#Probate Law - Legal Definition
Probate is the process of proving a will is valid and thereafter administering the estate of a dead person according to the terms of the will. It is a judicial act or determination of a court having competent jurisdiction establishing the validity of a will. First the will is filed with the clerk of the appropriate court in the county where the deceased person lived, along with a petition to have the court approve the will and appoint the executor named in the will (or if none is available, an administrator) with a declaration of a person who had signed the will as a witness. If the court determines the will is valid, the court then "admits" the will to probate.
Probate is a general term for the entire process of administration of estates of dead persons, including those without wills, with court supervision. The initial step in the process is proving a will is valid and then administering the estate of a dead person according to the terms of

Nurses are required to wear face masks for refusing the flu vaccine.
Health Impact News Editor Comments:
All across the U.S. hospitals are increasingly implementing mandatory policies to force their employees to receive the annual influenza vaccination as a condition of employment. In some cases, refusal results in termination of employment. In many other cases, anyone refusing to receive the mandatory flu vaccine is required to wear a mask over their face during the entire flu season, usually from the beginning of November until the end of March.
As we have recently reported, nurses across the U.S. are refusing the flu vaccine and choosing instead to wear masks (see: Nurses Across the U.S. are Taking a Stand Against Forced Flu Vaccines ). Many have reporte

Broadly defined, health law includes the law of public health, health care generally, and medical care specifically. Preserving public health is a primary duty of the state. Health regulations and laws are therefore almost all administered at the state level. Many states delegate authority to subordinate govermental agencies such as boards of health. These boards are created by legislative acts.
Federal health law focuses on the activity of the Department of Health and Human Services (HHS). It administers a wide variety of agencies and programs, like providing financial assistance to needy individuals; conducting medical and scientific research; providing health care and advocacy services; and enforcing laws and regulations related to human services. An important part of the HHS are the Centers for Medicare and Medicaid Services. which oversee the Medicare and Medicaid Programs. Their goal is to ensure that elderly and needy individuals receive proper medical care.

Graduate law degrees have come under the spotlight recently, with some questioning their value in terms of boosting employment rates and salary prospects. There’s certainly been mounting recognition that Master of Law (LLM) won’t immediately guarantee a US$160,000 annual starting salary.
However, while figures relating to return on investment may have been over-exaggerated in the past, it’s still the case that a master’s or PhD-level degree in law is likely to open new doors – in terms of both career options and academic challenges.
“Postgraduate training is a sign that a lawyer has an advanced knowledge of one or more aspects of law and has successfully demonstrated this through an assessment process,” says laureate professor Cheryl Saunders, an associate dean at Melbourne Law School, Australia. “If the university that has conferred the degree is known to be rigorous, the degree will be more highly valued.”

Common law is the system of deciding cases that originated in England and which was latter adopted in the U.S. Common law is based on precedent (legal principles developed in earlier case law) instead of statutory laws. It is the traditional law of an area or region created by judges when deciding individual disputes or cases. Common law changes over time.
The U.S. is a common law country. In all states except Louisiana, which is based on Napoleonic code, the common law of England was adopted as the general law of the state, or varied by statute. Today almost all common law has been enacted into statutes with modern variations by all the states. Broad areas of the law, such as property, contracts and torts are traditionally part of the common law. Because these areas of the law are mostly within the jurisdiction of the states, state courts are the main source of common law. The area of federal common law is primarily limited to federal issues that have not been addressed by

Statutes may originate with national, state legislatures or local municipalities. Statutes of lower jurisdictions are subordinate to the law of higher.
The term codified law refers to statutes that have been organized ("codified") by subject matter; in this narrower sense, some but not all statutes are considered "codified." The entire body of codified statute is referred to as a "code," such as the United States Code, the Ohio Revised Code or the New Hampshire Revised Statutes Annotated. The substantive provisions of the Act could be codified (arranged by subject matter) in one or more titles of the United States Code while the "effective date" provisions—remaining uncodified—would be available by reference to the United States Statutes at Large. Another meaning of "codified law" is a statute that takes the common law in a certain area of the law and puts it in statute or code form.
Another example of statutes that are not typically codified is a "p

