You don't have to be a lawyer to benefit from an education in law. A degree in legal studies can be a valuable asset for professionals working in diverse fields such as business, government and criminal justice. At a time when litigation and liability pose significant risks to employers, job candidates with an excellent understanding of the legal system may find themselves in high demand.

Online legal degrees are generally found at the bachelor's and master's levels. However, some schools may also offer certificates in legal topics, such as labor relations, for those who want specialized skills and knowledge. These certificate programs are generally available to those who already hold a bachelor's degree.

A bachelor's degree in legal studies can lead to work in the business world or the public sector. Other graduates may use their degree as the starting point to pursue a master's degree or attend law school. Bachelor degree programs often focus on topics such as citi ... Read more »

The different types of law school prerequisites mainly involve a bachelor's or higher degree, a good score on an official admissions test, previous legal work experience, a letter of recommendation and a panel interview. Not all law schools expect applicants to have every type of prerequisite. The amount of weight given to each prerequisite also varies depending on the specific law school. In addition to the formal prerequisites for law school admission, approval committees also look for strong communication skills.

Both oral and written language skills are considered to be crucial abilities in candidates for law school. While many law schools are flexible in the type of bachelor's or other degree an applicant has, proper grammar, spelling and punctuation are always expected. Degree subjects for law school prerequisites must be seen by admissions councils as relevant to the kind of lawyer the prospect wants to become. For instance, an educational background in sociology may ... Read more »

The Children s Law Clinic is a community law office that provides free legal advice, advocacy, and legal representation to low-income children. The clinic is staffed by Duke Law students who bring their compassion, commitment, and energy to the task of advocating for at-risk children. Since its establishment in 2002, the Children s Law Clinic has represented hundreds of children from a wide region around Durham.

The Children s Law Clinic is one of the few programs in North Carolina with expertise in special education and school discipline law. All North Carolina children with learning-related disabilities have a right to an appropriate public education, says Clinic Director and Clinical Professor Jane Wettach. That right is violated if those disabilities are not properly addressed or if students are improperly barred from their classrooms and schools. The law students in the clinic advocate for children in the public schools when parents have been unable to obtain appropriat ... Read more »

The Employee Retirement Income Security Act (ERISA) is a federal law that regulates and establishes oversight for private industry pension plans, retirement plan, profit-sharing plans and health insurance coverage by establishing rules and minimum standards that are meant to protect plan participants. ERISA only governs private (non-government) employers with 25 or more employees.

ERISA does not mandate the creation of any these plans; it only sets the standards for those that choose to establish them. ERISA was amended by the Consolidated Omnibus Budget Reconciliation Act (COBRA) in 1985 to include provisions for workers whose established health insurance coverage is affected by their employment situation. And a more recent amendment in 1996, the Health Insurance Portability and Accountability Act (HIPAA), protects the transferability and security of health care coverage for workers, especially when there is a pre-existing condition involved.

Mexico immigration is something you will need to consider on an individual basis. If you plan to retire and live most of the year in Mexico, you will need to get an immigrant permit to do so from the Mexican Consulate. If you plan to visit up to 180 days at a time, you may not need to obtain this permit and can be classified as a non immigrate permit. In Mexico, foreign visitors are welcome and encouraged.

Immigrant permits are those that are required for individuals that plan to gain permanent residency in the country.

Non immigrant permits are permits that allow you to come to the country for a specific purpose, such as a vacation.

When you come to Mexico, immigration does not require that you surrender your natural citizenship to become a Mexican National.

If you obtain an immigrant permit, you will be granted most of the rights that Mexicans have. This includes the ability to live and work in the country, as well as to claim some benefits. This st ... Read more »

#Pre law degree

No special college program is required or recommended by most law schools. Generally, law schools urge a solid four-year program leading to a bachelor's degree. As long as a student receives a quality education featuring critical analysis, logical reasoning, and written and oral communications, any WMU major is acceptable for a pre-law student. Most often chosen are English, business, political science, history and economics, but such disciplines as philosophy, anthropology, mathematics, sociology, natural sciences, engineering, education, fine arts and aviation are also suitable majors. An advisor can help you with these decisions or contact one of the above departments.

