International Law. unlike most other areas of law, has no defined area or governing body, but instead refers to the many and varied laws, rules and customs which govern, impact and deal with the legal interactions between different nations, their governments, businesses and organizations, to include their rights and responsibilities in these dealings.

The immense body that makes up international law encompasses a piecemeal collection of international customs; agreements; treaties; accords, charters (i.e. the United Nations Charter); protocols; tribunals; memorandums; legal precedents of the International Court of Justice (aka World Court) and more. Without a unique governing, enforcing entity, international law is a largely voluntary endeavor, wherein the power of enforcement only exists when the parties consent to adhere to and abide by an agreement.

Due to the diverse legal systems and applicable histories of different countries, laws addressing internationa ... Read more »

#EUROPA - Regulations, Directives and other acts

The aims set out in the EU treaties are achieved by several types of legal act. Some are binding, others are not. Some apply to all EU countries, others to just a few.

Regulations

A "regulation" is a binding legislative act. It must be applied in its entirety across the EU. For example, when the EU wanted to protect the names of agricultural products coming from certain areas such as Parma ham, the Council adopted a regulation.

Directives

A "directive" is a legislative act that sets out a goal that all EU countries must achieve. However, it is up to the individual countries to decide how. This was the case with the working time directive. which stipulates that too much overtime work is illegal. The directive sets out minimum rest periods and a maximum number of working hours, but it is up to each country to devise its own laws on how to implement this.

Decisions

A "decision" is bi ... Read more »

    #European e-Justice Portal - Glossaries and terminology

This section provides a brief overview of existing glossaries and multilingual "thesaurus" at European level.

A "glossary" is an alphabetical list of terms in a particular domain of knowledge accompanied by the definitions of those terms. In case of a bilingual glossary, the terms in one language are defined in a second language or glossed by synonyms or near-synonyms in another language. A glossary may be understood as containing explanations of concepts relevant to a certain field of study or action. In the law field, the term "glossary" may refer to two different tools: on the one hand it is used for a list of expressions with translations provided for each country; on the other hand, it is also used for a list of definitions for terminology.

    #EUROPA - EU law

EU law is divided into 'primary' and 'secondary' legislation. The treaties (primary legislation) are the basis or ground rules for all EU action.

Secondary legislation which includes regulations, directives and decisions are derived from the principles and objectives set out in the treaties.

    How EU decisions are made

The EU s standard decision-making procedure is known as 'Ordinary Legislative Procedure (ex "codecision"). This means that the directly elected European Parliament has to approve EU legislation together with the Council (the governments of the 28 EU countries). The Commission drafts and implements EU legislation.

    EU Treaties

The European Union is based on the rule of law. This means that every action taken by the EU is founded on treaties that have been approved voluntarily and democratically by all EU member countries.

The Treaty of Lisbon increased the number of policy areas where 'Ordinary Legislat ... Read more »

The phrase "degrees of murder" refers to the intent or severity of a particular murder charge. Some states define their degrees of murder numerically. Common degrees of murder include first degree murder and second degree murder. Other states place specific labels on their murder offenses, such as capital murder, murder, and justifiable homicide.

Despite the label of the degree of murder, the idea is to gradually increase the punishment with the degree. The more egregious the killing, or the motive behind a killing, then the higher the degree of punishment for that type of murder charge.

First-degree murder, or capital murder as it is often called, is the most serious form of murder. In most states, a first degree murder involves elements like deliberate planning, premeditation, or malice. Deliberate means that the defendant makes a clear-headed decision to kill the victim. Premeditation involves showing the defendant actually thought about the kill ... Read more »

Landlord-tenant law governs the rental of commercial and residential property. It is composed primarily of state statutory and common law. A number of states have based their statutory law on either the Uniform Residential Landlord And Tenant Act (URLTA) or the Model Residential Landlord-Tenant Code. Federal statutory law may be a factor in times of national/regional emergencies and in preventing forms of discrimination.

The basis of the legal relationship between a landlord and tenant is grounded in both contract and property law. The tenant has a property interest in the land (historically, a non-freehold estate) for a given period of time. See State Property Statues. The length of the tenancy may be for a given period of time, for an indefinite period of time, (e.g., renewable/cancelable on a month to month basis), terminable at any time by either party (at will), or at sufferance if the agreement has been terminated and the tenant refuses to leave (hold ... Terms of employment are often governed by contract law. When an employee has an employment contract, chances are that the contract says something about how the employee can and can't be fired. Most employment contracts only allow an employee to be fired for "good cause", which can seriously limit an employer's ability to deal with a troublesome employee. If the employee has an express written contract, then staying on the right side of the law is fairly simple -- just abide by the terms of the contract. Employment contracts come in many other flavors, however, and knowing whether you're complying with them or not can be difficult.

Contracts don't have to be in writing to be valid under the law. If you promise an employee during the interview that you won't fire them "unless there's a good reason", you've probably established an oral employment contract. Even a casual conversation can be the basis for an oral employment contract, which means that employers have to be very car ... Read more »

Find online degrees at online schools and learn more about the benefits of a distance learning program.

Course requirements and time commitments for online schools and distance learning programs vary depending in part on the type of online degree you're getting, whether you choose to go full-time or part-time, and if you include summer classes in your schedule.

If you want to complete your online degree program as quickly as possible, you may find more flexibility at an online school than at a campus school. Because distance learning programs like online colleges cater to students with busy or inflexible schedules, some online colleges will allow students to accelerate their studies to complete their degree in less time than it would typically take at a campus school.

Students are increasingly turning to online schools and distance learning over campus schools for many reasons; chief among them are flexibility and affordability. Here are some of the main reas ... Read more »

    #Family Law.

Guide to Parental Rights & Obligations

    What is Family Law?

Family law consists of a body of statutes and case precedents that govern the legal responsibilities between individuals who share a domestic connection. These cases usually involve parties who are related by blood or marriage, but family law can affect those in more distant or casual relationships as well. Due to the emotionally-charged nature of most family law cases, litigants are strongly advised to retain legal counsel.

The vast majority of family law proceedings come about as a result of the termination of a marriage or romantic relationship. Family law attorneys help their clients file for separation or divorce, alimony, and child custody, visitation, and support. Spouses married a short time may seek an annulment, and special rights may exist between same-sex couples. The division of property at the end of a marriage is also a common issue in family law cases.

Education then, beyond all other devices of human origin, is the great equalizer of the conditions of men, the balance-wheel of the social machinery.

Stanford Law School students who have themselves typically had positive and rich educational opportunities have a long history of working with disadvantaged youth and their communities to ensure that they, too, have access to equal and excellent educational opportunities. As early as 1986, interested Stanford Law School students spent their time doing this critical, ground-breaking civil rights work at the former East Palo Alto Community Law Project.

Since the Great Recession millions of Americans have found themselves in dire financial straits. While filing bankruptcy is often the last resort, many have been left with no other choice.

Bankruptcy can be a devastating move, both financially and psychologically. You are unable to borrow money or use a credit card. Your credit score may be lower than your age. But there is life after bankruptcy.

When the University of Arkansas School of Law set up a program for law students to work with consumers who have filed for bankruptcy protection, one fact quickly became clear. These consumers waited too long to act.

It s very sad, said Tim Tarvin, associate professor and supervising attorney in the student-staffed Federal Practice Clinic. It's not unusual for people to break down in the interview setting with the student attorneys who are representing them. These families have been working so hard trying to figure out how to pay off their debt, and it s just not wor ... Read more »