If you've been arrested and accused of a crime particularly a felony such as homicide you'll need a criminal defense attorney to protect your rights. Individuals who are already on probation or parole for another felony will find it equally important to retain a capable criminal law attorney. Even those accused of lesser crimes like theft or simple assault are likely to need legal representation from a licensed criminal defense attorney.
Your criminal defense attorney's job is to protect your rights and ensure your access to a fair trial. By examining the circumstances surrounding your case and weighing the strength of the evidence against you, your defense lawyer will apply current law, along with previous legal precedent, to your specific situation and use it to devise a solid legal strategy and build the best possible case for acquittal.
In criminal cases where ample evidence of innocence exists, a capable attorney will leverage that evidence to i

#Lenz s law
Lenz's law (pronounced (IPA ) [ˈlɛntsəz lɔ] ) was formulated by German physicist Heinrich Lenz in 1834 and gives the direction of the induced electromotive force (emf) and current resulting from electromagnetic induction .
Definition Edit
For a current induced in a conductor, the current is in such a direction that its own magnetic field opposes the change that produced it.
Connection with law of conservation of energy Edit
Lenz's Law is one consequence of the principle of conservation of energy. To understand why, consider a permanent magnet that is moved towards the face of a closed loop of wire (eg. a coil or solenoid ). An electric current is induced in the wire, because the electrons within it are subjected to an increasing magnetic field as the magnet gets closer and this produces an emf (Electromotive Force) that acts upon them. The direction of the induced current will depend on whether it is the north pole or the south

While alcoholism is a recognized illness across the nation, it is no longer recognized by the Social Security Administration as a disability. Currently, if you file for Social Security Disability, and the office discovers your alcoholism, it might block your attempt to receive disability benefits, even for a qualifying disability.
The decision is based on whether you would still be disabled if all alcohol-related issues were removed from your life. For example, alcoholism has caused you to have constant hand shaking to a point you cannot function without getting some alcohol into your body. In addition, you have schizophrenia. The SSA office will look at what happens when you remove the alcoholism from your life. Yes, the shaking will go away, allowing you to function in a work setting, however, the schizophrenia will remain, which may be a qualifying disability depending on the scope and range that the problem has an impact on your ability to work. What is an LLM? A Master of Laws, or LLM, is an advanced academic degree not to be confused with a professional degree in law, such as a Juris Doctor (JD). There are several important differences between an LLM and a JD. Lawyers typically earn an LLM for one of two reasons: to become familiar with a foreign system of law. or to gain expertise in a specific area of law .
A JD, on the other hand, allows lawyers to practice law in the United States. Some states allow lawyers with professional degrees from foreign countries to practice law in the United States if they earn an LLM focused on the American legal system, such as that offered by the online @WashULaw. but LLM regulations vary between states. Lawyers interested in taking this route to practicing law in the United States should contact their local Bar Admission Offices. An LLM earned for the sake of expertise in a narrow field of law does not affect a lawyer’s eligibility to practice law – it simply deepens a lawyer’s k

#Probate Law.
Probate is the legal process of administering the estate of a deceased person, resolving all claims against the estate, and distributing the deceased person's property. If a person dies with a will, these are sometimes called testamentary probate proceedings. If they died without a will, the person is said to have died intestate.
Testamentary Probate
Generally, when one leaves a will behind there is little to take through probate. It is often simply a matter of appointing an executor (sometimes called a personal representative) to administer the estate and see to it that the assets and obligations of the estate are handled according to the directions set forth in the will. However, in some instances, potential heirs or other creditors may challenge the contents of the will, asserting that they are entitled to more than what has been left for them. Under these circumstances, a probate court decides whose claims are valid or not and makes t

#Legislative law
legislation: an overview
Legislation refers to the preparation and enactment of laws by a legislative body through its lawmaking process. The legislative process includes evaluating, amending, and voting on proposed laws and is concerned with the words used in the bill to communicate the values, judgments, and purposes of the proposal. An idea becomes an item of legislative business when it is written as a bill. A bill is a draft, or tentative version, of what might become part of the written law. A bill that is enacted is called an act or statute.
Ideas for legislation can come from legislators who have experience in a particular field, or legislators can copy legislation because an idea that works well in one jurisdiction can be useful to its neighbors. Legislators also receive proposals from the National Conference of Commissioners on Uniform State Laws ; a conference of 250 lawyers appointed by governors to represent the states. The Council of

