A common law right exists even when no law has been passed by a legislature to establish that right. The right exists because the courts of the common law jurisdiction have recognized it. A number of rights were recognized at common law, but in the US, in , the term common law is often associated with common law marriage. Common law principles also govern certain aspects of US trademark law.

The term common law refers to legal precedent that has been developed in a court system, rather than through legislative action. In a common law system. cases are decided based on past court decisions. This kind of system developed in England and has greatly influenced the legal systems of countries, including the US, which were once governed by Great Britain. Common law rights, as a general rule, do not exist outside these countries.

One of the most frequent examples of a common law right arises from common law marriage. This is the relationship that arises when a couple lives t ... Read more »

Child support laws direct the non-primary residential parent to pay child support. Child support may be paid through the state or directly to the primary residential parent. Child support is to be used for food, clothing and housing for the minor children.

If you do not pay your child support, there are several consequences, depending on the state you are in. In some states, you may lose your license, serve jail time and, in all states, you are required to pay arrearages. Some states will allow you to pay the arrearages in payments, if you have a legitimate reason for not paying. Legitimate reasons are generally defined by the courts on a case-by-case basis.

Child support is court ordered and the time the child support starts depends on whether your spouse has petitioned for child support in the petition for dissolution of marriage, or if your spouse filed a separate motion for child support. Separate motions can be filed against you and once a hearing is held, you m ... Read more »

According to Newton s first law, an object in motion continues in motion with the same speed and in the same direction unless acted upon by an unbalanced force. It is the natural tendency of objects to keep on doing what they re doing. All objects resist changes in their state of motion. In the absence of an unbalanced force, an object in motion will maintain its state of motion. This is often called the law of inertia .

The law of inertia is most commonly experienced when riding in cars and trucks. In fact, the tendency of moving objects to continue in motion is a common cause of a variety of transportation injuries - of both small and large magnitudes. Consider for instance the unfortunate collision of a car with a wall. Upon contact with the wall, an unbalanced force acts upon the car to abruptly decelerate it to rest. Any passengers in the car will also be decelerated to rest if they are strapped to the car by seat belts. Being strapped tightly to the car, the p ... Read more »

The Occupational Safety and Health Act became federal law in 1970 when members of Congress passed it to facilitate increased safety in the workplace. An immediate effect of the legislation was the creation of two new federal entities: OSHA in the United States Department of Labor and the National Institute for Occupational Safety and Health under the Centers for Disease Control Prevention. While OSH, and therefore OSHA, covers many federal agencies, it does not apply to farms operated by families, local and state government agencies, self-employed individuals or any business under the jurisdiction of federal laws besides OSH.

The primary law that OSHA enforces is OSH, along with numerous regulations related to everything from longshoring guidelines to record keeping to workplace inspections. To pursue its agenda and persuade employers to remain in conformity, OSHA also has the ability to exact penalties for violations of employees' rights and, consequently, its standards.

If you re one of millions of Americans considering going back to school (or if you re going to school for the first time) you face not only an exciting decision, but a daunting one as well. There are hundreds of degrees and fields out there, and trying to decide on one can be confusing, to say the least. We ve put together a guide to the different types of college degrees and what they mean, but before you get started, here are a few things to think about:

  1. What level of degree do you need? Make sure a given college degree program is tied to a specific career goal. For example, if you want to become a public school teacher, you need a teaching certificate.
  2. Do you meet the program s prerequisites? Many types of degree programs, especially the more advanced ones, require you to hold previous degrees or qualifications. No matter how nicely you ask, an MSN program will not admit you unless you have a practical nursing degree.

Even if his opponents conceded that Abraham’s life was characterized primarily by faith, Paul knew that they still would have questions about why God gave the law to Israel about four centuries after Abraham. Did not the giving of the law nullify any previous arrangement?

What is the point of Paul’s analogy between a person’s final will and testament and God’s covenant with Abraham? Gal. 3:15–18 .

A covenant and a will are generally different. A covenant is typically a mutual agreement between two or more people, often called a “contract” or “treaty”; in contrast, a will is the declaration of a single person. The Greek translation of the Old Testament, the Septuagint, never translates God’s covenant with Abraham with the Greek word used for mutual agreements or contracts (syntheke ). Instead, it uses the word for a testament or a will (diatheke ). Why? Probably because the translators recognized that God’s covenant ... Read more »

THE LAW OF INERTIA

T he law of inertia states that:

A body will preserve its velocity and direction so long as no force in its motion's direction acts on it.

