#High court to rule on MPs claim that data retention act damages privacy

High court judges will give their decision on Friday on an accusation that the government has imposed laws which allow the police and security services to “spy on citizens” without proper safeguards.

Two MPs and other campaigners are seeking a ruling that the Data Retention and Investigatory Powers Act (Dripa) is “incompatible with EU law”.

Conservative former shadow home secretary David Davis and Labour backbencher Tom Watson say they are concerned to protect the confidentiality of their contacts with constituents and other members of the public – including whistleblowers – who might approach them with sensitive information.

Their case is backed by the human rights pressure group Liberty.

At the hearing, Dinah Rose QC, for the MPs, said the legislation was rushed through in July last year “with enormous speed and hardly any scrutiny”.

HIPAA BACKGROUND

HIPAA was enacted as a broad Congressional attempt at healthcare reform - it was initially introduced in Congress as the Kennedy-Kassebaum Bill. The landmark Act was passed in 1996 with two objectives.

  1. One was to ensure that individuals would be able to maintain their health insurance between jobs. This is the Health Insurance Portability part of the Act. It is relatively straightforward, and has been successfully implemented.
  2. The second part of the Act is the "Accountability" portion. This section is designed to ensure the security and confidentiality of patient information/data. In addition, it mandates uniform standards for electronic data transmission of administrative and financial data relating to patient health information.

Maritime law, or admiralty law, is one of the most established and oldest types of law. It generally covers laws or rules that govern tort, contract, marine commerce, ships, shipping, and worker compensation claims that arise on the world’s navigable waters. Topics can include salvage, towage, maritime liens, maritime contracts, marinas, and maritime injuries.

Although the topics covered by maritime laws are numerous, there are several that are quite interesting. For example, there are laws that govern what happens when someone finds property that is lost. Under international laws, if property is lost on the water and found by someone else, the finder can claim a salvage award for the retrieved property. Consequently, if a ship is damaged and loses cargo during a bad ocean storm, the finder can ask the shipping company to pay them money for any of the cargo they retrieve. Usually the salvage award is less than half of the value of the property that was salvaged.

    #HIPAA Preemption Charts

    The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") gave the federal Department of Health and Human Services ("HHS") the authority to promulgate regulations containing standards with respect to the privacy of individually identifiable health information. HIPAA provided that such standards shall not supersede State law that imposes more stringent standards (P.L. 104-191, 264(c)). HHS promulgated the federal standards, and they are now in Parts 160 and 164 of Title 45 of the Code of Federal Regulations (the "Privacy Rule").

    Under the Supremacy Clause of the U.S. Constitution, federal law preempts State law when preemption is the clear and manifest purpose of Congress. In instances where the purpose of Congress is not clear, only the judicial branch of government can determine whether a federal law preempts a State law under the Supremacy Clause.

    A Brief Background on the HIPAA Rules and the HITECH Act

    The Health Insurance Portability and Accountability Act (HIPAA) was enacted by the U.S. Congress in 1996. The Act is massive in scope with five separate Titles. Title II of HIPAA, known as the Administrative Simplification provisions, requires the establishment of national standards for electronic health care transactions and national identifiers for providers, health insurance plans, and employers. The Administrative Simplification provisions also address the security and privacy of health data. The standards are meant to improve the efficiency and effectiveness of the nation's health care system by encouraging the widespread use of electronic data interchange.
