Consumer laws and Consumer lawyers in India

Consumer rights are the rights given to a consumer to protect him/her from being cheated by salesman/manufacturer. Consumer protection laws are designed to ensure fair trade competition and the free flow of truthful information in the marketplace.

The laws are designed to prevent businesses that engage in fraud or specified unfair practices from gaining an advantage over competitors and may provide additional protection for the weak and those unable to take care of themselves. Consumer Protection laws are a form of government regulation which aim to protect the rights of consumers.

For example, a government may require businesses to disclose detailed information about products particularly in areas where safety or public health is an issue, such as food. Consumer protection is linked to the idea of consumer rights (that consumers have various rights as consumers), and to the formation of consumer organizations which ... Read more »

Meaning of "tort"

"Tort" means civil wrong. The word itself is derived from French or Latin roots. The law of torts is concerned with compensation for damage suffered as a result of another's acts or omissions.

Definition: Tort

From the French, deriving from the Latin torquere. to twist. Any civil wrong, other than a contract dispute, for which there is a remedy. Implies acts that bend or warp societal rules prohibiting causing harm to others.

Liability in tort arises when some interest of another is harmed. Tort law is not intended to punish wrongful conduct. Rather, the point of this branch of law is to determine liability for harm and assign the cause of harm to the most appropriate actor. This then gives the injured party a place to seek a remedy.

The nature of acts giving rise to injury creates the first organizing principle when considering tort liability. Some acts are clearly intended to give rise to injury, such as physi ... Read more »

Garrow s dead sexy

This series is clever and thought-provoking. The period dress and the way that court was conducted are historically accurate and fascinating. As well as the serious cases which are considered, there are the humorous incidents which help to balance the series.

Many British period dramas focus on the upper class folk. This one, by contrast, brings us face to face with the working class, with their appalling living conditions, clothing and poor hygiene.

Our hero is based upon a real-life figure, William Garrow (1760-1840). He is idealistic, trying to make the law work for those who are unable to help themselves and is well sexy in this version. Thanks to him, many of the rights we now take for granted, came to be accepted.

There are just four episodes of this fine series. I hope that the BBC will see fit to make more, as there is a lot more to be said.

Juris praecepta sunt haec: honeste vivere, autem non laedere, suum cuique tribuere.

Anthony W. Crowell

During the winter of 1890, a dispute arose at Columbia Law School over an attempt to introduce the Case Method of study. The Case Method had been pioneered at Harvard Law School by Christopher Columbus Langdell. The dean and founder of Columbia Law School, Theodore Dwight. opposed this method, preferring the traditional method of having students read treatises rather than court decisions. Because of this disagreement, Dwight and a number of other faculty and students of Columbia Law School left and founded their own law school in Lower Manhattan the following year.

On June 11, 1891, New York Law School was chartered by the State of New York, and the school began operation shortly thereafter. By this time, Theodore Dwight was in poor health, and was not able to be actively involved with the Law School, so the position of dean went to one of the other p ... Read more »

Change to Stark In-Office Ancillary Services Exception

The recent health care reform legislation included one somewhat significant change to the Stark In-Office Ancillary Services Exception. As you will recall, this exception permits the referral source physicians who are members of a physician group practice to refer a patient for imaging services (or other Designated Health Services - DHS) to be provided within the group practice without violating Stark. This exception is basically what permits physician group practices to own and operate and receive compensation for imaging services and other DHS provided within their group practice.

Effective immediately upon the legislation being signed by Obama (March 23, ), a physician within a group practice referring his/her patient for MRI, CT or PET to be provided within the group practice must provide the patient, at the time of the referral, written notice that the patient may obtain these imaging services from a supplie ... Send your California Labor Law claim to Mathew & George Attorneys At Law who will review your claim at NO COST or obligation. or call 1-888-580-0698

California and Federal Employment labor laws secure an employee's civil rights to overtime pay and benefits while protecting against workplace harassment and discrimination. California law states that hours worked beyond eight hours per day qualify for overtime pay of one-and-one-half times the regular hourly wage.

