Workplace bullying has been a chronic problem in many industries in particular; healthcare, education, childcare and not-for-profits. It is unlawful bullying to harass and intimidate a fellow employee in the workplace repeatedly and without justification to achieve an ulterior motive and creates a risk to health and safety. That motive may be to attempt to humiliate or force the bullied employee to resign without being paid proper entitlements and where there is no valid reason for that employee to do so.

It is not bullying to demand that employees reach standards of performance which are reasonable and for which the employee has the skills and training to meet.

Wrongfully, the bullied employee might be required to perform an excessive work level, be isolated or threatened by a fellow employee. It is not just managers who might bully an employee; it could be a competitor for a job promotion or the like. Sometimes it can be done by a manager needing a scapegoat upon w ... Read more »

For most couples, applying for the marriage license is the least romantic part of getting married. They go, they sit, they fill out the form, they show their IDs, they pay the fee and then they leave. It's about as romantic as a visit to the DMV. It is a necessary part of the process, though. Without a marriage license, your wedding is at best a really fancy and romantic party. The license is what seals the deal with the state and the government. It's important, even though it feels like a chore.

Marriage licenses can be traced all the way back to the middle ages. They started being used by the Catholic Church to get around a situation called The Banns of Marriage. For the most part the Banns of Marriage are associated with the Catholic Church though it has ties to the Church of England as well.

You are probably familiar with that part of the marriage ceremony during which the officiant asks if there are any objections to the union that is about to happen. This is a ... Read more »

Bankruptcy allows people to either get rid of most of their debt and start over or work out a plan to replay creditors.

Chapter 11 Bankruptcy provides for reorganization and payment of debts.

Chapter 12 Bankruptcy is for farmers and their families.

Chapter 13 Bankruptcy provides for debt repayment for only individuals.

Have you lost a job or had your income reduced? Do you have unanticipated medical bills? Have your living expenses increased beyond what you need to make your normal minimum payments on your credit cards and other bills? The vast majority of people who need to file bankruptcy end up in that position through no fault of their own. That isn t intended to mean that people who file aren t responsible for their debts. The World Law Dictionary English may be the common language of the world, but the Common Law is not the common law of the world.

Some of the world’s leading law faculties have joined together to create an online database of legal terminology, all linked to a single English dictionary of law, with the aim of making it easier to understand and communicate legal concepts in different languages.

The overall aim of the project is to create the world’s best and largest multilingual law dictionary.

At launch, which is planned for January 2016 for the first few languages, there will be 10,000 English legal terms in the dictionary.

Academics in the field of law and linguistics have complained for decades about the shortage of good bilingual legal dictionaries 1 pointing out that legal publishers are reluctant to spend the time or money required to produce a good legal dictionary 2. These scholars have written extensively on the shortcomings of multilingual leg ... Read more »

October, 2003; Last Reviewed Dec. .

A contract intends to formalize an agreement between two or more parties, in relation to a particular subject. Contracts can cover an extremely broad range of matters, including the sale of goods or real property, the terms of employment or of an independent contractor relationship, the settlement of a dispute, and ownership of intellectual property developed as part of a work for hire.

Typically, in order to be enforceable, a contract must involve the following elements:

The parties to the contract have a mutual understanding of what the contract covers. For example, in a contract for the sale of a mustang , the buyer thinks he will obtain a car and the seller believes he is contracting to sell a horse, there is no meeting of the minds and the contract will likely be held unenforceable.

The contract involves an offer (or more than one offer) to another party, who accepts the offer. For example, in a contract for ... Read more »

Questions touching the scope, effect or application of a rule of law which the courts apply in determining the rights of parties.

An issue before a court of appeal that requires the application of legal principles.

A question of law is usually contrasted with a question of fact. a mixed question of law and fact and even a question of discretion.

In the context of an appeal, a question of law is often put forward as an alleged error of law ; termed as a "question" for reasons of political correctness as it is not a recognized as a error until the appellate court says so.

In Woodhouse AC Israel Cocoa Ltd. Justice Alfred Denning (aka Lord Denning), wrote of the most commonly given example of a question of law :

"It has long been settled that the interpretation of a document is a matter of law for the court, save in those cases where there is some ground for thinking that the words were used by the writer — ... Read more »

The last thing most college students want to deal with is a legal matter. More often than not, simple discrepancies over rent agreements may turn into legal disputes that may ruin one’s credit score. Other times, questions about academic integrity may have long-lasting effects on one’s professional career.

If you’re faced with important legal questions that need immediate answers, it’s important to know your rights, and in some very serious cases, you might actually need a lawyer. Some common legal issues faced by college students are learning disability accommodations, honor code/academic violations, and DUI incidents.

Most recently, The Times and Democrat, reported that University of South Carolina student Sean Aston, was charged with a felony DUI for killing two motorcyclists. And Ramapo College student Douglas Hervey, 20, was charged in November with two counts of assault by motor vehicle.

Although the law may not like the sound of it, there are often different degrees of guilt that can be associated with a crime depending upon the prosecutor, defense attorney, and even the judge.

If you've ever heard of the case Commonwealth v. Woodward (also known as the "nanny case,) then you already have a leg up in the realization that there can be several different degrees of guilt associated with any given crime. In that case, a nanny was convicted of murdering a toddler by shaking the child until it died. According to the jury's verdict, the nanny was to spend a minimum of 15 years in prison. However, the nanny was released from prison a week after entering the establishment because the judge threw out the jury's verdict.