For the past few months, I have been selling my law school textbooks online at Amazon.com. Every time I sell one, I am tempted to include a note to the recipient, begging them not to continue on the road to unhappiness and possible financial ruin. Instead, I simply place the packing slip inside the front cover and say a little prayer that the person who ends up using the book finds more happiness with their law degree than I have.
At first, I felt a little sad about selling them, like I was saying good-bye to all the dreams I had before I went to law school. Dreams that I would become the next Alan Dershowitz. Dreams that my family would be proud of me and my distinguished legal career. Dreams that I would find happiness and financial security beyond my wildest dreams, despite growing up dirt poor.
The truth is I don't

#Probing Probate - Dummies What You Should Know
Probate is a term that is used in several different ways. Probate can refer to the act of presenting a will to a court officer for filing such as, to "probate" a will. But in a more general sense, probate refers to the method by which your estate is administered and processed through the legal system after you die.
The probate process helps you transfer your estate in an orderly and supervised manner. Your estate must be dispersed in a certain manner (your debts and taxes paid before your beneficiaries receive their inheritance, for example). Think of the probate process as the "script" that guides the orderly transfer of your estate according to the rules. (For more info, see What’s a Probate Estate All About? )
Many people think that probate applies to you only if you have a will. Wrong! Your estate will be probated whether or not you have a will.
- With a valid will: If you have a valid will, the

Online degrees are an integral part of the future of education. With more online degree programs being offered from online schools and brick-and-mortar institutions, chances are you will experience online education at some point in your life.
Generally, schools offer a combination of online degrees ranging from online certificate programs (credentials that can supplement an existing degree) to online associates degrees. bachelors degrees and masters degrees. Some schools offer doctoral online degrees, though they are slightly harder to find.
The type of online degree you choose to pursue will depend on what field you are going into. For example, technology students usually benefit from a bachelors or masters online degree, since technology careers tend to require a more in-depth education. Paralegal students may benefit from an online certificate program rather than a full degree, as career success is based more on experience.

#Lemon Laws legal definition of Lemon Laws
Lemon Laws
Laws governing the rights of purchasers of new and used motor vehicles that do not function properly and which have to be returned repeatedly to the dealer for repairs.
Laws in all 50 states and the District of Columbia provide remedies to purchasers of defective new vehicles, often called lemons. These so-called lemon laws protect consumers from substantial defects occurring within a specified period after purchase and provide that a manufacturer must either replace the lemon with a new, comparable car or refund the full purchase price. According to the consumer advocate group Consumers for Auto Reliability and Safety, automakers repurchase 50,000 vehicles a year, about .33 percent of the 15 million vehicles sold annually.
California and Connecticut passed the first lemon laws in 1982, in response to dissatisfaction with remedies in state sales laws and the 1975 federal Magnuson-Moss Warranty Ac

The Juris Doctor (also referred to as Doctor of Law or Doctor of Jurisprudence) is the highest professional graduate degree in the field of Law. The Juris Doctor degree is often abbreviated JD, and graduates holding the degree normally take on the professional suffix of "esquire" after their name, rather than using the prefix "Dr."
What Are the Benefits of Taking a Juris Doctor?
Juris Doctor programs take a scientific approach to law, teaching logic and adversarial analysis. Promoting a practical approach to legal study, Doctor of Law programs prepare students for a career as a lawyer, attorney, barrister, counselor or other legal professional. JD programs also prepare students to succeed in professional law exams (sometimes called the "Bar" exam), required to practice in most countries. Passing the legal professional examination is the gateway to becoming a solicitor, lawyer, attorney or legal counsel.

