The Trinity Law School, as it is now known, was founded in 1980 as the Simon Greenleaf School of Law and was originally located in Anaheim, California. It was originally named in honor of the Nineteenth century Harvard law professor Simon Greenleaf who was a major authority on the laws of evidence and also wrote The Testimony of the Evangelists. which was a work of Christian apologetics concerning the evidences for the resurrection of Jesus Christ .

The Simon Greenleaf School of Law was the brain-child of John Warwick Montgomery. Montgomery rose to prominence in the 1960s as a confessional Lutheran theologian and as a Christian apologist. He held the chair of Professor of Church History at Trinity Evangelical Divinity School in Deerfield, Illinois (1964–74). A founding board of trustees collaborated with Montgomery to establish in 1980 the Simon Greenleaf School of Law.

It commenced operations by offering evening classes in a four-year undergraduate cou ... Read more »

#Using the road (159 to 203).

The following list can be found abbreviated throughout the Code. It is not intended to be a comprehensive guide, but a guide to some of the important points of law. For the precise wording of the law, please refer to the various Acts and Regulations (as amended) indicated in the Code. Abbreviations are listed below.

Most of the provisions apply on all roads throughout Great Britain, although there are some exceptions. The definition of a road in England and Wales is ‘any highway and any other road to which the public has access and includes bridges over which a road passes’ (RTA 1988 sect 192(1)). In Scotland, there is a similar definition which is extended to include any way over which the public have a right of passage (R(S)A 1984 sect 151(1)).

It is important to note that references to ‘road’ therefore generally include footpaths, bridleways and cycle tracks, and many roadways and driveways on private land (including many car parks). ... Read more »

Stanford’s Graduate School of Business has leapfrogged the University of Pennsylvania’s Wharton School and Columbia Business School to become the most expensive two-year MBA program in the world, according to an analysis by Poets Quants. This year Stanford is telling applicants that the estimated cost of its two-year, full-time MBA program is a whopping $185,054, a new record.

That is some $18,242 more than Stanford said it would cost an MBA student only two years ago when Columbia was the school with the most expensive MBA program in the world. At that time, Columbia estimated that the cost to attend its MBA program was $168,307, while third-place Stanford’s price tag was $166,812. In just two years, Stanford’s estimated cost of the degree has risen by 10.9%, though the estimate includes a $4,000 global study trip.

For the LBers who have been following the rising cost of law school tuition and debt, University of Massachusetts School of Law has proposed a bold solution: cap tuition for the next three years.

That means the new schools full-time in-state tuition will hold steady at $23,068 and its full time out-of-state tuition at $30,760.

The establishment of UMass Law is about mission, not money, said UMass President Robert Caret on the school website.

The move may also be borne out of necessity. A brutal legal job market has given way to a steep drop in law school applications. UMass, which opened its doors in after acquiring $23 million of assets from the Southern New England School of Law, could have a hard time filling seats if the market doesnt improve.

The American Bar Association gave the school provisional accreditation earlier this month. According to the February Massachusetts bar exam results, not a single first-time test-taker from UMass passed the b ... Read more »

There is a practice called Physician self-referral. This is when a physician refers a patient to a medical facility, which he has part ownership, financial interests or investment in. It is thought to be a conflict of interest that a physician will stand to benefit from referring patients to his medical facility for health services. This self-referral practice has a potential to be abused because the physician may over-refer patients for services that may or may not be necessary. That is why; the law was developed to prevent such self-referral practices.

The Stark Law was passed by the federal government to prevent physician self referral and does not allow a physician to refer Medicare or Medicaid patients to facilities that are owned by the physician or a member of the physician s immediate family, unless it is under exception.

Finance is the study of raising, allocating and using monetary resources. Finance falls under business and economics and therefore it is said that to understand finance, one must understand business and in fact the entire economy. Over the years as businesses have branched out in different directions, finance has developed into more specific fields. Therefore students interested in finance can specialize in fields like

  • Financial Instruments and Portfolio Management
  • International Finance
  • Corporate Finance
  • Banking and Financial Institutions

Different colleges and universities may offer these courses at various levels, including masters of business administration (MBA) with a focus on abovementioned specializations.

#Utah Gun Laws

Talk to a Criminal Defense Lawyer

Utah protects the right to bear arms under Article I, Section 6 of the state constitution, but this does not mean that everyone may carry a gun, or that you may always carry a gun wherever you like. While you may openly carry a weapon without a permit, Utah requires a concealed carry permit to carry a weapon concealed on (or near) your body or vehicle unless you are in your own residence or on your own property. (Utah Code Ann. § 76-10-511).

For more information on concealed weapon permits, see Open and Concealed Gun Carry Laws in Utah .

The following sections explain who may not have a gun, as well as the circumstances when carrying a gun is illegal.

People Who May Not Carry a Gun in Utah

#Written Employment Contracts: Pros and Cons

Know when you should -- and should not -- ask a new employee to sign a written employment contract.

