#Transportation Safety Occupant Protection

Click It or Ticket-Enforcement

Oregon’s safety belt overtime enforcement program is a statewide selective traffic enforcement program (STEP) that seeks to reduce the number of motor vehicle-related deaths and injuries by increasing public awareness of laws regarding the three most prevalent factors contributing to traffic crash injuries: safety restraint use, speed, and impaired drivers. Over one hundred city, county and state police agencies utilize safety belt overtime during three two-week “blitz” periods annually. ODOT's Transportation Safety Division provides scheduling and instructional materials to participating agencies prior to each blitz. Participating agencies are asked to conduct public awareness/media activities during the weeks prior to and following each blitz. Observed belt use rates, number of enforcement contacts, and public information activities measure Campaign success. Officers are encouraged to acquire adva ... Read more »

Definition of Law. Part 4 to blupete's Essay

Is it not my design, at this place, to show what stands as law; but, rather my aim is to develop ideas on what law is.6 Law is a "rule of conduct imposed by authority. The body of rules, whether proceeding from formal enactment or from custom, which a particular state or community recognizes as binding on its members or subjects." Upon considering this definition (OED), the first question that arises, is: "On whose authority?" Prior to the 18th century it was on the authority of a divinely appointed king; during the 18th and 19th centuries in England it was on the authority of the landed aristocracy;7 in the 20th century it has been the people, in fact, I submit, the politicians who "manage" to get themselves elected8 ; now, as we enter the 21st century, it's hard to say whose in charge, maybe no one, and maybe, that's the way it ought to be.

For a further development of these ideas, it will be necessary for a person to un ... Read more »

#Trademark Legal Basics

What is a trademark?

A trademark is a word, slogan, symbol, design, or combination of these elements, which identifies and distinguishes the goods or services of one party from others. The word trademark or trademark law is frequently used generically to encompass similar identifiers of origin such as service marks, collective marks, certification marks, trade dress, and trade name.

What is the purpose of trademark law?

The primary purpose of the trademark laws is to prevent unfair competition by applying a test of consumer confusion and providing rights and remedies to the owner of the trademark.

The test for consumer confusion is to assure that the consumer can be confident that when buying a product or service bearing a particular trademark the product or service expected is actually delivered. In other words, the consumer relies on a standard of quality established by the association of the trademark in the marketplace ... Read more »

#Towards Global Sunday Law

Three Jewish men, Shadrach, Meshach, and Abednego, chose to follow their consciences, standing up against the king and his edict. Thus began a standoff that remains famous even to this day (see Daniel 3 ).

Unfortunately, we are seeing the same situation repeating itself today.

The Pope is calling for the world to acknowledge and honor Sunday as a day of rest. Legislation that will force the world to worship and rest on Sunday would be the ideal solution. There are many voices clamoring to fulfill exactly such a goal, using the economy, the environment, and even the family as reasons to legislate Sunday rest.

Another standoff is on the horizon. Those who refuse to give up the Biblical seventh-day Sabbath will face trials as tough as the furnace faced by Shadrach and his companions. However, we can hold fast hope, knowing that the God who spared the Israelite men from the fiery fur ... Read more »

Privacy Law in the USA

Copyright 1997 by Ronald B. Standler

Index

1. What is Privacy?

Privacy is the expectation that confidential personal information disclosed in a private place will not be disclosed to third parties, when that disclosure would cause either embarrassment or emotional distress to a person of reasonable sensitivities. Information is interpreted broadly to include facts, images (e.g. photographs, videotapes), and disparaging opinions.

The right of privacy is restricted to individuals who are in a place that a person would reasonably expect to be private (e.g. home, hotel room, telephone booth). There is no protection for information that either is a matter of public record or the victim voluntarily disclosed in a public place. People should be protected by privacy when they "believe that the conversation is private and can not be heard by others who are acting in an lawful manner." Am.Jur.2d Telecommun ... Read more »

    Patients Say Manufacturers Misled Them

Women who filed transvaginal mesh lawsuits allege that mesh manufacturers "had a legal duty to ensure the safety and effectiveness of their pelvic mesh products," but instead provided patients with "false and misleading information" about the products’ effectiveness and safety.

Judy Conlin of Corbin, Ky. had mesh products from Boston Scientific and Ethicon implanted to treat prolapse and incontinence in July 2011. Judy and her husband, Timothy, filed a lawsuit against both mesh manufacturers.

The Conlins' lawsuit claims the defendants failed to warn, are guilty of fraud and concealed that their products could cause permanent and debilitating injuries.

Other lawsuits accuse mesh manufacturers of several counts, including:

Legislation enacted by the federal and various state governments to regulate trade and commerce by preventing unlawful restraints, price-fixing, and monopolies; to promote competition; and to encourage the production of quality goods and services at the lowest prices, with the primary goal of safeguarding public welfare by ensuring that consumer demands will be met by the manufacture and sale of goods at reasonable prices.

Antitrust law seeks to make enterprises compete fairly. It has had a serious effect on business practices and the organization of U.S. industry. Premised on the belief that free trade benefits the economy, businesses, and consumers alike, the law forbids several types of restraint of trade and monopolization. These fall into four main areas: agreements between or among competitors, contractual arrangements between sellers and buyers, the pursuit or maintenance of Monopoly power, and mergers. The Sher ... #Tree house tests limits of Sullivan - s Island zoning laws - Post and Courier

Hal Coste measures the height of the tree house he built in his Sullivan s Island backyard. Wade Spees/Staff

SULLIVAN S ISLAND Hal Coste hopes to finish a tree house for his grandkids, but so far the town won t let him. In fact, the project may have to come down, he said.

