SCIENTIFIC LAWS and THEORIES

I've had a student ask me to clarify the difference between a scientific law and a theory . This person asked, in part:

. Is a law, in essence, something which has no detractors -- a unifying 'concept' for which scientists (at the present time) are in accordance with? Is a law a single idea by which all scientists, regardless of discipline, conform?

Can a theory be looked at as a 'transitory' law (i.e. a law in waiting)? In contrast to a law, is it correct to say that there can be several scientific theories about a particular phenomena whereas a law represents a single unified agreement among all scientists .

Such questions are very common. The difference between a law and a theory often confuses people. This happens, in part, because even among scientists there can be different usage of these terms. John Briggs West was born in Roxbury, Massachusetts on August 6, 1852.

His father was a bookkeeper and had married in Boston. John was one of five children.

According to law professor Robert Jarvis. in an article written in the American Journal of Legal History. John B. West had three other siblings but all died as infants.

John's older brother Horatio, born in 1848, would loom large in the legacy of West Publishing Company.

In 1870, his father got an accounting job in St. Paul, Minnesota. The family moved and upon arrival, John got a job at a bookstore. He was never a lawyer but started as a salesman. He travelled to small towns and became aware of the needs of the legal profession.

In 1872, he quit his job and started his own book-selling business, focusing on lawyers, John B. West, Publisher and Bookseller .

The UK copyright law fact sheet outlines the Copyright, Designs and Patents Act 1988, the principal legislation covering intellectual property rights in the United Kingdom and the work to which it applies.

  1. Introduction

Copyright law originated in the United Kingdom from a concept of common law; the Statute of Anne 1709. It became statutory with the passing of the Copyright Act 1911. The current act is the Copyright, Designs and Patents Act 1988.

  • Rights covered

    The law gives the creators of literary, dramatic, musical, artistic works, sound recordings, broadcasts, films and typographical arrangement of published editions, rights to control the ways in which their material may be used.

    The rights cover; broadcast and public performance, copying, adapting, issuing, renting and lending copies to the public.

    #Child support

    Child support is the financial support paid by one parent to the other, to help with the costs of a child aged under 18.

    The law says that both parents have a duty to support their children financially, whether they are biological (birth) or adoptive parents, same-sex or otherwise.

    Most children in Australia are covered by the Child Support Scheme, managed by the Department of Human Services (Child Support), a Commonwealth Government agency. Its role is to support separated parents to transfer payments for the benefit of their children.

    Parents can come to their own agreement about how much child support should be paid. If parents don t agree about child support, the Department of Human Services (Child Support) will assess how much child support should be paid.

    Children's Rights law exists to safeguard children, their wellbeing and their individual rights. These federal and state policies and laws were spearheaded by the children�s rights movement which promotes legal defenses and protections for children by addressing their social welfare; health, education and special needs; child trafficking; child labor and exploitation and how the juvenile justice system deals with minors.

    With regard to child labor, the Fair Labor Standards Act (FLSA) protects child laborers, along with other groups. However, because it was enacted when family farms were much more prevalent, the restrictions on agricultural work for children were fairly lax, and continue to remain so.     Ready for National Security!

    Within a day of its publication of the second Draft Foreign NGO Law on May 5, the Chinese government also published for comment a Draft National Security Law.  Today, that document became law. Although criticized for its vagueness and breadth, the passed law is still just as broad if not more so.  The new law also covers protection of seabeds and adds the word extremism to the provision on terrorism (Article 28), a provision that immediately follows the one that protects normal religious activity and calls for the opposition to foreign influences and interference in domestic religious affairs (Article 27).

    Blue laws have been part of U.S. LEGAL HISTORY since the colonial period. These laws, which today are usually referred to as Sunday closing laws, prohibit certain types of commercial activity on Sundays. Originally these laws were directed at personal activities regarded as moral offenses, such as gambling or the consumption of alcohol. In the nineteenth century, however, state and local governments passed laws that forbade businesses from operating on Sunday.     The High Court has ruled today that parts of the UK's emergency surveillance legislation, the Data Retention and Investigatory Powers Act 2014 (DRIPA), is unlawful. Conservative MP David Davis and Labour MP Tom Watson, represented by the Liberty human rights organisation, have successfully argued that the law breaks the public's right to a private life and to the protection of personal data, set out in the EU Charter of Fundamental Rights. Section 1 and 2 of DRIPA, which forces telecoms companies and internet providers to store customer data for up to 12 months, will now be abolished in March next year. The law is due to expire at the end of 2016 anyway, but bringing the date forward for these two crucial points could force the government to introduce replacement legislation earlier.