A written employment contract is a document that you and your employee sign setting forth the terms of your relationship. You don't have to enter into a written contract with every employee you hire. In fact, written employment contracts are generally the exception, rather than the rule. In some situations, however, it makes good sense to ask an employee to sign a contract.

This article explains the pros and cons of using written contracts with employees. For more information on employment contracts, including a sample offer letter you can use to create an at-will employment relationship, see Dealing With Problem Employees. by Amy DelPo and Lisa Guerin (Nolo).

#Utah Gun Laws

Utah Gun Laws

Utah is considered to have a casual stance on gun laws, when compared to other states with restrictive interpretations. The state employs the citizen s right to bear arms, and can be evident through the fairly simple statutes employed under Utah gun laws.

Utah gun laws do not impose the utilization of a permit to purchase firearms. Authorized gun dealers are required to conduct instant background checks that must be approved by the Public Safety Bureau of Criminal Identification, or BCI for short. A fee of $7.50 is charged to the buyer for the cost of the background check.

Those individuals that have a valid license for a concealed firearm are not subject to the background check or fee as long as the license is presented at the time of the sale. The possession of firearms is also not subjected to a permit or license. However, certain criteria outlining certain restrictions must be met in order to be considered under la ... Read more »

People are increasingly concerned about choosing the next move in life. They are increasingly concerned about their career and the profession that they are to take. It takes a good deal of thinking to go with the subject of inclination and it becomes all the more important to decide upon a good institution to set a career. Law is one of the most common fields that people choose for their career.

While a career in law is profitable enough, there are a number of things that are to be considered before getting into a law school. In this respect it is important to mention that the quality and reputation of the school is of concern. The second point which is equally important is the fact that law schools are hugely expensive and it requires a good fortune for the enthusiasts who want to etch a career in law. It is thus that many are seen looking for law schools that offer courses of free of charge.

Employment and labor laws in the State of California are often described as stringent for covered employers yet protective of employees. Despite all of this, there are still employees, as well as applicants, who are subjected to unfair workplace treatment. Instances of discrimination, harassment, and retaliation still continue to happen in a lot of workplaces, resulting in claims and lawsuits filed against erring employers. Fortunately, there are various agencies in the state that investigate claims of workplace discrimination in an aggressive manner, as well as going after erring employers that commit statute and regulation violations respective of the employment and labor laws in California.

One of these agencies is the Department of Industrial Relations or DIR. For any labor law violation employers commit, there is a certainty that affected employees can assert their rights against them by filing claims with the agency. #Fordham Law Review

Twice in the past two years, the U.S. Supreme Court has approved educational diversity as a compelling state interest that justifies the use of race in higher education admissions decisions. Nevertheless, it remains on somewhat shaky ground. Over the past decade, the Court has emphasized that its acceptance of diversity stems from the expectation that a diverse student body will enhance the classroom environment, with students drawing on their diverse backgrounds during classroom conversations that ultimately bring the law to life. Yet, the Court provides no support for its assumption that admitting and enrolling diverse students actually result in these educational benefits. In fact, empirical research on law students indicates that structural diversity (i.e. diversity in numbers) does not lead automatically to interactional diversity (i.e. meaningful interaction among diverse students) or classroom diversity (i.e. meaningful diverse interaction in the classroo ... Statutory Law is the term used to define written laws, usually enacted by a legislative body. Statutory laws vary from regulatory or administrative laws that are passed by executive agencies, and common law, or the law created by prior court decisions.

Unlike common law, which is subject to interpretation in its application by the court, statutory laws are generally strictly construed by courts. Strict construction means that courts are generally not able to read between the liens of a statute in order to liberalize its application. Rather, they will be bound by its express terms.

As legislative enactments, statutory laws follow the usual process of legislation. A bill is proposed in the legislature and voted upon. If approved, it passes to the executive branch (either a governor at the state level or the president at the federal level). If the executive signs the bill it passes into law as a statute. If the executive fails or refuses to sign the bill, it can ... Read more »

Family law is a comprehensive body of law that deals with family relationships. It stipulates the rights and obligations of parties in domestic relations. Family law covers a wide range of topics, including marriage, divorce, child custody, visitation, alimony, and adoption.

Marriage, civil union, and domestic partnership are different kinds of legal statuses recognized by family law. Marriage is a legal relationship between two persons, in which the parties, the husband and the wife, are bound by the rights and obligations stipulated in the marital contract. A civil union is a legal relationship between a same sex couple. Civil unions are also known as civil partnerships. The rights and obligations in a civil union are similar to those in a marriage. In a domestic partnership, partners live together and have a common domestic life, but without being bonded by marriage or a civil union.

By FOX BUTTERFIELD, Special to The New York Times
    Published: February 6, 1990

    Correction Appended

BOSTON, Feb. 5 The Harvard Law Review, generally considered the most prestigious in the country, elected the first black president in its 104-year history today. The job is considered the highest student position at Harvard Law School.