Regardless of one's major, choose these essential courses:

  • Writing, such as English and business communication
  • Legal reasoning, such as administrative law, constitutional law and business law
  • Awareness of the structure and processes of government, such as ... Read more »

Under current UK law you can live with someone in a number of legally recognised ways that include:

  • Civil Marriage
  • Civil partnership
  • Co-habitation

In each of these types of relationship you must be fully aware of the law if you want to separate from your partner. Separation law is slightly different depending on the type of relationship you have. For instance, civil marriages are legally binding. Separation law states that your marriage is dissolved if you separate from your partner for more than five years. If you want to legally separate earlier, you must follow divorce proceedings.

The Civil Partnership Act 2004 is now law. It allows same-sex couples to get legal recognition of their relationship. If you are in this type of relationship, you are called a civil partner , and this is recognised under UK law. Separation law with civil partnerships is similar to civil marriage. You should consult a family law solicitor if you ... Read more »

Common law is in effect legal precedent that is made by judges sitting in court. Unlike statutory provisions, which are laws that are codified as Acts of Parliament, the common law is constantly changing.

This is because of the fluid way in which judges interpret the law using their knowledge of legal precedent and common sense and by applying the facts of the case they are hearing to those prior decisions. English law works on a common law system, as opposed to a civil law system, which relies on statute and certain texts.

Origins of the Common Law

Common law is an invention of the English courts: the Kings Bench, the Court of Common Pleas and the Exchequer so as to ensure, as remains the case today, that there were laws that superceded the decisions of the lesser courts.

Judges create the common law by delivering written judgments about the cases before them. If, for example, Magistrates’ Courts across England and Wales were able to make and follo ... Read more »

#JD is the degree - A 2 Z

One of life’s great indulgences is the cognoscente’s feeling of smug superiority when others get some inside-baseball bit of information wrong. It’s a heady amalgam of emotions—lamenting how the world is going to hell while simultaneously assuring yourself that it is, at any rate, not YOUR fault. And I have noted in my own case that the impulse is exacerbated when I learned the key bit of information relatively late in life. I suppose the increased degree of smugness is borne of overcompensation. There are things that I can actually remember learning as an adult, and yet they still elicit a quick, happy disdain in my heart when someone else gets them wrong.

I’m not alone in this, I’m sure. Once, while out of town for a law school conference, I had dinner with a faculty member—let’s call him Professor Black—who might reasonably be described as combative; he also invited someone from another law school. At dinner, Professor Black told a little story ... Read more »

If your state is not on the list, it is controlled by federal regulations.

OSHA regulations apply to all businesses having one or more employees.

To comply with OSHA regulations, you must:

There are no federal laws that regulate smoking in the workplace, however there are many states that have laws regulating smoking. In addition, many cities and counties have ordinances that altogether ban smoking in the workplace. The reason there are so many laws concerning smoking in the workplace is that many federal and independent studies have illustrated the detrimental effects not only of smoking, but of second-hand smoke as well.

The Environmental Protection Agency has estimated that second-hand smoke is the cause of approximately 3,000 lung cancer deaths and 37,000 heart disease deaths a year. In addition, if smoking is not regulated in the workplace it could lead to higher costs ... Read more »

Probate is the legal process of administering the estate of a deceased person, resolving all claims against the estate, and distributing the deceased person's property. If a person dies with a will, these are sometimes called testamentary probate proceedings. If they died without a will, the person is said to have died intestate.

