Property Law

Generally, property is divided into two major areas: realty and personalty. Realty is land, whereas personalty is possessions for instance, jewelry, money, furniture, or (formerly) slaves. State laws regulate who may purchase property, who may own it, and how it will be distributed upon the death of the owner or owners. This premise applies unless the land is federal property, in which case the federal government makes the determination.

Property laws have been important from the beginning of this nation, especially since many new citizens did not or could not own property in their countries of origin. Disagreement among the colonies about continuing British legal traditions resulted in differences in colonial laws some colonies wanted to remain true to British leg ... Read more »

If you live in a state that borders Canada, you may already know that it is harder to cross the border than it was a few years ago. The good news is that an enhanced drivers license can make it easier to get to Canada for drivers in the United States.

An enhanced drivers license is a hybrid between a drivers license and a passport. By showing the license to border patrol agents, you can cross into the country with less scrutiny. The enhanced license adheres to Western Hemisphere Travel Initiative (WHTI) guidelines and is also good when entering Canada by sea.

Currently, four states have this form of license. Those states are New York, Michigan, Vermont and Washington. There is an extra fee to get the enhanced li ... Read more »

The Internet has led to the development of a burgeoning field of legislation wherein amateur lawmakers seek, in the manner of Murphy's Law, to glibly describe certain aspects or observations regarding internet behaviour in general and, more specifically, debates and discussions on Usenet groups and internet forums.

Warning. Internet law tends neither to be logically rigorous nor evenly applied. It often commits fallacies. Invocation of individual laws is usually a time-saving device used to prevent one from being dragged into an argument with someone who will under no circumstance alter one's own opinion.

#Pros and cons of online law school

October 14, 2009 by Editors

As a third-year law student who has given 15 hours of my life a week for the past two years to sitting in a classroom, I’m a little biased when it comes to evaluating online law schools. I can’t help but feel that actually being face-to-face with other students and professors is essential for the study of law, and moreover, for preparation to practice.

I had the misfortune of needing to take some online classes to graduate from college on time, and I have to say, the experience of analyzing British Literature alone and not discussing it with anyone didn’t teach me well, anything, about British Literature. I find it difficult to believe that studying the law solo would yield different results.

Below, I list some of the pros and (the many) cons to learning the law over the Internet.

Massachusetts General Laws, also known as the General Laws of Massachusetts. is a codification of many of the statutes of the Commonwealth of Massachusetts. The Commonwealth's laws are promulgated by an elected bicameral legislative body. the Massachusetts General Court. The General Court amends the General Laws by enacting session laws. which are published chronologically as the Acts and Resolves. Session law may effect modifications and additions in the General Laws. Not all session laws, which apply equally to codified law, are entered into the General Laws.

In legal citations, Massachusetts General Laws are abbreviated as M.G.L. or G.L. Provisions in the General Laws are identified by chapter and section, e.g. Mass. Gen. L. c. 93A, § 9. Chapters are grouped topically by part and title. The parts of the General Laws are as follows: I. Administration of Government ; II. Real and Perso ... Read more »

The South African court system is organised hierarchically, and consists of (from lowest to highest legal authority): Magistrates' Courts ; High Courts ; a Supreme Court of Appeal. the highest authority in non-Constitutional matters; and a Constitutional Court. which is the highest authority in constitutional matters. [ 2 ] The Constitutional Court has final authority to decide whether an issue is Constitutional or not. Certain specialised courts have also been provided for by the legislature, in order to avoid backlog in the main legal administration infrastructure. Among these is the Small Claims Court, which resolves disputes involving small monetary sums. In addition, African indigenous courts, which deal exclusively with indigenous law, also exist.

The Juris Doctor program focuses on the knowledge and skills necessary to be an effective member of the legal profession. Students work through the academic program much like they would if they were enrolled in a bricks-and-mortar law school. At the start of the first year, students are assigned to a section. They meet regularly as a group in their synchronous classes. They also get together outside of class—online, on the phone, and occasionally face to face—as they connect with a “study buddy” or form study groups. When the section completes the year, students tell us they know more about each other and have developed closer relationships than often resulted from their experiences in a traditional classroom environment.

#Master of Laws (LL. M. )

The Master of Laws (LL.M.)

Our LL.M. degree consists primarily of courses and seminars, and requires students to complete a research paper under faculty supervision on a topic of their choice. They may also elect to do more than one research paper. The LL.M. degree is awarded upon completion of 24 credits with at least a 2.7 (“B-”) average in two terms (eight months) of study.