The new president of the Review is Barack Obama, a 28-year-old graduate of Columbia University who spent four years heading a community development program for poor blacks on Chicago's South Side before enrolling in law school. His late father, Barack Obama, was a finance minister in Kenya and his mother, Ann Dunham, is an American anthropologist now doing fieldwork in Indonesia. Mr. Obama was born in Hawaii.

''The fact that I've been elected shows a lot of progress,'' Mr. Obama said today in an interview. ''It's encouraging.

An expansion of Bloomberg BNA's  Sexual Harassment in Employment Law—providing the most complete  coverage of harassment issues in the workplace

Workplace harassment has become one of the most litigious areas of employment law, with thousands of cases being brought against employers, resulting in millions of dollars in litigation costs and awards. Bloomberg BNA first addressed this explosive subject in its seminal treatise Sexual Harassment in Employment Law. Given the expansion of the theories of liability for harassment, however, and the evolution of employer and employee rights and obligations, litigators and employers need an updated  reference that addresses the entire spectrum of workplace harassment issues.

The new Workplace Harassment Law provides the comprehensive coverage that ... Read more »

What is Trespassing (Penal Code § 602)?

Trespass means many things to many people. To one person, it means walking into an area posted with signs that state, No Trespassing. To others, it means walking into a business, loitering for a long time and then leaving without making a purchase. To others, it may be a homeless person living for several days, or even weeks, at an empty foreclosed upon house without permission.

These ideas are all correct to some degree. Under California Penal Code § 602, trespass is defined as willfully entering another person s property with the specific intent to interfere with that person s property rights. Willfully means on purpose or deliberately. Specific intent means that one intends to not only do something, but that one intends the consequence of the act, i.e. loitering in a business with the consequence of interfering with that location s business.

The defenses to trespassing are fairly logical from the definition of ... Read more »

    #Florida Attorney General - The - Sunshine - Law

    Services

Open Government - The "Sunshine" Law

To assist the public and governmental agencies in understanding the requirements and exemptions to Florida's open government laws, the Attorney General's Office compiles a comprehensive guide known as the Government-in-the-Sunshine manual. The manual is published each year at no taxpayer expense by the First Amendment Foundation in Tallahassee.

Florida began its tradition of openness back in 1909 with the passage of Chapter 119 of the Florida Statutes or the Public Records Law. This law provides that any records made or received by any public agency in the course of its official business are available for inspection, unless specifically exempted by the Florida Legislature. Over the years, the definition of what constitutes public records has come to include not just traditional written documents such as papers, maps and books, but also tapes, photographs, film, s ... Abraham Lincoln University (School of Law)

Abraham Lincoln University School of Law offers a unique program for the study of law. This program is unlike any other in the United States. We combine traditional law school materials with time-tested teaching techniques to create a truly unique law program. I would like to share with you some highlights of our program and to explain how we differ from traditional law schools. I will explain the advantages that Abraham Lincoln Law School has over most traditional law schools.

Traditional law schools teach by the casebook/Socratic method. This means that students read books with edited cases that they must "brief" and then attend classes where students are called upon to recite their "briefs." A "brief" is a synopsis of a case that generally contains a recitation of the relevant facts, the issue before the court, the relevant rule of law, the analysis by the court and the court’s conclusion. The professor will then m ... Read more »

#Петиция · Revise the NH Tint Law to be less strict. ·

New Hampshire is 1 of 4 states that ban tint on the front windows to the left and right of the driver (link , link ) while every other state allows it.

While the reasons for such ban are minimal, the benefits to the people seem to have been overlooked. The NH tint law was created in 1989 and was last modified in 1997. This law, surprisingly, even goes against the state motto of "Live Free or Die".

Such moderate tint laws affect thousands of drivers everyday. Benefits of allowing tint on the front windows include, but are not limited to:

    • Adds additional crash safety from shattered glass. (link )
    • Reduces the sun's glare, helping prevent accidents due to excess glare. (link )
    • Reduces headlight glare and brightness, in the sideview mirrors, from drivers behind us. (link )
    • Blocks 99.9% of UV radiation which is important to prevent melanoma cancer to the skin and the eyes, ... Read more »

    #Worst law schools

Whittier Law School in Orange County, California is, officially, the worst law school in the United States. Appalachian School of Law edges out the University of Law Verne College of Law and several other richly deserving candidates for second-worst place.

Whittier, Appalachian and La Verne essentially tied for the uncoveted bottom spot, but Whittier “won” the tiebreaker, thanks to a pitiful 17.1 percent employment score. In addition Whittier’s 61 percent under-employment score is the highest among all ABA-approved schools.

Appalachian School of Law in the rural, westernmost reaches of Virginia appears very close to the bottom in all but two categories: under-employment and cost. Also, the number of students that ASL does not categorize for employment purposes (the “unknown employment” score) is notably high.

The third-place University of La Verne College of Law ranks dead last among the 194 law schools that “U.S. News” ranks by academic p ... Read more »
