What is Maritime and Admiralty Law?

Maritime law, also referred to as admiralty law, consists of the statutes and case precedents that govern legal disputes originating on navigable waters. Navigable waters include all bodies of water that are capable of being used for interstate or foreign commerce. Thus, a large river that flows into the ocean or crosses state lines would fall within maritime jurisdiction. A lake entirely within a single state would not.

This area of the law deals with a variety of factual scenarios. Examples include commercial accidents resulting in damage to vessels and cargo, seamen injuries, and hazardous material spills. Maritime law can also apply to piracy and criminal activity, liens against a ship, wake damage, and towage contracts. Furthermore, in an increasing number of cases, jurisdiction has been upheld in recreational boating accidents that occur on navigable waters.

Cases in which maritime law applies are heard in fede ... Read more »

Yes, it s true and it s pretty fucking stupid.

Basically they re talking about banning all alcohol advertising to protect the impressionable children which means that all alcohol related advertising in public areas would be illegal. Because apparently adverts encourage people to start drinking younger to which I ll point out that if stuff s illegal just because then someone will sure as hell rebel. And this includes underage drinking so I doubt the advertising blackout will do shit.

The new laws also mean that a restaurant can t for example use a following kind of positive Facebook review in their advertising, social media or otherwise: Great restaurant, absolutely mouthwatering food, make sure to check out their shrimps, nice atmosphere, a large selection of beers for all tastes. They re also forbidden from creating content that can be shared, which has also apparently lead to Finnish government to asking Facebook to ban the Share button in Finland.

Doctor of Education (Ed.D.)-Special Education

It is really very difficult to formulate strategies and statistical studies for the special education sector. The researchers have not been able to establish any concrete correlations between the education being provided to a special student and the exact outcome of it. The introduction of special education in the public schools has been criticized as the qualification requirement varies significantly from one education institute to another. Parents of students and critics often complain that other students might have to face certain risks if we include special students into regular class. Critics are of the opinion that placing regular students in the same classes as disabled students may decrease the educational progress of people with disability. Special education programs continue to be criticized by disability activists because they are still often differentiated from regular education programs.

Newton s law of gravity defines the attractive force between all objects that possess mass. Understanding the law of gravity, one of the fundamental forces of physics. offers profound insights into the way our universe functions.

He wondered if the same force at work on the apple was also at work on the moon. If so, why did the apple fall to the Earth and not the moon?

Johannes Kepler (German physicist, 1571-1630) had developed three laws governing the motion of the five then-known planets. He did not have a theoretical model for the principles governing this movement, but rather achieved them through trial and error over the course of his studies. Newton s work, nearly a century later, was to take the laws of motion he had developed and apply them to planetary motion to develop a rigorous mathematical framework for this planetary motion.

Newton eventually came to the conclusion that, in fact, the apple and the moon were influenced by the same force. He named ... Read more »

Attorneys looking to start up a firm often look for the best furniture, equipment, and supplies available so as to impress their prospective clients once the office is open. However, lawyers just starting out their careers or making a clean, fresh transition from another practice may have to be more practical in their considerations. Whether furniture and other equipment is necessary, or more of a luxury, is a determination each lawyer will have to make in the context of their budget and past experience. In essence, this is one of the first of many business decisions that a lawyer must make. After all, a beautiful and impressive mahogany or cherry wood desk might not look very useful later on should you have to cut costs on other equipment which would have made your work product better and more efficient.

Furniture: A Necessary Expense ?

We all depend on our cars for traveling and for many other purposes. Life without a car just seems impossible. But what if someone seizes your car and you can't take it back. In this case, understanding some laws regarding repossession would be a huge help.

Car repossession occurs when a person fails to pay the car payments that he/she owes to the creditor, and the creditor takes back the car. If you have bought your car on loan, and you are late with your payments, and you don't even have enough car insurance, your vehicle could be seized. Once you buy a vehicle on loan, your creditor has more rights on the car than you. If you don't make your monthly payments on time, the creditor has the full authority to take back your car without a warning or a court notice in advance. If you have fallen behind your monthly payments, then it is necessary for you to understand the various automobile repossession laws. The good news is that, there are some limitations that the creditor ha ... Read more »

In order for a Landlord to begin the eviction process, California law requires all persons residing in the property to be served with a Notice. If preparation or service of the notice is done incorrectly or not at all and the tenant raises it as a defense, the Court will dismiss the Landlord's complaint due to a procedural defect and the tenant will prevail at Court.

Call us today!

A landlord who wants to terminate (end) a month-to-month tenancy can do so by properly serving a written eviction notice of 30, 60 or 90 days on the tenant. Generally, a 30 or 60 day notice doesn't have to state the landlord's reason for ending the tenancy.

A landlord can use a written 3-day notice (eviction notice) if the tenant has done any of the following:

  • Failed to pay the rent.
  • Violated any provision of the lease or rental agreement.
  • Materially damaged the rental property ("committed waste").
  • Substantially interfer ... Read more »

Copywrite laws are they to vague?

Hey guys

This is something of a serious note, any feedback to the following will be much appreciated. As a fan of any art, literature, and so forth I found this quite disturbing at the stupidity of some companies.

This letter comes from a fan site dedicated to creating Skins and Meshes involving Marvel characters for the game Freedom Force. What has come to my understanding is that anything a fan does that "distributes" copyrighted material in any form (Like our great Star Trek Mods) is infringing on the rights of the company.

Funny thing I thought Fans are supposed to love and support their favorite Icon, I guess all those Star Trek conventions are breaking the law. I feel a gnawing disgust at the moment.