Students in this program freely select courses and seminars, according to their interests, from the wide variety of subjects offered by the Law School. It is customary in U.S. law school classes for students to participate through discussion, by faculty calling upon students for comments, and by students questioning each other and their professors. This kind of active student participation brings intellectual rigor and vibrancy to the American classroom, and the ensuing discussions are greatly enriched by the comparative perspective of a multinational student body.

#Master of Laws (LL. M. ) Program

Overview

The Law School's LL.M. program is strictly a research and writing one designed for people who have already received a basic law degree from an American law school or an equivalent degree (e.g. LL.B.) from a university outside the U.S. The LL.M. is primarily of value to those planning on a career as a legal scholar or researcher. No course work is required (although students must register to get program credit for their research); in fact, degree candidates are actively discouraged from enrolling in courses. Applicants should already have a sufficient education in the field of research to pursue a serious scholarly project.

(If you are interested in the basic American three-year law program, the J.D. degree program, you are at the wrong place; go to JD Admissions .)

The University of Wisconsin Law School's LL.M. program is research-based.

#Master of Laws (LLM Degrees)

Types of graduate law degrees

In English-speaking countries such as Australia. New Zealand. Canada. Ireland and the UK. the most common graduate law degree program is the LLM degree (Master of Laws ), which is internationally recognized and takes one year of full-time study to complete. Although an LLM degree is not compulsory to be able to undertake legal practice training, it is often chosen by students wishing to improve their knowledge and employability within a certain area of law.

In the US meanwhile, the first professional law qualification offered in the country is the JD degree (Juris Doctor), a graduate-level program taking three years of full-time study to complete, in addition to undergraduate study. Some JD programs can also be completed in combination with another master’s degree (e.g. public policy ), but these will take longer to complete. If you’re ho ... Read more »

#Maxwell s Equations: Ampere s Law

[Equation 2]

Equation [2] can be explained: Suppose you have a conductor (wire) carrying a current, I. Then this current produces a Magnetic Field which circles the wire.

The left side of Equation [2] means: If you take any imaginary path that encircles the wire, and you add up the Magnetic Field at each point along that path, then it will numerically equal the amount of current that is encircled by this path (which is why we write for encircled or enclosed current).

Let's do an example for fun. Suppose we have a long wire carrying a constant electric current, I [Amps]. What is the magnetic field around the wire, for any distance r [meters] from the wire?

Let's look at the diagram in Figure 1. We have a long wire carrying a current of I Amps. We want to know what the Magnetic Field is at a distance r from the wire. So we draw an imaginary path around the wire, which is the ... Read more »

Douglas Laycock, a professor at the University of Virginia Law School, writes in an email:

The issue with respect to Religious Freedom Restoration Acts (RFRAs) is whether people should be allowed to practice their religion, even when their acts would otherwise be illegal, if they are not doing any real harm. The American tradition of religious liberty has exempted religious practices since the seventeenth century. Quakers in colonial times didn't have to swear oaths, or serve in the militia.

Sometimes this is entirely uncontroversial. It is illegal to give alcohol to minors, but no one thinks that law should be applied to communion wine, or seder wine at the Jewish Passover.

For a time, the federal Free Exercise Clause (part of the First Amendment) required religious exemptions unless the government had a compelling interest in enforcing its regulation. Then in 1990, the Supreme Court changed that rule, and basically said that the free exercise of religion is ... Read more »

Laws are created to maintain equality, stability, and structure. To maintain order in society, laws are established as is punishment for disobeying these laws. Laws are broken down by classification and to some degree, may interact with one another. Substantive law sets the ground rules for individuals whereas procedural law is the policy on how to carry out the rules. Criminal law is for the protection of society and civil law is to serve the purpose of compensating someone for a loss due to the actions of another person. In the late 1800s, Vilfredo Pareto, an economist, established that 80% of the land in Italy was owned by 20% of the population. This was the first instantiation of a socio-economic law that soon appeared to have universal scope.

The Pareto law, in its generalized form, states that 80 % of the objectives - or more generally the effects - are achieved with 20 % of the means - or more generally the causes or the agents. Subsequently, it takes 80 % of the means to achieve the remaining 20 % of the objectives. In other words, the cost required to move from 80 % to 100 % of the objective is four times bigger than the one required to move from 0 % to 80 %.

