T his section is not meant to be a comprehensive overview of affirmative action law, cases, or policies. It is, however, a brief review of some of the laws and regulations that have impacted UCI policy, practice, and discussion on affirmative action in recent years.

Executive Order 10925

O n March 6, 1961 President John F. Kennedy issued Executive Order 10925, which included a provision that government contractors "take affirmative action to ensure that applicants are employed, and employees are treated during employment, without regard to their race, creed, color, or national origin." The intent of this executive order was to affirm the government's commitment to equal opportunity for all qualified persons, and to take positive action to strengthen efforts to realize true equal opportunity for all. This executive order was superseded by Executive Order 11246 in 1965.

#Homeowner association board listened to bad legal advice - LA Times

In the end, we realized we got really bad legal advice that led to unwise, if not illegal, behavior by board members. We ended up paying out millions of dollars in attorney fees and hundreds of thousands of dollars not covered by insurance.

In addition to ongoing special assessments, everyone's dues rose to $425 a month from $250. We still don't understand how this happened to us. Do you?

Answer: Litigation is always risky, but losing several big lawsuits in a short period of time is definitely a wake-up call. Worse, owners could pay for the board's poor decisions for years to come.

#HIPAA Preemption Charts

The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") gave the federal Department of Health and Human Services ("HHS") the authority to promulgate regulations containing standards with respect to the privacy of individually identifiable health information. HIPAA provided that such standards shall not supersede State law that imposes more stringent standards (P.L. 104-191, 264(c)). HHS promulgated the federal standards, and they are now in Parts 160 and 164 of Title 45 of the Code of Federal Regulations (the "Privacy Rule").

Under the Supremacy Clause of the U.S. Constitution, federal law preempts State law when preemption is the clear and manifest purpose of Congress. In instances where the purpose of Congress is not clear, only the judicial branch of government can determine whether a federal law preempts a State law under the Supremacy Clause.

UPDATE: AUG. 18, 1:42 P.M. – Elephant Insurance is moving its U.S. headquarters from one Henrico location to another.

The company announced that it will relocate to a 54,000-square-foot space in the Allianz Global Assistance building at 9950 Mayland Drive. The building is the former home of Circuit City.

Elephant Auto has been located in Henrico for five years. The move will nearly double its existing space in size and will allow the company to nearly double its workforce in the next several years, to more than 600 employees.

"Seeing eye dogs" are one type of service animal, used by some individuals who are blind. This is the type of service animal with which most people are familiar. The service animal is not a pet, but isn't required to be licensed or certified to meet this definition. But there are service animals that assist persons with other kinds of disabilities in their day-to-day activities. Some examples include:

  • Alerting persons with hearing impairments to sounds.
  • Pulling wheelchairs or carrying and picking up things for persons with mobility impairments.

Question: What is the law of liberty?

Answer: We find the law of liberty first mentioned in James 1:25, “But the one who looks into the perfect law, the law of liberty, and perseveres, being no hearer who forgets but a doer who acts, he will be blessed in his doing.” James here refers to the gospel, which, although it is called here a law, is not, strictly speaking, a law comprised of requirements and enforced by sanctions. Rather, it is a declaration of righteousness and salvation by Christ, an offer of peace and pardon by Him, and a free promise of eternal life through Him. The juxtaposition of the two contradictory terms “law” and “liberty” made the point, especially to the Jews, that this was an entirely new way of thinking about both. Paul uses this same technique when he refers to the “law of faith” in Romans 3:27.

#Hofstra Law - TLS wiki

Hofstra Law School, based in Hempstead, NY, is one of many different law schools that feed into the New York City market. Currently ranked 100 by US News and World Report, the school enjoys a better reputation than some of its peers (NYLS, Touro, etc.). However, that being said, risk-averse applicants might want to think twice about attending without significant scholarship money. The school's claim of a median post-graduate salary of $160,000 is suspect, especially in the currently struggling economy. Academics and facilities at the school are slightly lacking, and the school's tuition for full-time students is quite high at $41,780 per year. If you factor in the expensive cost of living near New York City (the ABA estimates that students will spend over $20,000 per year on living expenses alone at Hofstra), students can spend over $60,000 per year for their degree.

    The president of the Law Society has thrown his weight behind a controversial plan to study a charging model that will enable lawyers to earn extra fees when they win cases in court, and possibly make law firms more competitive.

    Stephen Hung Wan-shun said the solicitors' body would gauge members' views on the idea. "This is different from the 'no win, no fees' mechanism," Hung stressed.

    He was referring to a model banned in the city under the law of champerty - which prevents a person with no interest in litigation from offering help or encouragement to an involved party and sharing in the proceeds of a lawsuit or settlement.

    Georgia Code Section 53-2-1(b)(1) states that if a person dies without a will and he has no children, but is survived by a spouse, the spouse is the sole heir under intestate law.
