Home » Foreclosure Laws By State

Use the links below to research the laws for your particular state. Because the foreclosure laws vary from one state to the next, it s important to clarify which state you are researching.

When looking at the laws, there are 3 main things you should look for. The first is the approximate foreclosure timeline, which will tell you how much time you have to stop the foreclosure or find help. The second is the type of foreclosure. In all states, it is either a judicial foreclosure or a non-judicial foreclosure. Most states are judicial, which means the foreclosure will take place in a court and it will be part of public record. The third thing you should look for is whether a deficiency judgment is allowed. If a deficiency judgment is allowed, it means your lender can force you to pay your mortgage in full, regardless of how much the home sells for at a sheriffs sale or short sale.

Amnesty, which has been granted seven times in the US, is a controversial subject regarding illegal immigration laws. America has had a long-standing problem with workers who cross its borders illegally to find higher paying work than what is available in their home country.

There are many factors responsible for the illegal immigration problem. The US has a long border that is hard to police. In addition, there is high motivation for workers to risk the dangerous border crossing because of the relatively high potential reward for those who do make it across.

These undocumented workers then stay inside the US and generally work hard to make a living despite the lack of official government support. Some people who have studied the worker’s predicament suggest amnesty as a solution.

What do we mean by amnesty as applied to the problem of illegal immigration?

In 1986 a blanket amnesty bill was passed for the first time ever in the United ... Read more »

Call it harassment, intimidation, aggression coercive management or things seen as ‘just a joke’ are all common labels for what is called bullying. If you are one of those who is always harassed by your colleagues at work, here’s a list of things you can do to combat bullying:

Remember bullies just wait for a reaction from people getting bullied. But if you just walk away or ignore their jokes, mails and instant messages, you are clearly telling them that you just do not care. Sooner or later the intimidator will probably get bored with trying to bother you. You just continue minding your own business and learn to completely ignore them. Stop feeling shy and weird to face them. Just show as if you don’t know what is happening. Using this type of body language sends a message that you’re not vulnerable. Trust us and learn to ignore the aggressor.

Who wouldn’t get upset about being-bullied? Well it is pretty much natural. But remember, that’s exactly the kind of respon ... Read more »

I am waiting for the results from the Feb CBX from CA. They will be released on May 15th. I work with lawyers in the business group, in general banking, securities law, business formations, employment contracts and mergers. I assist as a legal assistant and have been with the same attorneys for almost 15 years. I am an expert in EDGAR filings but I plan to practice generally in business, family law, estate planning but with emphasis on assisting pro bono to those who have no money who need help escaping religious and political persecution.

I just finish and pass my 1L and moving into 2L. I think this is the law school to attend if you are not just studying but working as well. This is also the school for you if you have hard time getting into an aba school.

Over all, it is a great school and I believe you can transfer to an aba school after you pass baby bar. I will try to do that. Finally, I am very happy where I am now. My advice for you is to pray to God and God w ... Read more »

What encompasses domestic law, and how are lawyers and law firms, like Ciyou Dixon, P.C.,  different one from another?

A significant part of Ciyou Dixon’s practice focuses on family law, which is also known as “domestic relations .”  In fact, Ciyou Dixon, P.C. attorneys have handled appellate cases that have changed or clarified Indiana domestic law (Cohoon v. Cohoon, 2003 ). Today, domestic relations law is broader in scope than ever before, including traditional divorce and paternity cases, to a growing array of people who define themselves as a “couple” or in a “family” relationship, along with third parties who are rearing the children of other parents.

Domestic cases include: 1). child support. modification, emancipation. and termination, along with higher education expenses; 2). paternity establishment and challenge, along with the child support issues; 3). child custody determination and modification, both in terms of legal and physical custody ; ... The first edition was published in 1891, and the second edition in 1910, long before the first edition of the Oxford English Dictionary was completed in 1928. The sixth and earlier editions of the book also provided case citations for the term cited, which some lawyers view as its most useful feature, providing a useful starting point with leading cases. The Internet made legal research easier than it ever had been, so many state- or circuit-specific case citations and outdated or overruled case citations were dropped from the seventh edition in 1999. The eighth edition introduced a unique system of perpetually updated case citations and cross-references to legal encyclopedias. The ninth edition was published in the summer of .

