#Common law marriage - Family Lives

Understanding the myth of common law marriage

Contrary to popular belief, there is no such thing as a common law marriage . In England and Wales only people who are married, whether of the same sex or not, or those in civil partnerships can rely on the laws about dividing up finances when they divorce or dissolve their marriage.

The assumption by many unmarried couples in a long standing relationship that they have acquired rights similar to those of married couples is wrong. This common misconception needs to be addressed particularly as for many years official statistics show numbers of marriages in decline as more people choose to cohabit (living together without being married).

Many people also believe that by having a child together they acquire legal rights, whether married, in a civil partnership, or not. This is also not true. Although there is scope to apply to court for financial provision when there are childr ... Read more »

Trademarks are generally words, phrases, logos and symbols used by producers to identify their goods. However, shapes, sounds, fragrances and colors may also be registered as trademarks. See Qualitex v. Jacobsen Products Co. Inc.. 514 U.S. 159 (1995). In recent years, trademark law has expanded to include trade dress and antidilution protection. Almost any word, name, symbol, or device capable of distinguishing the source of goods may be used as a trademark subject to few limitations. However, a mark 's eligibility for trademark protection may be limited by application of the functionality doctrine. and a mark may be denied registration if it falls within any of the categories listed under 15 U.S.C. § 1052 .

Common Law Marriages

Common law marriages can have a bearing on student aid eligibility, since a married student is automatically independent.

The requirements for a common law marriage are as follows:
  • The couple must live together for a significant amount of time. The word significant is not defined in any state, but is generally interpreted as sufficient time to reasonably establish the intent of the couple to be married.
  • The couple must hold themselves out as married. This can include use of the same last name, referring to each other as husband and wife, maintaining a joint checking account, signing the lease as "Mr. and Mrs.", and filing a joint income tax return.
  • The couple must have the capacity to be married. This means they must have the legal and mental capacity to be married and not be already married to someone else.

#Community colleges seek state OK to give bachelor s degrees - Crain s Detroit Business

Conway Jeffress. Four-year nursing degree "inevitable."

LANSING Two metro Detroit community colleges say they are ready to offer bachelor's degrees in nursing. All they need is permission.

Schoolcraft College in Livonia and Henry Ford College in Dearborn are among the leaders championing an effort in Lansing to allow Michigan's two-year schools to award bachelor's degrees in more fields, something now limited to four-year universities.

Both schools support Senate Bill 98, which is pending in that chamber and would authorize community colleges to award bachelor's degrees in nursing and four other technical fields.

"If this happened this afternoon, I'd be ready tomorrow," Schoolcraft President Conway Jeffress said. Should legislation be approved, he said, it would take at least a year before the program cou ... Read more »

#Common Law Separation in Canada

A common law relationship is defined as two people who live together in a committed “marriage-like” relationship. According to recent Canadian census, common law relationships are quickly on the rise in our country. Despite the spike in this type of relationship, the rights of people living together outside of a marriage are still quite misunderstood. In fact, many people incorrectly believe that a common law couple is entitled to the same rights as a married couple, but this is most often not true. The exact laws of a common law marriage, and even the criteria needed to qualify as one, vary by province or territory across Canada.

#Overview of MBA Programs

Full-time, Part-time, On-line and Executive MBAs

#Competition driving some law firms out of Abu Dhabi

As Abu Dhabi Global Market opens its doors to international financial and professional services firms, a number of western law companies appear to be packing up and heading back down the road to Dubai.

Experts say the exodus comes as tough competition for a limited supply of work has been exacerbated by high rental costs.

What is Consumer Rights Law?

Consumer rights and consumer protection law provides a way for individuals to fight back against abusive business practices. These laws are designed to hold sellers of goods and services accountable when they seek to profit by taking advantage of a consumers lack of information or bargaining power. Some conduct addressed by consumer rights laws is simply unfair, while other conduct can be described as outright fraud. Consumer rights laws exist at the federal and state level. They are enforced by government agencies, offices of attorneys general, and through individual and class action lawsuits filed by victims.

Types of Consumer Protection Cases

The most common kinds of abusive business practices occur when consumers are in particularly vulnerable circumstances. For example, when people fall behind on their bills, debt collectors are in a position to make life even more d ... Read more »
