#Oregon expands background checks to almost all gun sales in the state - The Washington Post

Oregon Gov. Kate Brown. (Bruce Ely/Oregonian via AP)

Oregon Gov. Kate Brown signed a bill Monday expanding background checks for gun sales, changing the state’s law so that private gun sales will also require these checks.

The law has been praised by gun-control advocates and decried by opponents, which is what generally happens, but it still marks a relatively rare occurrence in the United States, where legislation tightening gun ownership or sales rarely becomes the law of the land.

Brown (D) told the Oregonian  that when President Obama visited the state last week, she discussed the bill with him and told him that she intended to sign it.

Her office tweeted photos of her signing the bill Monday:

A list of major U.S. federal laws (unless otherwise indicated) pertaining to the environment.

Atomic Energy Act 1954 : Was passed because of the government's keen interest in monitoring the commercial and national defense uses of atomic energy. Government concerns included radiation hazards and the disposal of radioactive waste. The act establishes a general regulatory structure for construction and use of nuclear power plants and nuclear weapons facilities. Unlike most environmental statutes, it does not permit citizen suits and affords only limited opportunities for suits by public interest groups.

Clean Air Act 1970 : Sets goals and standards for the quality and purity of air in the United States. By law, it is periodically reviewed. A significant set of amendments in 1990 toughened air quality standards and placed new emphasis on market forces to control air pollution.

#California State Knife Laws (2013 revision)

Disclaimer - I am not a lawyer. The following information is for reference only. The discussion and interpretation is my own. So, please keep that in mind. If you need qualified consultation or legal advice, please contact a licensed criminal attorney and/or local Sheriff's office. The discussion is regarding the lawful knife carry. nothing else!

Like I said above, the laws are complicated. In US to make things more complicated we have Federal and State laws, and in addition to that local counties and cities can have their own laws. Which particular law takes priority for any given issue depends on the laws and I guess particular case as well. In relation to knife carry, the state law is generally more or less universal, however, particular cities and towns have their own, as usual more strict laws regarding the knife possession and carry. I'll discuss that below, but as a rule of thumb, just because California state law ... Read more »

2015 should prove to be yet another eventful year for foreign investment in Canada. We expect that the global energy slowdown, reflected in substantially reduced oil and commodity prices, may lead to distressed asset sales or possibly even opportunistic takeover attempts in the energy and resource sectors, which represent a disproportionately large proportion of Canadian industry. Businesses that were acquired during headier times may again be on the block, and divestitures, rather than acquisitions, may be an important trend to follow.

As a genre of law which is based on custom, tradition, and/or precedent, common law is a historical background of the means towards a harmony and cooperation between human beings who have learned to live according to laws or norms.

    • Common law as opposed to statutory law and regulatory law. The first connotation concerns the authority that promulgated a particular proposition of law. For example, in most areas of law in most jurisdictions in the United States, there are "statutes" enacted by a legislature, "regulations" promulgated by executive branch agencies pursuant to a delegation of rule-making authority from a legislature, and "common law" decisions issued by courts (or quasi-judicial tribunals within agencies). This first connotation can be further differentiated, into (a) laws that arise purely from the common law without express statutory authority, for example, most of the criminal law, contract law, and procedural law before the twentieth century, and ... #California’s Three Strikes Sentencing Law

California's Three Strikes sentencing law was originally enacted in 1994. The essence of the Three Strikes law was to require a defendant convicted of any new felony, having suffered one prior conviction of a serious felony to be sentenced to state prison for twice the term otherwise provided for the crime. If the defendant was convicted of any felony with two or more prior strikes, the law mandated a state prison term of at least 25 years to life.

On November 6, 2012 the voters approved Proposition 36 which substantially amended the law with two primary provisions:

    1. the requirements for sentencing a defendant as a third strike offender were changed to 25 years to life by requiring the new felony to be a serious or violent felony with two or more prior strikes to qualify for the 25 year-to-life sentence as a third strike offender; and

The term criminal law, sometimes called penal law, refers to one of various bodies of rules in different jurisdictions whose common characteristic is the possible for unique frequently strict impositions as penalty for failure to fulfill.

Criminal punishment, depending on the offense and jurisdiction, may include implementation, loss of liberty, government supervision (parole or probation), or fines. There are some archetypal crimes, like murder, but the acts that are prohibited are not wholly consistent among different criminal codes, and even within a particular code lines may be blurred as civil infractions may give rise also to criminal penalty. Criminal law naturally is enforced by the government, unlike the civil law, which may be enforced by private parties.

    #Canon Law

Canon is the Greek word for rule, norm, standard or measure. It is used in several ways in church language:

    1. The canon of Sacred Scripture is the list of books recognized by the church as inspired by the Holy Spirit.
    2. Before the liturgical reforms of the Second Vatican Council, the single eucharistic prayer used universally in the Latin Mass was called the Roman Canon. Now that there are four eucharistic prayers in general use, they are usually referred to as Eucharistic Prayer I, II, III or IV, but they may also be called canons. The first of these is still called the Roman Canon because it is nearly identical to the original Roman Canon
    3. Canon is another name for a law in the Code of Canon Law. (Adjective form is canonical .)

    #Canon law

Invenerunt illum in templo sedentem in mйdio doctorum, audientem illos et interrogantem eos; stupebant autem omnes, qui eum audiebant, super prudйntia et

    Luc. II: 46-47.

