International law contains a system of rules referred to as the "laws of war." These rules establish the red lines that a combatant or occupying state may not cross. Among the instruments in which the rules are stated are the Hague Convention of 1907 and its regulations, and the four Geneva Conventions of 1949.

The principal concept of the Humanitarian Law is that, even in wartime, all acts are not allowed. Humanitarian law does not deal with the question of whether the war is justified, but with the means used during the conflict. For example, the rules limit the parties in order to minimize the harm to non-combatants, such as prisoners of war, the wounded, and civilians. In addition, humanitarian law contains provisions restricting the arms that may be used during the conflict.

The Hague Regulations. which establish the laws for conducting war on land, are considered part of international customary law. The Regulations state the rights and duties of the combatants, ... Read more »

Megan’s law , any law requiring that law-enforcement officials notify local schools, day-care centres, and residents of the presence of registered sex offenders in their communities. It is named after Megan Kanka, a seven-year-old New Jersey girl who was brutally raped and murdered in 1994 by a twice-convicted sexual offender who had been living across the street from her home. In various forms such statutes were passed by many U.S. states in the mid-1990s. In 1996 Megan’s law was adopted as a federal law in the United States.

Concern about sexually related child abuse. and especially pedophilia. became intense during the 1980s, chiefly in the United States but also in Europe and elsewhere. Although the main threat to children continued to come from members of the victim’s family, by about 1990 attention had come to be focused on sexual molestation committed by non-family members and strangers, and it was widely believed that offenders in such cases typically a ... Definition

A contract in which one party agrees to indemnify another against a predefined category of risks in exchange for a premium. Depending on the contract, the insurer may promise to financially protect the insured from the loss, damage, or liability stemming from some event. An insurance contract will almost always limit the amount of monetary protection possible.

Overview

In the absence of insurance, three possible individuals bear the burden of an economic loss; the individual suffering the loss; the individual causing the loss via negligence or unlawful conduct; or lastly, a particular party who has been allocated the burden by the legislature, such as employers under Workmen's Compensation statutes.

While types of insurance vary widely, their primary goal is to allocate the risks of a loss from the individual to a great number of people. Each individual pays a "premium" into a pool, from which losses are paid out. Regardless of whether ... Read more »

Employment contract law is the body of law related to agreements made between employers and employees. Written, oral, or implied contracts often give rise to disputes in an employment relationship, and in some cases the end result is wrongful termination. There are several types of employment contracts, including non-compete agreements, waiver of rights agreements, and severance agreements. An at-will employee is a worker who is offered no employee contract who or is offered a contract but can be terminated at any time. Employment workplace issues pertaining to at-will employees or employees under long-term contracts are often beyond the scope of employment contract law.

Employees often hire attorneys to review a contract of employment to avoid legal pitfalls and to ensure that their rights are protected and that the contracts are in their best interests. For example, an employee may have waived his rights to trial in the contract and must go to arbitration where a panel of ... Read more »

Workplace safety and health laws establish regulations designed to eliminate personal injuries and illnesses from occurring in the workplace. The laws consist primarily of federal and state statutes. Federal laws and regulations preempt state ones where they overlap or contradict one another.

The main statute protecting the health and safety of workers in the workplace is the Occupational and Safety Health Act (OSHA). Congress enacted this legislation under its constitutional grant of authority to regulate interstate commerce. OSHA requires the Secretary of Labor to promulgate regulations and safety and health standards to protect employees and their families. Every private employer who engages in interstate commerce is subject to the regulations promulgated under OSHA.

In order to aid the Secretary of Labor in promulgating and enforcing regulations, the act establishes the National Advisory Committee on Occupational Safety and Health. The Secretary of Labor may auth ... Read more »

Court cases are divided into two broad categories: civil and criminal. Businesses and private citizens file civil lawsuits, usually for the purpose of getting the other side to pay money or stop doing something. If you lose a civil lawsuit, your credit rating may suffer - but you won't go to jail.

If you are accused of a criminal offense, the government files the lawsuit. If you are found guilty, you may be required to pay a fine or go to jail. A criminal conviction can affect your ability to get a driver's license, find a place to live, or get a job.

In most states, child custody laws provide that mothers who are not married have complete control, care and custody of their children. Oklahoma is one of those states. Child custody laws in Oklahoma are governed by Title 10 of the state's code.

According to Title 10, Sections 104 and 106, of the Oklahoma Code, the birth mother of a child born out of wedlock has full legal custody of her child and has the right to care for her child as she sees fit. The unmarried mother is in full control of the child, including the support, education and residence of the child, unless it becomes necessary for a court of law to step in. If the mother is unable to fully support the child, the other parent must assist to the extent of his ability.