Eligibility
When can I use the Texas Lemon Law?
If you have purchased or leased a new motor vehicle and it develops a defect or condition that substantially impairs the motor vehicle’s use, market value or safety, you may be eligible for relief under the Texas Lemon Law. You are required to allow the manufacturer a reasonable opportunity to repair the defect(s) before you may file a complaint for lemon law relief. There is a $35 filing fee required with the submission of the Lemon Law complaint form. The number of reasonable attempts may vary based upon the defect’s effect on the normal operation of the motor vehicle.
How many “reasonable attempts” to repair a defect is the manufacturer allowed?
One way to show the dealer has had a reasonable number of attempts to fix a defect is to pass the following tests. Mileage requirements in the tests do not apply to travel trailers.
The Four Times Test
You pass this test if

Check Your Local Laws
While the rules differ from state to state, as a general rule, if the vehicle continues to have a defect within the warranty period, even after it has been repaired four or more times, or the vehicle has been out of service for 30 or more days, then the vehicle is labeled a Lemon. Most state laws provide that an automobile manufacturer must either refund a consumer’s money and take back the defective vehicle or replace the vehicle. Keep in mind in most states it is typically the consumer’s choice to elect the relief that best suits them. Immigration law in the United States
Federal immigration law determines whether a person is an alien, the rights, duties, and obligations associated with being an alien in the United States, and how aliens gain residence or citizenship within the United States. It also provides the means by which certain aliens can become legally naturalized citizens with full rights of citizenship. Immigration law serves as a gatekeeper for the nation's border, determining who may enter, how long they may stay, and when they must leave.
Congress has complete authority over immigration. Presidential power does not extend beyond refugee policy. Except for questions regarding aliens' constitutional rights, the courts have generally found the immigration issue as nonjusticiable.
States have limited legislative authority regarding immigration, and 28 U.S.C. § 1251 details the full extent of state jurisdiction. Generally, 28 U.S.C. § 994 details the federal sentencing guide

(Page 2 of 2 of Lemon Law for New Cars)
Although most state lemon laws apply to new car sales only, a few states have lemon laws that also cover used cars. You should check the definition of a "new car" in your state lemon law. (To find your state's lemon law, visit www.autopedia.com or www.lemonlawamerica.com .) Some laws, for example, will cover a car that was bought with a certain amount of mileage on the odometer. In others, the lemon law applies to used cars that were still covered by the original warranty at the time of purchase.
Getting a Refund or Replacement Car
If your car meets the lemon law requirements for your state, you have the right to obtain a refund or replacement car from the manufacturer. Although the process for getting this relief is different in each state, in all states you must first notify the manufacturer of the defect. If you're not offered a satisfactory settlement, most states require you to go to arbitr

It’s common practice among many physician groups to refer everything from blood tests to MRIs to entities from which they benefit financially. It wasn’t supposed to be that way: Congress in the 1990s passed the Stark Law, which prohibited doctors from “self-referring Medicare patients. But loopholes have kept the practice alive and well. Urologists at cancer-care giant 21 st Century Oncology Holdings Inc. for example, refer tests to the company s in-house lab, as a page-one article in The Wall Street Journal reports , taking advantage of the law s exceptions. The company says that its urologists refer tests to the in-house lab for valid medical reasons, not financial ones, and that such referrals are permitted by exceptions to the Stark law.
The Stark Law has exceptions. Under the “in-office ancillary services” exception, a doctor can refer a Medicare patient for a treatment or test to another doctor “who is a member of the same group practice” if the treatment or test is fu

When small spherical bodies move through a viscous medium, the bodies drag the layers of the medium that are in contact with them. This dragging results in relative motion between different layers, which are away from the body. Therefore, a viscous drag comes into play, opposing the motion of the body. It is found that this backward force or viscous drag, increases with increase in velocity of the body.
According to Stoke, the viscous drag 'f'', depends on the coefficient of viscosity ' h ' of the medium, the velocity (v) of the body and radius (r) of the spherical body.
Stokes' law explains why the speed of a raindrop is less than a freely falling body with constant velocity, from the height of clouds.
The same law helps a man coming down with the help of a parachute, to slow down.
Terminal velocity refers to the constant velocity, acquired by a freely falling body in a viscous medium. Consider a small spherical body, falling freely due to gravity in

