#Easiest and fastest way to do a divorce in Gwinnett?

Divorce / Separation Lawyer

Litigation Lawyer

If the two of you can agree you would be able to file an uncontested divorce. The Gwinnett Family Law Clinic has the forms for free (you can google them). If there are children it is a much more complex process with many more forms and spreadsheets.

If the two of you are not able to agree to the divorce then you will have to file a contested divorce. You may need an attorney to complete this process. Cobb County has a Pro Se divorce class for people who want to represent themselves in their divorce. It is a pilot project sponsored by the county bar and, I believe the only one in the state. I've taught it a few times and it's a good class. You can enroll even though your divorce may be filed in Gwinnett. The class will give you a feel for the process and what is involved in filing for divorce. The registration information is on the Cobb County Law Library web p ... Read more »

TLPI’s advocacy is based on interdisciplinary research and collaboration across a wide array of professional disciplines: education, psychology, neurobiology, medicine, social work, and public policy. Students in the Education Law Clinic help further TLPI’s mission by employing knowledge from these fields to advance the interests of traumatized children through legal representation and in the policy ar ... #Education Law.

What is Education Law?

Education Law is the area of law that relates to schools, teachers, and the rights of Americans to a public education, as well as standards for those students who attend private schools.

American Right to Education

American laws mandate that every child be given the opportunity to an education. Each state has its own school system, and as a result, there are very different laws among the various states with regard to management of schools, teachers, and funding for public education. However, they are all overseen by the federal government through the Department of Education.

Equal Education Opportunities

There is a strong emphasis on providing equal opportunities for education. This includes both to minorities and historically disadvantaged groups, as well as to those with disabilities. The Equal Education Opportunities Act of 1974 provides that no state can deny an equal oppo ... Read more »

#Education law

Education law: An Overview

One government function is education, which is administered through the public school system by the Department of Education. The states, however, have primary responsibility for the maintenance and operation of public schools. The Federal Government also has an interest in education. The National Institute of Education was created to improve education in the United States.

Each state is required by its state constitution to provide a school system whereby children may receive an education. State legislatures exercise power over schools in any manner consistent with the state's constitution. Many state legislatures delegate power over the school system to a state board of education.

There is a strong concern with equality in education. Within states this leads to efforts to assure that each child no matter where he or she is situated receives an adequate education. The Equal Education Opportunities Act of 1974 provi ... Read more »

#Parents For Megan s Law and The Crime Victims Center - Sex Offender Email Alert - Report Sex Offenders - Report Child Abuse - National Megan s Law Helpline

Megan’s Law

Megan’s Law is named after a 7-year-old Hamilton Township, New Jersey girl named Megan Nicole Kanka. On July 29, 1994, she was lured into her neighbor’s home with the promise of a puppy and was brutally sexually assaulted and murdered by a two-time convicted sex offender who had been convicted in a 1981 attack on a 5-year-old child and an attempted sexual assault on a 7-year-old. Sparked by community outrage, petitions began circulating throughout the state of New Jersey demanding the right to be made aware of sexual predators. Megan’s parents, Maureen and Richard Kanka, had gathered more than 430,000 signatures, and 89 days after Megan’s disappearance the first state law that mandated active community notification was signed into law, New Jersey’s Megan’s Law.

The word 'Company ' is an amalgamation of the Latin word 'Com' meaning with or together and 'Pains' meaning bread . Originally, it referred to a group of persons who took their meals together. A company is nothing but a group of persons who have come together or who have contributed money for some common person and who have incorporated themselves into a distinct legal entity in the form of a company for that purpose. Under Halsbury’s Laws of England, the term "company" has been defined as a collection of many individuals united into one body under special domination, having perpetual succession under an artificial form and vested by the policies of law with the capacity of acting in several respect as an individual, particularly for taking and granting of property, for contracting obligation and for suing and being sued, for enjoying privileges and immunities in common and exercising a variety of political rights, more or less extensive, according to the design of its instit ... These foundational or basic laws of states or organizations, guided by constitutional frameworks, are the bases for a cooperative give and take leading to peace and prosperity for all while at the same time ensuring the human rights of all members of that society.

Constitutional law is created through judicial interpretation of the constitution. Judicial review of the constitution by judges who study and construe the constitutional sections encompasses court decisions which create the body of constitutional law. This case law becomes the precedent for future cases.

In the United States. there are cases arising under the constitution, federal law, or a treaty. For example, when the United States is a party, there is usually sovereign immunity whereas the United States cannot be sued without its consent. Yet, there is no immunity where the action is beyond the scope of statutory power or the action is constitutionally void. When the suits are between a state and citize ... Read more »

Copywrite laws are they to vague?