California has unique state overtime pay laws that protect employees from working extensive hours. With differences between state labor law and federal regulations on overtime pay, employers (especially multi-state corporations) often may, either accidentally or intentionally, incorrectly classify employees to avoid paying overtime wages and therefore violate California labor laws.

About the Author

Howard Satterthwaite is a Barrister and the Student and Young Lawyers’ Director for the Lawyers’ Christian Fellowship.

Studying law is challenging and hard work but it is not without its rewards. It may mean spending more time in the library than your friends do, missing out on nights out, etc. but wouldn t you rather be studying the pursuit of justice and order and reflecting upon the clash of worldviews underpinning laws and legal philosophies ? Perhaps not ? I often meet students who feel somewhat disillusioned with their studies. They tell me that 'law is boring' and sometimes I have to agree we re not all made with minds that enjoy the intricate details of tax law, although some (believe it or not) are!

More often than not, however, this disillusionment stems from the challenge of integrating the Christian faith with law. This is where the rubber hits the road. Does the study of law really matter to God? What does God think about the a ... Read more »

On March 7, 1994, Governor Wilson signed into law AB 971 (Ch 12/94, Jones) referred to as the Three Strikes and You're Out criminal sentencing measure. In November, the voters reaffirmed the measure by overwhelmingly approving Proposition 184, an initiative that is essentially identical to Chapter 12. The measure is the most significant change to the state criminal justice system in more than a generation.

In January, we published The Three Strikes and You're Out Law A Preliminary Assessment. This analysis summarizes the findings of that piece, provides more up-to-date data, and recommends that the state closely monitor the implementation and impact of the Three Strikes law.

The Three Strikes law significantly increases the prison sentences of persons convicted of felonies who have been previously convicted of a violent or serious felony, and limits the ability of these offenders to receive a punishment other than a prison sentence. Violen ... Read more »

Below are links to a variety of sample national domestic violence laws. Some of these resources are regional or global surveys of national laws. Others are examples of laws that have been enacted in particular jurisdictions. While national laws may serve as useful models or resources, none should be transplanted into a different legal context without substantial consideration and adaptation. The principles of ensuring victim safety and batterer accountability must guide the drafting process of any new law.

Prior to drafting, it is important to address the issues of whether there is a need for a domestic violence law and whether introduction of such a law is appropriate at that particular time. The answers to these questions will depend on an evaluation of the ways in which battered women s needs are or are not being addressed in the current legal system, the contribution that can be made by a domestic violence law to deterring batterers behavior, and the current political si ... If Henry Bergh, founder of the American Society for the Prevention of Cruelty to Animals, were alive today, even he might be surprised by the sheer number and tenacity of politically savvy dog owners and animal welfare organizations.

During hearings on controversial local and state bills, legions of canine enthusiasts pack rooms to voice their support or opposition. In July 2007, animal advocates began lining up outside California s Capitol nearly two hours before a senate committee hearing on a statewide mandatory spay-neuter bill. Hundreds of people attended a hearing in Boston earlier this year when lawmakers decided to explore the idea of a statewide ban on pit bull-type dogs.

The reason for the intense interest and passionate debate is simple: Dogs have captured our hearts — so much, that 45 million U.S. households choose to share their lives with some 65 to 80 million dogs. But society s view of dogs often differs from how the legal system sees them. Under the ... Read more »

In the United States, the professional doctorate in law may be conferred in Latin or in English, as Juris Doctor (JD or J.D.) or Doctor of Jurisprudence (DJur or D.Jur.), respectively. "Juris Doctor" literally means "Teacher of Law", while the Latin for "Doctor of Jurisprudence"—Jurisprudentia Doctor —literally means "Teacher of Legal Knowledge".

