According to the Law of Republic of Kazakhstan "On state-guaranteed legal aid", the state-guaranteed legal aid is a legal assistance provided to individuals and legal entities, entitled to receive it on the grounds and in the manner prescribed by the laws of the Republic of Kazakhstan on a free basis.

All individuals and legal entities have the righttofree state-guaranteed legal aid in the form of legal information. In the interest of a person, whoneedsstate-guaranteed legal aid, his representative can petition in the manner, prescribed by the Law.

The state-guaranteed legal aid is provided in the form of:

1) Legal information;

2) Legal advice;

3) Protection and representation of the interests of individuals in the courts, prosecution authorities, other governmental bodies and non-governmental organizations.

The state-guaranteed legal aid is provided by:

1) Governmental bodies within their competence;

2) Lawyers;

3) Notaries Public;

4) Private Executives of the Court.

The person, whoneedsthe state-guaranteed legal aid, has the right to:

1) equal access to the state-guaranteed legal aid;

2) get information about his/her rights, responsibilities and conditions of the provision of the state-guaranteed legal aid;

3) apply for free legal aid to entities providing the state-guaranteed legal aid;

4) obtain the state-guaranteed legal aid or refuse to receive it in accordance with the legislation of the Republic of Kazakhstan;

5) appeal against the actions or inaction of entities providing the state-guaranteed legal aid in accordance with the legislation of the Republic of Kazakhstan;

6) confidentiality onthe issue, onwhichthe state-guaranteed legal aid was provided.

The person, who made the request on provision ofthe state-guaranteed legal aid, is required to:

1) submit proof/documents of his/her eligibility for the state-guaranteed legal aid, the list of which is approved by the Government of the Republic of Kazakhstan;

2) promptly notify about the change of circumstances affecting the conditions for the provision of the state-guaranteed legal aid;

3) ensure the accuracy of the information on which the need for the state-guaranteed legal aid is based.
