#Indiana Religious Freedom Restoration Act Allows Private Businesses to Discriminate Against Employees Based on Sexual Orientation - The Atlantic

The new statute s defenders claim it simply mirrors existing federal rules, but it contains two provisions that put new obstacles in the path of equality.

We noticed that you have an

No one, I think, would ever have denied that Maurice Bessinger was a man of faith.

And he wasn t particularly a still, small voice man either; he wanted everybody in earshot to know that slavery had been God s will, that desegregation was Satan s work, and the federal government was the Antichrist. God wanted only whites to eat at Bessinger s six Piggie Park barbecue joints; so His servant Maurice took that fight all the way to the U.S. Supreme Court, which in 1968 decided that his religious freedom argument was patently frivolous.

Growing up in the pre-civil-rights South, I knew a lot of folks like Maurice Bessinger. I didn ... Read more »

What are HIPAA Laws?

Your visit to the doctor now contains a page where you sign that you acknowledge that the physician s office has notified you about their compliance with HIPAA laws. More often than not, you probably read through quickly or barely skim the authorization form before signing it. However, HIPAA laws are important, and they are in place to protect you from identity theft, being denied care, and/or health insurance coverage.

HIPAA stands for the Health Insurance Portability and Accountability Act, enacted in 1996.

HIPAA laws created a new national standard in protecting your health information. As you see different physicians or become admitted to different hospitals, your health information should follow you. HIPAA delineates the need to properly protect your health information as it flows through to these different channels. As more and more transactions are completed electronically these day ... #International Labour Standards on Child labour

Child labour is a violation of fundamental human rights and has been shown to hinder children s development, potentially leading to lifelong physical or psychological damage. Evidence points to a strong link between household poverty and child labour, and child labour perpetuates poverty across generations by keeping children of the poor out of school and limiting their prospects for upward social mobility. This lowering of human capital has been linked to slow economic growth and social development. A recent ILO study has shown that eliminating child labour in transition and developing economies could generate economic benefits nearly seven times greater than the costs, mostly associated with investment in better schooling and social services. (Note 1 ) ILO standards on child labour are primary international legal tools for fighting this problem.

Selected relevant ILO instruments

#Indigenous Blacks & Mi kmaq Initiative - Schulich School of Law - Dalhousie University

The Indigenous Blacks Mi'kmaq (IB M) Initiative at the Schulich School of Law was established in 1989 to increase representation of Indigenous Blacks and Mi'kmaq in the legal profession in order to reduce discrimination.

From the efforts of many

The IB M Initiative was the result of efforts by African Nova Scotian communities and Mi'kmaq First Nations to obtain access to legal education and the legal profession and to address racism in the justice system. These efforts were the catalyst for Dalhousie University's study entitled Breaking Barriers: Report of the Task Force on Access for Black and Native People. The efforts coincided with the work of the Royal Commission on the Donald Marshall, Jr. Prosecution, which recommended that the then-fledgling IB M Initiative receive the financial support of the Governments of Canada and Nova Scotia, and the Nova Scotia B ... All employees in the United States are protected by federal labor laws. The only exceptions are people who work as independent contractors. These workers, however, have more control over their work environments and their pay, hours and other facets of employment. All hourly and salaried workers fall under basic regulations, although the exact nature of the regulations varies based on the employee type. Employers can require salaried employees to work more than 40 hours per week without additional compensation, whereas the same cannot be required of hourly employees.

Some of the laws people believe are set in stone are not necessarily so. For example, the Occupational Safety and Health Association (OSHA) provides for "reasonable" accommodation with regard to breaks. The standard accommodation is a 15-minute break for every 4 hours of employment, but that standard is not a law. In addition, companies do not have to pay for that time, but instead can require employees to clock ... Read more »

#Inheritance Law and Your Rights

Inheritance law governs the rights of a decedent's survivors to inherit property. Depending on the type of inheritance law your state has, a surviving spouse may be able to claim an inheritance despite what you may have written into your will. This statutory right of a surviving spouse hinges on whether a state follows the community property or common law approach to spousal inheritance. Children, and sometimes grandchildren, also have a right to claim an inheritance when a parent or grandparent dies.

