The Health Insurance Portability and Accountability Act, or HIPAA, was introduced in 1996 to protect consumers rights regarding their health information. The HIPAA is comprised of the Privacy Rule, the Security Rule, and the Patient Safety Rule. The Privacy Rule protects the privacy of individuals and their health information. The Security Rule dictates certain security standards for all computerized health information nationwide. The Patient Safety Rule protects health information that is collected and analyzed in order to improve patient safety. The District of Columbia now has a curfew for all persons under the age of 17. It is important for you and your family to know what the law says, how it is being enforced, and what alternative programs there are for young people.

The Juvenile Curfew Act of 1995 (DC Code 2-1541 et. seq.) states that persons under the age of 17 cannot remain in or on a street, park or other outdoor public place, in a vehicle or on the premises of any establishment within the District of Columbia during curfew hours, unless they are involved in certain exempted activities.

Service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities. Examples of such work or tasks include guiding people who are blind, alerting people who are deaf, pulling a wheelchair, alerting and protecting a person who is having a seizure, reminding a person with mental illness to take prescribed medications, calming a person with Post Traumatic Stress Disorder (PTSD) during an anxiety attack, or performing other duties. Service animals are working animals, not pets. The work or task a dog has been trained to provide must be directly related to the person’s disability. Dogs whose sole function is to provide comfort or emotional support do not qualify as service animals under the ADA.

This definition does not affect or limit the broader definition of “assistance animal” under the Fair Housing Act or the broader definition of “service animal” under the Air Carrier Access Act.

Hundreds of law students are in Montgomery this week sitting for the Alabama State Bar. Passing the test is required to practice law in Alabama. The state s accredited law schools, including the University of Alabama, Cumberland, and Jones Law School had passage rates between 88 and 91 percent last July.

There are two unaccredited law schools in Alabama. Birmingham School of Law, which had a bar passage rate of 37 percent. There s also Miles Law School, where last July 35 students took the Bar, but only three passed. That s a rate of 8.6 percent.

Historians believe that the Romans developed civil law around 600 C.E. when the emperor Justinian began compiling legal codes. Current civil law codes developed around that Justinian tradition of codifying laws as opposed to legal rulings.

Common law dates to early English monarchy when courts began collecting and publishing legal decisions. Later, those published decisions were used as the basis to decide similar cases.

Today the difference between common and civil legal tenets lies in the actual source of law. Common-law systems make refer extensively to statutes, but judicial cases are considered the most important source of law, allowing judges to pro-actively contribute to rules. For example, the elements needed to prove the crime of murder are contained in case law rather than defined by statute. For consistency, courts abide by precedents set by higher courts examining the same issue.

#De Facto Definition

As a matter of fact; something which, while not necessarily lawful, exists in fact.

A common law spouse may be referred to a de facto wife or de facto husband: although not legally married, they live and carry-on their lives as if married.

A de facto government is one which has seized power by force or in any other unconstitutional method and governs in spite of the existence of a de jure  government.

In R v Sanson. Justice Watt wrote:

"De facto characterizes a state of affairs which, for all practical purposes, must be accepted notwithstanding its illegality or illegitimacy. The de facto doctrine is sometimes engaged to uphold rights, obligations and other effects which are said to have arisen under an enactment later held to be without constitutional integrity."

What is Alcohol Law?

Alcohol law covers criminal, administrative, and personal injury cases involving alcoholic beverages. Each of these categories of cases is governed by a unique set of rules, and alcohol lawyers tend to limit their practices accordingly. Rules dealing with alcohol are generally a matter of state and local law. However, federal laws and regulations control issues such as the importation, taxation, labeling, and advertising of alcoholic beverages.

Federal lawmakers have also found creative ways to influence alcohol regulation issues that fall within the exclusive authority of the states. For example, in 1984 the U.S. Congress passed legislation that makes the full appropriation of highway funds to a state contingent upon that state outlawing the purchase or possession of alcohol by people under the age of 21. Initially criticized as congressional extortion, all states have now come into compliance with the federal act.

What is Domestic Violence Law?

Domestic violence law provides the criminal rules for punishing those who cause emotional or physical harm to others with whom they share a family or other close relationship. It also deals with the civil protections available to victims of this type of harm. Federal legislation has been enacted making domestic violence a crime, most notably the Violence Against Women Act (VAWA). #Defamation Act 2013 aims to improve libel laws - BBC News

Campaigners have welcomed the changes

New libel laws aimed at giving better protection to people expressing their opinions are to come into force in England and Wales.

Claimants will have to show they have suffered "serious harm" before suing, under the Defamation Act 2013.

The changes - coming in on 1 January - will also address "libel tourism".

The government said the law would reverse the "chilling effect" current libel laws have had on freedom of expression and legitimate debate.

Journalists, scientists and academics have faced unfair legal threats for fairly criticising a company, person or product in the past, the Ministry of Justice said.

It said the Act would provide "clearer, better protection for people publicly expressing opinions", while campaigners said it was "good news for free speech" but urged Northern Ireland to follow suit.
