#Florida Recording Law

Note. This page covers information specific to Florida. For general information concerning the use of recording devices see the Recording Phone Calls, Conversations, Meetings and Hearings section of this guide.

Florida Wiretapping Law

Florida's wiretapping law is a two-party consent law. Florida makes it a crime to intercept or record a wire, oral, or electronic communication in Florida, unless all parties to the communication consent. See Fla. Stat. ch. 934.03. Florida law makes an exception for in-person communications when the parties do not have a reasonable expectation of privacy in the conversation, such as when they are engaged in conversation in a public place where they might reasonably be overheard. If you are operating in Florida, you may record these kinds of in-person conversations without breaking the law. However, you should always get the consent of all parties before recording any t ... #Follow These Steps Before Borrowing for Law School - US News

Law students shouldn’t count on loan forgiveness, but should research future salaries before borrowing.

Dane Rennier turned down several federal student loans during his law school tenure at the University of Missouri—Columbia. He wasn't going to stress himself out about borrowing what was needed to complete his education, but he also didn't want to go into any unneeded debt.

He worked as much as he could to reduce the amount he needed to take out in student loans. He also always kept in mind starting salaries for a criminal prosecution attorney and his future monthly payments.

Rennier borrowed less than $60,000 during his time at the public law school – less than the typical law student. According to data from the American Bar Association cited in Getting a Grip on Your Student Debt by Heather Jarvis, a student loan expert and licensed attorney, public law school students borrow an average of $ ... One of the major European legal systems, Roman law being the other, English law has spread to many other countries, including former English colonies such as the USA, Canada, Australia, and New Zealand.

English law has an evolving history dating from the local customs of the Anglo-Saxons, traces of which survived until 1925. After the Norman Conquest they grew up, side by side with the Saxon shire courts, the feudal courts of the barons and the ecclesiastical (church) courts. From the king's council developed the royal courts, presided over by professional judges, which gradually absorbed the jurisdictions (legal powers) of the baronial and ecclesiastical courts. By 1250 the royal judges had amalgamated the various local customs into the system of common law – that is, law common to the whole country. A second system known as equity developed in the Court of Chancery, in which the Lord Chancellor considered petitions.

In the 17th and 18th centuries common law absorbe ... Read more »

#Foreclosure Laws and Procedures By State

The foreclosure process varies somewhat from state to state, and depends primarily on whether the state uses mortgages or deeds of trust for the purchase of real property. Generally, states that use mortgages conduct judicial foreclosures; states that use deeds of trust conduct non-judicial foreclosures. The principal difference between the two is that the judicial procedure requires court action on a foreclosed home.

The below table represents our current knowledge of which states use mortgages (judicial) or deeds of trust (non-judicial) or both. The table also includes estimated foreclosure timelines for each state. Please check with your local county government to verify this information. Inform us of any errors at info@realtytrac.com.

Compare all state foreclosure timelines on this simple one-page chart and click on any state name to read about detailed foreclosure procedures for that state.

Shoplifting is the crime of taking merchandise or goods from a store or other establishment without intending to pay for it. Shoplifting also can include acts such altering a price tag, acting as a lookout or distraction to allow another person to steal something, and using or consuming goods while still in the store. For example: eating grapes in the produce section of a grocery store without first paying for them.

Shoplifting is a crime of theft or larceny and can be classified as a misdemeanor or a felony depending on the total value of the goods stolen. How the crime is classified influences the severity of the penalties that can be imposed on someone convicted of the crime.

The legal elements that constitute shoplifting differ by state, but in general to commit the crime a person must:

  • Take, use, conceal, consume, or alter merchandise with the intent not to pay for it or not pay the full price indicated, or
  • Facilitate the theft by acting ... Read more »

Today's news and the lighted signs along our Houston highways these weekend remind us not only to "click it or ticket" and "Seat belts all the time, all riders, every ride" is not only a new campaign to remind Houston area drivers to wear their seat belts but could also be kicking off the new year of seat belt laws for our children too.

Last September a series of new laws regarding drivers and riders in Texas including laws regarding cell phone and texting while driving as well as new laws regarding booster seat use. The law regarding booster seats gave parents a "grace period" where from Sept. 1, and June 1, parents could obtain the booster seat they needed for their children. Warnings were issued. But starting today parents will no longer receive warnings but tickets, fines and possibly even greater prosecution for not having their children in a booster car seat.

What is the new child safety /booster/car seat law in Texas?

#Foreclosure Law.

What is Foreclosure Law?

Foreclosure law provides the means for a mortgage lender to take possession and sell a home when the borrower has defaulted on the loan. The money from the sale is used to pay off the balance of the loan, and the new buyer takes the home free of the mortgage. If the proceeds are not enough to pay off the loan, the borrower may be held personally liable for the difference, in addition to being forced out of the house. From the lenders perspective, foreclosure is slow and expensive. Thus, the lender will usually be just as motivated as the borrower to see that the loan is paid on time and foreclosure does not become necessary.

To understand foreclosure law, it helps to consider the nature of a mortgage. Mortgages are used when potential homebuyers seek to borrow purchase money, or when homeowners with equity in their property want to borrow cash to make home improvements or for other purposes. In either case, a bank l ... Read more »

#FPF list of Federal Anti-discrimination laws - Future of Privacy

The Voting Rights Act of 1965, 42 U.S.C. §§ 1973 et seq.. was enacted to prevent and remedy racial discrimination in voting. Section 2 prohibits voting practices that have the purpose or result of discriminating against members of a racial or minority language group.  Plaintiffs must establish, “based on the totality of circumstances.   that its members have less opportunity than other members of the electorate to participate in the political process and to elect representatives of their choice.”  Section 2 has been used most frequently to challenge election systems that dilute minority voting strength, such as literacy tests and similar devices that were historically used to disfranchise racial minorities.