    #UMass Law wins ABA accreditation after eight-year battle for respect - Metro Desk.

    The state s only public law school earned national accreditation Tuesday, capping off its eight-year battle for respect and affirming efforts by the outgoing University of Massachusetts Dartmouth chancellor who fought hard to see the school established.

    UMass Law will now have provisional accreditation from the American Bar Association, which will review it every year for the next three to ensure it continues to meet ABA standards. At the end of the three years, the school will be eligible for full accredited status.

    Workplace bullying has been a chronic problem in many industries in particular; healthcare, education, childcare and not-for-profits. It is unlawful bullying to harass and intimidate a fellow employee in the workplace repeatedly and without justification to achieve an ulterior motive and creates a risk to health and safety. That motive may be to attempt to humiliate or force the bullied employee to resign without being paid proper entitlements and where there is no valid reason for that employee to do so.

    It is not bullying to demand that employees reach standards of performance which are reasonable and for which the employee has the skills and training to meet.

    #UK government rewrites surveillance law to get away with hacking and allow cyber attacks, campaigners claim - News - Gadgets and Tech - The Independent

    The British government quietly changed anti-hacking laws to exempt GCHQ and other law enforcement agencies from criminal prosecution, it has been claimed.

    Details of the change were revealed at the Investigatory Powers Tribunal which is hearing a challenge to the legality of computer hacking by UK law enforcement and intelligence agencies.

    The Government amended the Computer Misuse Act (CMA) two months ago. It used a little-noticed addition to the Serious Crime Bill going through parliament to provide protection for the intelligence services. The change was introduced just weeks after the Government faced a legal challenge that GCHQ’s computer hacking to gather intelligence was unlawful under the CMA.

    On April 28, the Securities and Exchange Commission (SEC) released a Guidance Update addressing the importance of cybersecurity and the steps registered investment advisers (and registered investment companies) may wish to consider in light of growing cybersecurity risks. This Guidance Update is the latest instance of the SEC s increased emphasis on cybersecurity as a priority for advisers. A Cybersecurity Roundtable was hosted by the SEC on March 26, and the Office of Compliance Inspections and Examinations released a Risk Alert on February 3, 2015 summarizing its cybersecurity examinations of over 100 advisers and broker-dealers.

    The Guidance Update provides several measures that advisers may wish to consider when creating a cybersecurity policy. These suggestions are not, however, intended to be comprehensive and advisers should tailor their cybersecurity policies to the particular nature and scope of their businesses.

    The University of Massachusetts School of Law has a mounting deficit, which hit $3.8 million last fiscal year.

    DARTMOUTH When UMass took over a tiny private law school in 2010, the controversial deal came with a promise to the public: Taxpayer money would not be used to pay for it, and the state would even earn a profit as enrollment was projected to more than double by 2017.

    But with many law schools nationwide decimated by the recession, the state s first public law school is struggling to gain its footing, according to a Globe review.

    The University of Massachusetts School of Law has a mounting deficit, which hit $3.8 million last fiscal year, a gap expected to widen next year. UMass Dartmouth is picking up the bill for now, that school said.

    #UK government sets out plans to toughen strike laws

    LONDON The British government published plans on Wednesday for the biggest shake up of strike laws since the Thatcher era 30 years ago, setting itself up to battle trade unions over proposed limits to walkouts at key public services.

    Prime Minister David Cameron, who last week described a 24-hour stoppage on the London Underground rail network as "unacceptable and unjustified", promised the curbs in his re-election campaign earlier this year.

    Business lobby groups welcomed the plans while the Trades Union Congress said they would make legal strikes "close to impossible".

    One union warned a rule requiring union members to make an active choice to pay into political funds would bankrupt the opposition Labour Party, as unions are its biggest financial backers.

    Every accredited American law school is required by the American Bar Association to have a law library meeting certain minimum specifications with respect to quantity and quality of materials available. Some law school libraries are kept in the same building as the general library, but many are either in the law school's building or in a separate facility altogether. Most court buildings also have a law library; the United States Supreme Court building houses one of the most extensive in the world, rivaled by the Law Library of Congress.