If a mother can not financially provide for her child, the other parent can provide support, and the mother does not have to compensate him for voluntarily supporting the child, unless there is an agreement to do so. A third party may also sup ... Read more »

The Guidelines were originally written by the Judicial Administration Committee of the Judicial Conference of Indiana and then adopted by the Indiana Supreme Court. The Court periodically reviews amendment to the guidelines. When the guidelines are revised, a new online support calculator is developed and is available on the Calculator site. Blank forms can also be printed from the site.

Indiana calculates support based on the gross weekly income of both parents. Gross weekly income includes salaries, variable income like commissions and overtime, investment income, worker's compensation, unemployment benefits, disability benefits, inheritance and gifts. Based on the weekly income of both parents, the court will calculate the basic child support obligation and divide that obligation between the parents. Parents may be required to pay other amounts, such as for health care, in addition to the basic child support obligation.

Gaining a broader understanding and awareness of employment laws will decrease the likelihood that a business will unknowingly commit a crime, so the following questions and answers have been developed to help everyone understand common employment laws.

When does an employer have to pay overtime?

The Fair Labor Standards Act (FLSA) requires that employers pay non-exempt (hourly) employees a rate of one-and-a-half times their regular pay for any hours worked greater than forty per week. However, consult a state’s Department of Labor website because some states require that employers pay employees overtime for excess hours worked each day.

When is an employer required to give employees breaks and lunches?

Federal law does not require an employer to provide breaks. However, many states require that non-exempt employees and contingent workers be given one paid 10-minute break for every four hours worked and one unpaid 30- ... Read more »

A franchise business is a business in which the owners, or "franchisors", sell the rights to their business logo, name, and model to third party retail outlets, owned by independent, third party operators, called "franchisees". Franchises are an extremely common way of doing business. In fact, it's difficult to drive more than a few blocks in most cities without seeing a franchise business. Examples of well-known franchise business models include McDonalds, Subway, UPS, and H R Block. In the United States, there are franchise business opportunities available across a wide variety of industries.

To invest in a franchise, the franchisee must first pay an initial fee for the rights to the business, training, and the equipment required by that particular franchise. Once the business begins operating, the franchisee will generally pay the franchisor an ongoing royalty payment, either on a monthly, quarterly, or annual basis. This payment is usually calculated as a percentage of t ... Read more »

Chapter I Child Support Guidelines

In this chapter, I discuss some important aspects of the Child Support Guidelines. This will provide you with a much better idea of exactly what your legal rights and obligations are.

Child Support Amount

The big question on everyone’s mind is, “How much child support will I have to pay or will I receive?”

The amount of child support you are required to pay is based on tables that are a part of the Child Support Guidelines. These tables can be found at Justice.gc.ca.

The tables use a formula based on the cost of living and provincial income tax to determine the amount of child support a person must pay. Additionally, the amounts in the Child Support Guidelines are based on average amounts that families spend to care for their children nationally.

The two primary factors in determining the amount of child support you must pay is your annual income and the number of children you are p ... Read more »

The different types of law school prerequisites mainly involve a bachelor's or higher degree, a good score on an official admissions test, previous legal work experience, a letter of recommendation and a panel interview. Not all law schools expect applicants to have every type of prerequisite. The amount of weight given to each prerequisite also varies depending on the specific law school. In addition to the formal prerequisites for law school admission, approval committees also look for strong communication skills.

Both oral and written language skills are considered to be crucial abilities in candidates for law school. While many law schools are flexible in the type of bachelor's or other degree an applicant has, proper grammar, spelling and punctuation are always expected. Degree subjects for law school prerequisites must be seen by admissions councils as relevant to the kind of lawyer the prospect wants to become. For instance, an educational background in sociology may ... Read more »

Statute law is written law passed by legislatures. It is different than judge-made common law or case law. Statute laws are laws that are formally established to deal with specific situations, and written down in code books.

In common law societies such as England, Canada, and the United States, law is made by two distinct bodies. The legislature makes some laws, and judges make other laws. In the US, this distinction is set forth by separation of powers rules in the Constitution.

When the legislature makes a law, it is considered statute law or statutory law. The legislature can make a law on anything that they have the power to govern. In the United States, for example, state legislatures are vested with the power to make laws on property and divorce, among other things, while federal legislatures are allowed to make laws on matters governing interstate commerce and on issues such as international relations.

The legislature, unlike the courts, does not have ... Read more »
