#Civil Rights Act of 1964

Public Domain, www.commons.wikimedia.org

In an 11 June 1963 speech broadcast live on national television and radio, President John F. Kennedy unveiled plans to pursue a comprehensive civil rights bill in Congress, stating, this nation, for all its hopes and all its boasts, will not be fully free until all its citizens are free ( President Kennedy s Radio-TV Address, 970). King congratulated Kennedy on his speech, calling it one of the most eloquent, profound and unequivocal pleas for justice and the freedom of all men ever made by any president (King, 12 June 1963).

The earlier Civil Rights Act of 1957, the first law addressing the legal rights of African Americans passed by Congress since Reconstruction, had established the Civil Rights division of the Justice Department and the U.S. Civil Rights Commission to investigate claims of racial discrimination. Before the 1957 bill was passed Congress had, however, removed a prov ... Read more »

"Vicious dog" or "dangerous dog" laws impose special restrictions on dogs that are officially labeled dangerous. By focusing on dogs known to pose a danger to people, these laws can protect the public and crack down on irresponsible dog owners. Many states have dangerous dog laws, and so do many cities.

Generally, the process of having a dog declared dangerous is set in motion by a formal complaint from an animal control officer or someone who has been threatened or injured by the dog. A hearing follows, at which a judge hears evidence and determines whether or not the dog is dangerous under the terms of the law.

If a dog is found to be dangerous, the judge will order the owner to take measures to prevent the dog from injuring anyone. At the least, the owner will have to keep the dog securely confined. If the judge determines that the danger can't be kept within an acceptable level, the owner may be ordered to have the dog destroyed or remove it from the city. An own ... Read more »

Questions touching the scope, effect or application of a rule of law which the courts apply in determining the rights of parties.

An issue before a court of appeal that requires the application of legal principles.

A question of law is usually contrasted with a question of fact. a mixed question of law and fact and even a question of discretion.

In the context of an appeal, a question of law is often put forward as an alleged error of law ; termed as a "question" for reasons of political correctness as it is not a recognized as a error until the appellate court says so.

In Woodhouse AC Israel Cocoa Ltd. Justice Alfred Denning (aka Lord Denning), wrote of the most commonly given example of a question of law :

"It has long been settled that the interpretation of a document is a matter of law for the court, save in those cases where there is some ground for thinking that the words were used by the writer — ... Read more »

PA trespassing laws

Could someone explain to me what the PA trespassing laws consist of.

I do some fox hunting at night and occasionally I'll hunt a field or wood strip that we don't have permission from the land owner. Sometimes I know who the land owner is, but he don't live locally. I want to make sure that I'm legal doing this. I really don't want to get a citation

To my understanding of the PA trespass laws the only way I can be arrested while hunting on private property with out permission is.

1. If the owner has the land posted or clearly marked with no trespassing signs.

2. If the owner has told me to stay off his land (verbal or by letter).

3. If I am damaging crops or any part of the property

4. If I am endangering any person.

5. If I am violating a hunting law (like a safety zone)

Recently I was talking to a land owner that told me that if there is a no trespassing notice in the local ... Read more »

#Civil Cases vs. Criminal Cases - Key Differences

Civil cases usually involve private disputes between persons or organizations. Criminal cases involve an action that is considered to be harmful to society as a whole. Below is a comparison of the key differences between civil and criminal cases.

A civil case begins when a person or entity (such as a corporation or the government), called the plaintiff, claims that another person or entity (the defendant) has failed to carry out a legal duty owed to the plaintiff. Both the plaintiff and the defendant are also referred to as "parties" or "litigants." The plaintiff may ask the court to tell the defendant to fulfill the duty, or make compensation for the harm done, or both. Legal duties include respecting rights established under the Constitution or under federal or state law.

Civil suits are brought in both state and federal courts. An example of a civil case in a state court would be if a citizen (including a corporat ... Read more »

Legal Separation Laws in the U.S. Copyright HG.org

A legal separation and a physical separation are not the same thing. In a physical separation, although the couple lives separately, there is no formal legal agreement.

A legal separation allows a husband and wife to live separately and formalize the arrangement by a court order or a written agreement. The arrangement addresses spousal support, and child custody, visitation and support, when relevant.

It is not equivalent to a divorce or dissolution and recognizes the possibility that the couple may reunite. It does not terminate a marriage, and so, does not allow the parties to remarry.

It is not necessary to be legally separated before obtaining a divorce. Although, most states have provisions for legally separated couples to commute their separation agreement to a divorce action, should they decide to do so.

Not all states recognize legal separations.

#Civil Cases

A federal civil case involves a legal dispute between two or more parties. A civil action begins when a party to a dispute files a complaint, and pays a filing fee required by statute. A plaintiff who is unable to pay the fee may file a request to proceed in forma pauperis. If the request is granted, the fee is waived.