Hey guys

This is something of a serious note, any feedback to the following will be much appreciated. As a fan of any art, literature, and so forth I found this quite disturbing at the stupidity of some companies.

This letter comes from a fan site dedicated to creating Skins and Meshes involving Marvel characters for the game Freedom Force. What has come to my understanding is that anything a fan does that "distributes" copyrighted material in any form (Like our great Star Trek Mods) is infringing on the rights of the company.

Funny thing I thought Fans are supposed to love and support their favorite Icon, I guess all those Star Trek conventions are breaking the law. I feel a gnawing disgust at the moment.

#What is wrong about giving online legal advice?

Are there any legal restrictions for giving financial advice in the US?

    Nikhil Nirmel. Founder of Lawdingo.com

I m building a company around the concept of delivering legal advice online ( Lawdingo.com ) and I can speak to some of the concerns I ve heard from lawyers:

    - Ambiguity surrounding establishment of an attorney-client relationship.

    - Concerns about cross-jurisdictional advice

    - Fee splitting (in cases where there s an intermediary)

    - Confidentiality. If attorney-client communication assumed to be private is made public, it could violate an assumed attorney-client privilege.

Each one of these problems can be solved, and that s what we ve done at Lawdingo. I do believe, as you seem to as well, that the internet has the potential to be an amazing medium for seeking guidance from an attorney.

    #Parental Consent and Notification Laws

    Abortion

If you are under 18, your state may require one or both of your parents to give permission for your abortion or be told of your decision prior to the abortion. In most states with these requirements:

You can ask a judge to excuse you from getting permission or telling your parent or guardian. (This is called a "judicial bypass.")
    • A legal guardian can give permission or be notified in place of a parent. If you meet legal rules showing that you are independent of the care and control of your parents or a guardian, you do not need to get their permission or notify them.

In some states, you can be excused from involving a parent without going to a judge if you are the victim of abuse or neglect and you or your doctor report this to the appropriate authorities. If you are facing a medical emergency and require an immediate abortion, most states will not impose their parental involvement requir ... What is Employment Discrimination Law?

Employment discrimination law refers to federal and state laws that prohibit employers from treating workers differently based on certain attributes unrelated to job performance. Discrimination by government employers violates the constitutional guarantees of equal protection and due process. Discrimination by private employers may conflict with any number of statutory protections, most notably, Title VII of the Civil Rights Act of 1964.

Not all classifications qualify for protection against discrimination in the workplace. Under current law, individuals are protected against discrimination based on race or skin color, national origin, genetic information (such as family medical history), gender or pregnancy, religion, disability, and age. In some cases, it is also illegal for employers to discriminate based on marital status, political affiliation, and sexual orientation.

    #Elements of a contract

    Elements of a contract

    Offer and acceptance

A contract is formed when an offer by one party is accepted by the other party.

An offer must be distinguished from mere willingness to deal or negotiate. For example, X offers to make and sell to Y calendars featuring Australian paintings. Before any agreement is reached on size, quality, style or price, Y decides not to continue. At this stage, there is no legally binding contract between X and Y because there is no definite offer for Y to accept until the essential terms of the bargain have been decided.

An offer need not be made to a specific person. It may be made to a person, a class of people, or to the whole world.

An offer is a definite promise to be bound, provided the terms of the offer are accepted. This means that there must be acceptance of precisely what has been offered. For example, a used car dealer offers to sell B a Holden panel van f ... Read more »

Cyber law refers to the law that governs the use of communication technology, mainly the Internet. It is a mix of all laws concerning intellectual property, freedom of expression, privacy and jurisdiction. When it comes to the Internet, the lack of clarity with regard to geographical boundaries and jurisdictions can pose a problem. For example. in just a single deal three different states/jurisdictions could be involved

    (a)  The laws of the state or country which the user belongs to

    (b)  The laws of the state or country applicable to the individual or organization with whom the deal has been struck

    (c)  The laws of the state or country where the host server is located.

In other words, a single transaction could be subject to the laws of three countries at a time. The jurisdiction in one particular country may consider the contents of a website legal whereas the same contents may be declared illegal by the jurisdiction of another geographical area or ... #Employees Rights 101

Employment law covers all rights and obligations within the employer-employee relationship -- whether current employees, job applicants, or former employees. Because of the complexity of employment relationships and the wide variety of situations that can arise, employment law involves legal issues as diverse as discrimination, wrongful termination, wages and taxation, and workplace safety. Many of these issues are governed by applicable federal and state law. But, where the employment relationship is based on a valid contract entered into by the employer and the employee, state contract law alone may dictate the rights and duties of the parties.