For example : a package thrown out of an airplane will continue to move at the speed of the airplane on the horizontal axis (in the direction of the airplane's movement). Since the law of gravity acts on the package (a vertical downward axis), the package will gather speed along the vertical axis, but on the horizontal axis its speed will remain equal to that of the airplane.

(In this explanation we have left out the force of air-resistance).

The law of inertia is the basis of the new physics of the seventeenth century. This law is also true according to modern physics. Galileo discovered the law during the first decade of the seventeenth century, but in fact he did not understand the law in the general way we have formulated it here. The general formulation of th ... Read more »

Some civil lawyers handle civil rights cases. These are cases in which an individual -- or group, for class action lawsuits -- believes that her basic human rights have not been respected. Examples include seeking damages for unlawful police searches, or discrimination in housing, employment or education. People can feel that their right to privacy is violated during unwarranted searches or that they were denied opportunities to get a job, a residence, or go to a school because of certain characteristics.

Personal injury law is an enormous legal field encompassing many different types of harm. Essentially, personal injury lawyers can assist you when you are harmed through the negligence, recklessness or carelessness of another party. Common practice areas include slip and falls, car and truck accidents, mass transportation accidents, medical malpractice and dog bites. These attorneys help you seek compensation for medical bills incurred, time lost at work, loss of consortium ... Read more »

ERISA

Health Plans Benefits

The Employee Retirement Income Security Act of 1974 (ERISA) is a federal law that sets minimum standards for most voluntarily established pension and health plans in private industry to provide protection for individuals in these plans.

ERISA requires plans to provide participants with plan information including important information about plan features and funding; provides fiduciary responsibilities for those who manage and control plan assets; requires plans to establish a grievance and appeals process for participants to get benefits from their plans; and gives participants the right to sue for benefits and breaches of fiduciary duty.

There have been a number of amendments to ERISA, expanding the protections available to health benefit plan participants and beneficiaries. The Fair Work Commission's new powers to hear workplace bullying complaints took effect from 1 January , spotlighting the obligation on employers to ensure appropriate measures are in place to reduce or eliminate the risk of workplace bullying and respond to complaints by workers.

Measures to reduce or eliminate bullying are however not just about the risk of a claim being made to the Commission.

The Productivity Commission has estimated the total cost of workplace bullying in Australia to be between $6 billion and $36 billion a year.

The number of bullying complaints to work health safety regulators is also increasing around 5,000 to 6,000 complaints a year are made in New South Wales and Victoria respectively.

It is also clear that the number of bullying-related workers' compensation claims (often for psychological injury) is rising. Safe Work Australia reports a 70% increase in the number of national workers' compensation claims for bullying over t ... Read more »

Ohio s gun laws are comparable to nearly half of the other American states and are designed to give law-abiding citizens the opportunity to bear arms after going through the appropriate application process and obtaining the proper permits.

In some instances, out-of-state visitors can carry firearms as well, although a significant amount of homework should be conducted before a person packs his or her bags for the Buckeye State.

To date, Ohio has concealed carry handgun reciprocity agreements with nearly half of the 50 American states. States and cities set their own mobile home park laws, and these laws are usually separate and distinct from existing landlord-tenant laws. Mobile home park laws address issues such as the responsibilities of both park owners and residents, as well as the circumstances under which a part tenant can be evicted. Eviction laws for mobile home parks are often stricter than those for tenants living in rental homes or buildings, as it can be very difficult to move a mobile home once it is installed at a mobile home park.

Grounds for eviction from a mobile home park can be far more limited than the grounds for eviction from other types of housing. If you own your mobile home, the owners of your park usually can evict you only if you repeatedly violate park rules or fail to pay your rent for an extended period. Another circumstance under which you can be evicted is if the park owner plans to sell the park or to use the land for another project or business. In addition, your mobile h ... Read more »

Law school can seem like a daunting challenge. Many aspire but few actually accomplish the goal.

