Criminal convictions have long-term consequences. For someone who has been charged with a crime, whether a DUI, assault, or a property crime like embezzlement or petty theft, worries about jail time and possible punishments and penalties may be just the beginning. Criminal charges are serious, and even with a first offense, a person charged with a crime may be facing consequences that can affect their life permanently.

While the most pressing concern associated with criminal charges is often fear of being separated from family or loved ones, the ways a defendant can be permanently affected vary greatly. For example, a criminal defendant may lose their job or even their professional license, both common consequences of a criminal conviction. As extreme as it may sound, some states automatically revoke a plumber s license for certain offenses. In addition, conviction for some crimes, such as drunk driving, can result in driver's license suspension. Some criminal defendants may ... Read more »

The personal details of a further 8,000 people alleged to have shared music or films illegally have appeared online.

A list of more than 8,000 Sky broadband subscribers and a second of 400 PlusNet users surfaced following a security breach of legal firm ACS:Law.

It comes after a database of more than 5,000 people suspected of downloading adult films emerged on Monday.

The UK's Information Commissioner said ACS:Law could be fined up to half a million pounds for the breaches.

The two new lists, produced by ACS:Law, contain the names, addresses and Internet addresses (IP addresses) of users suspected of illegally sharing music.

In addition, they contain details of how much compensation infringers paid ACS:Law, along with internal case notes.

The BBC has also seen e-mails which contain credit card details of people who have paid the firm compensation. Others contain responses from people claiming their innocence.

#Cohabitation Law - Legal Definition

Cohabitation is generally defined as two people living together as if a married couple. State laws vary in defining cohabitation. Some states have statutes which make cohabitation a criminal offense under adultery laws. Under one state's law, cohabitation means "regularly residing with an adult of the same or opposite sex, if the parties hold themselves out as a couple, and regardless of whether the relationship confers a financial benefit on the party receiving alimony. Proof of sexual relations is admissible but not required to prove cohabitation." Another state statute defines cohabitation as "the dwelling together continuously and habitually of a man and a woman who are in a private conjugal relationship not solemnized as a marriage according to law, or not necessarily meeting all the standards of a common-law marriage." Yet another state, Georgia, defines cohabitation as "dwelling together continuously and openly in a meretricious relations ... Read more »

#Cohabitation Property Rights for Unmarried Couples

When unmarried couples live together for a while, it is likely that they accumulate a good amount of property. In this case, it is in each person's best interest to write out a property agreement that spells out who owns what and how the property will be distributed should the couple separate. This is especially important if a couple acquires real estate together. On the other hand, this agreement is probably not necessary for couples who have only lived together a short time and do not have much property.

Without an agreement, you could face expensive and time consuming legal battles, defending your property rights. This trouble can be saved by each party entering an agreement they both consent to, while the relationship is sound.

What a Cohabitation Property Agreement Should Include

A cohabitation property agreement is about you and your partner, and therefore, should include what meets ... Read more »

The broad topic of constitutional law deals with the interpretation and implementation of the United States Constitution. As the Constitution is the foundation of the United States, constitutional law deals with some of the fundamental relationships within our society. This includes relationships among the states, the states and the federal government, the three branches (executive, legislative, judicial) of the federal government, and the rights of the individual in relation to both federal and state government. The area of judicial review is an important subject within Constitutional Law. The Supreme Court has played a crucial role in interpreting the Constitution. Consequently, study of Constitutional Law focuses heavily on Supreme Court rulings.

While the topic also covers the interpretation and implementation of state constitutions, without qualification it is usually understood as referring to the Federal Constitution.

The Constitution establishes the three bra ... Read more »

A trademark is any word, name, symbol, or design, or any combination thereof, used in commerce to identify and distinguish the goods of one manufacturer or seller from those of another and to indicate the source of the goods. See 15 U.S.C. § 1127 .

Trademarks are generally words, phrases, logos and symbols used by producers to identify their goods. However, shapes, sounds, fragrances and colors may also be registered as trademarks. See Qualitex v. Jacobsen Products Co. Inc.. 514 U.S. 159 (1995). In recent years, trademark law has expanded to include trade dress and antidilution protection. Almost any word, name, symbol, or device capable of distinguishing the source of goods may be used as a trademark subject to few limitations. However, a mark 's eligibility for trademark protection may be limited by application of the functionality doctrine. and a mark may be denied registration if it falls within any of the categories listed under 15 U.S.C. § 1052 .

Feb. 7: John Halligan shows the Web page devoted to his son, Ryan, who was bullied online for months by classmates before committing suicide. (AP)

PROVIDENCE, R.I. Ryan Patrick Halligan was bullied for months online.

Classmates sent the 13-year-old Essex Junction, Vt. boy instant messages calling him gay. He was threatened, taunted and insulted incessantly by so-called cyberbullies.

In 2003, Ryan killed himself.

He just went into a deep spiral in eighth grade. He couldn't shake this rumor, said Ryan's father, John Halligan, who became a key proponent of a state law that forced Vermont schools to put anti-bullying rules in place.

He's now pushing for a broader law to punish cyberbullying — often done at home after school — and wants every other state to enact laws expressly prohibiting it.

States from Oregon to Rhode Island are considering crackdowns to curb or outlaw the behavior, in which kids taunt or insult peers on social W ... Read more »

Governments get their financial support by taxing the people or organizations, who either reside within the country or who are citizens. Tax law governs the method and the amount of taxation. In the United States (US ), tax law originates with the United States Congress. However, most of the detailed tax rules are actually enacted by the Department of the Treasury, which is an agency of the United States government, and its subagency, the Internal Revenue Service (IRS ). Regulations issued by the Department of the Treasury must conform both to the Tax Code, which is the law enacted by Congress and to any constitutional requirements; otherwise, the regulation may be voided by the courts.

Because the amount of taxes that must be paid depends on transactions, especially the receipt of income, tax authorities depend heavily on self reporting by those who are taxed, that may be subject to review by the IRS through audits.

Before 1913, the US government's main source of in ... Read more »

#Commercial Law.

What is Commercial Law?

Commercial law provides the rules that merchants and others involved in commerce must follow as they conduct business amongst themselves and with consumers. It governs the sales of goods and services, negotiable instruments, security interests, leases, principal and agent relationships, contracts of carriage, and much more. In a broad sense, commercial law also encompasses related issues like business bankruptcy and tax planning.

Because various legal issues may be included or excluded from the subject of commercial law depending upon how expansively it is defined, it may be more helpful to consider the matter in terms of timing. Commercial law covers legal issues that arise prior to the initiation of a lawsuit. By contrast, once a lawsuit is filed, the same issues are more properly characterized as litigation. Thus, commercial law attorneys help their clients negotiate and enter into business deals. Litigation attorne ... Read more »