    Testamentary Probate

Generally, when one leaves a will behind there is little to take through probate. It is often simply a matter of appointing an executor (sometimes called a personal representative) to administer the estate and see to it that the assets and obligations of the estate are handled according to the directions set forth in the will. However, in some instances, potential heirs or other creditors may challenge the contents of the will, asserting that they are entitled to more than what has been left for them. Under these circumstances, a probate court decides whose claims are valid or not and makes the appropriate ... Read more »

Some civil lawyers handle civil rights cases. These are cases in which an individual -- or group, for class action lawsuits -- believes that her basic human rights have not been respected. Examples include seeking damages for unlawful police searches, or discrimination in housing, employment or education. People can feel that their right to privacy is violated during unwarranted searches or that they were denied opportunities to get a job, a residence, or go to a school because of certain characteristics.

In 1973, as drug use and crime rates around the country were on the rise, New York State passed a set of narcotics laws that became known by the name of their primary champion, Gov. Nelson A. Rockefeller. The laws mandated that a conviction for possessing four ounces or more of heroin or cocaine be punished by at least 15 years to life in prison.

The laws were praised by prosecutors, who said they made it easier to make cases against drug kingpins when lower-level dealers or users faced tough penalties. Other criticized the laws for their harshness, noting that many first-time offenders caught with small amounts of narcotics ended up with lengthy sentences.

In 2007, Clyde Haberman described the long-running debate in the About New York column of The New York Times:

"For true endurance, the statutes known as the Rockefeller-era drug laws are hard to beat. The same may be said about attempts to scrap those laws, which came into being in 1973, so long ago that d ... Read more »

Consumer law is a field of law which is designed to protect consumers and to provide them with formal legal means of obtaining reparations for damage caused by faulty products. A wide variety of topics are covered in consumer law, including warranties, quality standards, consumer privacy. and certain types of contracts. The goal of such law is to ensure that consumers have rights which are clearly spelled out, and that companies which sell products and services are clearly aware of their responsibilities under the law.

The advent of consumer law came about in the early 20th century, with a series of scandals over contaminated food which led to the passage of the Pure Food and Drug Act and a number of other measures designed to protect consumers. Prior to regulation of the sales industry, companies could include any ingredients they liked, including known toxins, and they could make a wide range of claims about their products without facing legal penalties. A simple act of kindness such as a phone call on his birthday or a surprise visit to rake leaves may be more suitable based on family tradition. According to Ben Klempner, family therapist and counselor, respectful boundaries can make or break your relationship with your father-in-law. Discuss your intentions with your spouse.

#Joint Tenancy legal definition of Joint Tenancy

    Joint Tenancy

A type of ownership of real or Personal Property by two or more persons in which each owns an undivided interest in the whole.

In estate law, joint tenancy is a special form of ownership by two or more persons of the same property. The individuals, who are called joint tenants, share equal ownership of the property and have the equal, undivided right to keep or dispose of the property. Joint tenancy creates a Right of Survivorship. This right provides that if any one of the joint tenants dies, the remainder of the property is transferred to the survivors. Descended from common-law tradition, joint tenancy is closely related to two other forms of concurrent property ownership: Tenancy in Common. a less restrictive form of ownership that sometimes results when joint tenancies cease to exist, and Tenancy by the Entirety. a special form of joint tenancy for married couples.

    #Joint Law and Graduate Degrees

At Iowa, JD students are able to develop joint degree programs with most graduate colleges and departments in the University. The cross-crediting feature of the joint degree program allows students to receive the JD and another graduate/professional degree by taking six to 24 hours (equivalent to one or two semesters) less course work than would be necessary if the two degrees were pursued independently.

    Joint Degree Objectives

The College of Law places few restrictions on the University of Iowa graduate department/college in which a student might pursue graduate work while pursuing a law degree. The "relatedness" of the dual degree objective is the main criterion; the joint degree student should bring to one discipline the insights and experience gained in the other. Currently, the most popular joint degrees include:

    • JD/MBA (Management)
    • JD/MPH (Public Health)
    • JD/MHA (Health Management Policy)

Tort law is a branch of the law which covers civil wrongs, such as defamation and trespassing. among many other transgressions. Under tort law, if someone suffers a physical, legal, or economic harm, he or she may be entitled to bring suit. If the suit is deemed valid, damages may be awarded to the victim to compensate for his or her troubles. Most of these laws are found in regional, state, and national civil codes, which often spell out limits on damages and the statute of limitations for tort cases.