From the beginning of the Woodward case, the prime question that needed to be answered was what charges should be brought against the nanny. The question "did she do it?" was easily answered in the affirmative by almost every par ... Read more »

The broad topic of constitutional law deals with the interpretation and implementation of the United States Constitution. As the Constitution is the foundation of the United States, constitutional law deals with some of the fundamental relationships within our society. This includes relationships among the states, the states and the federal government, the three branches (executive, legislative, judicial) of the federal government, and the rights of the individual in relation to both federal and state government. The area of judicial review is an important subject within Constitutional Law. The Supreme Court has played a crucial role in interpreting the Constitution. Consequently, study of Constitutional Law focuses heavily on Supreme Court rulings.

While the topic also covers the interpretation and implementation of state constitutions, without qualification it is usually understood as referring to the Federal Constitution.

Members of the state Board of Higher Education shot down the proposed University of Massachusetts law school yesterday after months of forceful debate over the plan and intense scrutiny by state officials, who concluded that the school's financial plan was too fragile and that legal questions about its structure had not been answered.

The 8-to-3 vote against the state's first public law school followed an emotional two-hour meeting at Bunker Hill Community College, where supporters of the merger between unaccredited Southern New England School of Law and nearby UMass-Dartmouth cheered statements in favor of the project and bristled at opponents' arguments. Scattered hugs and tears followed the decision.

A curfew is a law, regulation, or ordinance that forbids particular people or particular classes of people from being outdoors in public places at certain specified times of the day.

Local ordinances and state statutes may make it unlawful for minors below a certain age to be on public streets, unless they are accompanied by a parent or an adult or on lawful and necessary business on behalf of their parents or guardians. A trademark is any word, name, symbol, or design, or any combination thereof, used in commerce to identify and distinguish the goods of one manufacturer or seller from those of another and to indicate the source of the goods. See 15 U.S.C. § 1127 .

Trademarks are generally words, phrases, logos and symbols used by producers to identify their goods. However, shapes, sounds, fragrances and colors may also be registered as trademarks. See Qualitex v. Jacobsen Products Co. Inc.. 514 U.S. 159 (1995). In recent years, trademark law has expanded to include trade dress and antidilution protection. Almost any word, name, symbol, or device capable of distinguishing the source of goods may be used as a trademark subject to few limitations. However, a mark 's eligibility for trademark protection may be limited by application of the functionality doctrine. and a mark may be denied registration if it falls within any of the categories listed under 15 U.S.C. § 1052 .

For those seeking a career that deals with money, an MBA specialization in finance can prove to be invaluable. It is a career field which requires one to possess skills in mathematics, economics, and financial theory, all of which are covered in great detail in a finance degree, specialization or track.

A finance MBA prepares students for careers in:

  • * Accounting
  • * Financial planning
  • * Banking
  • * Corporate finance
  • * A number of other careers in, and closely related to, the financial sector

Since you’ll be dealing almost exclusively with numbers, mathematics is an essential part of any finance degree. Courses focus on investment, investment strategy, local and global economics, mergers acquisitions (M&Amp;A), corporate risk insurance and financial theory.

While courses vary from school to school, finance MBAcourses typically include:

"Defamation" is a catch-all term for any statement that hurts someone's reputation. Written defamation is called "libel," and spoken defamation is called "slander." Defamation is not a crime, but it is a "tort" (a civil wrong, rather than a criminal wrong). A person who has been defamed can sue the person who did the defaming. (For in-depth information on defamation claims, check out Nolo's Defamation, Libel Slander  section.)

Defamation law tries to balance competing interests: On the one hand, people should not ruin others' lives by telling lies about them; but on the other hand, people should be able to speak freely without fear of litigation over every insult, disagreement, or mistake. Political and social disagreement is important in a free society, and we obviously don't all share the same opinions or beliefs. For instance, political opponents often reach opposite conclusions from the same facts, and editorial cartoonists often exaggerate facts to make their point.

People often confuse being separated with a legal separation. This article explains the differences between these concepts and provides a basic overview of military divorce.

Sometimes, couples (both military and civilian) that are going through a rough patch in their marriage choose to separate before pursuing a divorce. They may want time to see how they do living apart or to seek counseling to save their marriage. During a separation, most couples will live apart. If they can’t afford to live apart, they may act as though they are separated while living in the same home - as roommates without cohabitation (sexual relations).

When it becomes clear that the separation is going to last for some time or that the next likely step is divorce, a couple may enter into a “separation agreement,” which is a written agreement that spells out how the couple wants to handle certain issues during their separation, including child custody and support, alimony payments (if any), an ... My son has been married for four years. From the planning of the wedding until now, it has been difficult. I was blamed for things that happened before the wedding which were not true and I just find my daughter-in-law to be very cold. According to my son she had a list of 11 things I did wrong before the wedding. The wedding was difficult as I was completely ignored. She never calls me or emails me. My son said she is not that type of person. He said she doesn't email her best friend. They come to my house occasionally for holidays. I was never invited to their home as he said the house was too small. They now have a son. I gave her a beautiful shower and nice gifts. Everyone got a thank you note but me. I cry a lot over this. I tried talking to my son and he says she is not outgoing. Her parents live out of town and come occasionally and spend the night. I feel hurt and left out. I cannot talk to my son anymore. He says I am too emotional. I think too much about things. What do I ... Read more »

Lawrence Connell is a tenured law professor at Widener Law School in Delaware.  I have noted in prior posts that Connell was accused of a wide range of racist and sexist conduct directed at students in his classes and at Dean Linda Ammons (because of hypothetical examples Connell used in class).

Connell has sued, and also went through a university disciplinary hearing process.  The faculty committee which heard the evidence found that Connell did not violate any university policy with regard to the allegations of racist and sexist conduct.  The committee report, available exclusively here. while it ultimately vindicates Connell, is a depressing narrative of the sorry state of political correctness and race/sex politics on campus, in which the feelings and reaction of accusers carry as much weight as the objective reality of the statements made.  While Connell was vindicated on a wide range ...
