#IHL and human rights law
29-10-2010 Overview
International humanitarian law and international human rights law are two distinct but complementary bodies of law. They are both concerned with the protection of the life, health and dignity of individuals. IHL applies in armed conflict while human rights law applies at all times, in peace and in war.
Both international humanitarian law and human rights law apply in armed conflicts. The main difference in their application is that international human rights law allows a State to suspend a number of human rights if it faces asituation of emergency. IHL cannot be suspended (except as provided in Article 5 to the Fourth Geneva Convention).
However, a State cannot suspend or waive certain fundamental rights that must be respected in all circumstances. These include the right to life, the prohibition of torture and inhuman punishment or treatment, the outlawing of slavery or servitude, the principle of legality and

Fix Mistakes
Check your credit report to make sure your credit score isn t being dinged unfairly. If creditors have cited you for late payments when you ve paid on time, write to the credit bureau where the erroneous entries appear and request an investigation. Each bureau has 30 days to complete its investigation in most cases and must remove the disputed item from your report if it can t find proof that the entry is valid. It may keep you from being able to refinance for a couple of months, but the difference fixing your report can make to your credit score may be worth the effort.
Keep Your Payments Current
If you have bad credit, it may be because you re in a financial pinch and delinquent on some of your obligations. Keep your car loan in good standing by making payments on time, even if it means being late on other bills. Lenders are more inclined to write a loan to a car owner who has

#Planned Parenthood mum on whether docs skirting law by altering abortion methods
Planned Parenthood is hitting back on claims clinics may be illegally selling fetal tissue, after an undercover video showed an official discussing how they collect fetal body parts. The tissue is donated for research, the group said, and they don’t profit from it.
But so far, Planned Parenthood hasn’t specifically addressed a separate question: whether their doctors actually alter the timing and method of abortions to get that tissue, which also would be illegal under federal law.
And that question may be a focal point as lawmakers on several congressional committees launch investigations into the group.
"I don't care how much political weight Planned Parenthood throws around this town. No one is above the law," Rep. Martha Roby, R-Ala. said Friday.
The video was secretly shot by the pro-life group Center for Medical Progress last year and released this week to the med

The Supreme Court of Canada, where the Dagenais ruling was laid down. Photo by Peregrine981.
Situations in journalism raise both legal and ethical questions. In many newsrooms, whether an action is legal is considered to be the first hurdle that any action must clear, before ethical issues are raised. Also, ethical standards such as fairness and accuracy are used in court cases to evaluate stories for libel and other legal problems.
How free is the Canadian press, legally?
From a legal perspective, the freedom of the press is guaranteed constitutionally by Section Two of the Charter of Rights and Freedoms. But the charter also states in Section One that fundamental freedoms in a democracy can be limited for justifiable reasons. Hence, press freedom is not absolute, legally.

In almost every study conducted, where law abiding citizens are allowed to be armed and there are lots of them, crime rates go down. Why does government not understand this? The truth is in most instances they do, at least the hardcore anti-gun crowd. They know exactly what they are doing.
However, I do believe there is a portion of the anti-gun crowd that are simply afraid of guns for whatever reason. I assume they are much like some people I know, in that they have never fired a gun, handled one, or actually been around people who responsibly carry a weapon. To them, I say, "Get over your fear, by gaining knowledge: first hand knowledge."
But getting back to the issue of government, in cities where there are strict gun control laws, crime increases. It's quite simple actually. The people with guns are either government or criminals. In some case, they end up being the same, as we have seen in recent months in regards to Chicago.

In general, these laws define a lemon as a new car which requires a certain number of substantial repairs within a certain period--either time or miles after purchase.
The Magnuson-Moss Warranty Act is called the Federal Lemon Law as applied to motor vehicles. The Magnuson-Moss Warranty Act provides the purchaser protections for all consumer goods that come with a written warranty. The Federal Lemon Law allows a consumer to collect attorneys' fees and costs of suit; however, the cost of filing and the jurisdictional threshold for damages make it more practical for most consumers to file initially under their state's Lemon Laws.

Three Jewish men, Shadrach, Meshach, and Abednego, chose to follow their consciences, standing up against the king and his edict. Thus began a standoff that remains famous even to this day (see Daniel 3 ).
Unfortunately, we are seeing the same situation repeating itself today.
The Pope is calling for the world to acknowledge and honor Sunday as a day of rest. Legislation that will force the world to worship and rest on Sunday would be the ideal solution. There are many voices clamoring to fulfill exactly such a goal, using the economy, the environment, and even the family as reasons to legislate Sunday rest.
Another standoff is on the horizon. Those who refuse to give up the Biblical seventh-day Sabbath will face trials as tough as the furnace faced by Shadrach and his companions. However, we can hold fast hope, knowing that the God who spared the Israelite men from the fiery furnace is coming again soon.

