The law destroys the flexibility of the courts and the judge. It is unjust in certain conditions (victimless crimes, young criminals, etc.). Criminals often plea bargain their first two convictions. It is a violation of the 8th Amendment to the Constitution. An arrest of someone with two convictions almost guarantees the cost and time of a trial. The law adds more criminals to an already crowded and expensive prison system.

California has led the charge on a new concept of dealing with repeat offenders--the Three Strikes Law. Under this law, a person who is convicted of three felonies is given a mandatory 25-to-life sentence. A felony is defined as any crime punishable by 1 year or more in prison.

The law has been criticized for applying a one-size-fits-all sentence to repeat offenders. The often noted example is one young man who received the sentence after stealing a pizza. However, advocates of the law quote the large number of repeat offenders that alwa ... Read more »

Here you will find basic information on window tinting laws, "medical necessity" exemptions, and more. (also see: State-Specific Information on Vehicle Window Tint Laws )

To find the top online law school students should consider

1. Use of Socratic Method

Under the Socratic Method system of legal instruction. before each class, students are assigned cases to read and brief. This is followed by in-class presentations by the students. This is a crucial part of the learning process, students are questioned by the professor regarding the facts, rule of law, or the court’s reasoning in the case assigned for class.

The Socratic Method prepares students for the practice of law, it teaches law students how to analyze and make legal arguments, how to properly read and brief cases, and, lastly, how to prepare for the pressures of a legal practice. Although much of the practice of the law involves research and writing, all attorneys must discuss the law with other attorneys, judges, and their clients. Therefore, a properly trained attorney must be prepared to form legal arguments, analogize, and respon ... Read more »

Crazy driving laws aren t restricted to Massachusetts. They abound across the country. To keep you aware, we at DMV.org have organized a list of some of the most hare-brained laws you should be aware of before taking your next vacation or cross-country road trip.

#Constitutional Law Classes and Courses Overview

    Essential Information

Law students pursuing a Juris Doctor (J.D.) degree in constitutional law take courses focusing on issues related to constitutional governments and the history and basis of the U.S. Constitution. Many constitutional law courses are based on specific rights granted by the Bill of Rights of the U.S. Constitution.

Some topics that are covered in constitutional law courses include the supreme court, constitutional amendments, and the death penalty. These courses equip students with an understanding of how constitutional laws have been interpreted in the past, and how they can be applied to current events.

The practice of law involves representing a client in a court of law or during legal negotiations, and providing legal counsel to clients. While lawyers may also draft documents and conduct research into case and statutory law, these tasks are often relegated to paralegals, or legal support staff. To practice as a lawyer, an individual must have earned a juris doctor (J.D.) degree, in most cases from a law school accredited by the American Bar Association, and pass a bar examination to become licensed in their state. While there is much interest in online degree programs in law, it is important to note that at present there are no fully online programs leading to the J.D. that are accredited by the ABA, according to the ABA website. Since most states require students to have graduated from an ABA-accredited program to sit for the bar exam, online law school programs are not currently a feasible path to becoming a lawyer for individuals in all states.

Think very, very carefully before going to law school and perhaps ruining your life, permanently. The law schools have been flooding the market with a large oversupply of attorneys for decades. This has been a problem for a long time, not just in the current recession. The legal job market is horrible right now and it was only a little less awful earlier in the decade and in the 1990's. Consequently, the happy-talk about how the legal job market will improve significantly after the recession ends is bogus and intended to fool you. A huge amount of JDs, perhaps as much as 50%, never find work as attorneys, and many who do find work don't earn enough to make having gone to law school worthwhile. If you are looking for something to do with a liberal arts degree, find something else. Also, because of the huge oversupply of attorneys, working as a lawyer can be very miserable. Attorneys work very long hours under intense pressure in Machiavellian environments and many do not ea ... Read more »

I'm going to tell you a little story, but before I do, a warning: It ain't pretty.

It's a perfectly fine Thursday afternoon. I'm going about my business, happily editing a blog post, when I get an email from the head of HubSpot's legal department. Oh boy.

Apparently, he'd received a letter from a popular stock photography website claiming we had wrongfully used two of their images on our blog.

My first thought was, "What? This must be a mistake." We're very good about only using photos and images we have permission to use on the blog. As a result, we usually either purchase stock photos or use images sourced from sites like Flickr licensed under Creative Commons, which is a nonprofit offering easy-to-use copyright licenses that make it easy for people t ... #Consumer Protection

Consumer protection is an umbrella term covering a group of laws and organizations that protect the rights of consumers and foster the free flow of accurate information in the marketplace. Consumer protection laws are designed to prevent businesses from engaging in fraud or unfair practices, to protect individuals from scam artists, and identity thieves and crooks.

