Statute Law is law that is written down and codified into law. Statutes begin as bills: and there are public and private bills.

Public Acts are those that affect either the whole of the UK or some of its constituent countries: England, Scotland, Wales and Northern Ireland, whereas private Acts may grant limited powers to public bodies such as local authorities, or apply only to specific locations within the UK. There has been a significant increase in the number of statutes passed in law in the United Kingdom in the 20th and 21st centuries.

How a Bill Becomes Law

To begin with, a bill goes through scrutiny and is refined before the final draft is created. Then it is given its first reading, and after its second reading there is a general debate as to its contents.

Once at the ‘Committee stage’ both the House of Commons and the House of Lords may make amendments to it. Then further amendments may be made when it is considered at the report stage. A t ... Read more »

Whistleblower law is related to Wrongful Termination law and includes the statutes that protect employees from being terminated or otherwise discriminated against in retaliation for exposing suspected dishonest or illegal activities or wrongdoings, that violate the public trust, occurring in their place of employment. Although the term ?whistleblower? is generally associated with government workers who report government fraud, these laws actually offer protection to employees of public or private companies, as well as government agencies. Some of these statutes also make provisions for monetary awards for employees who expose an employer who is guilty of these types of violations.

The federal Whistle Blower Protection Act (WPA) protects most federal employees who work in the executive branch. It also requires that federal agencies take appropriate action. The Office of Special Counsel (OSC) was created by this act and is tasked with investigating complaints by the fed ... Read more »

This can take the form of copyright concerns for original works, trademarks for different brands, or even patents for media related technologies or processes. You don t have to pay a lawyer.

You don t have to pay anyone.

Howard E. Deutch, Esq. Member of the Bars of Maryland, Virginia, Pennsylvania, District of Columbia and the United States Supreme Court

My name is Howard Deutch.  I’ve been practicing law since 1973. During that time I have written a lot of legal forms.  In fact, over those years I have created and/or stolen 587 of the best contracts, leases, Wills, assignments, guarantees, etc. anywhere. I m getting up in years now (see my picture for proof).  So I decided it was time I make these forms available to anyone who has a need for them.

There are plenty of forms on the internet.  Some are good and some are worse than useless.  Some cost money and some are free. And that’s the problem.  How do you know which form you should use?  Which can you trust?

I can’t vouch for any of the other forms on the internet.  As I said before, s ... Read more »

Today we had the honor of being invited to speak to the maritime law society at Stetson University College of Law .

Stetson has the oldest law school in Florida, founded in 1900. Its campus is located on the beautiful Mediterranean style architecture campus in Gulfport, Florida.

I discussed the topic Crime on Cruise Ships, and explained the epidemic of cruise crimes on cruise ships over the past decade.

Assisting me with the presentation was Caitlin Burke (bottom right), an intern at our firm. Ms. Burke graduated from the University of Florida where she majored in Recreation, Parks and Sport Management. Ms. Burke wrote a senior honor's thesis entitled a Qualitative Study of Victimization and Legal Issues Relevant to Cruise Ships . Caitlin was also a guest blogger last year when she authored Why Cruises are NOT the Best Vacations with Kids .

Home Surrogacy Laws in US

Issuance of a U.S. citizenship at birth to a baby born abroad is ruled by Immigration and Nationality Act (INA) Sections 301 and/or 309. The determination of citizenship to children born overseas to a U.S. parent falls within jurisdiction of the U.S. Department of State, which requires a U.S. citizen to have a biological connection to a child in order to transmit U.S. citizenship to such child. Merely being named as a parent on a Ukraine birth certificate for a baby born as a result of surrogacy arrangement in country doesn’t mean that the birth certificate can meet the U.S. immigration and citizenship necessities.

The State Department determines the citizenship of every kid born as a result of surrogacy program one by one, on a case by case basis, when fastidiously considering the precise facts encompassing the child’s birth and his or her parents’ scenario. The most effective proof accessible to parents to point out their blood relationshi ... Read more »

A surviving spouse will automatically inherit any property that she and the decedent owned jointly with a right of survivorship. This will include the marital residence and any other real estate purchased during the marriage, as well as any joint bank accounts. The spouse will inherit a one-half interest in any community property. That is any property acquired during the marriage without a right of survivorship, such as an automobile.

In Tennessee, a spouse may intentionally disinherit his spouse. She will still be entitled to her share of joint or community property, but if she is left out of the decedent's will, she will not be entitled to anything else. However, the omission must be intentional and must be made clear in the will or by other evidence. For example, if a decedent's will contains a statement to the effect of: "I bequeath only $1.00 to my wife for reasons known to both of us," that language clearly establishes an intent to disinherit. However, if there is no s ... Read more »

Portland Oregon is a bit stricter than some other states when it comes to automotive window tint. You are not allowed to tint your vehicle darker than the legal limit and Oregon State law requires that all tinted cars carry a Tint certificate declaring what percentage of light is passing through the glass and film. They refer to this number as the Visible Light Transmittance or VLT%.

