The Family and Medical Leave Act (FMLA) provides certain employees with up to 12 weeks of unpaid, job-protected leave per year. It also requires that group health benefits be maintained during the leave.

The FMLA provides an entitlement of up to 12 weeks of job-protected, unpaid leave during any 12-month period for the following reasons:

For birth and care of the employee's child; For placement for adoption or foster care of a child with the employee; To care of an immediate family member (spouse, child, parent) who has a serious health condition; or To care of the employee's own serious health condition Up to 26 weeks of leave in a single 12-month period to care for a covered servicemember recovering from a serious injury or illness incurred in the line of duty on active duty.
