, as BigLaw firms started to lay off thousands of associates, conventional wisdom seemed to hold that if you have any other career prospects, you should look to those before turning to law school. This question aims to gather conventional wisdom and speculation from law applicants, students, and graduates alike, specifically as such wisdom and speculation pertains to the general (acknowledging that one s prospects will vary according to grad ... Resources for researching Federal and state whistleblower laws are listed below.

Whistleblower laws make it illegal for employers to retaliate in any way against employees who:

  • Report employers' violations of whistleblower laws to the proper authorities
  • Refuse to engage in activities made unlawful by whistleblower laws
  • Participate in legal proceedings under whistleblower laws

Retaliation provisions typically include protection from discharge and harassment, and allow victims to file lawsuits for damages. See an attorney about suing for either.

Not every law with employer retaliation protection provisions has the word whistleblower in its title. Many have such provisions regardless of their titles.

An example is the Sarbanes-Oxley Act of 2002 (SOX). a landmark whistleblower law that provides unprecedented protections for corporate whistleblowers.

Collectively, the laws with such provisions are ... Read more »

In law, a lawsuit is a civil action brought before a court in which a party (plaintiff) has claimed to have received damages from a defendant's actions, the plaintiff, seeks a legal or equitable remedy. The defendants are required to respond to the complaint of the plaintiff. If the plaintiff is successful, judgment will be given in the plaintiff's favor, and a range of court orders may be issued to enforce a right, award damages, or impose an injunction to prevent an act or compel an act. A declaratory judgment may be issued to prevent future legal disputes.

A lawsuit may involve dispute resolution of private law issues between individuals, business entities or non-profit organizations. Touro College claims an online-only school is turning out graduates with phony law degrees, according to a lawsuit.

Marshall Islands-based Novus University Law School “engaged in false, deceptive, misleading and unfair practices by representing itself to be a bona fide foreign law school,” Touro claims in Manhattan Supreme Court papers.

Touro — itself once embroiled in a grade-changing scandal — says Novus collected tuition from students but “conferred worthless law degrees,” according to court papers filed last week.

Authorities in Texas and Oregon have already declared law degrees from Novus invalid, and Touro is asking a judge to declare the school a diploma mill.

“Novus graduates often apply and are erroneously accepted to American Bar Association-accredited programs,” Touro charged.

Touro said it made the discovery when it became embroiled in “meritless litigation” involving Novus, which did not respond to messages seeking comment.

The Canada Labour Code includes provisions that protect the health and safety of workers on the job. The bedrock of Canadian health and safety law are three fundamental rights. First, employees have the right to refuse to perform dangerous tasks at work, without fear of reprisal i ... Read more »

The majority of law schools require a bachelor's degree for admission, but you don't need any particular major. You can take a traditional pre-law major, such as English or history, or study whatever interests you, such as music or engineering, according to the American Bar Association. Undergraduate classes that will help you in law school include English, speech, economics, government and philosophy. Most law school admissions offices also require scores on the Law School Admission Test .

A doctorate in law doesn't immediate qualify you to represent clients. Every state requires law school graduates to pass bar exams before they can practice law. The requirements vary, but many states require two-day written exams, with follow-up oral testing of those who pass. During the oral exams, you must show your competence and demonstrate the character needed for a lawyer. If you move to a different state, in many cases you must pas ... Read more »

Rental car laws vary from state to state, so it is important to understand the laws that apply to the state you are planning to visit and rent your car in.

It almost goes without saying that all drivers who will be driving the rental car will need a valid driver's license. This does not include learner's permits. Foreign nationals may use their international driver's license, if they have one. If you wish to use your license from your home country, you will most likely also need to produce your passport and additional identification. Make sure to check with the rental company before you arrive in order to make sure you bring what you need.

In New York, anyone over the age of 18 may rent a car, as long as they have a valid driver's license and insurance. Any extra costs for insuring you as a younger driver may be passed to you in the price of the rental itself as car rental companies are permitted to charge different rates depending on the age of the person renting th ...
