This is my list of the ten most significant US Supreme Court cases relating to criminal law. I think I’ve cited every case on this list in a brief or motion within the last few months, and any competent criminal attorney would know most of these cases offhand.

In Mapp v. Ohio, 367 US 643 (1961). the Supreme Court held that evidence could not be admitted in a criminal trial if it was obtained through an illegal search in violation of the Fourth Amendment. As the court explained in Mapp and since, they want to discourage police misconduct by preventing the state from using a violation of a suspect s rights to obtain evidence. Mapp is particularly important because it was the first case to apply the exclusionary rule in a state prosecution, and the overwhelming majority of convictions are in state court rather than federal court. ... SULLIVAN S ISLAND Hal Coste hopes to finish a tree house for his grandkids, but so far the town won t let him. In fact, the project may have to come down, he said.

He faces a possible $1,040 fine at an Aug. 3 municipal court hearing after being charged with violating a town order to stop work on the play house that he has been building in a backyard pecan tree.

The tree house is an accessory structure, zoning officials said, which by law can be up to 15-feet high. The 96-square-foot structure is 14 feet from floor to roof but the town measures height from the ground, which means the tree house is officially 30 feet tall because it is 16 feet from the ground to the floor of the tree house.

Privacy is the expectation that confidential personal information disclosed in a private place will not be disclosed to third parties, when that disclosure would cause either embarrassment or emotional distress to a person of reasonable sensitivities. Information is interpreted broadly to include facts, images (e.g. photographs, videotapes), and disparaging opinions.

The right of privacy is restricted to individuals who are in a place that a person would reasonably expect to be private (e.g. home, hotel room, telephone booth). There is no protection for information that either is a matter of public record or the victim voluntarily disclosed in a public place.
