#Colloquium in Legal, Political, and Social Philosophy

Colloquium in Legal, Political, and Social Philosophy

The Colloquium in Legal, Political, and Social Philosophy was founded by Ronald Dworkin and Thomas Nagel in 1987. It is the original model for all of NYU Law's colloquia. The Colloquium is now convened by Liam Murphy, Samuel Scheffler, and Jeremy Waldron, two of whom will host in any given year.

Each week on Thursday a legal theorist or moral or political philosopher presents a paper to the group, which consists of students, faculty from the Law School and other departments of NYU, and faculty from other universities. The choice of subject is left to the paper’s author, within the general boundaries of the Colloquium’s subjects, and the discussions are therefore not connected by any structured theme for the term as a whole, though in past years certain central topics were canvassed in several weeks’ discussion. The Colloquium aims, not to pursue any particu ... Read more »

TULTITLN, Mexico Arizona's new law forcing local police to take a greater role in enforcing immigration law has caused a lot of criticism from Mexico, the largest single source of illegal immigrants in the United States .

But in Mexico, illegal immigrants receive terrible treatment from corrupt Mexican authorities, say people involved in the system.

And Mexico has a law that is no different from Arizona's that empowers local police to check the immigration documents of people suspected of not being in the country legally.

"There (in the United States), they'll deport you," Hector V zquez, an illegal immigrant from Honduras. said as he rested in a makeshift camp with other migrants under a highway bridge in Tultitl n. "In Mexico they'll probably let you go, but they'll beat you up and steal everything you've got first."

Mexican authorities have harshly criticized Arizona's SB1070, a law that requires local police to c ... Read more »

Washington Post Staff Writers

About a half-hour later, Young and her partner, Sinjoyla Townsend, who met 13 years ago in a Constitutional Law class at the University of the District of Columbia, became the first same-sex couple to apply to be married in the District as the city officially joined five states in allowing gay marriage .

I'm just so happy. We're whole now. We will actually be a true family like everyone else, Young, 47, said as Townsend, 41, used her thumb to wipe away her soon-to-be wife's tears. After the couple from Southeast Washington rose from the desk, couples in line behind them broke into spontaneous applause and cheers.

For Young, Townsend and the cheering masses, being there, in the tiny and usually sleepy marriage bureau, on the very first day meant everything. There was the history of it all, but mostly it was about having the nation's capital validate their relationships and their fa ... Read more »

#Cohabitation Law - Legal Definition

Cohabitation is generally defined as two people living together as if a married couple. State laws vary in defining cohabitation. Some states have statutes which make cohabitation a criminal offense under adultery laws. Under one state's law, cohabitation means "regularly residing with an adult of the same or opposite sex, if the parties hold themselves out as a couple, and regardless of whether the relationship confers a financial benefit on the party receiving alimony. Proof of sexual relations is admissible but not required to prove cohabitation." Another state statute defines cohabitation as "the dwelling together continuously and habitually of a man and a woman who are in a private conjugal relationship not solemnized as a marriage according to law, or not necessarily meeting all the standards of a common-law marriage." Yet another state, Georgia, defines cohabitation as "dwelling together continuously and openly in a meretricious relations ... Read more »

In my last post, I looked to do an in-depth comparison of different law firm practice management software. Today, we re going for an in-depth review of one of the more popular practice management software applications out there, Clio.

I ve been meaning to try different law practice management software applications out there. In forums like/r/Lawyers on Reddit I ve come across practicing attorneys who give glowing recommendations of Clio and other web-based practice management software.

#Cohabitation Property Rights for Unmarried Couples

When unmarried couples live together for a while, it is likely that they accumulate a good amount of property. In this case, it is in each person's best interest to write out a property agreement that spells out who owns what and how the property will be distributed should the couple separate. This is especially important if a couple acquires real estate together. On the other hand, this agreement is probably not necessary for couples who have only lived together a short time and do not have much property.

Without an agreement, you could face expensive and time consuming legal battles, defending your property rights. This trouble can be saved by each party entering an agreement they both consent to, while the relationship is sound.

What a Cohabitation Property Agreement Should Include

A cohabitation property agreement is about you and your partner, and therefore, should include what meets ... Read more »

military law , the body of law concerned with the maintenance of discipline in the armed forces.

Every state requires a code of laws and regulations for the raising, maintenance, and administration of its armed forces, all of which may be considered the field of military law. The term, however, is generally confined to disciplinary military law as defined above—i.e. that part of the code that aims at and sanctions the maintenance of discipline in the armed forces. In the past this was also known by the name of martial law. a term that now has the meaning of military enforcement of order upon a civil population either in occupied territory or in time of disorder.