He faces a possible $1,040 fine at an Aug. 3 municipal court hearing after being charged with violating a town order to stop work on the play house that he has been building in a backyard pecan tree.

The tree house is an accessory structure, zoning officials said, which by law can be up to 15-feet high. The 96-square-foot structure is 14 feet from floor to roof but the town measures height from the ground, which means the tree house is officially 30 feet tall because it is 16 feet from the ground to the floor of the tree house.

The system of law that has developed in England from approximately 1066 to the present.

The body of English law includes legislation, Common Law. and a host of other legal norms established by Parliament, the Crown, and the judiciary. It is the fountain from which flowed nearly every facet of U.S. law during the eighteenth and nineteenth centuries.

Many of the concepts embodied in the U.S. Constitution such as the separation and delegation of powers between three branches of government and the creation of an elective national assembly representing the will of the people trace their roots to English law. Fundamental legal procedures applied in the U.S. civil and criminal justice systems also originated in England. The jury system, for example, slowly matured into its modern form over several hundred years of English history. The antecedents of many substantive areas of U.S. law, including the ubiquitous system of state and federal taxation, may be found in Engl ... Read more »

Yesterday was daylight savings day, which means that you are probably running about your job this morning a little more groggy because you lost an hour of sleep. As I was waffling through emails today in my own groggy state, I received an alert about a new area code being added to the Nashville, Tennessee area.  Naturally, I thought about bid day .

What about bid day? Think about how technology has improved all aspects of the construction industry.  Think about how we deal with electronic drawings. Think about how we communicate between the project site and the home office.  And think about how we transmit proposals on bid day by fax and email.

But technology does not solve all problems. Sometimes, problems with technology create their own problems.  For example, in Federal Acquisition Services Team, LLC (pdf), B-410466, December 31, , the government contractor challenged an agency s decision not to consider its proposal tha ... #Two-year law degree for graduates - University of Leicester

    Posted by mjs76 at May 19, 2011 02:00 PM | Permalink

Have you considered a career in law? The University of Leicester School of Law is one of a just a handful of universities that offers a fast track two-year LLB law degree for graduates. In the recent Guardian rankings, we were placed 15th out of 95 Law Schools.

LLB Law degrees can lead to the Legal Practice Course (LPC) which is required if you wish to be a solicitor, or the Bar Professional Training Course (BPTC) which is required if you wish to be a barrister. The LLB degree is also of value to international students who wish to pursue a legal career as it is recognised for entry on to equivalent courses in countries such as Canada.

In order for a law degree to be classed as 'qualifying' and allow entry on to the LPC, BPTC or equivalent, it must contain a number of compulsory 'professional exemption subjects'. The traditional three-year LLB Law ... Read more »

Let's be clear: in this market, the "best" law firm is the one that will employ you. If you have a job, congratulations, you're number one. But the methods for evaluating the large law firms that are best at the business of practicing law are stuck in the past. The new normal means new challenges for firms. Is bigger always better? More revenue sounds nice, unless the firm is overly reliant on a few rainmakers who can jump ship and leave the rest of the firm scrambling for clients. Surely, the last client who cared about white-shoe status is somewhere trying to find a new ribbon for his typewriter.

The Power 100 blends objective data points (changes in headcount over time, “homegrown” partners, and number of women partners) with subjective feedback from over 20,000 associates, partners, and other members of the legal community. The result is a more complete picture of each firm, encompassing employee satisfaction, compensation, reputation, desirability as an employer, and da ... Read more »

A distinction between single-firm and multi-firm conduct is fundamental to the structure of U.S. antitrust law, which, as noted antitrust scholar Phillip Areeda has pointed out, "contains a 'basic distinction between concerted and independent action.'" [ 2 ] Multi-firm conduct tends to be seen as more likely than single-firm conduct to have an unambiguously negative effect and "is judged more sternly." [ 3 ] European competition law also includes a fundamental distinction between single-firm and multi-firm conduct, but a different analytical structure is applied. In U.S. antitrust law, the Sherman Act addresses single-firm conduct by providing a remedy against "[e]very person who shall monopolize, or attempt to monopolize. any part of the trade or commerce among the several States." [ 4 ] This prohibition does not condemn monopoly per se but only monopoly that has been acquired or maintained through prohibited conduct: Most businessmen don't like their competitors, or for t ... #Types of Law Degrees and Legal Studies Degrees

    Essential Information

Students who want to practice law in the United States can enroll in a Juris Doctor degree program and complete it after three years of full-time study.

Three main types of law degrees are available in the United States. The first law degree is the Juris Doctor (J.D.), and it qualifies graduates to practice law in the U.S. The second law degree is the Master of Laws (LL.M.), and the third degree is the Doctor of Juridical Science (S.J.D.).

Some J.D. programs may be combined with other master's degree programs in specific facets of law, business or public policy, and these programs might last longer than three years. The first year of study focuses on basic topics, like international law, criminal law and civil procedure. Second- and third-year students may customize their education to reflect their interests, taking electives in such areas as tax and business.
