The basic feature of labor law in almost every country is that the rights and obligations of the worker and the employer between one another are mediated through the contract of employment between the two. This has been the case since the collapse of feudalism and is the core reality of modern economic relations. Many terms and conditions of the contract are however implied by legislation or common law, in such a way as to restrict the freedom of people to agree to certain things in order to protect employees, and facilitate a fluid labor market. In the U.S. for example, majority of state laws allow for employment to be "at will", meaning the employer can terminate an employee from a position for any reason, so long as the reason is not an illegal reason, including a termination in violation of public policy. [ 1 ]

One example in many countries [ 2 ] is the duty to provide written particulars of employment with the essentialia negotii (Latin for essential terms) to ... Read more »

In equations formulated by Sir Isaac Newton, the force of gravity grows with the mass of two objects and gets weaker the more distant the objects are from each other.

In general, a scientific law is the description of an observed phenomenon. It doesn t explain why the phenomenon exists or what causes it. The explanation of the phenomenon is called a scientific theory. It is a misconception that theories turn into laws with enough research.

In science, laws are a starting place, said Peter Coppinger, an associate professor of biology and biomedical engineering at the Rose-Hulman Institute of Technology. From there, scientists can then ask the questions, Why and how?

Both scientific laws and theories are supported by a large body of empirical data and are widely accepted by the vast majority of scientists within a discipline. Both also help unify a particular field of scientific study. However, theories and laws, as well as hypotheses, are separate parts of t ... Read more »

What is Family Law?

Family law consists of a body of statutes and case precedents that govern the legal responsibilities between individuals who share a domestic connection. These cases usually involve parties who are related by blood or marriage, but family law can affect those in more distant or casual relationships as well. Due to the emotionally-charged nature of most family law cases, litigants are strongly advised to retain legal counsel.

The vast majority of family law proceedings come about as a result of the termination of a marriage or romantic relationship. Family law attorneys help their clients file for separation or divorce, alimony, and child custody, visitation, and support. Spouses married a short time may seek an annulment, and special rights may exist between same-sex couples. The division of property at the end of a marriage is also a common issue in family law cases.

With respect to property division at the time of divorce, every s ... Read more »

We have all heard of the current 'laws of attraction' wave sweeping across the world and the use of new age philosophical phrases, like 'positive thinking', the 'universal laws of attraction', and the '11 forgotten laws of attraction'. However, how many of us have truly realized the essence of these terms which have been a part of so many books and movies? Deemed as one of the most important laws governing the universe, the laws of attraction are believed to be the key to worldly success and freedom. The world is full of people who are constantly running the rat race to make money, have a great relationship, a nice home, and a great car (Read: A red Ferrari). So why is it that some people find success a walk in the park, while others struggle with a life of mediocrity and unhappiness? To answer this all important question, we need to understand the laws of attraction.

What is Adoption Law?

Adoption law provides a means for parents to voluntarily assume the legal rights and responsibilities of a child not born to them. Following an adoption, all legal ties between the child and the birth parents are permanently severed. The new adoptive parents and the child are treated just like a natural family in the eyes of the law. The adoptive parents decide important matters involving medical treatment, education, and religion, as well as ordinary day-to-day issues that arise in the child?s life. Adopted children can inherit from their new parents the same as natural offspring. Some jurisdictions even provide for the issuance of an amended birth certificate displaying the new parents? names.

State statutes govern adoption proceedings, and the substantive and procedural rules vary across the country. Most statutes require the local department of family services to perform a home study to ensure a stable environment free of dangers and ... Read more »

This includes seeking and obtaining the person's personal information in order to contact them; e.g. looking for their details on computers, electoral rolls, personal files and other material with the person's personal details without their consent. Service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities. Examples of such work or tasks include guiding people who are blind, alerting people who are deaf, pulling a wheelchair, alerting and protecting a person who is having a seizure, reminding a person with mental illness to take prescribed medications, calming a person with Post Traumatic Stress Disorder (PTSD) during an anxiety attack, or performing other duties. Service animals are working animals, not pets. The work or task a dog has been trained to provide must be directly related to the person’s disability. Dogs whose sole function is to provide comfort or emotional support do not qualify as service animals under the ADA.