Inheritance Rights of a Surviving Spouse

Whether a state follows community property laws or common law determines how inheritance law affects the distribution of a married decedent's estate. The following are community property states: Arizona, California, Idaho, Nevada, New Mexico, Texas, Washington, Wisconsin, and Alaska (although in Alaska, there must be a written agreement between the spouses). The remaining states follow c ... Read more »

#Police Lives Matter: Louisiana Boy Thanks Local Law Enforcement

A 9-year-old Louisiana boy found a special way to show his respect for law enforcement.

Jayden Witsell has made it his mission to hand out letters to officers one-by-one, along with a St. Michael coin for protection.

Jayden and an officer whose life he touched, Joe McMahan, appeared on "Fox and Friends Weekend" today.

"People don't really care about police officers, and I want to have more respect for them," Jayden explained. "When I heard about those two Hattiesburg officers getting shot, that's when I started."

McMahan, who works for the Slidell Police Department, revealed that he was driving one day when Jayden's mother actually pulled him over.

"I see her flashing her brights, and I'm thinking it's a citizen wanting directions or something," McMahan said. "So I pulled over. And at that time, that's when Jayden got out of the car and asked if he could give me something."

By Bob H Clarke | Submitted On August 31,

Online degrees are becoming increasingly popular in the legal business, and the medical malpractice attorney profession is no exception. Depending on where you live you may be able to get a complete education through distance studies, while you in other states may be able to at least take some of your courses online. Here we will investigate this particular avenue of legal malpractice closer.

The first thing you will need to check out is whether online classes are indeed acceptable in your area, in order to become a legal malpractice professional. In the US some states allow online studies only for those who have already passed their bar exam, while others allow at least part of the full studies to take place online.

It also goes without saying that you should only enroll at a school that has been officially credited. This is something you can easily check with the US Department of Education.

There are many types of law degrees that you can study for in Australia. Some exist because of the need for professional as well as non-practising qualifications. Law schools also offer Juris Doctor degrees as an alternative to Bachelor of Laws.

An academic qualifying degree fulfills the academic side of qualifying for admission into legal practice. If you want to practise law, you need to also complete Practical Legal Training. However, many graduates with a law degree actually choose not to do the extra training required to enter the law profession.

A straight Bachelor of Laws is typically a 4-year degree. It is open to school leavers with a high enough ATAR (or equivalent) score. University graduates or people with some university experience can also enrol in a LLB. Generally, this reduces the length of the course from 4 years down to 3 years.

A combined law degree (also called a double or dual degree) means you graduate with 2 degrees. You do this by taki ... Read more »

#Police Search for Missing NYU Law School Grad Last Seen in Harlem - Central Harlem - New York

Landon Thomas View Full Caption

HARLEM Police are searching for an NYU law school graduate who has been missing for a week, joining friends and relatives who have been scouring the streets and posting fliers, they said.

Landon Thomas, 25, was last seen leaving his apartment on 215 West 145th St. about 5:30 p.m. April 27, friends said.

He and his roommate were preparing to move out of their Harlem apartment that evening, but Thomas left the apartment without his drivers license and never came home, according to his roommate Roman Zanishka, 25.

The plan was, I get back from work and as soon as I get back we start moving, said Zanishka, who said Thomas is very punctual and often gives people a call if he knows he is going to be more than 15 minutes late.

I sent him a text. I thought it was strange but maybe he had just stepped out.

The title lawyer can conjure contradictory notions. Are they the protectors of the afflicted, as Law and Order would have us believe? Or are they the crooks depicted in John Grisham s The Firm ? Are they the smooth-talking smarty-pants billing their clients gazillions of hours from ergonomic chairs inside their sleek offices? Or are they the safeguards of our futures, the ones we trust to administer our wills? Are they victims of a shortsighted public opinion? Or are they simply the butt of many bad jokes? The jury finds this case complicated.