If a motorist is pulled over for tinted windows they are required to provide a certificate proving the car was tinted within legal limits. The law requires that the meter reading be 35% or higher for all windows on a car. Many law enforcement officers carry a meter and will perform a test prior to writing a ticket. If your VLT is lower than 35% be prepared for a hefty fine! The picture above is an example of tint percentages. As you can see the lower the % the darker the tint. If the tint is to dark on a car that would not pass the meter test and a ticket for illegal window tint would be issued. ... Read more »

A creditor that finances property has the right to repossess the property when the debtor defaults on the contractual obligation to pay off the loan on a timely basis. When the debtors purchase the property through a financing plan, they normally have to sign a contract listing the property being purchased, the amount of the loan, dates when payments are due and the creditor's right to repossess the collateral if the debtors cease making payments.

If the debtor breaches the contract and is no longer able to make timely payments, the secured creditor may send a written notice to the debtor stating that it plans on repossessing the property. If the creditor is not able to get in contact with the debtor or if the debtor is not willing to cooperate, the creditor can locate the property and legally repossess it. The creditor cannot breach the peace or violate any trespassing laws when repossessing the property.

Military Law is founded on the Uniform Code of Military Justice (UCMJ). The UCMJ applies to all branches of the US military and governs most issues of legal concern for soldiers and others subject to the jurisdiction of US military courts. For example, the UCMJ covers the different types of court-martial, the apprehension and treatment of prisoners (both foreign and domestic), and the trial process for military tribunals. The UCMJ also covers the rules governing military jurisdiction, legal investigations, discharges from the service, the release and revision of military records, post-trial review procedures, and appellate procedures. The UCMJ applies to all active-duty, reservist, national guard, and retired military personnel.

The Laws of War (also known as ?juris in bello?), on the other hand, refers to the international laws pertaining to acceptable justifications for nations to take military action against another and the limits of acceptable wartime condu ... Read more »

What is Administrative Law? It covers a wide and varied area of practice, encompassing many different types of governmental legal procedures and regulations, and is not easily defined. Much of government and its public programs operate largely through various agencies on different levels: federal, state, county, and city. These agencies are also known as boards, commissions, departments, and divisions.

They generally have their own specific rules and regulations, which are not usually found in the statutes, with stringent procedures individuals must follow to obtain assistance from the agency and to file claims, grievances and appeals. Legal rulings by Administrative Law Judges (ALJ?s) have governing authority the same as most precedent law. Administrative law attorneys can offer assistance when maneuvering through these complicated proceedings.

The Administrative Procedure Act is the governing law for federal administrative agencies. Most states also have the ... Read more »

Q: What is "auto dealer fraud"?

A: "Auto dealer fraud" is a term that describes deceptive and unlawful practices used by automobile dealers, at almost any stage of the vehicle purchase process -- from advertising, to negotiation of vehicle pricing and financing terms. Examples of auto dealer fraud include "bait and switch" advertising practices, deceptive inflation of vehicle prices, and failure to disclose information about a vehicle.

Q: How does a "bait and switch" occur?

A: "Bait and switch" sales tactics are a form of false or deceptive advertising, in which a car dealer lures potential buyers to the dealership by advertising one vehicle at a certain price, then tells the customer that the particular vehicle is no longer available before using aggressive tactics to sell a different, more expensive vehicle (or the advertised vehicle at a price higher than the advertised price).

Q: What kinds of things must used car dealers ... Read more »

Many consumers have never heard of antitrust laws, but enforcement of these laws saves consumers millions and even billions of dollars a year. The federal government enforces three major federal antitrust laws, and most states also have their own. Essentially, these laws prohibit business practices that unreasonably deprive consumers of the benefits of competition, resulting in higher prices for products and services.

The three major Federal antitrust laws are:

  • The Sherman Antitrust Act
  • The Clayton Act
  • The Federal Trade Commission Act.

The following information on these laws comes from the Antitrust Enforcement and the Consumer guide.

This Act outlaws all contracts, combinations, and conspiracies that unreasonably restrain interstate and foreign trade. This includes agreements among competitors to fix prices, rig bids, and allocate customers, which are punishable as criminal felonies.

The Sherman Act also mak ... Read more »

David Van Zandt is the president of the New School. He served as the dean of Northwestern University School of Law from 1995 to .

Updated July 25, , 11:40 AM

The cost of a legal education is driven by two significant factors. The first is demand for the education and the certification it makes possible. The second involves the requirements the American Bar Association imposes on law schools.

Practicing law in the United States almost always requires a juris doctor issued by a law school accredited by the American Bar Association, which allows one to sit for the bar examination in all states. A law license remains valuable because revenue from legal service will continue to grow as national and global economies become more complex and businesses are subjected to greater regulation.

The third year of law school is not essential for acquiring the core competence to practice.

The A.B.A. now requires students to ta ... Read more »