Law schools are ranked based on a number of factors, including faculty, selectivity, quality and post-graduate placement success. Student-to-faculty ratio matters, with higher rankings given to schools with fewer students per teacher and more library resources. Schools that accept students with higher LSAT scores and GPAs are also ranked higher. Impressions of the school from law institutions, practicing lawyers and judges also highly influence a school's rank. Finally, the rate at which a school's students pass the bar exam and subsequently get hired at law firms helps to determine the school ranking.
Beyond the top-100 ranked schools, law schools are ranked into second, third and fourth tiers. It is illegal to drive a mini-truck on any U.S. highway, including those in Missouri. They are considered too small to be on the road next to regular-sized vehicles without a safety issue. Adultery is voluntary sexual relations between an individual who is married and someone who is not the individual's spouse. Adultery is viewed by the law in many jurisdictions as an offense injurious to public morals and a mistreatment of the marriage relationship.
Statutes attempt to discourage adultery by making such behavior punishable as a crime and by allowing a blameless party to obtain a Divorce against an adulterous spouse.
Although adultery has been historically regarded as a legal wrong, it has not always been considered a crime. In Europe during the fifteenth and sixteenth centuries, adultery was punishable solely in courts created by the church to impose good morals. In the ecclesiastical courts, adultery was any act of sexual intercourse by a married person with someone not his or her spouse. The act was considered wrongful regardless of whether the other person was married. At Common Law, adultery was wrongful intercourse between a married woman and any

#Lessons Learned the Hard Way: Cohabitation and the Law
There are many reasons cohabitating couples may cite for not getting married. Some may say that they do not need a "piece of paper" to prove their love and commitment to each other. Other couples choose to live together without getting married in order to avoid the legal entanglements that can arise should the relationship end. Couples basing their decision on the latter reason should bear in mind that although cohabitating relationships often dissolve fairly simply, that is not always the case.
Perhaps the most notorious example of the legal quagmire that can surround the end of a cohabitating partnership is the case of Lee and Michelle Triola Marvin. Lee Marvin, the famous actor, and his partner, Michelle, lived together for several years before deciding to call it quits. When they did, Michelle claimed that she was entitled to support and an equal division of the property acquired during the relationship, but the ac

“The first thing we do, let’s kill all the lawyers,” shouts Dick the Butcher in Shakespeare’s Henry VI, Part II .
Since the 2008 recession, that’s what some think the American economy has conspired to do.
But let’s hope that what many have deemed a “crisis” for legal education doesn’t drive smart, principled students away from law. That would be a tremendous loss for our country. Our society doesn’t work without well-educated legal leaders dedicated to preserving America’s commitments to the Constitution and fair legal frameworks for dispute resolution.
Democracy requires the effective application of legal principles and rules in political life; capitalism requires legal checks to ensure fair competition in the economic sphere and protect the rights of employees, consumers, shareholders, and owners alike; and, n

#Libel and Slander - Libel and Slander
The law of defamation protects a person s reputation and good name against communications that are false and derogatory. Defamation consists of two torts: libel and slander. Libel consists of any defamation that can be seen, most typically in writing. Slander consists of an oral defamatory communications. The elements of libel and slander are nearly identical to one another.
Historically, the law governing slander focused on oral statements that were demeaning to others. By the 1500s, English courts treated slander actions as those for damages. Libel developed differently, however. English printers were required to be licensed by and give a bond to the government because the printed word was believed to be a threat to political stability. Libel included any criticism of the English government, and a person who committed libel committed a crime. This history carried over in part to the United States, where Congress under the presidency

The public variety of this type of law applies when two or more countries or sovereign entities are involved. These laws might cover topics such as human rights, wartime laws and the laws at sea. Violations of these laws might result in ramifications such as sanctions by other countries, the ending of certain agreements between the countries that are involved or, in the most severe cases, declarations of war.
When legal matters involve people, businesses or private organizations from separate countries, rather than government bodies, it is considered private international law. This type of law often involves settling matters such as which country's laws apply or where the case will be decided. It often is necessary for governments to step in to help their citizens settle these matters or to help them achieve a fair result.