Many people divide tort law into three rough categories: negligent torts, intentional torts, and strict liability torts. Torts arising out negligence are civil wrongs caused by negligent behavior or a failure to practice due diligence. For example, if you are playing soccer in the street and you accidentally kick the ball through someone's living room window, this may be a negligence tort. Medical malpractice and other forms of professional negligence are also covered under th ... Read more »

According to Newton s first law, an object in motion continues in motion with the same speed and in the same direction unless acted upon by an unbalanced force. It is the natural tendency of objects to keep on doing what they re doing. All objects resist changes in their state of motion. In the absence of an unbalanced force, an object in motion will maintain its state of motion. This is often called the law of inertia .

The law of inertia is most commonly experienced when riding in cars and trucks. In fact, the tendency of moving objects to continue in motion is a common cause of a variety of transportation injuries - of both small and large magnitudes. Consider for instance the unfortunate collision of a car with a wall. Upon contact with the wall, an unbalanced force acts upon the car to abruptly decelerate it to rest. Any passengers in the car will also be decelerated to rest if they are strapped to the car by seat belts. Being strapped tightly to the car, the p ... Read more »

    #Journalism Ethics - Media Law

The Supreme Court of Canada, where the Dagenais ruling was laid down. Photo by Peregrine981.

Situations in journalism raise both legal and ethical questions. In many newsrooms, whether an action is legal is considered to be the first hurdle that any action must clear, before ethical issues are raised. Also, ethical standards such as fairness and accuracy are used in court cases to evaluate stories for libel and other legal problems.

How free is the Canadian press, legally?

From a legal perspective, the freedom of the press is guaranteed constitutionally by Section Two of the Charter of Rights and Freedoms. But the charter also states in Section One that fundamental freedoms in a democracy can be limited for justifiable reasons. Hence, press freedom is not absolute, legally.

    Definition

A contract in which one party agrees to indemnify another against a predefined category of risks in exchange for a premium. Depending on the contract, the insurer may promise to financially protect the insured from the loss, damage, or liability stemming from some event. An insurance contract will almost always limit the amount of monetary protection possible.

    Overview

In the absence of insurance, three possible individuals bear the burden of an economic loss; the individual suffering the loss; the individual causing the loss via negligence or unlawful conduct; or lastly, a particular party who has been allocated the burden by the legislature, such as employers under Workmen's Compensation statutes.

While types of insurance vary widely, their primary goal is to allocate the risks of a loss from the individual to a great number of people. Each individual pays a "premium" into a pool, from which losses are paid out. Regardless of whether ... Read more »

If you re one of millions of Americans considering going back to school (or if you re going to school for the first time) you face not only an exciting decision, but a daunting one as well. There are hundreds of degrees and fields out there, and trying to decide on one can be confusing, to say the least. We ve put together a guide to the different types of college degrees and what they mean, but before you get started, here are a few things to think about:

    1. What level of degree do you need? Make sure a given college degree program is tied to a specific career goal. For example, if you want to become a public school teacher, you need a teaching certificate.
    2. Do you meet the program s prerequisites? Many types of degree programs, especially the more advanced ones, require you to hold previous degrees or qualifications. No matter how nicely you ask, an MSN program will not admit you unless you have a practical nursing degree.

    #Was it worth it?

    Was it worth it?

Daianna Karaian, an alumna of the Kellogg School of Management, reveals how much of her MBA she still finds useful a year after graduation

THESE days, questioning the value of a business degree is one of the few growth industries. The Economist itself indulges in the practice from time to time. Is two years out of the job market and tens of thousands of dollars in tuition a wise investment? A year ago, as a newly-minted—and unemployed—MBA, I was sceptical.