All employees have basic rights in the workplace -- including the right to privacy, fair compensation, and freedom from discrimination. A job applicant also has certain rights even prior to being hired as an employee. Those rights include the right to be free fro ... Read more »

    Fordham University (Fordham Law School)

Known as “the Friendly Law School” of New York City, Fordham University is an amiable oasis within the hustle and bustle of its hometown. While the curriculum is indisputably difficult, Fordham students are guided through the myriad challenges they face with the encouragement and support of the school’s accomplished faculty, who “are available, encouraging, incredibly knowledgeable of their subject matter, interesting, and personable. They take time and view students as people and individuals with whom

they are working.” Inside the classroom, Fordham professors are “genuinely enthusiastic about teaching” and “truly want their students to go beyond basic understanding of the law.” The overall effect is an “extremely challenging intellectual environment” that is

somehow “less mind-boggling” than its reputable name might suggest.

    #Employment Discrimination

    Employment discrimination: an overview

Employment Discrimination laws seek to prevent discrimination based on race, sex, religion, national origin, physical disability, and age by employers. A growing body of law also seeks to prevent employment discrimination based on sexual orientation. Discriminatory practices include bias in hiring, promotion, job assignment, termination, compensation, retaliation, and various types of harassment. The main body of employment discrimination laws consists of federal and state statutes. The United States Constitution and some state constitutions provide additional protection when the employer is a governmental body or the government has taken significant steps to foster the discriminatory practice of the employer.

The Fifth and Fourteenth Amendments of the United States Constitution limit the power of the federal and state governments to discriminate. The Fifth amendment has an explicit requirement that ... Read more »

    #Employment Non-Discrimination Act

    The Problem

Qualified, hardworking Americans are denied job opportunities, fired or otherwise discriminated against just because they are lesbian, gay, bisexual or transgender (LGBT). There is no federal law that consistently protects LGBT individuals from employment discrimination; there are no state laws in 29 states that explicitly prohibit discrimination based on sexual orientation, and in 32 states that do so based on gender identity. As a result, LGBT people face serious discrimination in employment, including being fired, being denied a promotion and experiencing harassment on the job.

What is the Employment Non-Discrimination Act?

The Employment Non-Discrimination Act (ENDA) would provide basic protections against workplace discrimination on the basis of sexual orientation or gender identity. ENDA simply affords to all Americans basic employment protection from discrimination based on irrational prejudice. The b ... Read more »

#Employment Law - Guide to Labor Law.

    Guide to Labor Law

    What is Employment Law?

Employment law governs the rights and duties between employers and workers. Also referred to as labor law, these rules are primarily designed to keep workers safe and make sure they are treated fairly, although laws are in place to protect employers interests as well. Employment laws are based on federal and state constitutions, legislation, administrative rules, and court opinions. A particular employment relationship may also be governed by contract.

American labor laws trace back to public outcry against the oppressive practices of the industrial revolution. In the early 20th century, the first laws were passed to compensate injured workers, establish a minimum wage, create a standard work week, and outlaw child labor. In the 1960s and 70s, Congress acted to prohibit discrimination and unsafe work conditions. Current issues involve employee healthcare and equal pay ... Read more »

In the USSR the provisions of housing law differ, depending on the state bureau that administers the housing space and on the form of ownership. There are several categories of housing: buildings belonging to the local Soviets; buildings belonging to state, cooperative (except housing construction cooperatives), or public organizations; buildings belonging to the housing construction cooperatives; buildings that are the personal property of citizens; and occupational housing. The right to living space in buildings belonging to local Soviets is based on the decision of the executive committee of the local soviet, with the participation of representatives of the public; in buildings belonging to state, cooperative, and public organizations, living space is allocated by a joint dec ... Scientific laws are repeatedly observed phenomena in nature that appear to be nearly universally true. Often times laws will be developed from and described by mathematical models of the phenomena in question. Laws are different from theories in that they are not designed to provide a causal framework in which to describe why a series of observations reliably occur but are rather merely descriptions of the observed phenomenon. Creationists often like to refer to scientific laws as the unimpeachable authority of science and often try and use such things as the Second Law of Thermodynamics to argue against evolution. This is, of course, a logical fallacy that relies on equivocation .

A posteriori laws are capable of being precisely mathematically analysed and described. They also permit the prediction of future events by extrapolation from past events or present circumstances.