The Process

To begin a civil lawsuit in federal court, the plaintiff files a complaint with the court and “serves” a copy of the complaint on the defendant. The complaint describes the plaintiff’s damages or injury, explains how the defendant caused the harm, shows that the court has jurisdiction, and asks the court to order relief. A plaintiff may seek money to compensate for the damages, or may ask the court to order the defendant to stop the conduct that is causing the harm. The court may also order other types of relief, such as a declaration of the legal rights of the plaintiff in a particular situation.

#Choosing a Law School

From fields of study to future career paths, here's what you need to keep in mind when choosing a law school.

Location, Location, Location

If you're not considering a Top 10 school, you may want to start your search by thinking about where you'd like to practice law one day. As a law student, you'll get to be involved in the community through clinics and build connections with professors and students which will, in turn, open doors for job opportunities. So, with that in mind, you can cross out any schools located in states where you do not want to practice as a lawyer.

Don't Play the Field

As you start to narrow down your list of schools based on where they are, you should also be thinking about what kind of law you'd like to practice after you graduate. Law schools do have specialties, just as practicing lawyers do. By applying to schools that are focused on your preferred field of study, you'll be able to better prepare ... Read more »

#Civil Rights

civil rights: an overview

A civil right is an enforceable right or privilege, which if interfered with by another gives rise to an action for injury. Examples of civil rights are freedom of speech, press, and assembly; the right to vote; freedom from involuntary servitude; and the right to equality in public places. Discrimination occurs when the civil rights of an individual are denied or interfered with because of their membership in a particular group or class. Various jurisdictions have enacted statutes to prevent discrimination based on a person's race, sex, religion, age, previous condition of servitude, physical limitation, national origin, and in some instances sexual orientation.

The most important expansions of civil rights in the United States occurred as a result of the enactment of the Thirteenth and Fourteenth Amendments of the U.S. Constitution. The Thirteenth Amendment abolished slavery throughout the United States. See U.S. ... Read more »

#Civil Rights Law.

What is Civil Rights Law?

Civil rights law deals with the protections and liberties enjoyed by the American people. These rights are designed to ensure that people are treated equally and without respect to their ethnicity, gender, or other such attributes. They also guard against overly intrusive conduct by the government. Government actors are not permitted to make decisions arbitrarily, or to deprive individuals of their lives or property without affording them due process of law. While civil rights violations give rise to a host of civil and criminal penalties for the offender, attorneys practicing in this area of the law are generally engaged in seeking financial compensation for victims.

Primary sources of civil rights law include the first ten amendments to the U.S. Constitution (the Bill of Rights), as well as a number of important pieces of federal legislation passed in recent decades. The Civil Rights Act of 1964 is a notable ex ... Read more »

#Civil Law Definition

A body of law derived and evolved directly from Roman Law, the primary feature of which is that laws are struck in writing; codified, and not determined, as in the common law, by the opinions of judges based on historic customs.

Has several meanings. In common law jurisdictions, the term can mean law as between citizens; law which regulates affairs between citizens or persons as between themselves (private law ).

Can also be distinguished from the criminal law which is the state or government's list of prohibited actions, and the process or procedure for dealing with transgressions thereof.

The most common use of the term is to refer to civil law legal systems. Many states in the world have comprehensive legal systems called civil law jurisdictions, largely inspired by Roman law. the primary feature of which was that laws were written into a collection; codified, and not determined, as is common law, by judges. Send your Wrongful Termination claim to a Lawyer who will review your claim at NO COST or obligation.

To answer the question, "What is Wrongful Termination?" (and to determine whether someone may have been wrongfully terminated), it helps to understand what the phrase "employment at-will" means.

All states have adopted the employment "at-will" doctrine to some degree, which means that employees can generally quit their jobs at any time without advanced notice or cause. It also means that an employer can generally fire or lay off their employees at any time without a reason. Employers often, and legitimately, ask employees to sign contracts or agreements that document and enforce the terms of at will employment, usually in company policy manuals.

There are exceptions to this doctrine. Employees and employers aren't allowed to breach employment contracts or agreements, or violate laws, regulations, constitutional provisions or public policy ... Read more »

October, 2003; Last Reviewed Dec. .

A contract intends to formalize an agreement between two or more parties, in relation to a particular subject. Contracts can cover an extremely broad range of matters, including the sale of goods or real property, the terms of employment or of an independent contractor relationship, the settlement of a dispute, and ownership of intellectual property developed as part of a work for hire.

Typically, in order to be enforceable, a contract must involve the following elements:

The parties to the contract have a mutual understanding of what the contract covers. For example, in a contract for the sale of a mustang , the buyer thinks he will obtain a car and the seller believes he is contracting to sell a horse, there is no meeting of the minds and the contract will likely be held unenforceable.

The contract involves an offer (or more than one offer) to another party, who accepts the offer. For example, in a contract for ... Read more »