Consumer protection involves everyday issues and threats like identity theft, sales contracts, lemon laws, travel and fraud. A consumer is anyone who acquires goods or services for direct use or ownership.

All consumers should learn how to do simple things like manage a credit score, read the fine print on a gift card and understand the importance of choosing a secure email password. It's also important to know when the law is on your side and when to contact an attorney to help you enforce your rights.

#Consumer rights and law - European Commission

In the EU, consumer protection legislation guarantees that everyone has the right to be treated fairly when buying household goods at the supermarket, paying the bill at the energy supplier or downloading music.

The Charter of Fundamental Rights and the European treaties since the Single European Act guarantee a high level of consumer protection in the EU. It is also a general objective defined in Article 12 of the Treaty on the Functioning of the EU.

    European legislation guarantees consumers:

    • fair treatment;
    • products which meet acceptable standards;
    • a right of redress if something goes wrong.

EU legislation in other areas also has to take consumer protection into account .

#Consumers International - UN Guidelines on Consumer Protection

United Nations Guidelines for Consumer Protection

Our hard fought advocacy has delivered consumer protection guidelines at the international level.

The United Nations Guidelines for Consumer Protection (UNGCP) act as an international reference point of the consumer movement, but with new developments in technology and business practices, there is a strong argument for revising them to ensure they are still relevant to the challenges facing consumers.

The guidelines were adopted by the UN in 1985 after 10 years of campaigning by CI. They gave important legitimacy to the principles of consumer rights and practical support and guidance for developing national consumer protection legislation.

In 1999, they were updated with a new section on sustainable consumption and production (section G) to reflect environmental concerns emerging during the 1990s.

But it is an area of the law where, beyond that simple fact, the waters are very murky.

In a nutshell, the Supreme Court of Canada said that the section of the Criminal Code which made abortion a crime was of no force or effect so it is as if that section did not exist. The Supreme Court can overrule Parliament when the latter's laws are incompatible with the Charter of Rights and Freedoms. That was the case here.

Behaviour in Canada can only be criminal if a federal law specifically prohibits it.

There is a long history of abortion in common law. known as "destroying infants in the mother's womb" and punishable by "transported beyond this season for the term of his or her natural life or for any term not less than 15 years" (William Russell, A Treastise On Crimes and Misdemeanors (Philadelphia: T JW Johnson Co.,1857), p. 671).

My son has been married for four years. From the planning of the wedding until now, it has been difficult. I was blamed for things that happened before the wedding which were not true and I just find my daughter-in-law to be very cold. I was never invited to their home as he said the house was too small. They now have a son. I gave her a beautiful shower and nice gifts. Everyone got a thank you note but me. I cry a lot over this. #Contract law - European Commission

One of the European Union s most significant achievements is the Single Market. Its fundamental freedoms entitle businesses and citizens to move and interact freely in a borderless Union.

The steady lowering of the barriers between EU Member States has brought numerous benefits to citizens. Citizens in their capacity as consumers have enjoyed a number of economic benefits such as lower air fares and mobile telephone roaming charges and the possibility to access a larger variety of products. Traders have been able to extend their activities cross-border, by importing and exporting goods, providing services and establishing themselves abroad. Thus they benefit from the economies of scale and the greater business opportunities that the single market offers.

Despite this impressive success, barriers between EU Member States still remain. Many of these barriers result from differences between ... Read more »

#Contracts of employment - Acas Mobile

    Key points

    • A contract of employment is an agreement between an employer and employee and is the basis of the employment relationship.
    • Most employment contracts do not need to be in writing to be legally valid, but it is better if they are.
    • A contract 'starts' as soon as an offer of employment is accepted. Starting work proves that you accept the terms and conditions offered by the employer.
    • Most employees are legally entitled to a Written Statement of the main terms and conditions of employment within two calendar months of starting work. This should include details of things like pay. holidays and working hours. Download our Written Statement of Employment [55kb] template.
    • An existing contract of employment can be varied only with the agreement of both parties.

Watch our expert adviser talk about one of the most asked questions to the Acas Helpline.

#Cooley Law School To - Cease Operations - At One Of Its Campuses

This summer, we began reporting on the uphill battle the Thomas M. Cooley Law School faced with regard to its declining revenue and student enrollment. In early July, we were the first to break the news that Cooley Law would stop accepting first-year students at its Ann Arbor campus as part of a financial management plan. At the time, James Robb, the law school’s associate dean of external affairs and senior counsel, said there were no plans to close the campus.

Plans apparently changed quickly, because at the end of July, we learned that Cooley Law was considering consolidating the Ann Arbor campus with other Cooley campuses by the end of the fall 2014 semester. Once again, Robb assured the media that no definitive plans had been made yet.

Now that we re almost halfway through the fall 2014 semester, it seems that Cooley Law has begrudgingly decided to lie in the bed that it has made. This may be th ... Read more »