There s a little truth and a lot of exaggeration in all these portrayals of lawyers. In many cases, lawyers at well-known firms do make a lot of money. But most put in a lot of time and effort to earn those handsome paychecks. District attorneys, like the ones depicted on TV, do prosecute those accused of committing heinous crimes. But there are some lawyers who never step foot in a courtroom or utter a single eloquent remark in front ... Read more »

I love Iris West and I hate that people hate her but it was getting hard for me to defend her when I wasn t even 100% in love with the way she was written. Her character has so much potential when she was writing about the Flash, or digging into her boss s disappearance, or punching villains in the face etc, but every time her story started to get interesting, the writers would make her the star of dumb filler episodes. I hope the writers can do her better now that the Everyone is lying to me story line seems to be over. I understand why she s mad and I agree to a certain point, but you wouldn t date/marry a CIA agent and get angry at them for not telling you all of the government s intel, because they re keeping secrets from you and not being honest. Statute Law is law that is written down and codified into law. Statutes begin as bills: and there are public and private bills.

Public Acts are those that affect either the whole of the UK or some of its constituent countries: England, Scotland, Wales and Northern Ireland, whereas private Acts may grant limited powers to public bodies such as local authorities, or apply only to specific locations within the UK. There has been a significant increase in the number of statutes passed in law in the United Kingdom in the 20th and 21st centuries.

How a Bill Becomes Law

To begin with, a bill goes through scrutiny and is refined before the final draft is created. Then it is given its first reading, and after its second reading there is a general debate as to its contents.

Once at the ‘Committee stage’ both the House of Commons and the House of Lords may make amendments to it. Then further amendments may be made when it is considered at the report stage. A t ... Read more »

#Intellectual property

Overview

In general terms, intellectual property is any product of the human intellect that the law protects from unauthorized use by others. The ownership of intellectual property inherently creates a limited monopoly in the protected property. Intellectual property is traditionally comprised of four categories: patent. copyright. trademark. and trade secrets .

The products of the human intellect that comprise the subject matter of intellectual property are typically characterized as non-rivalrous public goods. Essentially, this means that the same product may be used simultaneously by more than one person without diminishing the availability of that product for use by others. In the words of Thomas Jefferson:

"If nature has made any one thing less susceptible than all others of exclusive property, it is the action of the thinking power called an idea, which an individual may exclusively possess as long as he keeps it to himself; bu ... Read more »

    #International Law Enforcement Academies (ILEA)

    International Law Enforcement Academies (ILEA)

Speaking before the United Nations General Assembly at its 50th Anniversary on October 22, 1995, then-President Clinton called for the establishment of a network of International Law Enforcement Academies (ILEAs) throughout the world to combat international drug trafficking, criminality, and terrorism through strengthened international cooperation.

Now, years later, the United States and participating nations have moved ahead with the establishment of ILEAs to serve four regions: Europe, Africa, South America and Asia.

Depending on regional needs and United States national interests, we are prepared to consider establishing similar ILEAs elsewhere. We would seek a host country that enjoys political stability, has the ability to provide adequate infrastructure and is willing to share costs and responsibilities. The host government should also be able to p ... Read more »

Whistleblower law is related to Wrongful Termination law and includes the statutes that protect employees from being terminated or otherwise discriminated against in retaliation for exposing suspected dishonest or illegal activities or wrongdoings, that violate the public trust, occurring in their place of employment. Although the term ?whistleblower? is generally associated with government workers who report government fraud, these laws actually offer protection to employees of public or private companies, as well as government agencies. Some of these statutes also make provisions for monetary awards for employees who expose an employer who is guilty of these types of violations.

The federal Whistle Blower Protection Act (WPA) protects most federal employees who work in the executive branch. It also requires that federal agencies take appropriate action. The Office of Special Counsel (OSC) was created by this act and is tasked with investigating complaints by the fed ... Read more »

A common law wife is a woman who is married under common law to another person, and is recognized as being part of a common law marriage. Various countries and regions within them have laws dealing with marriage and whether or not common law marriages can be recognized. A common law wife may change her name if she so desires, though she may have to receive a court order for her name change to be fully recognized by government agencies and certain private businesses.

Common law marriage, of which a common law wife would be a part, is the process by which two people can be married without a legal or religious proceeding and without filing papers with local government recognizing the marriage. Different countries and regions within a country can have very different laws regarding common law marriage and the way in which it can be performed and accepted. In Australia, for example, a common law marriage is typically referred to as a “de facto relationship” or “domestic relationsh ... Read more »

    Home Surrogacy Laws in US

Issuance of a U.S. citizenship at birth to a baby born abroad is ruled by Immigration and Nationality Act (INA) Sections 301 and/or 309. The determination of citizenship to children born overseas to a U.S. parent falls within jurisdiction of the U.S. Department of State, which requires a U.S. citizen to have a biological connection to a child in order to transmit U.S. citizenship to such child. Merely being named as a parent on a Ukraine birth certificate for a baby born as a result of surrogacy arrangement in country doesn’t mean that the birth certificate can meet the U.S. immigration and citizenship necessities.