Canon Law, the oldest continuously functioning legal system in the western world, is the internal legal system of the Catholic Church:

    Internal. canon law lies wholly within the Church's authority to compose and administer, this, in contrast to the wide variety of external (usually civil) laws to which the Church generally defers in the pursuit of her divine mission;

    Legal. canon law operates according to the principles of law chiefly as set out in Aristotelian-Thomistic legal philosophy, this, in contrast to suggestions that canon law is simply applied theology, morals, or the rules of religious cult;

System. canon law must be read as a whole for proper understanding and use, this, in contrast to suggestions that canon la ... Read more »

Between 753 b.c. and a.d. 1453, the legal principles, procedures, and institutions of Roman law dominated Western, and parts of Eastern, civilization. The legal systems of western Europe, with the exception of Great Britain, are based on Roman law and are called civil-law systems. Even the common-law tradition found in the English-speaking world has been influenced by it. In the United States, the Common Law has been paramount, but Roman law has influenced the law of the state of Louisiana, a former French territory that adopted a French civil-law code.

Roman law began as an attempt to codify a set of legal principles for all citizens. In 450 b.c. the Twelve Tables were erected in the Roman Forum. Set forth in tablets of wood or bronze, the law was put on public display, where it could be invoked by persons seeking remedies for their problems. Though the texts of the tablets have not survived, historians believe they dealt with legal procedures, torts. and Family Law issues. ... Read more »

A Ketubah in Aramaic, a Jewish marriage-contract outlining the duties of each partner

A marriage, by definition, bestows rights and obligations on the married parties, and sometimes on relatives as well, being the sole mechanism for the creation of affinal ties (in-laws). These may include:

    • Giving a husband/wife or his/her family control over a spouse’s labor, and property.
    • Giving a husband/wife responsibility for a spouse’s debts.
    • Giving a husband/wife visitation rights when his/her spouse is incarcerated or hospitalized.
    • Giving a husband/wife control over his/her spouse’s affairs when the spouse is incapacitated.
    • Establishing the second legal guardian of a parent’s child.
    • Establishing a joint fund of property for the benefit of children.
    • Establishing a relationship between the families of the spouses.

These rights and obligations vary considerably between societies, and between group ... Read more »

    #Car Repossession Laws.

Most people who own a car rely on it for getting virtually everywhere they need to go. That may include school, church, the store, or to pick up the kids; but for most, it primarily includes work. Thus, when you are late on your car payments, it may seem terribly ironic that the bank wants to deprive you of the means of getting to work to pay them back faster, but that is exactly what could happen.

Whether leased or finance, your creditor has important rights to possession of the vehicle in the event of a default. These rights are established in both the lending documents signed at the time of purchase and in the laws of the state in which you live. Most commonly, when a buyer fails to make timely payments on a vehicle, the lender will have a contractual and statutory right to take possession of the vehicle without going to court or giving you advance warning. This is what is known by most as a repossession. Your creditor may also be able to ... Read more »

This is a piece about the laws relating to surrogacy. For many people surrogacy is the only means to achieve parenthood. However the current surrogacy laws tend to leave the applicants and the child vulnerable.

    Why Surrogacy Laws Need Reviewing

Prior to retiring I lived in the UK and worked for 15years as a self employed Guardian. A Guardian is a qualified experienced person who is appointed by the Courts to represent the wishes and feelings of children in Care Proceedings and Adoption. The Guardian’s role is to work in partnership with a solicitor, who legally represents the child, to investigate the child’s circumstances and interview any relevant person involved with the child such as social workers, family and schools. She/he then writes a report for the Court detailing the child’s wishes and feelings, his/her findings and making a recommendation regarding the child’s future.

In respect to uncontested Adoption, Step Parent Adoption and Surrogacy the Guard ... Read more »

Freedom Outpost's Constitutional scholar Publius Huldah recently explained why Federal gun laws are unlawful. She noted that the first gun control measures put in place in the United States did not take place until 1927, when Congress banned the mailing of certain weapons. We went from 1776 to 1927, 150 years after our founding, when Congress decided, "We better start disarming the American people."

Huldah goes through the history of the Federal government's unlawful actions to regulate firearms in America and she points out that when it started, the Progressives had already begun a takeover. I'll also note the Federal Reserve had been established in 1913 as well.

In 1938 Congress legislated that gun dealers had to obtain a Federal Firearms Licenses and maintain names and addresses of those they sold their firearms to.

She was sarcastic when she asked if we would ask the current President and Congress for "crumbs," begging them to let us keep "some of our fir ... Read more »

Below you will find some of the most popular questions asked by interviewers in the legal profession. Most questions are relevant to all types of legal firm, whether interviewing or recruiting solicitors, paralegals, training contract interviews, work placements or pupillages. Please feel free to print the list off we are aware of a number of UK and overseas law firms who have been using these questions as a template for their legal job interviews since 2001.

When going for interviews, bear in mind that a large number of solicitors and particularly partners of law firms have never received formal training in interview technique. General Approach

I m interdisciplinary in inclination. Part sociologist and part from STS (science, technology and society), I ve worked with sociologists, philosophers, engineers, medical practitioners, geographers and students of STS. The world is interdisciplinary, and it demands an interdisciplinary approach of the kind being developed in CRESC.

I assume that the world is materially heterogeneous, a mix of the social, economic, material, human, natural , and technical. We need rigorous ways of thinking and studying these heterogeneous processes. That s why I ve worked with actor-network theory and its successor material-semiotic projects. ANT isn t the only way of thinking about heterogeneity. Different approaches are needed, and this is another CRESC strength. But, suitably modulated, materia ... Read more »