As more and more online law school options emerge, though, that trend may change a bit. Online schools are becoming a very popular way to accomplish the education mission and there's no reason to think law schools too won't tailor their programs to accommodate this rapidly growing new market of perspective students.

It may be a challenge to find an online law school that offers the entire spectrum of classes via the internet but looking for a law school that offers even some of its classes via the internet can make it much easier for many perspective attorneys to pursue their educational goals. When schools offer some of their coursework online, they encourage students to blend this modern way of learning with the more traditional, classroom-based, way of learning.

Choosing an online law school versus the more traditional campus-based law school might depend upon ... Read more »

When in doubt, some of the schools contact the State Bar of California and request an evaluation of a prospective student s pre-legal education to determine their eligibility for the program.

Graduation from a California law school will make you eligible to sit for the California State Bar Exam. Once you pass the bar exam in California, law school graduates can work in federal courts in any state. You can also work as In House Counsel with corporations, arbitrator or mediator, law professors or with federal agencies such as Homeland Security, IRS, EEOC, DHS, Social Security and the Justice Department. The first step of the eviction process in Kansas is the delivery to the tenant of what is called a three-day notice. The notice advises the tenant that she must correct a lease violation or vacate the premises within the three-day period of time set forth in the notice. For example, if the notice is provided because the tenant failed to pay rent, she must pay the rent due and owing within the three-day period or move out of the property. If the tenant fails to comply with the provisions of the three-day notice, the landlord has the legal right under Kansas law to pursue an eviction lawsuit.

The second phase of the eviction process in Kansas is a forcible detainer case. Forcible detainer is an eviction lawsuit in the state of Kansas. A forcible detainer case is filed in the county or district court in the county where the rental property is located. The case is filed pursuant to the provisions of the Kansas limited actions law, found at Kansas Statutes Annotated, Chapter 61. ... Read more »

In a victory for the news media, the Supreme Judicial Court today sided with the Quincy Patriot Ledger and ruled that the affidavit filed by police in support of a search warrant should be open to the public.

The case involved a State Police investigation into allegations that a prominent Quincy real estate developer, William O Connell, had engaged in unlawful sexual relations with a minor. Shortly after police executed the warrant, a Quincy District Court judge impounded the affidavit.

The Patriot Ledger intervened in the criminal case to seek access to the impounded affidavit. Ruling that the document was presumptively public, the District Court judge lifted the impoundment order. Prosecutors and O Connell both appealed.

In its decision today, the SJC noted that there is a longstanding presumption in favor of public access to search warrants and supporting materials. While a judge may restrict access for good cause, impoundment should be used only in limite ... Read more »

In Europe, each country is left to devise its own employment protection system, and each country has slightly different laws. France, for example, has a written Labor Code and other enforceable rights that protect employees from harmful situations, while the United Kingdom has no written labor law, but does hold specialist employment tribunals as part of their court system to help solve any employee's concerns. China requires the majority of the workforce to be under contract with employers, which makes it next to impossible for an employer to fire an employee; this form of employment law states that unless an employee has broken a rule or regulation, the contract must be upheld as stated. Also, to help avoid employees working too many hours, China does not usually have salary -paid employees, but instead generally offers only 40 hour work weeks, with paid over-time when necessary.

Under the FMLA, workers in Arizona are entitled to unpaid leave for family or medical reasons if they meet certain conditions. They must have worked for the same employer for a minimum of 1,250 hours during the previous year and they must work for a non-exempt employer, which is any state, federal or city government or agency, or any private employer with 50 or more employees involved in interstate commerce.

The maximum length of FMLA leave time is 12 weeks in a single 12-month period. This leave time is expanded for military caregivers.

Military caregiver leave, while also part of the FMLA, is offered a bit differently than regular leave. This leave is offered to employees who need to care for a spouse, child, parent or next of kin who is also a military member on active duty or on call to active duty. Employees must meet the same basic eligibility requirements but receive a longer unpaid leave time of 26 weeks, as opposed to 12 weeks.

MFY’s Mental Health Law Project serves over 1,600 people each year, enabling people with mental illness to remain in the community.