Practically, this entails that, beyond a certain threshold, the marginal cost of improving a situation further (e.g. to increase one's market share in a given market segment) becomes prohibitively high.

Hereafter are a few examples where the Pareto law typically applies:

80 % of a stock is filled with 20 % ... Read more »

#Masters Degree or Master - s Degree?

What is the proper way to spell masters degree ?

or is it master s degree?

or Masters degree?

or Master s degree?

To answer this question, I ve consulted the MLA Handbook for Writers of Research Papers. and some university dissertation guidelines.

Speaking generically, you would write master s degree:

Jack has finally earned his master s degree.

He holds a Master of Fine Arts from State University.

When it comes to abbreviating academic degrees, you d better check the style book that governs your work.

For example, here is what the guidelines say on the site of Ohio University:

Use periods when abbreviating academic degrees.

Ex. Dr. Bond received her A.B. M.A. and Ph.D. from the University of Pennsylvania. Ohio University

Northeastern University, like the MLA guide, prefers to drop the periods:

The Rule of Law Program capitalizes on the extraordinary initiative and commitment of Stanford law students and on invitations to partner with educational institutions and legal communities in countries seeking a more robust rule of law. Under the guidance of Professor Erik Jensen, a 30-year veteran of international development theory and practice, Stanford law students analyze both theoretical and practical ways that international and domestic actors can effectively support and strengthen the rule of law, taking full account of the local political economy of change and stasis.

From 2000 to 2006, the Rule of Law Program surveyed general trends in the Rule of Law and hosted specialized country workshops on countries such as Mexico, India, and China. In 2007 the Program reoriented its focus to supporting and guiding student driven, country specific projects. #Maxwell School Career Development: International Law

International Law is an interdisciplinary academic field for students who are interested in cross-border issues such as international business and human rights. To practice International Law, it is essential to first develop your legal knowledge and skills. Increasingly, international lawyers are specializing in at least one other area by combining a focused master’s degree that supplements their legal skills. While a J.D. and an international degree cannot guarantee work that is global in nature, the combination will give you a leg up when such jobs develop within an organization. Additionally, it is beneficial to be proficient in at least one other language and to have overseas experience.

For every job in international law, analytical ability, research and writing skills, and the knowledge of the basic differences in the world’s legal systems as well as their political and cultural contexts is essential.

#MBA accreditation: Why is it important?

Three quality standards that can help you pick a business school with more confidence

Accreditation from a reputable organization is one good way to check the quality of a business school. Accreditation organizations evaluate the quality standards of a business school's teaching, faculty, services, and students, among other things.

The three most-coveted, international accreditations for MBA programs are those awarded by AACSB, AMBA, and EQUIS; their methodologies and regional focuses are briefly described below.

In 2014, there were 67 business schools worldwide that were accredited by all three of the below organizations. This distinction is often referred to as the "triple accreditation."

The US- and Singapore-based Association to Advance Collegiate Schools of Business (AACSB) accredits business schools offering graduate and undergraduate business programs. It began doing this in 1919, and now accredi ... Read more »

#Mba Definition from Financial Times Lexicon

An MBA (Master of Business Administration) degree is the most widely-recognised business degree in the world and its popularity continues to grow, particularly in Asia.

The origins of the MBA go back more than a century to the Ivy League universities in the US. Dartmouth College established the first graduate business school in the US in 1900 – then called the Amos Tuck School of Administration and Finance. Harvard Business School launched its first postgraduate management degree in 1908.

The popularity of the MBA grew in Europe 50 years later, following the establishment of Insead in Fontainebleau, near Paris, by a group of Harvard graduates. It enrolled its first MBA cohort in September 1959. London Business School opened its doors to MBA students in 1966.

Today the MBA is usually seen as a post-experience degree, designed for those with some work/management experience. The full-time degree can last anything fro ... Read more »

Indiana has supplemental anti-discrimination laws and work-protection laws, known as specific labor laws, that guarantee each employed individual receives benefits and protection from wrongful discharge. Such laws include minimum wage (meaning that each employee must receive at least $7.25 for each hour worked), state military leave (which allows employed military reserves up to 15 days' paid or unpaid leave depending upon the employer's decision) and jury duty (which means that an employee cannot be terminated if absent from work as a result of jury duty).

