Study at your own pace!
Course Description

Yet many individuals or business owners do not fully understand the implications of signing a contract or breaching a contract. Today we had the honor of being invited to speak to the maritime law society at Stetson University College of Law .
Stetson has the oldest law school in Florida, founded in 1900. Its campus is located on the beautiful Mediterranean style architecture campus in Gulfport, Florida.
I discussed the topic Crime on Cruise Ships, and explained the epidemic of cruise crimes on cruise ships over the past decade.
Assisting me with the presentation was Caitlin Burke (bottom right), an intern at our firm. Ms. Burke graduated from the University of Florida where she majored in Recreation, Parks and Sport Management. Ms. Burke wrote a senior honor's thesis entitled a Qualitative Study of Victimization and Legal Issues Relevant to Cruise Ships . Caitlin was also a guest blogger last year when she authored Why Cruises are NOT the Best Vacations with Kids .
Stetson has a well established introductory maritime program and a well

#Is an MBA Still Necessary?
Current Issue
This story first appeared in the October 2012 issue of Entrepreneur . To receive the magazine, click here to subscribe.
It used to be that top corporations picked up MBA graduates as fast as schools could slap mortarboards on their heads. These young guns drove corporate reorganization, product innovation and marketing and implemented new styles of leadership. They were a symbol of a new culture, and anyone serious about a career in business aspired to earn those three letters.
Today, the power of the MBA is not so certain. Many in corporate America and academia say the degree that once defined bright, snappy leadership now symbolizes a discipline that has lost touch with the business world. They argue that MBA programs have become too focused on research, and that in-house training at large firms has more practical applications. They claim the programs have failed to create the types of leaders who can de

Prior to 1970, employees had no federal agency specifically tasked with ensuring their safety. Congress passed the Occupational Safety and Health Act in that year. The new agency created to oversee the act also took its name from the legislation. OSHA, as it became known, was placed under the Department of Labor. OSHA monitors job safety nationwide and issues regulations that have the same weight as laws. Companies or individuals found out of compliance with OSHA regulations may be fined or punished by jail time. Here are a few questions and answers to help you understand OSHA laws.
The primary way OSHA sets regulations is through its standards. These are multi-page documents that set out all the parameters that a company must follow on a specific issue. A standard may tell companies how it must set up signs, signals, and barricades around a site with workers. Another standard might require that all ladders be capable of a certain load for different tasks. Shipping and stora

What is Administrative Law? It covers a wide and varied area of practice, encompassing many different types of governmental legal procedures and regulations, and is not easily defined. Much of government and its public programs operate largely through various agencies on different levels: federal, state, county, and city. These agencies are also known as boards, commissions, departments, and divisions.
They generally have their own specific rules and regulations, which are not usually found in the statutes, with stringent procedures individuals must follow to obtain assistance from the agency and to file claims, grievances and appeals. Legal rulings by Administrative Law Judges (ALJ?s) have governing authority the same as most precedent law. Administrative law attorneys can offer assistance when maneuvering through these complicated proceedings.
The Administrative Procedure Act is the governing law for federal administrative agencies. Most states also have the

#Internet Privacy: A New Bill Finally Offers Protections
It should not come as a surprise to anyone these days that Internet companies have digital dossiers on all of us — the websites we visit, the friends we ve sent emails to, the photos we re tagged in, the medical symptoms we ve searched for. But there has never been any way for us to know just what these companies know about us — or who they re selling our information to.
But that could finally be about to change — in California, which is on the cutting edge of technology policy, and perhaps, eventually for the whole nation. A long-overdue bill in the California legislature, The Right to Know Act, would force companies such as Google and Facebook to reveal what personal information they have collected and how it s being used.
The public cares about Internet privacy — even though tech companies like to argue otherwise — and opinion polls show strong support for laws to protect it. In one national poll, responden

Fact: not every criminal defense attorney or law firm in Plano gets you the same legal outcome.
The truth is two different lawyers often get you wildly different results – even if they theoretically represent you for the same crime.
For example, take a look at this case. Criminal defense attorney Kent Starr helped this client, accused of manslaughter (which has a 2-20 year prison sentence by the way), go home a free person.
Here’s how the story goes:
A certain client (we have to protect their confidentiality) approached Kent for legal representation. This client was accused of killing another individual in Collin County, TX.
This client was charged with criminally negligent homicide (has a 180-day to 2-year sentence). The client actually admitted involvement with the death of another person. However, the client did not believe their actions amounted to criminally negligent homicide. Kent agreed with the client

Law school rankings play an important role in helping applicants choose the law schools they will apply to. Is this justified?
This is a very tricky area, even though it is not by any means inappropriate for applicants to use them like this. Rankings are barely an art form, let alone scientific, because of the methodological problems involved in their creation. An immense amount of information must be reduced down to a few factors that can then be used to calculate scores to allow readers to differentiate among schools. Even in the simplest of universes, this would be difficult.
For instance, how important is it to have a library of 1,000,000 volumes rather than 600,000 volumes, and how does that compare with having a student body TOEFL average of 620 rather than 640? Is the school with 1,000,000 volumes and a TOEFL average of 620 better than the school with 600,000 and 640, respectively? Or is it equal to it or worse? It is not obvious how the two schools should be

#Introduction to the Workers Compensation Law
(On-the-Job Injury or Illness)
Introduction to the Workers' Compensation Law
Workers' compensation is insurance that provides cash benefits and/or medical care for workers who are injured or become ill as a direct result of their job.
Employers pay for this insurance, and shall not require the employee to contribute to the cost of compensation. Weekly cash benefits and medical care are paid by the employer's insurance carrier, as directed by the Workers' Compensation Board. The Workers' Compensation Board is a state agency that processes the claims. If Board intervention is necessary, it will determine whether that insurer will reimburse for cash benefits and/or medical care, and the amounts payable.
In a workers' compensation case, no one party is determined to be at fault. The amount that a claimant receives is not decreased by his/her carelessness, nor increased by an employer's fault. However, a wo

Workplace safety and health laws establish regulations designed to eliminate personal injuries and illnesses from occurring in the workplace. The laws consist primarily of federal and state statutes. Federal laws and regulations preempt state ones where they overlap or contradict one another.
The main statute protecting the health and safety of workers in the workplace is the Occupational and Safety Health Act (OSHA). Congress enacted this legislation under its constitutional grant of authority to regulate interstate commerce. OSHA requires the Secretary of Labor to promulgate regulations and safety and health standards to protect employees and their families. Every private employer who engages in interstate commerce is subject to the regulations promulgated under OSHA.
In order to aid the Secretary of Labor in promulgating and enforcing regulations, the act establishes the National Advisory Committee on Occupational Safety and Health. The Secretary of Labor may auth

Employment contract law is the body of law related to agreements made between employers and employees. Written, oral, or implied contracts often give rise to disputes in an employment relationship, and in some cases the end result is wrongful termination. There are several types of employment contracts, including non-compete agreements, waiver of rights agreements, and severance agreements. An at-will employee is a worker who is offered no employee contract who or is offered a contract but can be terminated at any time. Employment workplace issues pertaining to at-will employees or employees under long-term contracts are often beyond the scope of employment contract law.
Employees often hire attorneys to review a contract of employment to avoid legal pitfalls and to ensure that their rights are protected and that the contracts are in their best interests. For example, an employee may have waived his rights to trial in the contract and must go to arbitration where a panel of