With a background in sustainability and marketing gained from non-profits, government and small business, I went to business school to discover unexplored territory: the MBA would be my bridge into big business. I regularly pulled all-nighters poring over finance and accounting textbooks, poking into the darkest corners of Excel, and solemnly applying Little s Law to eliminate hypothetical bottlenecks in imaginary factories. Within six months I felt I ... Read more »

United States immigration refers to the process of non-U.S. citizens moving to the United States. Throughout history, immigration has been a difficult process. Initially, this was because of the physical difficulties of getting across the ocean to come to America, but also because of racial prejudices that made it difficult for people from certain countries to become citizens. Today, though the process for citizenship is long, the United States accepts more immigrants as permanent residents than any other country.

After transferring their visa, a person can become a permanent resident and be eligible for a Green Card. A Green Card is proof of permanent resident status. Being issued one means that a person has the right to live and work in the United States. Also, people who are permanent residents are able to apply for full citizenship after a certain period of time. Aside from transferring visas, people can be eligible for permanent resident status through work or through m ... Read more »

#Judge Upholds Law Allowing Michigan Commission To Permit Wolf Hunting - CBS Detroit

MARQUETTE (AP) The Michigan Court of Claims has upheld a law empowering an appointed panel to allow hunting of wolves.

The state Legislature approved the Scientific Fish and Wildlife Conservation Act last August. It gave the Michigan Natural Resources Commission the authority to classify animals as game species. The commission already had given wolves that designation, which led to the state s first authorized wolf hunt in 2013.

The law nullified two citizen votes last fall that would have prevented wolf hunts. A group called Keep Michigan Wolves Protected filed suit, saying the law violated the Michigan Constitution.

In a ruling issued Friday, Court of Claims Judge Mark T. Boonstra disagreed, writing that the group s suit fails to state a claim upon which relief may be granted. He said the court was not taking a position on whether wolves should be hunted ... Read more »

Like any sector, the field of education has specific legal issues. Providing services to special needs students, free speech rights, approving homeschool curricula, locker searches, cross-town busing, and affirmative action policies are just a few of the reasons why Education Law is recognized as a specific legal subfield. Currently, the legal cases and policies that shape the operation and expectations of the U.S. education system evolve daily and require knowledgeable professionals.

Since our nation's inception, the government has played a role in defining the importance and nature of education. The first federal act relating to education was the Ordinance of 1785. Passed by the Continental Congress, the Ordinance set aside portions of each congressional district for schools. In 1787, Congress passed the Northwest Ordinance that became the first federal policy statement acknowledging the benefit of knowledge and education for the general welfare.

This law makes it unlawful for anyone to purposefully permit or facilitate the endangerment of the health or life of any child under the age of 18. THE LAW OF INERTIA

T he law of inertia states that:

A body will preserve its velocity and direction so long as no force in its motion's direction acts on it.

For example : a package thrown out of an airplane will continue to move at the speed of the airplane on the horizontal axis (in the direction of the airplane's movement). Since the law of gravity acts on the package (a vertical downward axis), the package will gather speed along the vertical axis, but on the horizontal axis its speed will remain equal to that of the airplane.

(In this explanation we have left out the force of air-resistance).

The law of inertia is the basis of the new physics of the seventeenth century. This law is also true according to modern physics. Galileo discovered the law during the first decade of the seventeenth century, but in fact he did not understand the law in the general way we have formulated it here. The general formulation of th ... Read more »

    Power without fuel

Roger Shawyer, a British scientist thought up and developed a technology called EmDrive. It’s based on the theory of special relativity that it’s possible to convert electrical energy into thrust without the need to expel any form of repellent.

“This technology is a quantum leap – it would enable vertical take-off and landing for airplanes, it s quiet and it uses liquid hydrogen as a fuel, so it s green too”, said Roger Shawyer. “The big aerospace companies have designed their last big jets, that s one of the implications.”