Invariably an earned doctorate, the J.D./D.Jur. is equivalent in academic rank to the Doctor of Laws or Legum Doctor (LLD or LL.D.). However, while the LL.D. remains an earned doctorate in Ireland and many Commonwealth countries, it is invariably an honorary degree in the United States. [ 15 ] [ 16 ]

In Europe the first academic degrees were law degrees, and the law degrees were doctorates. [ 17 ] [ 18 ] [ 19 ] The foundations of the first universities were the glossators of the 11th century, which were schools of law. As of the early 2000s a relatively new specialty devoted to the legal issues of Senior Citizens. including estate planning. health care. planning for incapacity or mental incompetence, the receipt of benefits, and employment discrimination.

The genesis of elder law can be found in the convergence of several profound social developments. One phenomenon is a rapid increase in the elderly population. According to statistics from the 2000 U.S. census, more than 12 percent of the population in the United States was over the age of 65; and that percentage was expected to rise to 20 percent by the year 2050. Another phenomenon is that generally, older U.S. citizens in the early 2000s are wealthier and better educated than ever before. These two circumstances have led to a rise in the collective political clout of older U.S. citizens. This newfound political strength has coincided with a trend toward cutting the government benefits and entitlements on which many ... Read more »

Before the unification of the Supreme Court in 1873, solicitors practised in courts of equity. while attorneys practised in the common law courts. After 1873 the title of "attorney" disappeared, being replaced by "solicitor" in all courts. [ 1 ]

In the English legal system, solicitors traditionally dealt with any legal matter apart from conducting proceedings in courts (advocacy ), with some exceptions. Minor criminal cases tried in Magistrates' Courts. for example, and small claims civil cases tried in county courts are almost always handled by solicitors. Barristers, as the other branch of the English legal profession, have traditionally carried out the functions of advocacy. In the past, barristers did not deal with the public directly. This rigid separation no longer applies. Solicitor advocates with an additional audience rights qualification may now act at all levels of the courts. Conversely, the public may now hire and interact with a barrister directly in certain ty ... Read more »

(redirected from Federal Labor Law )

A work stoppage; the concerted refusal of employees to perform work that their employer has assigned to them in order to force the employer to grant certain demanded concessions, such as increased wages or improved employment conditions.

A work stoppage is generally the last step in a labor-management dispute over wages and working conditions. Because employees are not paid when they go on strike and employers lose productivity, both sides usually seek to avoid it. When negotiations have reached an impasse, however, a strike may be the only bargaining tool left for employees.

Employees can strike for economic reasons, for improvement of their working conditions, or for the mutual aid and protection of employees in another union. In addition, even if they do not have a union, employees can properly agree to stop working as a group; in that case they are entitled to all the protections that organized strikers a ... The rule of law (also known as nomocracy ) is the legal principle that law should govern a nation, as opposed to arbitrary decisions by individual government officials. It primarily refers to the influence and authority of law within society, particularly as a constraint upon behavior, including behavior of government officials. [ 2 ] The phrase can be traced back to 16th century England, and it was popularized in the 19th century by British jurist A. V. Dicey. The concept was familiar to ancient philosophers such as Aristotle. who wrote "Law should govern". [ 3 ]

Rule of law implies that every citizen is subject to the law, including law makers themselves. In this sense, it stands in contrast to an autocracy. collective leadership. dictatorship. or oligarchy where the rulers are held above the law (which is not necessary by definition but which is typical). Lack of the rule of law can be found in democracies and dictatorships, and can happen because of neglect ... Read more »

If you are thinking about going to Law School you may wonder how long does it take to get a Law Degree? Well, that all depends on how long do you want to be in Law School. Joking aside, here are the details.

First things first, you must obtain a bachelor degree. Granted this is a criminal justice blog, the bachelor degree program doesn’t have to be in criminal justice. But in the end, you must have one. The degree can take anywhere from 2 and 1/2 years to 4, or more. Read my post on how long does it take to complete a degree (it applies to all degree types – not only Criminal Justice, Homeland Security, Political Science, or Public Safety degrees).

Thus far, you have a minimum of 2.5 years of education, and the national average of 4 years, before you can even dream of being in Law School.

Generally, a law degree takes 3 years. Three years of your life which you will have to devote entirely to school. No girlfriends, no boyfriends, no social life, no liberties ... Read more »
