Civil Law Versus Criminal Law

Civil law refers to a wide array of rules that govern legal matters among private citizens such as injuries, broken contracts, trademark infringement, andfraud. Civil law cases involve either a breach of duty or contract. In addition, civil law actions--suits in civil court--are brought about by private citizens, whereas criminal prosecutions are brought about by the government. Furthermore, civil law remedies for wrongful acts include monetary damages or reimbursements, and injuctions or court orders requiring or banning certain kinds of conduct. In contrast to criminal cases, the defendant--the party accused of being liable for wrongful acts--is not subject to fines or imprisonment.

Overview and Background

The most common kind of civil court cases in the United States are tort cases, which include cases of intentional wrongs, negligence and liability such asfraud, defamation, trespassing, and f ... Read more »

According to U.S. News and World Report’s ranking of the United States’ best colleges and universities, Massachusetts-based Babson College (Olin) ranks No. 1 for its graduate MBA in entrepreneurship. Following Babson, Stanford University ranked second and Harvard University third for this year’s title of best entrepreneur-based MBA program – which U.S. News says can help students channel creativity, participate in business plan competitions and launch a business. MIT (Sloan) and University of Pennsylvania (Wharton) placed fourth and fifth, respectively. The annual survey results were released on Sept. 13.

The debate continues, however, over whether an entrepreneurial MBA degree is worth the time and money for aspiring entrepreneurs. Can the necessary skills for successful entrepreneurship be taught? Or, are entrepreneurs better off skipping the upwards of $85,000-per-year price tag for an MBA, and using that money to help fund their own start-ups?

The earliest form of insurance is probably marine insurance, although forms of mutuality (group self-insurance) existed before that. Marine insurance originated with the merchants of the Hanseatic league and the financiers of Lombardy in the 12th and 13th centuries, recorded in the name of Lombard Street in the City of London, the oldest trading insurance market. In those early days, insurance was intrinsically coupled with the expansion of mercantilism, and exploration (and exploitation) of new sources of gold, silver, spices, furs and other precious goods - including slaves - from the New World. For these merchant adventurers, insurance was the "means whereof it cometh to pass that upon the loss or perishing of any ship there followeth not the undoing of any man, but the loss lighteth rather easily upon many than upon a few. whereby all merchants, especially those of the younger sort, are allured to venture more willingly and more freely." A crime is defined in law in Ireland as an act which may be punished by the State. The way in which a criminal offence is investigated and prosecuted depends on the type of crime involved. For these purposes criminal offences may be described in different ways such as:

  • Summary offences
  • Indictable offences
  • Minor offences
  • Serious offences
  • Arrestable offences

Summary and indictable offences indicate the manner in which these offences are tried or dealt with in the courts. A summary offence is one which can only be dealt with by a judge sitting without a jury, that is the District Court, while an indictable offence is one which may be or must be tried before a judge and jury.

All common-law offences are held to be indictable offences as the common law did not distinguish or differentiate between indictable and non-indictable offences. However, criminal statutes or criminal laws passed into law by the Oireachta ... Read more »

A relationship in which one woman bears and gives birth to a child for a person or a couple who then adopts or takes legal custody of the child; also called mothering by proxy.

In surrogate motherhood, one woman acts as a surrogate, or replacement, mother for another woman, sometimes called the intended mother, who either cannot produce fertile eggs or cannot carry a pregnancy through to birth, or term.

Surrogate mothering can be accomplished in a number of ways. Most often, the husband's sperm is implanted in the surrogate by a procedure called ARTIFICIAL INSEMINATION. In this case, the surrogate mother is both the genetic mother and the birth, or gestational mother, of the child. This method of surrogacy is sometimes called traditional surrogacy.

Less often, when the intended mother can produce fertile eggs but cannot carry a child to birth, the intended mother's egg is removed, combined with the husband's or ... Read more »

    What is Civil Rights Law?

Civil rights law deals with the protections and liberties enjoyed by the American people. These rights are designed to ensure that people are treated equally and without respect to their ethnicity, gender, or other such attributes. They also guard against overly intrusive conduct by the government. Government actors are not permitted to make decisions arbitrarily, or to deprive individuals of their lives or property without affording them due process of law. While civil rights violations give rise to a host of civil and criminal penalties for the offender, attorneys practicing in this area of the law are generally engaged in seeking financial compensation for victims.

Primary sources of civil rights law include the first ten amendments to the U.S. Constitution (the ?Bill of Rights?), as well as a number of important pieces of federal legislation passed in recent decades. The Civil Rights Act of 1964 is a notable example of federal law ... Read more »

It is not unusual for attorneys to receive inquiries about defamation actions from people who are in conflicts with neighbors or other members of their communities, and have become the subjects of vicious lies. The area of law most implicated by that type of conduct is defamation of character , a cause of action which is generally defined to include libel and slander .

