#DFA - New Car Lemon Law

The Arkansas New Motor Vehicle Quality Assurance Act, Act 297 of 1993, provides procedures for a consumer to receive a replacement vehicle, or full refund, for a new motor vehicle which cannot be brought into conformity within the warranty provided. The time period a new vehicle is covered under the Lemon Law ends 24 months after the date of the original delivery of the motor vehicle, or the first 24,000 miles whichever is the latter. The refund from the manufacturer shall be for the full purchase price (less an offset for use by the consumer determined by multiplying the purchase price by a fraction of the number of miles driven by the buyer divided by 120,000 miles), collateral charges such as sales taxes, title taxes, and extended warranties. When the sales tax is refunded to the consumer by the manufacturer, the manufacturer is then entitled to a refund from this office.

Being such a specific field surrounded with mystery and controversy, Lawful Interception proved to be a very difficult project. Unlike all other software solutions, documentation and community surrounding this particular field is very scarce, and information is almost impossible to obtain without proper connections or significant financial support.

Apart from this, there is only a handful of LI solution providers out there, making huge profits and having the monopoly on this specific market. The main tool of this apparent monopoly is a big effort to withhold the freedom of information and portray Lawful Interception as an extremely complicated solution. On top of that, operators are obliged by law to have their networks provide LI functionality for Law Enforcement Agencies. We have decided to put a stop to all this. Being in this world for some time now, a decision has been made to make a big contribution to open source community by releasing the first Open Source E ... Read more »

The best college and university rankings are usually determined by combining a wide variety of important factors. When evaluating the strength of an online college degree, the size of the university, the cost, amount of programs offered, and accreditation are solid indicators, but by no means the only elements that should be considered. Useful undergraduate and graduate rankings also take into account things like graduation rate, job placement rates, both student and educator feedback, as well as the general popularity of the university.

Other ranking criteria includes:

  • retention and acceptance rates
  • tuition per undergraduate credit hour
  • student-teacher ratios
  • technical support reputation

These factors combined help determine a school s score. Many different publications and organizations compile these scores into ranks that assist students in selecting the right school. U.S. News and World Report and the Princeton ... Read more »

The Department of Magical Law Enforcement is the largest department at the Ministry of Magic. Arguably the most important of the various departments, it is a combination of police and justice facilities, and is roughly the equivalent to the Home Office of Muggle Britain or the Department of Justice in the United States. A civil right is an enforceable right or privilege, which if interfered with by another gives rise to an action for injury. Examples of civil rights are freedom of speech, press, and assembly; the right to vote; freedom from involuntary servitude; and the right to equality in public places. Discrimination occurs when the civil rights of an individual are denied or interfered with because of their membership in a particular group or class. Various jurisdictions have enacted statutes to prevent discrimination based on a person's race, sex, religion, age, previous condition of servitude, physical limitation, national origin, and in some instances sexual orientation.

The most important expansions of civil rights in the United States occurred as a result of the enactment of the Thirteenth and Fourteenth Amendments of the U.S. Constitution. The Thirteenth Amendment abolished slavery throughout the United States. See U.S. Const. amend. XIII. In response to the Thirteenth A ... Read more »

While three-year law degrees at brick-and-mortar schools are traditional, they’re not for everyone.

The programs are expensive, time consuming and some restrict fulltime students from working more than 20 hours a week or at all at an outside job.

Luckily, there are other options for obtaining a law degree and it’s online.

Recently, online law degrees have gained more clout and popularity as they’ve become better established and continually appealed to students because of their low price and flexibility.

Consider the following:

  • In the last seven years, the number of people taking online courses has more than doubled to 3.9 million, according to a survey.
  • More than two-thirds of all higher education institutions now have some form of online courses.
  • Among business leaders who are familiar with online degrees, more than four in five (83%) strongly believe online degrees are as credible as traditional degrees.

#Deportation Definition

The removal of a foreign national under immigration laws for reasons such as illegal entry or conduct dangerous to the public welfare.

Deportation is the unilateral measure by a government to expel an undesirable foreign national (alien ) usually for one of two reasons:

  • He or she has since been discovered to have entered the host or deporting state illegally; or
  • He or she, since their admission into the deporting or host state. has done something to disqualify him or her from staying.

Deportation differs from extradition and that it is a civil procedure and not a criminal procedure. In an extradition hearing, the ultimate destination of the individual is essential to the process. In the deportation hearing, the destination is not the focus of the hearing.

In Fong Yue Ting. the United States Supreme Court used these words:

"Strictly speaking, transportation, extradition. and deporta ... Read more »

The Quran claims to be a clear document.

After a family tragedy, family members will be deeply saddened and must then allocate the inheritance. Let's assume a case where the deceased left $100,000,000. As the Quran is unclear, there are many potential allocations. The Quran does not mention who determines the allocation, and in many cases no allocation is mentioned. There can be huge disagreements, and greedy people may try to find ways to get all this money. The laws of inheritance are described via 4:11, 4:12 and 4:176. [1]

To summarize my understanding of these verses, an inheritance is allocated among children, parents, siblings, and wives. Below is a small sample of cases that the Quran does not adequately address:

1. In some translations, 4:11 mentions 2 or more daughters, others mention more than 2 daughters.

2. In 4:11 the Quran ignored the case of a deceased who only had sons.

3. The case of daughters only but no parents was not menti ... Read more »

You should always be mindful of wrongful termination laws. Firing someone for the wrong reason could land you in a whole lot of legal hot water.