Mental health consumers, no less than other populations, regularly face legal battles to maintain housing, secure an adequate income, and live with the full dignity and civil rights to which they are entitled. For persons struggling with severe mental illnesses, these legal battles are another stressor that can ultimately lead to deterioration of mental health status, hospitalization, and homelessness. By providing civil legal assistance to mental health consumers, MFY stands as a bulwark against crisis – preventing homelessness, loss of income and loss of civil rights so that mental health consumers can maintain stability within their chosen community.

MFY was in the vanguard when it first established its Mental Health Law Project in 1983, partnering with outpatient mental health providers throughout New York City and with 11 New York C ... Read more »

The law of one price is a theory in economics that identical goods should be priced the same, after accounting for the exchange rate, in different countries as long as the market is efficient. When the prices differ and people take advantage of arbitrage opportunities, their actions push the prices to converge, balancing them out in the end. Radically differing prices are an indicator of market inefficiency or peculiar circumstances.

According to the law of one price, buyers will seek out the lowest price, while sellers look for the highest price, and because the two must meet in the middle, prices, especially on financial markets, should be similar. Stocks trading in one market should trade for a similar price in another market, for example. If people are aware of different prices in another market, they will gravitate towards the prices most favorable to their interests. Elderly people are often dependent and defenseless. As a result, they are often mistreated by those who are supposed to care for them. Elder abuse law is legislation designed to protect the elderly and to punish those who are guilty of mistreatment. In the United States, the problem and the laws are taken very seriously. All states have a body of elder abuse law.

Although elder abuse laws do apply to the actions taken in these facilities, the laws also cover a wider range. In-home care professionals, medical facilities, and family members can also be regulated by these laws.

A person or facility can be liable for neglect if it can be proven that an elderly person in its care suffered. In mo ... Read more »

Becoming an attorney through an online law program is possible, but it's also complicated. Blend Images - Jon Feingersh / Brand X Pictures / Getty Images

Would you like to earn an online law degree from the comfort of your own home? It’s not easy, but it is possible. Earning an online law degree poses several unique challenges. No online law school is accredited by the American Bar Association (ABA); however, forty-nine states require that law school graduates earn a degree accredited by the ABA in order to take the bar exam needed to practice law.

California is the one state that allows graduates from distance learning law schools to sit for their bar, assuming the examinees meet certain requirements. If you live in California, or if you’re willing to relocate, you may be able to become a practicing lawyer with an online law degree. After you work as a lawyer for a few years, it may be possible to practice law in some other states. Here’s what you need to know:

TTT officially stands for Third Tier Toilet, which is the Third Tier in the US News Rankings. TTT is also applied to the Fourth Tier or any non-ABA schools. In general, these schools are said to have lower prestige and worse career prospects.

Since we are talking about TTTs, it wouldn't hurt to talk about another popular term: Top Tier. Top Tier is usually referred to as Tier 1 law schools in the US News. Many law schools (on their websites) refer to themselves as Top Tier if they are in Tier 1 (ranked 1-50 in the US News).

Some elitists also like to refer to the Top Tier as Top 10, Top 14, Top etc. It really depends on who you talk to. Most people like to include their own school in the Top Tier. For example, a ND Law grad may refer to the Top Tier as T25 or a Columbia Law grad may view it as the Top 10, while Georgetown Law grad Top 14.

The MBA program at any school in the United Kingdom may be a good option for international students. The prestigious universities of Oxford and Cambridge lead the way, but there are many smaller schools with quality programs for those seeking to excel in the global business community.

One great advantage of most UK schools to many international students is that they accept a three-year bachelor’s degree. And an MBA can be earned in one year instead of the two years required at most schools in the United States.

Various degrees in countries such as India, the Bachelor of Arts(BA), Bachelor of Science (BSc) and Bachelor of Commerce (BCom), are all three-year programs. In some countries, these degrees are not recognized as equivalent to the four-year bachelor’s degrees issued there. However, the UK will often accept these as equal to an Ordinary British Bachelor Degree.

In some cases one will need to have graduated with Honors for the three-year degree to be acc ... Read more »

A person's estate is made up of all the property owned by them -- individually or in partnership with one or more others -- at the time of their demise and includes the following:

  • any debts owing at the time of death

If the deceased owned a business, his or her interest in that enterprise would also be included in the estate. The business interest is made up of any real estate owned by the business, equipment, tools, accounts receivable, and goodwill built up while the business was operating.