Members of armed forces do not cease under modern conditions to have duties as citizens and as human beings. All systems of military law thus must aim to ensure that the soldier is in no way enabled to escape the obligations of his country’s ordinary law or of international law as recognized in ... #Collaborative process - Alternatives to court - Resolution - first for family law

Collaborative law PODs

All collaboratively trained lawyers join a local practice group called a POD . This group will meet up around once a month together with collaboratively trained members of other professions to discuss practice issues. Meeting in this way helps lawyers and other professionals to work more effectively together on collaborative cases.

What is the collaborative process?

Under the collaborative process, each person appoints their own collaboratively trained lawyer and you and your respective lawyers all meet together to work things out face to face. Both of you will have your lawyer by your side throughout the process and so you will have their support and legal advice as you go.

You and your lawyers sign an agreement that commits you to trying to resolve the issues without going to court and prevents them from representing you in court if the col ... Read more »

I dont understand where people are getting their info from. LaVerne is not an ABA accredited school. Southwestern is not above Loyola either!

The rankings go like this.

UCLA (tier 1)

USC (tier 1)

Loyola (tier 2)

Pepperdine (tier 2)

Southwestern (tier 3)

UCLA has consistently ranked higher than USC. But only by a spot or two in the mid to high teens. I would recommend UCLA for the cost, and USC for the alumni support.

Pepperdine and Loyola seem to trade spots periodically. Loyola was consistently above Pepperdine. Loyola has a strong alumni backing as well though.

Southwestern is tier 3, maybe dropped to tier 4 recently.

The rest. Im not familiar with. They are likely non-ABA accredited schools which you want to stay away from.

Please ask me if you have any questions, its always better to get advice from someone in the mix of things. Im currently a 2L at USD Law.

People often confuse being separated with a legal separation. This article explains the differences between these concepts and provides a basic overview of military divorce.

Sometimes, couples (both military and civilian) that are going through a rough patch in their marriage choose to separate before pursuing a divorce. They may want time to see how they do living apart or to seek counseling to save their marriage. During a separation, most couples will live apart. If they can’t afford to live apart, they may act as though they are separated while living in the same home - as roommates without cohabitation (sexual relations).

When it becomes clear that the separation is going to last for some time or that the next likely step is divorce, a couple may enter into a “separation agreement,” which is a written agreement that spells out how the couple wants to handle certain issues during their separation, including child custody and support, alimony payments (if any), an ... The broad topic of constitutional law deals with the interpretation and implementation of the United States Constitution. As the Constitution is the foundation of the United States, constitutional law deals with some of the fundamental relationships within our society. This includes relationships among the states, the states and the federal government, the three branches (executive, legislative, judicial) of the federal government, and the rights of the individual in relation to both federal and state government. The area of judicial review is an important subject within Constitutional Law. The Supreme Court has played a crucial role in interpreting the Constitution. Consequently, study of Constitutional Law focuses heavily on Supreme Court rulings.

While the topic also covers the interpretation and implementation of state constitutions, without qualification it is usually understood as referring to the Federal Constitution.

Divorce in America is governed by the laws of the individual state in which it occurs. Divorce, also known as "dissolution of marriage," is a legal process in which a judge or other authority legally terminates a marriage, restoring them to the status of being single and permitting them to marry other individuals. Divorce proceedings also include matters of spousal support, child custody, child support, distribution of property and division of debt. Divorce laws vary from state to state. While divorcing spouses once were required to show a reason for the dissolution of the marriage by assigning fault to one of the parties (like adultery, sterility, abandonment, insanity, or imprisonment), every state now allows for "no fault" divorces (usually on the basis of "irreconcilable differences"). Nevertheless, many states still allow their courts to take into account the behavior of the parties when dividing property and debts, evaluating child custody issues, and determining child and spo ... I love it when a ready-to-go post is delivered to my in-box, without my even having to ask. This morning, I received from Steve in Qingdao a carbon copy of an email he had sent to a software client of ours for whom we just started working on their China labor law issues after having registered their WFOE. The email is from Steve to the client explaining the various labor documents he prepared for them, including most particularly, a China Employment Contract, but it serves as a great introduction to many of the key differences between China s employment laws and those of the United States.

Here s the email:

As you will see, the Chinese employment system is based on Asian socialist and Northern European models. China s employment law system is quite different from the U.S system. The main difference is that the U.S. is an employment at will system, which means you can terminate employees at any time for pretty much any reason. China s system is the opposite. The Chine ...
