Ready for National Security!

Within a day of its publication of the second Draft Foreign NGO Law on May 5, the Chinese government also published for comment a Draft National Security Law.  Today, that document became law. Although criticized for its vagueness and breadth, the passed law is still just as broad if not more so.  The new law also covers protection of seabeds and adds the word extremism to the provision on terrorism (Article 28), a provision that immediately follows the one that protects normal religious activity and calls for the opposition to foreign influences and interference in domestic religious affairs (Article 27).

The law itself comes off more as abstract principles. Every day in this country, cyclists are treated like second-class citizens, barely tolerated by careless motorists and lazy pedestrians who refuse to share the streets. It’s time to confront reality and enact new traffic laws that reflect the inarguable truth: Cyclists are better than you in every way possible.

From cutting down on pollution, to lowering your commute time, the very existence of cyclists in your city is a blessing. Building protected bike lanes and bike boxes for turning is the least you can do. Anyone with a basic modicum of courtesy knows that cyclists should be allowed to do whatever we want, whenever we want—from riding on the sidewalks if the streets are crowded, to blocking the exits of subway cars during rush hour. All transactions in Indian real estate sector are governed by various laws enacted by the Central Government of India and respective State governments. One such law is the RENTAL LAWS. These laws govern the rental of commercial and residential property and are necessary to enforce individual civil rights of both landlord and tenant and prevention of any kind of deceit.

The real estate scene in India is flawed by land market distortions. The most glaring ones include inflexible zoning, rent and tenancy laws. Zoning laws, rent controls and protected tenancies have been detrimental to the healthy rental trends in India. They have put a freeze to land in city centers that could be otherwise made available for new retail outlets and flats.

In the United States. court action based on workplace bullying is problematic at best. A plaintiff must prove a) that the bullying actually occurred, b) that the bully's actions fall into at least one of the four categories mentioned above and c) that the plaintiff's subsequent problems stemmed from the bully's actions. As of this writing, only five states have legislation against workplace bullying pending, and no state has ever passed laws against it. However, some states do have laws against creating or maintaining a "hostile work environment". Many states also have general laws against harassment, but charges of harassment are notoriously hard to prove. [How to reference and link to summary or text ]

#UK - s emergency surveillance law struck down by MPs

The High Court has ruled today that parts of the UK's emergency surveillance legislation, the Data Retention and Investigatory Powers Act 2014 (DRIPA), is unlawful. Conservative MP David Davis and Labour MP Tom Watson, represented by the Liberty human rights organisation, have successfully argued that the law breaks the public's right to a private life and to the protection of personal data, set out in the EU Charter of Fundamental Rights. Section 1 and 2 of DRIPA, which forces telecoms companies and internet providers to store customer data for up to 12 months, will now be abolished in March next year. The law is due to expire at the end of 2016 anyway, but bringing the date forward for these two crucial points could force the government to introduce replacement legislation earlier.

#UF Law offers first free massive open online course - UF Law Communications - University of Florida

GAINESVILLE, Fla. – The University of Florida Levin College of Law is joining the MOOC revolution on a global scale. The law school’s first Massive Open Online Course will begin May 1, with The Global Student’s Introduction to U.S. Law.

The course is free and open to all – admission to UF is not required – and will appeal particularly to pre-law undergraduate students and international students contemplating further study of the U.S. legal system.

Workplace bullying has been a chronic problem in many industries in particular; healthcare, education, childcare and not-for-profits. It is unlawful bullying to harass and intimidate a fellow employee in the workplace repeatedly and without justification to achieve an ulterior motive and creates a risk to health and safety. That motive may be to attempt to humiliate or force the bullied employee to resign without being paid proper entitlements and where there is no valid reason for that employee to do so.

It is not bullying to demand that employees reach standards of performance which are reasonable and for which the employee has the skills and training to meet.