This definition does not affect or limit the broader definition of “assistance animal” under the Fair Housing Act or the broader definition of “service animal” under the Air Carrier Access Act.

Thinking about law school? Consider California law schools. California offers a complete menu of law schools ranging from ABA approved schools, Concord Law School, state approved schools, unaccredited law schools, correspondence and online law schools. But the really unique thing about the California law schools is that their graduates, even those graduating form non ABA approved programs, generally speaking, are permitted to take the bar exam and become practicing lawyers.

Must you take the LSAT before attending a California law school?

That depends upon the particular school. As a general rule if wish to be considered for one of California’s ABA approved law schools the answer is yes. As for the other schools the LSAT is not always required and, in quite a number of cases, it is just not a requirement at all. The LSAT has been criticized for many years. Collaborative law (also called collaborative practice. divorce. or family law ) is a legal process enabling couples who have decided to separate or end their marriage to work with their lawyers and, on occasion, other family professionals in order to avoid the uncertain outcome of court and to achieve a settlement that best meets the specific needs of both parties and their children without the underlying threat of contested litigation. The voluntary process is initiated when the couple signs a contract (called the "participation agreement"), binding each other to the process and disqualifying their respective lawyer's right to represent either one in any future family related litigation.

Ever since its inception in the 1980s, the Collaborative Law movement has spread rapidly to most of the United States, Europe, Canada and Australia. [ 2 ] More than 22,000 lawyers have been trained in Collaborative Law worldwide and than 1,250 lawyers have comple ... Read more »

Second-degree murder is ordinarily defined as: 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable heat of passion ; or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. Second-degree murder may best be viewed as the middle ground between first-degree murder and voluntary manslaughter .

For example, Dan comes home to find his wife in bed with Victor. At a stoplight the next day, Dan sees Victor riding in the passenger seat of a nearby car. Dan pulls out a gun and fires three shots into the car, missing Victor but killing the driver of the car.

Some jurisdictions make a distinction between different situations that constitute murder and prosecute the charges differently. These states usually break the crime of murder into first degree murder and second degree murder.

The exact definition of second degree murder varies between jurisdictions, but there are a few common ele ... Read more »

The study of business law is where legal topics such as contracts and intellectual property collide with business subjects like bankruptcy and banking. In today s global economy, this discipline often has an international focus that is especially relevant to foreign-trained lawyers with interest in financial and commercial law in a transnational context, though business law may also pertain to different state business and legal practices.

At the graduate school level, there are many entry-points into business law. A joint JD/MBA program, for instance, will attract students looking to earn both a law degree and a business degree. A Master of Laws (LL.M) with a focus in business law, on the other hand, usually is geared towards students who already have their JD and are practicing attorneys who want to expand their business knowledge. There are also master s degrees that do not require a JD, but may be geared towards students with a business background looking to gain more leg ... Read more »

What is Consumer Rights Law?

Consumer rights and consumer protection law provides a way for individuals to fight back against abusive business practices. These laws are designed to hold sellers of goods and services accountable when they seek to profit by taking advantage of a consumer?s lack of information or bargaining power. Some conduct addressed by consumer rights laws is simply unfair, while other conduct can be described as outright fraud. Consumer rights laws exist at the federal and state level. They are enforced by government agencies, offices of attorneys general, and through individual and class action lawsuits filed by victims.

Types of Consumer Protection Cases

The most common kinds of abusive business practices occur when consumers are in particularly vulnerable circumstances. For example, when people fall behind on their bills, debt collectors are in a position to make life even more difficult by calling in the early morning or l ... Read more »