The EEOC or private attorney is required by Indiana state law to comply with all state guidelines when pursuing a wrongful discharge claim and is responsible for investigating the situation in which the wrongful discharge allegedly took place. The EEOC or private attorney must also provide mediation to all involved and, if needed, he must file a lawsuit against the employer.

#Prospective Students

My first contact with Michigan Law School was in Washington, D.C. where I was attending an annual recruiting conference as an aspiring new faculty member. My interview with the Michigan faculty delegation was scheduled near the end of the day, after I had been through a barrage of conversations with faculty committees from other schools, which largely ran together because of the sameness of their questions.

The Michigan interview was different: They had read articles that I had written, and they quickly launched into an intense but entertaining group discussion that cut right to the heart of the work. After I joined the faculty the following fall, I was able to participate in these conversations daily, and it became even clearer to me that Michigan Law was an intellectual environment in which I could thrive as a teacher, as a scholar, and as an attorney.

But Michigan is more than ideas and arguments. Michigan is home to people—students, alumni, ... Read more »

Prospective Students: Message from the Dean

Welcome to the University of Chicago Law School. I welcome you from a perspective of considerable personal experience. I was a student here myself (from 1968 to 1971) and I have been a member of the faculty since 1973. Chicago is, quite simply, a most remarkable institution.

What is unique about us? We have a small and very select faculty and student body. This allows for great accessibility and interaction, which we prize. The very design of the building is intended to foster student-faculty contact. Unlike most law schools, where faculty offices are located in a separate and distinct part of the building, faculty offices at Chicago are on the perimeter of the library, so students and faculty run into each other constantly. We take a deep interest in our students and we take pride in their achievements, both while they are here and in the years and decades to ... Read more »

I recently finished my first year at Whittier in the top 20%. While many students elect to transfer out if they are in the top 20/30%, I have enjoyed my experience at Whittier. For having such a strict curve, the people are very friendly and there is not an overwhelming sense of competition. Prior to coming to Whittier I went on visits to UC Hastings, Santa Clara, and San Diego, where I could feel the cutthroat nature of the students. I instead decided to take a scholarship to go to Whittier even though it is a Tier 4 school. I believe that for the most part, the professors are as good as almost any other school. Three out of my six professors this year graduated from Harvard or NYU law school and were extremely good professors.

The other concern many people have is the 50% attrition rate. While this may seem frightening, it is important to remember that while 30% flunk out, the other 20% transfers. Even thou ... Read more »

#What are Curfew Laws?

We've all had experience with curfews: as the teenager rushing out of the house, or as the parent calling out "Be home by midnight!" But in legal terms, curfews are more than just house rules that can result in a firm "You're grounded!" if violated. Curfews are also laws that effectively prohibit or limit the right to be out in public at certain times, or in some cases, require businesses to close their doors during certain hours.

There are three main types of curfew laws: juvenile curfew laws, emergency curfew laws, and business curfew laws. These are explained in more detail below.

Juvenile Curfew Laws

Juvenile curfew laws are typically enacted at the state and local level, and prohibit people of a certain age (usually under 18) from being in public or in a business establishment during certain hours (such as between 11:00 p.m. and 6:00 a.m.). Goals behind these laws are frequently cited as maintenance of social order, and preventi ... Read more »

#What are Piracy Laws? (with pictures) - mobile wiseGEEK

Today, the Internet is one of the most common ways in which people get the information they need. However, the globalized nature of this communication system has made it very difficult to enforce the piracy laws intended to give content creators protection from those who wish to unfairly profit from their work. Anti piracy software, piracy reporting systems, and campaigns to educate the public about intellectual property laws have turned into the best defense available against this crime.

Essentially, piracy is copyright infringement. The term is most often applied to electronic or audio visual/media. The most common examples of piracy online include sites that allow for the illegal downloading of music, movies, and video games. Software piracy is a common problem as well, especially for expensive programs such as Microsoft Office or Adobe Photoshop .

In the United States, piracy laws allow for up to five year ... Read more »

According to Ohio Revised Code 2923.16, individuals without a permit to carry a concealed weapon are required to follow strict guidelines when transporting a firearm. Section B of the law states that no person may have a loaded firearm in a vehicle that can be accessed without leaving the vehicle. If a firearm is in the vehicle, it must be unloaded. It also must be carried in a closed package, box or case. If not in case, it must be in a compartment that can not be accessed while in the vehicle or it must be in plain sight while secured to a rack.