Generally speaking, defamation is the issuance of a false statement about another person, which causes that person to suffer harm. Slander involves the making of defamatory statements by a transitory (non-fixed) representation, usually an oral (spoken) representation. Libel involves the making of defamatory statements in a printed or fixed medium, such as a magazine or newspaper.

Typically, the elements of a cause of action for defamation include:

    1. A false and defamatory statement concerning another;
    2. The unprivileged publication of the statement to a third ... Read more »

This is a piece about the laws relating to surrogacy. For many people surrogacy is the only means to achieve parenthood. However the current surrogacy laws tend to leave the applicants and the child vulnerable.

    Why Surrogacy Laws Need Reviewing

A Guardian is a qualified experienced person who is appointed by the Courts to represent the wishes and feelings of children in Care Proceedings and Adoption. LAWYER RANKINGS

Some states and some localities have referral services that will at random refer an individual to a lawyer who has developed a certain area of expertise in a specific field, such as Domestic, Bankruptcy, Landlord/Tenant, etc. Additionally, there are certain services that will rank lawyers or rate lawyers, such as the ratings system we apply to lawyers listing on our site. However, caution should be used in viewing any ratings assigned to a lawyer or law firm within any publication since such ratings may be politically motivated. Some services look at the number of years a lawyer has practiced. Sometimes special ratings are given to lawyers who are members of large firms. Therefore, if a lawyer is not rated as highly by some of these various services, it does not necessarily mean that the lawyer is not extremely skilled or well qualified for that particular purpose. These sources of lawyer rankings may be helpful, as is the case with our ratings ... Read more »

A person admitted to practice law in at least one jurisdiction and authorized to perform criminal and civil legal functions on behalf of clients. These functions include providing legal counsel, drafting legal documents, and representing clients before courts, administrative agencies, and other tribunals.

Unless a contrary meaning is plainly indicated this term is synonymous with attorney at law, lawyer, or counselor at law.

In order to become an attorney, a person must obtain a Juris Doctor degree from an accredited law school, although this requirement may vary in some states. Attendance at law school usually entails three years of full-time study, or four years of study in evening classes, where available. Anyone working in a law office needs this knowledge; and often a course like this can be a first step toward a job such a situation

Businessmen, politicians, public servants, accountants. in fact many different professions need a solid understanding of legal terminology

The language of law differs from most other role-specific languages in that legal language is culture-bound and intertwined with each particular society and its legal system. Legal language is not a universal language such as is the case of the language of natural science, which is an almost universal language utilised by scientists worldwide. Legal language is developed in laws or sentences, in administrative acts or in private negotiations, and it is always based in the dialectical relationship between being and having to be, between legal prescription and concrete case. While retaining its fundamental characteristics, it has diversity of styles and of environments.

The term criminal law, sometimes called penal law, refers to one of various bodies of rules in different jurisdictions whose common characteristic is the possible for unique frequently strict impositions as penalty for failure to fulfill.

Criminal punishment, depending on the offense and jurisdiction, may include implementation, loss of liberty, government supervision (parole or probation), or fines. There are some archetypal crimes, like murder, but the acts that are prohibited are not wholly consistent among different criminal codes, and even within a particular code lines may be blurred as civil infractions may give rise also to criminal penalty. Criminal law naturally is enforced by the government, unlike the civil law, which may be enforced by private parties.

The first civilizations usually did not differentiate between civil law criminal law. The first written codes of law were produced by the Sumerians. Around 2100-2050 BC Ur-Nammu, the Neo-Sumerian king of U ... Read more »

Since we re on the topic of consumer law, this is an opportune space to advise the readers of our disclaimer. But fear not: it is a softie! This article reviews general legal information only. It cannot possibly, and by design, be used to answer a specific question since the unique facts of any consumer transaction might make a rule of law set out herein inoperative. If you have a real live kicking consumer protection issue, contact your local consumer protection agency and if none is available, then call a lawyer.

And while we re selling apples, we should also make this pitch for oranges:

Consumer law is often called consumer protection law because, on the face of it anyway, consumer law is there to protect the consumer, not the manufacturer, the distributor or the retailer. However, manufacturers, distributors and retailers benefit substantially from robust consumer protection law because happy consumers keep the economy humming.

    Format: Paperback

I just finished my Contracts final, but I will not blame my grade on this book.

This does what it is supposed to. It supplements the material that the Prof. presents in class. If you are not sure what the modern rule is, this is where you go. If you are not sure if there is an exception, this is where you go. If you are not sure what the basic functions of the rule is, this is where you check. If you are not sure what Restatement or UCC section applies, this is where you check.

This book is great for supplementing your notes and filling in the gray areas. For that, it is invaluable, but like all commercial outlines, it cannot replace your notes.

As the previous reviewer says, the flow charts are excellent. This certainly facilitates understanding, I would just recommend not putting all your eggs in this basket.