Wrongfully, the bullied employee might be required to perform an excessive work level, be isolated or threatened by a fellow employee. 3L Joseph Roth won the IPIL Sponsored Scholarship Grant for Judicial Clerks for his forthcoming UC Irvine Law Review article on a limitation on the First Sale doctrine. #Ukraine Introduces Free Legal Aid for All

Kyiv, November 14, 2012. Starting January 1 st. 2013, any person facing criminal legal charges in Ukraine will be entitled for free legal aid. A network of centers taking up pro bono cases has been set up in all regions of the country and in the cities of Kyiv and Sevastopol. Immediately upon detention, law enforcement agency must inform the respective legal aid center about the case. The center has one hour to assign a lawyer.

Additionally, it is allowed to apply for legal aid directly. The centers are obliged to come up with a decision regarding each case within ten days. The initial network of 27 centers will be extended by adding new centers in more regional and city offices. The work of the centers is funded by the state and local budgets, as well as other sources. #Citizen - s Guide To U. S. Federal Law On Child Support Enforcement

18 U.S.C. § 228- Failure to pay legal child support obligations

Section 228 of Title 18, United States Code, makes it illegal for an individual to willfully fail to pay child support in certain circumstances.

For one, an individual is subject to federal prosecution if he or she willfully fails to pay child support that has been ordered by a court for a child who lives in another state, or if the payment is past due for longer than 1 year or exceeds the amount of $5,000.  A violation of this law is a criminal misdemeanor, and convicted offender face fines and up to 6 months in prison (See 18 U.S.C. § 228(a)(1)).

If, under the same circumstances, the child support payment is overdue for longer than 2 years, or the amount exceeds $10,000, the violation is a criminal felony, and convicted offenders face fines and up to 2 years in prison (See 18 U.S.C.§ 228(a)(3)).

#UMass Law wins ABA accreditation after eight-year battle for respect - Metro Desk.

The state s only public law school earned national accreditation Tuesday, capping off its eight-year battle for respect and affirming efforts by the outgoing University of Massachusetts Dartmouth chancellor who fought hard to see the school established.

UMass Law will now have provisional accreditation from the American Bar Association, which will review it every year for the next three to ensure it continues to meet ABA standards. At the end of the three years, the school will be eligible for full accredited status.

    Although the law may not like the sound of it, there are often different degrees of guilt that can be associated with a crime depending upon the prosecutor, defense attorney, and even the judge.

    If you've ever heard of the case Commonwealth v. Woodward (also known as the "nanny case,) then you already have a leg up in the realization that there can be several different degrees of guilt associated with any given crime. In that case, a nanny was convicted of murdering a toddler by shaking the child until it died. According to the jury's verdict, the nanny was to spend a minimum of 15 years in prison. However, the nanny was released from prison a week after entering the establishment because the judge threw out the jury's verdict.

    A legal separation and a physical separation are not the same thing. In a physical separation, although the couple lives separately, there is no formal legal agreement.

    A legal separation allows a husband and wife to live separately and formalize the arrangement by a court order or a written agreement. The arrangement addresses spousal support, and child custody, visitation and support, when relevant.

    It is not equivalent to a divorce or dissolution and recognizes the possibility that the couple may reunite. It does not terminate a marriage, and so, does not allow the parties to remarry.

    It is not necessary to be legally separated before obtaining a divorce. Although, most states have provisions for legally separated couples to commute their separation agreement to a divorce action, should they decide to do so.

    I m sure you are right that there are a combination of factors. Still, I think there is probably a tipping point somewhere. I m sure some candidates simply cannot relocate to attend a T4 school, so they attend a distance learning school, but I imagine many of those students at a DL school performed poorly on the LSAT.

    It s been a while since I looked, but I think even Cal Western students have an average LSAT of over 150. In my state, I don t think you have to be that smart to pass the bar, so I can t imagine someone who gets 165 on the LSAT has a much better chance of passing the bar than someone who scored 155. There must be a tipping point though.

    Total assumption here. but in a state with a bar passage rate of 85%, you probably see something like this