Launching satellites into space would be much cheaper and EmDrive could be key to solving the energy crisis, if solar power could be harnessed off the satellites and sent back to Earth. But the big thing is that it potentially could facilitate practical space travel in and around the solar system. If the EmDrive would work, it could take a spacecraft to the moon in a matter of hours and ... Read more »

The Occupational Safety and Health Act became federal law in 1970 when members of Congress passed it to facilitate increased safety in the workplace. An immediate effect of the legislation was the creation of two new federal entities: OSHA in the United States Department of Labor and the National Institute for Occupational Safety and Health under the Centers for Disease Control Prevention. While OSH, and therefore OSHA, covers many federal agencies, it does not apply to farms operated by families, local and state government agencies, self-employed individuals or any business under the jurisdiction of federal laws besides OSH.

The primary law that OSHA enforces is OSH, along with numerous regulations related to everything from longshoring guidelines to record keeping to workplace inspections. To pursue its agenda and persuade employers to remain in conformity, OSHA also has the ability to exact penalties for violations of employees' rights and, consequently, its standards.

In some instances, out-of-state visitors can carry firearms as well, although a significant amount of homework should be conducted before a person packs his or her bags for the Buckeye State.

To date, Ohio has concealed carry handgun reciprocity agreements with nearly half of the 50 American states. Do you know what it means to be "wrongfully discharged" from employment? Do you know that there are many, many things employers can do to perhaps inadvertently expose themselves to a wrongful discharge suit? Do you know the steps that must be taken to bring a wrongful discharge claim? Do you know that employees can receive many different types of damages if they have been wrongfully discharged? Here are 10 points to keep in mind when considering a wrongful discharge lawsuit:

  • Although many employment relationships are "at-will," meaning that either the employer or the employee may terminate the relationship at any time with or without reason, that does not mean that employers can act in a discriminatory manner. If an employer terminates an employee, even one who is "at-will," in violation of federal, state, or local anti-discrimination laws, it can face serious legal troubles.

Wake Up America — Marshall Law

    By David J. Stewart | April 2009 | Updated January 2015

What many Americans don't know, or don't care to know (but they will know eventually when it is too late) is that Marshall Law is increasingly being used in the United States. Every time an officer performs a search of your person or property without probable cause. they are violating your 4th Amendment rights.

Romans 13 teaches Christians to submit to the “higher powers.” The U.S. Constitution is a higher power than the U.S. and state governments. God and His Word in the Bible are the highest powers. Hence, Biblical morality always trumps man's laws. The corrupted new modern Bible versions have changed the meaning of Romans 13 by changing “higher powers” to “governing authorities.” As mentioned, the U.S. Constitution is a higher power than the government, because it includes the will of the people. Regulation without representation is tyranny.

Disability law is largely regulated by the Americans with Disabilities Act (ADA) of 1990. This Act prohibits discrimination against individuals with disabilities in employment, housing, education, and access to public services.

The ADA defines a disability as any of the following:

    1. "a physical or mental impairment that substantially limits one or more of the major life activities of the individual."
    2. "a record of such impairment." or
    3. "being regarded as having such an impairment."

While alcoholism is included as a disability, other socially undesirable behavior is excluded from the Act. For example, sexual behavior disorders, compulsive gambling, and pyromania are all excluded. The ADA, however, does not list all impairments covered. The ADA further requires that reasonable accomodation be made so as to provide individuals with disabilities equal opportunities. Child support laws direct the non-primary residential parent to pay child support. Child support may be paid through the state or directly to the primary residential parent. Child support is to be used for food, clothing and housing for the minor children.

If you do not pay your child support, there are several consequences, depending on the state you are in. In some states, you may lose your license, serve jail time and, in all states, you are required to pay arrearages. Some states will allow you to pay the arrearages in payments, if you have a legitimate reason for not paying. Legitimate reasons are generally defined by the courts on a case-by-case basis.

Child support is court ordered and the time the child support starts depends on whether your spouse has petitioned for child support in the petition for dissolution of marriage, or if your spouse filed a separate motion for child support.