A majority of all employees in the United States are "at will" employees. What this means is that you can fire these employees at any time and for any reason, so long as the reason is not discriminatory, retaliatory or otherwise illegal.

Both state and federal laws are in place that prohibit employers from firing employees for certain reasons. These wrongful termination laws will apply whether the employee is at will or the employee is working under an employment contract.

Under federal law, it is illegal for employers to fire an employee because of the employee's race, gender, national origin, disability, religion or age (so long as the employee is at least 40 years old). In addition to these "protected classes," federal law also makes it illegal for employers to fire an employee because she is pregnant or has a med ... Read more »

The Thomas M. Cooley Law School, colloquially called the Cooley Law School or just Cooley, is in Michigan. The school is accredited by the American Bar Association and has campuses in Ann Arbor, Auburn, Grand Rapids and Lancing. Cooley is noted for having the largest student body of any law school in the nation, as well as for having a large number of minority students.

Cooley Law School has a minimum LSAT requirement for admission, but it also created an index that incorporates undergraduate GPA called the Cooley Admission Index for those students who do not meet the baseline LSAT score but show academic aptitude. The Cooley Admission Index multiplies an applicant's GPA by 15 and adds the sum of that to the applicant's LSAT score to create an overall index score.

Cooley Law School also offers a part-time program with less stringent admission requirements. Admission into this program requires a 190 to 194 index score if the student does not meet the minimum 143 LSAT ... Read more »

As a reporter it s crucial to understand the basics of libel and libel law. Generally speaking, the United States has the freest press in the world. as guaranteed by the First Amendment to the U.S. Constitution. American journalists are generally free to pursue their reporting wherever it may take them, and to cover topics, as The New York Times motto puts it, “without fear or favor.”

Rumor, innuendo and gossip are things hard-news reporters generally avoid (as opposed to reporters on the celebrity beat). Most importantly, reporters do not have the right to libel the people they write about.

In other words, with great freedom comes great responsibility. Libel law is where the press freedoms guaranteed by the First Amendment meet the requirements of responsible journalism.

#Different law degrees

your key guide to university options

To law degree or not to law degree

Choosing whether to study law at university or whether to study another subject and convert later is a difficult choice for some. Here we explain conversion courses and offer advice on how to make the decision.

Some people don t know if they want to be a lawyer, but they want to study law because it interests them as an academic subject. For these people, choosing to study a law degree is easy.

For others, while they may wish to practice as a lawyer, they face a choice between studying a law degree or studying a non-law degree and then completing a conversion course (the Graduate Diploma in Law/Common Professional Examination).

Insurance Law is, as the name implies, the body of law pertaining to insurance. This includes insurance policies, insurance claims, insurance regulations and rates, and recently enacted laws, like the Affordable Care Act. Basically, insurance law can be broken into three categories: the business of insurance, the content of insurance policies, and the handling of claims.

Business of Insurance

These laws affect the requirements for companies wishing to operate the insurance industry. These laws can vary widely from state to state, but can affect things like ensuring the insurance company will have sufficient liquidity to cover claims in the event of catastrophic events or natural disasters. These laws also govern licensing insurance companies, regulating who insurance companies can turn away from coverage, the types of insurance a company must offer in a jurisdiction if it wishes to offer other policies, and many others.

#Disability Compensation Division - About Workers - Compensation

About Workers Compensation

WORKERS COMPENSATION (WC)

The employees safety and well being on the job are important to the employers. However, accidents and illnesses can arise from work and when they do, the employees are covered under the WC law. The Hawaii WC law was enacted in 1915, and its purpose was to provide wage loss compensation and medical care to those employees who suffer a work-related injury. The WC law in essence requires the employer to provide certain benefits without regard to the fault of the employer and prohibits an employee from filing civil action against the employer for work-related injuries or illnesses. Any employer, other than those excluded (section 386-1), having one or more employees, full-time or part-time, permanent or temporary, is required to provide WC coverage for its employees.

Re: Internet privacy laws in Switzerland

It's important to remember that your use of the internet is not always logged in the same place. Your ISP may keep some records, depending on which of their services you use. Before I go into a more detailed explanation I'll talk about what I know of the Swiss situation.

Generally things here are quite relaxed, there's no specific laws aimed at ISPs that I know of. This situation is very different elsewhere (example EU and US) where ISPs are compelled to hold detailed logs for long periods (they hate doing it, it's a lot of work!). The situation in these places scares me somewhat, and I'm glad that I'm living in a country which doesn't seem to want to sacrifice privacy/freedoms in the name of perceived security.

I run a server with about 50 domains on it (including this one). As far as I am aware I could go to jail for 5 years if I were to read any of the private emails which reside on the server. But ... Read more »

#Disability legal definition of disability

Disability

The lack of competent physical and mental faculties; the absence of legal capability to perform an act. The term disability usually signifies an incapacity to exercise all the legal rights ordinarily possessed by an average person. Convicts, minors, and incompetents are regarded to be under a disability. The term is also used in a more restricted sense when it indicates a hindrance to marriage or a deficiency in legal qualifications to hold office.

The impairment of earning capacity; the loss of physical function resulting in diminished efficiency; the inability to work.

In the context of Workers' Compensation statutes, disability consists of an actual incapacity to perform tasks within the course of employment, with resulting wage loss, in addition to physical impairment that might, or might not, be incapacitating.