The State Department determines the citizenship of every kid born as a result of surrogacy program one by one, on a case by case basis, when fastidiously considering the precise facts encompassing the child’s birth and his or her parents’ scenario. The most effective proof accessible to parents to point out their blood relationshi ... Read more »

Don't mess with God; he got Bronze Age on Balaam's Ass

I am the Lord thy God. Thou shalt have no other gods before me.

The "Godwins" Law is often cited informally as saying that in a battle between "God" and "gods", God wins (otherwise known as reductio ad victoriam Dei ).

    Eat your heart out, Darwin.

There are many corollaries to the "Godwins" Law, some considered more canonical (by being included in the original Hebrew texts) than others invented later. [2] For example, there is a tradition in many Theocracies and Western Monasteries that once such a comparison is made, the discussion is finished and whoever challenged God has automatically "lost" their soul while the debate was in progress. This principle itself is frequently referred to as the "Godwins Law." [3] It is considered poor form to raise such a comparison arbitrarily with the motive of ending one's own life.

The "Godwins" Law applies especially to inappropriate, inordinate, ... Read more »

    #International humanitarian law

International humanitarian law also called the law of armed conflict or the laws of war regulates the conduct of warfare. Most of the applicable rules are to be found in the four 1949 Geneva Conventions and their two 1977 Additional Protocols. In addition, the

1907 Hague Conventions and the annexed Regulations lay down important rules on the conduct of hostilities, notably on military occupation. There are also several treaties that prohibit or restrict the use of specific weapons, including anti-personnel mines. exploding or expanding bullets, blinding laser weapons. and, most recently in 2008, cluster munitions.

An important distinction exists between international armed conflicts and those of a non-international character . (For a detailed discussion of this issue, see our paper on the legal qualification of armed conflict .) The legal regulation of international armed conflicts is more detailed and the p ... #International Programs

Columbia Law School has been internationalizing American legal education since its founding prior to the Civil War. Long before global markets and instant worldwide communications required practicing attorneys to address laws outside the United Sates, Columbia faculty and students were developing the precepts and principles of public international law, international economic law, and comparative law.

Columbia s initial forays into international law were launched in the mid-1800s through such luminaries as Francis Lieber, and continued into the 20th century with the efforts of Philip C. Jessup, Wolfgang Friedman, Telford Taylor, and Oscar Schachter, among others. Over the past 10 years, Columbia s already rich programs in international and comparative law have expanded dramatically, ensuring that the Law School remains at the forefront of these significant areas of study.

Today, Columbia is home to a new generation of international law profess ... Read more »

A surrogate, also called substitute, is an individual that acts on behalf of another. The most common type of surrogate is a surrogate mother. Surrogate mothers are quickly becoming popular among couples that may be having trouble conceiving, couples that cannot have children, gay couples, single women, and women that have had risky pregnancies. While surrogacy has become a popular path for many different types of couples (and individuals), the laws have been either slow to catch up or non-existent. For this reason, and many others, it is important to understand the different types of surrogates/surrogacy and any laws that may apply to each.

There are two types of surrogates: gestational and traditional. Gestational surrogates are the most common type of surrogate. In this case, the surrogate carries a child that is not genetically related to her. The egg and sperm may come from the biological mother and father or the eggs and/or sperm may come from an anonymous (or known) d ... Read more »

    International Law: an Overview

Traditionally, international law consisted of rules and principles governing the relations and dealings of nations with each other, though recently, the scope of international law has been redefined to include relations between states and individuals, and relations between international organizations. Public_international_law. concerns itself only with questions of rights between several nations or nations and the citizens or subjects of other nations. In contrast, Private_international_law deals with controversies between private persons, natural or juridical, arising out of situations having significant relationship to more than one nation. In recent years the line between public and private international law have became increasingly uncertain. Issues of private international law may also implicate issues of public international law, and many matters of private international law have substantial significance for the inte ... Read more »