Meanwhile, Under Section 5, specific states and counties with a history of discrimination must receive federal preclearance before they implement any change affecting voting. These jurisdictions may ... Read more »

The United States was founded under the principals of federalism. Under federalism, governing powers are divided between the federal government as well as the state governments. For states existed before the founding of the US, the writers of the Constitution respected the state s authority by limiting federal powers to only those expressly stated within the Constitution. All other governing powers are, therefore, state powers.

For knife law, the only federal law is theВ Switchblade Knife Act of 1958 as well as the amendment to the act (seeВ 15 U.S.C. В§1244). The federal knife law only applies to individuals who are traveling internationally as well as between states. If you reside in a federal district (see Washington D.C. knife laws ), the federal law is the only law that governs knives for you. If you live in one of the 50 states, the federal law would only apply to you if you are traveling from one state to another or if you are entering federal property, such ... Read more »

Unlike other distance education institutions in the US, law schools form a distinct subset of graduate institutions because of the unique requirements necessary to become a lawyer. The State Bar of California is currently the only state regulatory authority that allows graduates of correspondence law schools to sit the bar exam, although once a law graduate becomes licensed in California they may become eligible to take the bar exam in other states.

Northwestern California University School of Law (NWCULaw™) was established in 1982 and is the oldest continuously operating degree-granting online law school in the country offering online correspondence based distance education. Its programs were developed so that economic obstacles, family commitments, remoteness of location, and other hardships would not prevent deserving individuals from studying law.

The School was approved to issue degrees by the State of California Department of Education in 1982. Its Juris Doctor ... Read more »

Commercial law is the body of law that governs the broad and sometimes vague areas of business, consumer transaction, and commerce. The application of commercial law has developed a specific set of laws that apply to commercial activities, pursuits, and transactions. This arm of civil law deals with issues both simple and complex that often relate to questions of both public and private sector laws. Commercial law governs sale and distribution of goods, and proper procedure for payment of transactions.

Many nations operate under civil codes that are made of detailed statements regarding commercial law. In the United States (US), commercial law is regulated by Congress under the power granted to it to regulate interstate commerce, and by state governments under jurisdiction of police power. The commercial laws in the US were adopted from 17th century principles of the law merchant and were first incorporated into common law. The US federal government has attempted to have som ... Your Earning Ability

How much time you put in and how much of yourself you put into that time, largely determines your earning ability. Georgia enacted a law that begins by clarifying the importance of breastfeeding, and states that a mother has a right to breastfeed in public where she is allowed to be with her baby. #Garnishment legal definition of garnishment

    Garnishment

A legal procedure by which a creditor can collect what a debtor owes by reaching the debtor's property when it is in the hands of someone other than the debtor.

Garnishment is a drastic measure for collecting a debt. A court order of garnishment allows a creditor to take the property of a debtor when the debtor does not possess the property. A garnishment action is taken against the debtor as defendant and the property holder as garnishee. Garnishment is regulated by statutes, and is usually reserved for the creditor who has obtained a judgment, or court order, against the debtor.

A debtor's property may be garnished before it ever reaches the debtor. For example, if a debtor's work earnings are garnished, a portion of the wages owed by the employer go directly to the Judgment Creditor and is never seen by the debtor.

Some property is exempt from garnishment. Exemptions are created by ... Read more »

    Godwin's Law states

As an online discussion grows longer, the probability of a comparison involving Nazis or Hitler approaches one.

    Often, this is interpreted as

In any given discussion, once such a comparison is made, the discussion is automatically over and the one who made the comparison has lost the debate by default.

This module allows the first comment that invokes Godwin's Law to automatically close the discussion for a given node. This is intended to prevent the discussion from devolving further.

This module doesn't intend to censor the discussion, only close it when certain keywords are found. Note that this leads to the possibility of abuse by trolls, so use with caution. Perhaps future versions can trigger other actions, such as user bans or admin alerts.

The Godwin's Law module also allows for other keywords to trigger an automatic comment thread closure, so other offensive ... Read more »

International trade law is the body of laws and agreements that governs how countries do business with each other. The economic health of many countries depends, at least in part, or the ability to import and export goods. International trade laws set out the parameters for how these trades take place. Most of the time, the laws are designed to ensure fairness to all parties, as well as to create something of a globally uniform and predictable set of rules.

There are three primary types of international trade law. The first is national: any country that makes its own internal rules about how trade will be conducted with other countries, or regulates how much of a certain resource can be exported, has created an international trade law. Second is bilateral. When two countries together agree to conduct their trade in a certain way, or to open trade freely between their borders, they create a bilateral trade agreement or trade law. Office of the Information Commissioner

Internet service provider AOL is becoming frustrated by the lack of effective anti-spam laws in the UK.

"While the volume of spam originating in the UK may be lower than many countries, strong anti-spam legislation sends the right signal," said a spokesman for AOL.

"We would like more legal avenues in the UK to hit spammers where it really hurts - in the pocket," he said.

The problem lies in loopholes which effectively give spammers the right to spam any address in the UK, said Steve Linford, who heads up Spamhaus.

"British law allows spammers to spam business addresses and it is up to spammers to determine whether an address is a private one or a business one," he told the BBC News website.

"Apparently the Department of Trade and Industry was told that British businesses wanted spam, although we have never heard of any," he said.

The job of enforcing the spam law falls to the Office of th ... Read more »