# The Basics of Buying Auto Insurance
Understanding Your Auto Insurance Deductibles
If you have ever had full coverage on a vehicle then you may be familiar with the term ‘deductible.’ In short your deductible is the amount of money that you will have to cover in the event you are in an auto accident.
Tips for Finding and Taking Advantage of Discounts on Auto Insurance

A MBA program can receive more than 4,000 applications a year.
Many MBA programs do not require a set of prerequisite courses prior to admission; rather, they require the newly admitted student to take these classes within the MBA program before beginning core coursework. A minority, however, do have prerequisite course requirements. For prerequisite requirements for a particular business school, you can visit that school's admissions criteria section on its website. Many schools require various forms of math, economics, and statistics as prerequisite courses. Many also require a marketing course and a management course. Schools that require math prerequisites generally require at least two semesters of calculus, and at least an introductory statistics course. Like the Kellogg School of Management -- rated the fourth best business school in the nation by Bloomberg as of -- many MBA programs require linear algebra, advanced econometrics and intermediate microeconomics. Comment: Immigration Saves US Demographics
The Washington Post points out that after the current recession ended, US birth rate has begun to climb-but the total fertility rate-i.e. number of children each woman has over lifetime is still only 1.858, far below the replacement rate of 2.1 children. This means that, without immigration, nation's population would be shrinking, and given the aging of the baby boomers, nation's workforce would be shrinking even faster, leading to unsustainable social burden and shrinking of the economy in the long run.
Opponents are right that immigration is tied to declining standards of living - but in exactly the opposite way they think. If we do not sustain our population and attract the best and the brightest to compete in the world we are in for rocky economic times and some serious demographic problems. Th

New York, still reeling from the attacks of September 11, is relying on the administration of Mayor Mike Bloomberg to help the city get back on its feet. Michael Cardozo, corporation counsel, is one man Mayor Bloomberg turns to when asking, "What's the right thing to do?"
Michael A. Cardozo '66 admits that he found the weight of his family's history at Columbia a bit daunting when he arrived at the Law School. He remembers, in particular, a class with "the great torts professor" Willis L.M. Reese .
"He would call on someone to talk about one of Benjamin Cardozo's cases," recalls Mr. Cardozo, "and he would say, Don't worry, we have Cardozo waiting in the wings to explain it.' I can still remember quaking in my seat."
You could say that law runs in the veins of the Cardozo family. Although Mr. Cardozo would not have predicted his current position as corporation

#Immigration Law
Immigration is the act of entering a country with the intent to permanently live and/or work there. United States immigration laws encompass a wide range of situations that involve a person from a foreign country coming to this country, whether for a temporary visit, or to live here permanently.
The American immigration system is set up primarily to grant immigration status based on factors such as family reunification, in-demand work skills, and capital investment. The immigration system also covers refugees and asylum seekers, and provides a "lottery" for immigration status to people who have less pressing immigration needs. The procedure for gaining legal immigrant status will depend upon, among various factors, which path you are eligible to pursue based on your employment, education, and family situation.
A Nation of Immigrants
Millions of men and women from around the world have immigrated to the United States. Indeed, immigrati

#Planning to study law at university? Read this first
Sponsored by:
Starting university is a milestone that marks the beginning of an important rite of passage into independent adulthood.
Having the freedom to eat baked beans on toast for breakfast, lunch and dinner means there is plenty to get excited about, but the transition from A-levels to doing a degree can be daunting.
Law is often seen as a difficult course, so for school leavers beginning legal studies, that small step can sometimes feel more like a giant leap.
For Eleanor Sheerin, studying law at university felt like a massive step up. The University of Warwick undergraduate, now in her penultimate year, says: A lot of people, including myself, felt quite spoonfed at school. You could previously get away with a lot of waffling and bluffing, but at university you can't do that.
A lot of areas of law, such as property and criminal, are very precise.

#no fault auto insurance
# An explanation of how no-fault car insurance claims work, and when a lawsuit may still be possible.
Most states follow the rule that if you are involved in a car accident and you are injured, then you have the option of bringing a claim for compensation against the negligent driver -- usually through that driver’s insurance company. In that situation, as part of the "third party claim" process, you must convince the other driver’s insurance company that its own insured was at fault for the car accident. Only then can you collect any damages for your injuries.
Proving the other driver’s fault to the insurance company can be a long and complicated process involving the submission of police reports, witness statements, photographs, and any other information or documentation the insurance company may require. Even after all of that, the other driver’s insurance company may still deny the claim, forcing you to file a lawsuit.

#applying for credit cards
#Apply for all on same day??
03-17-2010 07:44 PM - edited 03-17-2010 09:22 PM
I have a question that I'm sure has been asked here before but here goes. I plan on applying for a 2-3 credit cards and was thinking it would be better to apply for them all on the same day as my credit report wont be updated to the following day and the inquiries won't effect my score on that day as each of the creditors will not know that I recently applied for credit. I just paid down my utilization down to 20% and my experian score shot up to 741 (as per discover card credit monitoring) and thinking its time to add to my credit card portfolio. I really don't need the credit but like the peace of mind of having a cushion available. Had major credit problems 9 years ago (all off file) and its taken lots of hard work to get this far. I already have the following:
Only balance I carry is $900 on discover and I PIF at least $1k per month on my amex green.