Hofstra Law School, based in Hempstead, NY, is one of many different law schools that feed into the New York City market. Currently ranked 100 by US News and World Report, the school enjoys a better reputation than some of its peers (NYLS, Touro, etc.). However, that being said, risk-averse applicants might want to think twice about attending without significant scholarship money. The school's claim of a median post-graduate salary of $160,000 is suspect, especially in the currently struggling economy. Academics and facilities at the school are slightly lacking, and the school's tuition for full-time students is quite high at $41,780 per year. If you factor in the expensive cost of living near New York City (the ABA estimates that students will spend over $20,000 per year on living expenses alone at Hofstra), students can spend over $60,000 per year for their degree.

As mentioned above, Hofstra's tuition is expensive. Full-time students end up paying $49,780 per year in tuit ... Read more »

Laws protecting both landlords and tenants may vary from country to country, by U.S. state . or by city, town or village.

What hardly ever varies is the emotion the subject raises on both sides of the fence in many communities around the world.

In some cases, eviction may be as simple as the landlord choosing not to renew a lease after its expiration date. More commonly, nonpayment of rent or property damage remain the most typical causes for sudden evictions.

Before any action can be taken, landlords in many jurisdictions are bound by a strict set of rules. Typically, just cause must be evident, followed by a lawsuit in a local court and an official notice of a number of days or weeks given to the tenant before eviction.

Matters that civil attorneys deal with include breaches of contract, warranty violations, personal injury, invasions of privacy, negligence, medical practice and wrongful death.

Civil attorneys begin their education by obtaining a bachelor's degree, typically in a humanities-related field like English or political science. After graduation, students attend three years of law school.

Once finished with law school, civil attorneys take the bar exam in their respective states in order to independently practice law.

What is a bank account garnishment?

A bank account levy (also referred to as bank account garnishment,) occurs when a creditor is able to take all, or a portion of, the money in a debtor’s bank account for payment of an overdue debt.  In most cases, a court order is required for this to occur, but the federal government can issue a bank account levy administratively (without going through a court.) There are numerous specific laws on both the federal and state level that apply to bank account garnishments.

Bank Levy Process

When a bank receives a notice of a levy, they must immediately freeze the debtor’s account. In addition to being unable to make a withdrawal, if your bank account is frozen, any outstanding checks or automatic debit card payments won’t clear (unless there are enough exempt funds in the account) – so be sure to make alternate arrangements.

If this wasn’t done, the garnishee would simply withdraw the ... Read more »

Question: What to Do If You Hate Your In-Laws

Frankly, I’m getting sick of having to be with these people, who get on my nerves, insult, and manipulate me. My wife would like me to meet with her siblings and talk out our differences, but I’d rather relocate to get away from them. What should I do?

Answer: Unfortunately, unless you marry an orphan with no siblings, you do indeed marry the family of your husband or wife, too. While you don’t have to be as intimate with your in-laws as you are with your spouse, you do have an obligation to try and make the relationship work. For your wife’s sake, you should try to communicate with your in-laws and explain what’s been bothering you. Try to come to a resolution, even if you don’t agree. That doesn’t mean feigning forgiveness. That means agreeing to disagree and committing to respecting one another.

Relocation seems a bit extreme. But you can create some distance for y ... Read more »

Like most motorists, you will likely get a traffic ticket or be stopped by the police at least once in your lifetime. Minor traffic violations such as speeding or double parking generally are classified as "infractions" that are not punishable by jail time. Most of the time, fines for traffic tickets can be paid through the mail without the need for legal representation. But for more serious traffic offenses, or when extra points on your license could lead to a suspension, it makes sense to consult with an attorney.

FindLaw's Traffic Laws section covers everything from getting pulled over by police and having your vehicle searched, to understanding your rights and fighting a traffic ticket. This section also provides a state-by-state directory of traffic laws and DMV offices.
