#Criminal law policy - European Commission

While the EU cannot adopt a general EU criminal code, EU criminal legislation can add, within the limits of EU competence, important value to the existing national criminal law systems.

Added value of EU rules

Action at EU level in this field is crucial for a number of reasons:

  • The most serious types of organised crime are committed across borders. To prevent criminals from misusing those EU countries with the most lenient legal systems and 'safe havens' from appearing. a certain approximation of national laws can be necessary.
  • Through adopting minimum standards for procedural rights in criminal proceedings and making the fight against crime more efficient, EU criminal law fosters citizens' confidence in a high level of security throughout the Union. This is of particular importance to those exercising their right of free movement.

Format: Hardcover

Don't be taken in. No question about it, Andy Law is an extremely charismatic man and the concept of St Luke's is highly inspiring. But the reality is somewhat otherwise.

I worked at St Luke's, so i should know. Libel laws undoubtedly prohibit me from speaking my mind here, so suffice to say that the gap between image and reality is every bit as big as that between ads and the products they flog.

When this book was published, many employees at St Luke's were flabbergasted by the inaccuracies contained within it. It certainly is a very imaginative book.

The painful reality is that whichever way you wrap it, advertising (as opposed to marketing) is a very un-21st century idea. For t ... Read more »

More and more students now view online LLM programs as a convenient and cost-effective means of achieving a postgraduate qualification. However, even those who are open to the idea entertain secret worries that on graduation their certificate might have the word ONLINE emblazoned on it, making it somehow less valid. This concern is probably a throwback to about ten or fifteen years ago when distance learning courses were considered dodgy. These days many well-known and highly ranked universities, including Ivy League institutions like Harvard, offer a range of fully accredited and recognised distance learning degree courses, which has helped to bring distance learning into the mainstream.

If you re seriously considering doing a Master of Laws online, don t be put off and don t worry, your certificate will most likely not indicate whether you earned it via face-to-face or e-learning. And even if it does it s still a valid postgraduate qualification.

#Criminal defense lawyer

Press Release:

The Texas Criminal Defense Lawyers Association (TCDLA) remains concerned regarding developments in the Waco biker cases.

Last week, a Detective from one of the investigating police agencies on the biker cases was appointed to serve as a grand jury foreman. It is reported that same grand jury may consider the case involving the accused bikers. This is shocking, even though within the technical requirements of the law regarding grand jury service. The fact that a District Judge approved this appointment makes it even more concerning. It is TCDLA s hope that the grand jury seated with the Detective as foreman will not consider this complex case. Imagine a private investigator for one of the defendants attorneys being appointed to the grand jury considering the case? That would not be any more appropriate.

TCDLA s concerns with this case began when a Justice of the Peace with strong law enforcement ties set identical bon ... Read more »

#Crimes That Will Make an Immigrant Deportable

How crimes of moral turpitude, aggravated felonies, and other crimes can make even a green card holder deportable from the U.S.

All immigrants, including those with green cards, can be deported if they violate U.S. immigration laws. The most common reason for people to be placed into removal proceedings is because there is evidence that they have committed a crime.

Specifically, immigrants can be deported if they commit either what is called a "crime of moral turpitude" under certain conditions described in this article, or an "aggravated felony," unless the crime counts as a petty offense. In addition, certain crimes are specifically listed within the immigration laws as being grounds of deportability.

This article addresses what criminal convictions will cause a person to get into trouble as well as whether any recourse may be available to the offender.

If you are considering a career in law, it is worth spending some time investigating the various options available before committing your time and money. There is a bewildering array of areas of legal practice and each one has a variety of qualification routes and exemptions.

As the legal system in each country is different, a qualification in law will only permit you to practice in the country in which you qualified. This also applies within the United Kingdom. If you qualify in England and Wales, you will not be permitted to practice in Scotland or Northern Ireland unless you take a transferring qualification. This should be taken into account if you live near the border or are considering moving in the future.

Any legal career will involve hard work, organisation, precision and attention to detail, all carried out under pressure. You will also need to be able to deal with people of all kinds in a professional manner. The rewards can be substantial, both personally ... Read more »

Guide to Penal Law

What is Criminal Law?

Criminal law involves a system of legal rules designed to keep the public safe and deter wrongful conduct. Those who violate the law face incarceration, fines, and other penalties. The American criminal justice system is both complex, and adversarial in nature. With the exception of minor traffic violations, accused individuals will require the assistance of an attorney.

Specific crimes and the consequences for violating them are found in penal codes enacted by legislators at the local, state, and federal levels. Less serious crimes are classified as misdemeanors. These typically carry a maximum of up to one year in the county jail. Examples include petty theft, possession of small amounts of controlled substances, and first-offense drunk driving.

Crimes of a more serious nature are classified as felonies. These carry punishments of a year or more in state or federal prison. Felonies in ... Read more »

Whether you own a Swiss Army pocket knife, a Bowie hunting knife, a stiletto switchblade, a dagger, or a butterfly knife, knife owners are often subject to federal, state, and local laws. Although knives are popular as collectibles, tools, and self-defense weapons, carrying a knife or owning certain types of knives may be illegal under state or federal law. In popular media, knives are often depicted as flashy weapons brandished by villains. Knives also have a long history of use in gang violence. As a result, many people glamorize knives and fail to recognize their potential for danger.

State Knife Laws

Are knives legal? States in the U.S. have differing views on this question. Most states regard short-blade pocket knives as legal. Generally, the longer a knife's blade (e.g. more than 2 or 3 inches), the more likely a state will consider the knife illegal or subject to restriction. Here a few examples:

What Do Criminal Lawyers Do?

Criminal Lawyers represent clients in actions initiated against individuals by the federal or state government. Unlike in civil law. those who are prosecuted for a crime are guaranteed the right to assistance of counsel. The Sixth Amendment of the United States Constitution guarantees this right.

This right, generally, must be invoked by the individual and applies only after the initiation of formal adversarial proceedings whether by way of formal charge, preliminary hearing, indictment, information, or arraignment.

Criminal lawyers are there to support an arrested individual; an individual questioned by police but not formally charged; or an individual charged with a crime. Criminal Lawyers are able to provide clients with a valuable knowledge and understanding of the charges and implications of your actions.

"Shoplifting" generally refers to the theft of merchandise from a store or place of business. Shoplifting is a type of larceny. which simply means taking the property of someone else without their permission, and with the intent to permanently deprive the owner of the property taken.

Though states may punish shoplifting under their general larceny or theft statutes, many states have enacted statutes to specifically address shoplifting. States may refer to the crime by different names, including "retail theft" and "concealment of merchandise."

These state laws vary widely, but generally, shoplifting offenses includes two elements:

1. willfully concealing or taking possession of items being offered for sale; and

2. the intent to deprive the items' rightful owner (typically the store) of possession of the items, without paying the purchase price.

Crucially, this means that in most states, one can break shoplifting laws without attempting to get o ... Read more »

Traditionally, international law consisted of rules and principles governing the relations and dealings of nations with each other, though recently, the scope of international law has been redefined to include relations between states and individuals, and relations between international organizations. Public_international_law. concerns itself only with questions of rights between several nations or nations and the citizens or subjects of other nations. In contrast, Private_international_law deals with controversies between private persons, natural or juridical, arising out of situations having significant relationship to more than one nation. In recent years the line between public and private international law have became increasingly uncertain. Issues of private international law may also implicate issues of public international law, and many matters of private international law have substantial significance for the international community of nations.
